good morning, america. breaking news for our viewers in the west. michael flynn, president trump's former national security adviser charged by the special counsel in connection with the russia investigation. not guilty. the stunning verdict in that high-profile case involving an undocumented immigrant who shot and killed a young woman in san francisco. now acquitted of murder. her death a rallying cry for president trump on the campaign trail. >> we're going to shut down the sanctuary cities. overnight president trump calling the verdict disgraceful. what her family is saying this morning. nfl star and a new lawsuit. accusing this philadelphia eagles player of seducing another man's wife. the scorned husband claiming alienation of affection, demanding $50,000. could you be sued for the same

i want to go right to our senior justice correspondent pierre thomas for the latest. pierre, we expect to see general flynn in court in the next hour or so, expected to plead guilty. this is a major development. >> reporter: yes, it is, george. the special counsel has filed a criminal information against former national security adviser michael flynn, charging, as you said, that he lied to the fbi about his contacts with the russian ambassador. a hearing has been scheduled at 10:30 at federal district court here in washington where we expect that flynn will plead guilty. special counsel bob mueller says that these alleged lies took place while flynn was in office just days after the trump administration was in place. the conversation with the russian ambassador involved requests that the u.s. impose sanctions against that country for meddling in the u.s. election. we understand he's been photographed, fingerprinted by the fbi, in essence booked, george. >> they concern conversations that mr. flynn was having with the russian ambassador during

the transition when he was designated to be the national security adviser, sanctions imposed by the obama administration after the russian intere interference in our election are what at's issue. >> exactly george. what flynn apparently did not know is that the u.s. monitors the conversations of the russian ambassadors, apparently picked up this conversation. when the fbi went and interviewed him after he was in office, they knew precisely what the conversation was about and according to the fbi he lied when they talked to him. >> flynn was eventually fired by the president after they realized that he had lied to top officials. i want to bring in our chief white house correspondent jon karl for more on that. let's get more on general flynn. he was the head of the defense intelligence agency, fired by barack obama and then became a major campaign adviser and surrogate for candidate trump and designated to be his national security adviser. >> reporter: major figure during the transition and only served as national security adviser, george, for 24 days. ultimately fired because he lied to the vice president for the

very thing that he is now being charged with lying to the fbi about. and george, i've got to tell you, when you rewind, this is about a conversation he had with the ambassador, the russian ambassador on the day that the obama administration imposed sanctions on russia for meddling in the election, ex spelling diplomats. i remember vividly talking to sean spicer when this news broke and him telling me in this conversation flynn and the ambassador never talked about those sanctions that had been imposed just hours before the conversation, didn't find it believable then and of course now it turns out it was entirely untrue. >> the conversation, we'll learn more as we learn more about the flynn plea but one of the things at issue would be was flynn signaling to the russians that when president trump -- when mr. trump becomes president they will go easier on the sanctions. >> reporter: exactly. the denial was that the issue came up at all.

they denied there was an offer to go easy. but george, what's interesting to me is what is not in this indictment. flynn also, it was revealed some time after that, that he had earned more than $500,000 for lobbying work on behalf of the turkish government. he hadn't disclosed any of it. much of that work was done while he was a campaign adviser for then candidate donald trump. none of that is mentioned, the failure to disclose that. >> i want to bring that to our chief investigative correspondent brian ross. that could be quite significant, brian, because it would lead you to believe that general flynn gave an awful lot of information to the special counsel, robert mueller, in return because this is such a narrow charge right there and of course this could be significant because we know that according to james comey, the former fbi director, president trump had pulled him aside and asked him to go easy on michael flynn. >> exactly right, george. this is quite a deal for general flynn. his son was not charged at all and thought he might have been charged. and the big question now is,

what did general flynn tell mueller's people he would be prepared to testify. there's a clear implication here that they're building a case of obstruction against president trump because of those comments he made to the fbi director comey. did he fire comey because of these developments. >> right. remember, this is an indictment of a man who was national security adviser to the president of the united states, generally someone like prosecutor mueller, speci woulda deal like this if they could get incriminating information on someone higher up, in this case the president, the vice president, the attorney general, maybe the president's son. >> absolutely. he clearly gave mueller information he's prepared to testify against the president. >> one of the things we have learned, jon karl, over the course of the last several months as mueller has been working is that despite the initial denials, you referred to sean spicer earlier, that there were no contacts at all with the russians. we now know of 30 contacts and you have to connect that with

