point. sutro tower sparkling in the background. sunshine once that sun gets up here. early on we could have pockets of fog in the north bay but by 4:00, look at this, spectacular, nothing but sunshine. temperatures settling in the 60s. but with the clear skies the temperatures will cool quickly later on this evening so the winter jacket your best friend out the door. get rid of it later on this afternoon. a beautiful look to the month of december. a check of the roads with frances. good morning there. traffic is very slow on southbound 680 as you make your way through walnut creek, an injury crash just past the live camera shot near highway 24 blocking lanes causing the big slowdown. we're checking out the drive time. this is the wrong one but across the bay bridge it's sluggish, 12 minutes there. i will check out the drive time in my next report. what is surprisingly slow is north 101 heading to sfo on the connector ramp.

the lane is blocked and so that's why traffic is jammed north 101. guys? >> frances, thank you. i.c.e. officials say they will work to take custody of jose ines garcia zarate and remove him from the country. >> yesterday afternoon a jury acquitted him of first degree and second-degree murder charges. he was found not guilty of manslaughter. jurors only found garcia zarate guilty of possession of a firearm. he faces charges for possessing a stolen gun. a judge will decide that sentence at a later date. zarate will receive credit for time served, almost two and a half years. kate steinle's family was not in the courtroom when the verdict was read. john diaz after the verdict came down. >> jim steinle told him, we're just shocked -- saddened and shocked -- that's about it. there's no other way you can coin it. justice was rendered but it was not served many who live in kate steinle's hometown are outraged. >> janine de la vega is live in

pleasanton. good morning, janine. >> reporter: good morning, matt. there is a mix of emotions being felt here, disappointment but also anger. kate steinle grew up in the east bay town of pleasanton which is 40 miles just outside of san francisco. she was living in the city when she decided to take that fateful walk onto pier 14 with her father. many residents have been invested in the case and stunned to hear the jury's decision. >> i was horrified it would be a not guilty. being it was such an obvious guilty verdict. >> if i was somebody walking with my daughter in san francisco and the next thing she ended up dead, somebody has to pay the price. >> reporter: there were some who blasted san francisco for being a sanctuary city and say steinle's accused killer who was deported five times should have never been allowed there.

but for the most part there's just a lot of outrage. steinle's family still lives in pleasanton and her parents told the "san francisco chronicle" they are shocked and saddened. reporting live from pleasanton, janine de la vega. former alameda district attorney john creighton joined us on set during our live coverage of the verdict last my. >> he went into more detail explaining what involuntary manslaughter means and how the jury could come up with a not guilty verdict. >> keep in mind involuntary manslaughter there has to be a crime committed, in this case brandishing. and the brandishing has to be so reckless that it creates a high risk of death. and as a result, someone died. apparently the jury concluded that the defendant did not brandish the weapon, or if he did brandish it, he didn't brandish it in such a reckless way that it would qualify as an involuntary manslaughter. >> john, if i walk out on the

lauer since the news broke. she says they're trying to make the best of a horrible situation. nbc is reporting there may now be as many as eight accusers in the lauer scandal. men are even less likely to characterize behaviors that don't have touch as sexual harassment. 24% of the men polled thought flashing someone does not count. and 30% thought making sexual comments about someone's body is not harassment. nearly half of men polled also thought pushing up against someone on public transportation does not constitute as harassment, but 70% of women disagree. >> i can't get over those numbers. new at 6:00 muni's newest train has been taken out of service after a rider's fingernail became stuck in the door. the mta tells the examiner the passenger was reaching for the door as it was closing. the woman declined medical treatment at the scene. muni still trying to figure out how her fingernail became stuck. the train went into service on november 17th. drivers who had their

back now with the national reaction to the kate steinle murder trial verdict. >> the jury's decision reigniting the national debate over sanctuary cities. here's abc 7 news reporter lisa amin gulezian. >> reporter: this sketch of jose ines garcia zarate hugging his attorney after hearing the jury's verdict is angering many conservatives. >> he's not found guilty of killing her. it's outrageous. >> reporter: the decision is reigniting the debate over sanctuary cities as well. attorney general jeff sessions released this statement saying, quote, san francisco's decision to protect criminal aliens led to the preventible and heartbreaking death of kate steinle. garcia zahrate had been deport several times. immigration and custom enforcement said i.c.e. will work to take custody of mr. garcia zarate and ultimately

remove him from the country. those at the california immigrant policy center worry about the direction this verdict could take the nation. >> we've not allowed the administration to exploit this tragedy to try and carry out deportations of millions of people. >> reporter: this advocacy group is asking for stricter gun laws as a starting point. an executive chairman of hyper loop one is being accused of sexual misconduct according to sfgate.com. former uber colleagues say he placed his hands on a female worker's leg and moved it up her dress. five other women who met pishevar in a professional context told bloomberg they were sexual sexually harassed by him.

a judge now says albany high school acted properly when it suspended students over racial posts on social media. it happened in march. five students liked or commented on one student's instagram account which included images of nooses, on african-american students. suspended students sued saying the district violated their rights to free speech. they said the school was justified because the students caused the disruption. there's a new study raising concern about smartphone use among teenagers. researchers found that young people who became addicted to their smart phones and the internet have chemistry imbalances that can be seen in their brains. the imbalances can make it hard to pay attention and make teens more likely to have depression or anxiety. the good news they found those imbalances could be reversed with behavioral therapy. it seems there may be an upside to worrying. matt, do you want to take this one? >> stanford researchers say being concerned can offset feelings of depression.