the earlier indictments of paul manafort and john gates. >> was there any collusion between anybody in the trump campaign or associated with the trump campaign and those russian efforts to interfere with the election. >> we're going to stay with this all morning long but we turn to that controversial verdict in san francisco in the shooting death of kate steinle. >> reporter: after six days deliberating, the jury found jose ines garcia zarate not guilty of murder or manslaughter. >> we believe the verdict is a correct and accurate reflection of the law. >> reporter: kate steinle was 32, walking along san francisco's waterfront in 2015 with her father when she was shot. >> she loved life and the people in it and she loved us and we miss her greatly. >> reporter: in a 2015 jailhouse interview garcia zarate admitted shooting steinle. >> did you shoot kate steinle,

the lady who was down on pier 14? >> yes. >> reporter: but claimed he found that gun and, when he picked it up, it fired. accident or intentional the case supercharged the presidential election's debate over illegal immigration. garcia zarate was a convicted felon, previously deported five times. >> we're going to shut down the sanctuary cities have that led to preventible deaths of so, so many. >> reporter: just before the shooting garcia zarate was in jail on drug charges, but those charges were dropped and san francisco officials set him free ignoring a federal i.c.e. request to hold him. overnight the agency said this tragedy could have been prevented if san francisco had simply turned the alien over instead of releasing him back onto the streets. >> from day one this case was used as a means to foment hate, foment division and foment mass deportation.

>> reporter: steinle's father told the san francisco chronicle the verdict came as a shock, saying justice was rendered but it was not served. president trump tweeting too calling the verdict disgraceful. garcia zarate was convicted on a minor weapons charge and for that he could face jail time. after that i.c.e. officials say they will try to deport him again. george. >> he is not likely to be in this country long. clayton sandell. thank you very much. over to robin. new fallout on capitol hill over those sexual harassment allegations. calls are growing for representative john conyers to step down as he faces multiple accusations and a house ethics probe. nancy pelosi doing an about face now saying he needs to go. our senior congressional correspondent mary bruce has more there in washington. good morning, mary. >> reporter: robin, good

morning. well, john conyers remains hospitalized this morning with stress-related illness, a clear sign that this controversy is taking a toll on the 88-year-old congressman as the drumbeat for his resignation is growing louder. in a rare move of bipartisanship, this morning leaders on both sides of the aisle are calling for congressman john conyers to go. >> i think he should resign. he should resign immediately. >> congressman conyers should resign. >> reporter: but the congressman's lawyer says he's not going anywhere. >> it is not up to nancy pelosi. nancy pelosi did not elect the congressman. and she sure as hell won't be the one to tell the congressman to leave. >> reporter: the powerful former chair of the congressional black caucus says he's made the case to conyers in person. >> he's given us over 50 years of service, but this is not going to get any better. in fact, i can see it getting worse. >> reporter: conyers denies all allegations of misconduct but admits paying one former staffer a $27,000 settlement. now, congress has secretly paid out $17 million to settle workplace complaints and we've now learned of a big payout for claims against disgraced former

congressman eric massa. close to $100,000 in taxpayer money paid to two male staffers. it's the largest known settlement of its kind for misconduct by a single lawmaker. robin. >> we've been hearing a lot from conyers' lawyer asking why there aren't calls for democratic senator al franken to resign now that more women have come forward accusing him of sexual misconduct. what are you hearing from senators? >> reporter: i talked to lawmakers on both sides of the aisle who feel the allegations against al franken should continue to be investigated by the ethics committee, but they are calling for a swift review. now, some do note that the allegations against franken are very different and that unlike conyers, franken has apologized. >> true, all right, thank you, mary. we get the latest on matt lauer facing new sexual misconduct accusations after being fired by nbc. as the network faces questions about what they knew. abc's linsey davis has that story. >> reporter: questions continue to swirl about who knew what and when. we're hearing from matt lauer's

first wife married to him in the '80s, telling entertainment tonight that she supports him 100% and says she called lauer last week to tell him a reporter showed up at her door and said some things were going to be coming out and that he said none of it was true. one week later, of course, those allegations came out and he was terminated. now we're starting to see the first images emerging of the former "today show" host in photos by dailymail.com leaving his $33 million estate on long island, new york. as many as six women have come forward with allegations by lauer. one alleges she was summoned to his office for sex. another claims that he exposed himself and others accuse him of making lewd inappropriate comments. nbc unequivocally denies any knowledge of complaints against lauer prior to monday and jeff zuck zucker, the former president who led the "today" show when he was just 26 years old had this to say. >> obviously i've known matt for 25 years.

and i didn't know this man. >> in a statement released thursday morning lauer said there are no words to express my sorrow and regret for the pain i have caused others by words and actions. to the people i have hurt, i am truly sorry. he added some of what is being said about me is untrue or being mischaracterized but there is enough truth in these stories to make me feel embarrassed and ashamed. as of last night it appeared all of his social media accounts had been deleted. >> in that statement some hints of what mat's going to be doing now. >> he says very clearly repairing the damage will be his full time job. >> linsey davis, thanks very much. michael. >> thank you, george. now to a new record-braking moment on the stock market. the dow closing above 24,000 points for the first time ever and this comes as republicans try to pass their tax plan. our chief business correspondent rebecca jarvis is here to break it all down for us. what does it mean for everybody, rebecca? >> for those who have an account like a 401(k) it means you're doing quite well. this is the biggest one-day gain of 2017. just 30 trading sessions after

surpassing the 23,000 mark, the dow closing above 24,000 for the first time ever. thanks to optimism about planned republican tax cuts. since trump's election last november, we have hit six of these new thousand-point milestones. so what's really getting things higher here? consumers, we're spending more and feeling more confident about the economy. remember, the black friday sales weekend. second, the major factor is potential for tax reform. many companies have said they will pass those savings to shareholders in the form of stock buybacks and dividends which is good news if you own stocks. about half of americans do. but not necessarily, michael, if you are waiting on a raise. >> if you're waiting on a race you're -- well, okay. well, where do things go from here? everybody is excited about it hitting 24,000. where does it go from here? >> if you look at that typical 401(k) right now, this year so far it's up about $16,000. we've now seen this bull market in stocks, that is stocks rising

get their first glimpse of this royal couple on their first official public engagement to commemorate world aids day followed by a visit to a local school. >> there's something both glamorous and sweet about them and the crowd is responding with this pop star atmosphere for this american royal bride to be meeting her people for the first time. they began working the line together but soon struck out on their own. megan wearing a navy blue coat and a big smile greeting the old and young alike, accepting flowers from one woman. the couple being married at windsor castle told the bbc they're excited to start working together. >> i know the fact that she'll be really unbelievably good at the job part of it as well is obviously a huge relief to me because she'll be able to deal with everything else that comes with it but we're a fantastic team. we know we are. >> her and harry together have the ability to be a tour de force on the world stage.

delaware on thursday. it was felt from maryland all the way here to new york and thankfully there have been no reports of injuries or damage. >> just a little earthquake. a little one. right now we move on to the latest powerful man brought down by accusations of sexual misconduct, music mogul russell simmons. there he is. stepping down from his companies after a second woman spoke out. amy, you have the details. >> that's right. this new allegation comes from a screen writer that says simmons offered her a ride back home in 1991 but wound up at his place where she says she was coerced into having sex. this morning russell simmons stepping away from his businesses amid allegations of sexual misconduct. simmons known as the ceo of hip-hop after starting def jam records in the '80s and producing and starring in reality television. >> the show you told me over the phone? >> yeah, "rock tricks." >> reporter: under fire after screenwriter jenny lumet who wrote "the mummy." >> you saw that, right? >> her father is sidney lumet shared an encounter saying he

offered her a ride home before the car doors locked and allegedly took her to his own apartment where they had a sexual encounter she says was not consensual. lumet writing, i didn't know if the situation would turn violent. i remember thinking i must be crazy. i remember hoping that the russell i knew would return at any moment. simmons releasing a statement in response saying while her memory of that evening is very different from mine, it is now clear to me that her feelings of fear and intimidation are real. while i have never been violent i have been thoughtless and insensitive in some of my relationships over many decades and i sincerely apologize. after keri claussen khalighi told the "l.a. times" about an encounter with simmons and brett ratner. >> she alleges they went out to dinner and afterwards was invited to go back to simmons' residence in new york to watch a music video. seems to me alleges that russell