they have cleared the lanes so traffic is improving a little bit. the drive time still slow from highway 4 to walnut creek. it is green as you make your way to highway 13. the toll plaza is backed up past the jeff crossing. robert mueller appears to have reached a plea deal with michael flynn, appears to be prepared to plead guilty to at least one count of lying to the fbi. i want to bring in pierre thomas for more on this. pierre? >> george, well, the situation is we have a hearing scheduled for 10:30 a.m. this morning, special counsel's office filed a special complaint against michael flynn, and it's about comments made to the fbi in regard to whether he had

conversations about russian sanctions with the former russian ambassador. he was forced out of office in relation to whether he had those conversations. he said he did not discuss those sanctions. we now know that he did. the special counsel has filed a criminal complaint. flynn is expected in court at 10:00 a.m. where we expect him to plead guilty. >> we'll learn more at that time. these are conversation that is occurred in december 2016 when flynn was slated to be national security adviser for president trump when, indeed, he was inaugurated in january. this was during the transition at that time and these were at least two conversations in late december with the ambassador at a time president obama's administration was looking to level sanctions and punishment against the russians for their involvement in the election. >> then acting attorney general

sally yates contacted the white house, told the white house they were concerned he had misled officials about it including the vice president pence, and the fbi subsequently interviewed him about these accusations. the fbi according to our reporting, secretly recorded the conversation, knew what he said. and then when they asked him forthcoming and is being charged with that today, george. >> pierre, we'll learn more at this plea hearing at 10:30 what information if, indeed, general flynn is pleading guilty, what he's willing to give in return for this. this is a relatively narrow count right now. we had also seen reports in the past of his failure to report his lobbying activity on behalf of foreig governments which could have also led to criminal indictments. >> exactly. not often federal felonies in connection with that kind of activity but the level and the

amount of foreign lobbying that flynn had done had gone under the scrutiny of the fbi. he had been investigated for acting on behalf of turkish officials, and he had filed information updating the fact he had done considerable work after the fact, george, but that is not listed in the document we have so far but, again, we expect to learn more at 10:30. >> i want to bring in our correspondent john karl for more on this. this is significant for a number of reasons. general flynn active as a surrogate for candidate trump at the time. slated to be his national security adviser. this is an activity during the transition. we also know president trump early in the administration was seized with the flynn investigation according to james comey, the former fbi director, was asked by the president at one point to try to go easy on flynn. >> absolutely that was a key part of the comey story. we also recalled, george, the

president spoke glowingly of flynn even as he was about to fire him for misleading statements he made to the vice president. and one big question here whether the president would issue a pardon, a preemptive pardon to flynn. he had not done that. interesting to see where that goes now. but i am struck by the point you made which is this is a narrow indictment, very specific to those two conversations. there's nothing here about flynn's son who had been questioned by special counsel mueller and the question is what did flynn agree to do in return for this narrow indictment rather than something that could have been significantly worse for him. is he going to give information on the president? >> that would be the big question. a final question back to pierre thomas right now. knowing the way special counsel mueller has worked in past you would expect him to reach a deal with someone who is indeed the

national security adviser for the president only if that person could get information on someone higher up or someone else in the chain. the president, one of his sons, his son-in-law. >> absolutely, george. that's typically how it works. you're given a deal like this to get additional information to make sure you have every avenue covered and, george, one of the key things i think we'll look for is why. why did flynn feel the need to mislead the fbi and these other people. that's the big question we've never gotten a clear answer to. >> perhaps some answers will be coming at 10:30. we will be here all day long. once more a flee agreement reached with robert mueller pleading guilty to one charge of false statements to the fbi concerning conversations he had with the russian ambassador in december of 2016. much more ahead on the updated "gma." i'm george stephanopoulos in new york.

abc 7 news reporter amy hollyfield is live in san francisco. good morning, amy. >> reporter: good morning, matt. look what has happened here at pier 14. a poster board surrounded by candles, roses, and some american flags. those on both sides of the case are calling for everyone to remember the steinle family during this and show them love and support and this can't be easy for them. jose ines garcia zarate showed little emotion when the verdict was read yesterday. the jury had the options of first or second-degree murder or involuntary manslaughter but found him not guilty on any of those charges. zarate says the gun he found on the ground just went off when he pick it up. attorneys from both sides are asking that everyone respect the verdict. >> they deliberated as a group. they therd readback testimony. they looked at the physical

southbound 242 connecting to 680. slow and go across the san mateo bridge. guys? >> frances, thank you. las vegas police released video showing the man who robbed a casino at gunpoint. cameras follow a man in a wig as he entered the bellagio and made his way into the poker room. he pulled a weapon on staff at the cashier cage and demanded money and the workers handed it over. cameras showed the man running out of the casino and drove off in a silver car. investigators have found the car but not the driver. police are not saying how much money he got away with. the san francisco spca at rescue world has a new guard canine that has neither a bark or a bite to ward off crooks. it's a robot. night scope's autonomous robot patrols the campus standing more than five feet tall and weighs 398 pounds capturing audio and video 24/7. evidence of vandalism and crime can be sent to police.