and security camera footage that show just how this audacious heist went down. midafternoon a silver chevy pulls up at the bellagio and now know the car's owner is tied up in the trunk. the robber at the wheel. he's then picked up walking into the casino, a disguise of glasses, wig, hat and a bandage across his face. >> went up to the poker cage and proceeded to rob the cage and took off with an unknown amount of cash. >> reporter: even appears to wait in line, he's armed but the gun stays hidden. actor james woods who plays a vegas low life in the classic "casino" is gambling just feet away and tweeted in true poker player fashion we all were focused on the hands we were playing and nobody actually realized it was happening. could be a scene out of "oceans eleven." >> you bet big and then you take the house. >> reporter: but their plan was to hit the bellagio, mirage and mgm all at once. cash in the shopping bag the

>> i found some pictures that he had sent to her that i found highly inappropriate. i know that she texted him after i found out and the only thing she texted was he knows. >> reporter: north carolina is only one of seven states that allows so-called alienation of affection lawsuits. in 2010, a north carolina woman won a $9 million judgment against the alleged mistress of her husband of 33 years. as for the jeffords, joshua says they split shortly after he confronted his wife over the alleged relationship. joshua says he was admitted to a treatment facility for substantial emotional distress and is seeking at least $50,000 in damages. >> he's taken about everything from me that anyone could have taken that was important to me. >> reporter: cox who signed a six-year $102 million contract last year has yet to respond to the lawsuit. josh's estranged wife catherine did not respond to our request for comment and the pair are separated.

good morning. we are coming on the air with major news in the russia investigation. president trump's former national security adviser michael flynn, you see him entering the courthouse in washington d.c. just moments ago, has pleaded guilty, guilty to charges of giving false statements to the fbi. that would suggest he is now cooperating with special counsellor robert mueller. i want to go straight to pierre thomas in washington with the latest. >> reporter: quite a fall from grace, a former three-star general, former national security adviser, a man who had been in the military 33 years pleading guilty. booked, fingerprinted and charged by the fbi, now admitting that he lied to the fbi about his contact with the

former russian ambassador concerning sanctions that were being posed by the obama administration in regard to the russians attacking the 2016 election, george. he told the fbi that he didn't recall certain things and the fbi had information that he actually had had this conversation. now he's pled guilty, george, facing up to five years. >> let's walk through the timeline right there. the conversation occurred in december 2016 after president trump had won, during the transition when general flynn was slated to be national security adviser. he had two conversations with the russian ambassador kislyak in december after president obama had imposed sanctions in retaliation for the russian intereference in our election. the suggestion here is there were discussions about easing those sanctions. we know now that flynn lied about those conversations to the fbi once he was indeed national security adviser. >> exactly, george. it's days into the administration, the trump

administration, a new administration, and the fbi comes to flynn and asks him about this conversation with the russian ambassador, and the fbi stated that he lied to them and today flynn is pleading guilty to doing just that, george. >> i want to bring in our chief white house correspondent jon karl for more. let's stick with that timeline in december and january of 2016. the white house said these conversations didn't occur in the way that was being reported. the acting attorney general at the time, sally yates, who was president obama's appointee warned the white house that he had been compromised in these conversations. >> and remember what this was. this was december 29th which was the day that the obama administration expelled a long list of russian diplomats and imposed sanctions on russia for interfering with the election. and then we learned that flynn spoke on that day, just hours after that happened, to the russian ambassador and what the white house told us when the news broke was that they didn't discuss the sanctions.

it was unbelievable then and now it turns out not to be true. flynn lied about that to the vice president, to mike pence, the vice president, and he was ultimately fired because of that lie. now we learn that he said that same lie under oath to these fbi investigators. >> jon, let me go on because what else happened in january and february that was significant was that at that time, after sally yates givers the warning to the white house, she's fired by president trump. we know then that general flynn is fired as well by president trump once the lie is revealed, and that according to james comey, the president asked the fbi director at the time to go easy on flynn. >> exactly. and george, to me the big question now is why was this indictment so narrow? he's only pleading guilty, he's only charged with lying about that conversation. but we also learned that he earned more than $500,000 in a separate -- this is a separate issue, $500,000 for lobbying

work on behalf of the turkish government that he did not disclose. he did not disclose that, another thing that he was vulnerable legally. we also know that his son, michael flynn jr., was being questioned about the special counsel. no charge of michael flynn jr. so really, george, the question here is, did he agree to testify on something else in exchange for what is a rather narrow indictment here on a single lie, one count of lying to the fbi. >> i want to bring that question to our chief investigative correspondent brian ross who's also joining us right now. this would certainly seem to suggest that michael flynn had a fair amount of information to offer the special counsel in return. >> that's right, george. he has promised full cooperation to the mueller team. he's prepared to testify. we are told by a confidante, against president trump, against members of the trump family and others in the white house. he is prepared to testify that president trump as a candidate, donald trump, ordered him, directed him to make contact with the russians which contradicts all that donald trump has said at this point.

as well we're told that flynn made the decision to cooperate only in the last 24 hours, that he is distraught about the decision but feels that he's doing the right thing for his country, that he was facing huge legal bills of more than $1 million and he said that finally he had to go ahead and do this for that reason. he expects to put his house on the market. he is facing serious financial problems. >> and jon karl, let's go back then on the importance of michael flynn right here. michael flynn, a chief foreign policy adviser to president trump, candidate trump, during the campaign. he had a relationship with him going straight through even april 2017 after he was fired. one of the reports we had seen is that president trump had asked him to stay strong in that. so the big question will be what kind of direction was he getting from president trump during the campaign perhaps about any work with the russians, what did flynn tell him about those conversations with ambassador kislyak, and hawhat did the president tell him about the fbi investigation. >> remember, george, he was the first major national security

figure to come on and support the trump campaign, big speaker at the republican convention, the third person named to the trump transition team, very major role in filling out his national security team. this is a major figure, and the question is going to be exactly what he told the president. the president actually had recommended, if you remember this, he had actually said that flynn should demand immunity before testifying before congress, so one question that had been asked here many times and never emphatically denied is would the president consider issuing a pardon of michael flynn. that never happened. >> of course we've had no response from the president. i want to bring in dan abrams who's joining us by phone as well. dan, i'm reminded that several months ago flynn's lawyer in talking about a possible immunity deal said he has a story to tell. >> absolutely. look, this is a really big deal because it comes back to the president. here's what i mean. meaning we've talked about the

fact that paul manafort is now charged and the response to that is, well, that's just related to manafort, related to his finances. even the plea of george papadopoulos, when you actually look at the details there, it's the potential implication of campaign aides, not the president himself. and yet that's what makes this different, the possibility that flynn may be able to link something to the president himself makes this a very different kind of plea. >> that's what i wanted to ask you about. you're familiar with prosecutions, with robert mueller, with how he's worked in the past. it is not a leap at all to conclude that he would not have reached an agreement with general flynn unless general flynn could provide significant information about people higher up in the food chain than general flynn. that would imply the president, the vice president, perhaps the attorney general, members of president trump's family. >> right. we don't know exactly who, but absolutely.

it's the question that jon karl asked a minute ago which is why so limited? we're talking about two relatively small lies, and i say small in the context of this whole investigation. so why let him plead to just those two because they're small, so that in exchange for that they can get his full, honest, open testimony and help with regard to much bigger fish here. that is a classic move by prosecutors in any case, not just a case like this, where you try to get someone to plead to something smaller, get them to help you cooperate to get the potentially bigger fish. that seems like what we have here. so if you're the president of the united states, you are more nervous about this, far more, than you are about the papadopoulos or manafort development. >> one of the things pierre thomas, we would expect to learn as we learn more about what kind of cooperation general flynn is giving in perhaps future

indictments is what other contacts he had with the russians. we do know he appeared in moscow for pay to give a speech to russia today and that vladimir putin was at that dinner. >> absolutely, george. we know that the military has been looking at that particular visit and looking at whether that's in violation of some of the military guidelines as opposed to what you can do. george, we know that the fbi has gone back and tried to look at were there additional contacts between flynn and the russians during the campaign. they will get those answers as to whether that happened. they will try to find out if he sought to get additional dirt on hillary clinton which the russians sought to produce and put out over the internet and they will be able to find out, george, if flynn has more to say about who else he told in the campaign, if anyone, about those kinds of contacts. >> as we've been reporting, general michael flynn has pleaded guilty for lying to the fbi, reached an agreement with

the special counsel robert mueller. i want to bring in our chief white house correspondent jon karl for more. one thing that's been clear through the campaign, several times from questions from you at the podium at the white house, this white house, the president and his associates, had denied any contact with the russians during the campaign. we now know of at least 30 contacts. the combination of flynn's plea agreement, the plea agreement of george papadopoulos blows those denials completely out of the water. >> it does. now, it's important to point out that the conversations in question here happened during the transition, not during the campaign itself. but george, we heard from the president's personal lawyer simply that he is not concerned about this development, this indictment. i would say that they should be very concerned about this because this seems to me to be the tip of the iceberg. again, a very narrow indictment from somebody that was a key figure not just during the transition, not just in the first 24 days of the trump

presidency but during the campaign. and the question is, as you have raised, what did he agree to testify to in exchange for this very narrow indictment. >> jon, we learned that general flynn's lawyers had contacted the lawyers for president trump just the night before thanksgiving to say they were no longer going to be cooperating, sharing information, which would suggest that this deal was coming. we haven't heard anything yet from the white house today. but what can you tell us about the mood around there since this word hit a couple of hours ago? >> george, i can tell you that the president's legal team and the president himself, i am told, learned about this through news reports. they were not given a heads up from the flynn legal team for the reason you mentioned. they were not given a heads up from the special counsel's office. so there is, you know, clearly a state of anxiety here surrounding this despite the public posture. the only thing we've heard directly on the record from the legal team is they're not concerned. i can tell you the vibe is they are concerned. >> brian ross, one of the big

questions here is how much are we going to learn about what kind of information general flynn has given to the special counsel? as you reported just a minute ago, he's promised full cooperation. we would likely learn about what kind of information he has either from a filing from the special counsel to the court as he did with george papadopoulos or he has no obligation to do that. he could just hold it until there are more indictments coming. >> exactly right. according to confidantes of general flynn, he feels he has been abandoned by president trump and he is now prepared to testify fully about trump. he says mr. trump directed him to be in contact with the russians during the campaign. >> directed him to be in contact with the russians during the campaign. do we know what those contacts were about? >> initially they began with contacts to deal with isis, cooperation in syria to deal with isis and then it evolved beyond that. george, if you look at the timeline as you were discussing with jon and pierre, he lied to the fbi on january 24th.

on january 26th, sally yates, the acting attorney general, told the white house that flynn had lied to the fbi. the very next day on january 27th, the president out of the blue calls james comey into the white house for a dinner and reportedly asked for his loyalty. >> and of course later on calls james comey again and finally indeed fires the fbi director, james comey. >> right. >> i want to bring our chief legal analyst dan abrams back in on this. we have heard repeatedly from the president's lawyers, dan, that he is not under investigation. hard to agree with that conclusion now. >> yeah, and they wouldn't necessarily know. i mean, they talk sometimes as if the way that this works is if the president were being investigated at all he would definitely know. yes, there are cases where the prosecutors, the fbi, others will say you are or you aren't the target of an investigation. but the way these things often happen is someone isn't necessarily the, quote, target

of the investigation but as information comes in, as they develop their case, those targets change and shift and there's no requirement for them to say, you sir, whoever the person is, are now being investigated more. so the only people who are actually going to know is the president being investigated today are robert mueller and his team. >> we do know that robert mueller did meet with jared kushner, the president's son-in-law and mr. kushner along with general flynn had also met with the russian ambassador earlier in 2016 when they talked about a possible back channel of communication. >> that's right, george. we know from our reporting that a lot of the questions that the special counsel had for the son-in-law kushner resolved around general flynn. and george, i want to go back to one thing and put this in context. we're talking about the national security adviser, the president's chief adviser on national security.
