clothing on the ground. san francisco police say officers fired at least one round shooting and killing a carjacking suspect. >> the body worn cameras have been retrieved, and they will be reviewed for evidence. >> reporter: the carjacking happened at 10:30 this morning. california lottery officials tell abc 7 newses driver is shaken but she is not seriously injured. >> tailgate was open, and it was loaded with different items. i have no idea what was inside. >> reporter: san francisco  police say the carjacking suspect drove the van to alice griffith housing projects with police not far behind. >> the suspect exited the vehicle and an officer-involved shooting occurred. >> reporter: the suspect pronounced dead at the hospital. the police say it's too early to say whether the suspec was

armted aarmt armed and a gold suv was also stopped. >> we believe they have some involvement in the robbery. >> reporter: no officers were injured during the car chase or officer-involved shooting. police say that they will hold a town hall as per policy within ten days of this incident. melanie wood row, abc 7 news. and now to our other top story. the man acquitted by a san francisco jury in the killing of kate steinle is now facing an arrest warrant from the federal government. >> lyanne melendez covered every day of the trial at the hall of justice. and you join us with the new developments. >> that's right. we ccan confirm will there are two orders of criminal warrant and detainer from i.c.e. demanding that zarate be turned over. and are here is how the process

will work. before being transferred to san francisco to face drug charges, zarajose ines garcia zarate hadn detained in texas for illegally re-entering the united states and 14 days after he confessed to shooting kaite steinle on juy 14, 2015, a u.s. district court in texas issued a warrant for his arrest. and today less than 24 hours after the verdict, that same court again asked that he be turned over to the u.s. marshal. that request was sent to the sheriff's office in san francisco which said once he is eligible for bto be released, sf will notify the u.s. marshal pursuant to the federal criminal warrant. according to immigration law, because he illegally re-entered the united states five times, he faces ten years in a federal prison. he could also get a penalty enhancement of ten more years because he committed a crime

after reentry. remember, he was noufound gid guilty gilt guilty of possessing the gun that killed kate steinle. still last night i.c.e. sent out items own detainer, an order asking to hand him over to be deported to mexico. but that would only happen if and after he served time in a federal prison. in the meantime, zarate will be sentenced december 14. his defense will most likely ask for the minimum 16 months. the prosecution for the maximum of three years. >> in this case m this case m te cou zarate could receive a sentence of three years, but eahe's alrey been jail 2 1/2. >> and the justice department can almost guarantee that he will go from a san francisco jail into a van belonging to the

u.s. marshal which will then transport him to a federal prison. but he hasn't been charged yet. >> let's say the feds prosecute this case against him and win. and then he goes to jail for aun specified period of time. what happens after that and presumably 10 to 20 and then his term is served? >> let's say he serves 10 to 20 like we said. after that, i.c.e. has requested him remember immigration, they will take him into custody. they will put him in a bus towards the border. he will then go to the detention center in southern california and they will drop him off at the border. the u.s. mexican border. and then he is a free man in his native mexico. >> but that could be 10 to 20 years from now. >> a long time. >> a lot to play out here. thank you. in the east bay town where steinle group up, people are still processing what this verdict means and their feelings.

sanctuary city status protected the gunman who had been deported five times. >> it puts a bad reflection on the bay area as a whole because of the other states would look at this and say okay, here you are a sanctuary city, this guy is walking off scot-free. >> reporter: steinle's family still lives here in pleasanton. those who know the family did not want to speak out out of respect for their privacy. reporting from pleasanton, janine dell vega, nabc 7. >> at the pier, many were determined to keep the focus on kate steinle and not the verdict. flowers and other mementos with placed where steinle was killed. and it is a growing memorial. one woman says the not guilty verdict angered her. >> it is really a tragedy. politics was put before there young girl's life. and they couldn't even find involuntary manslaughter? just breaks your heart.

i can't imagine what her family must be feeling. >> a bench was dedicated in steinle's memory after her death. one of steinle's favorite quotes is engraved on that bench and it reads, whatever is good for your soul, do that. reaction to that verdict continues to pour in from around the country. lots of people as you can imagine still expressing shock and anger. >> and kristen sze is here with the latest opinions and movements spurred by this decision. >> president trump tweeted his displeasure last night, right away calling the verdict disgraceful. he was joined quickly by sarah palin and ted cruz. today high profile figures outside the political world chimed in. james woods tweets, after yesterday's astonishing verdict, we don't have to cow down to liberal madness anymore. he uses the #indicates law now demanding passage of a bill that would increase penalties for deported undocumented immigrants

warehouse fire in oakland and tonight there is a special tribute to the 36 victims. there will be a moment of silence at a memorial set up at the oakland museum of california. the ghost ship founder and a fellow tenant have pleaded not guilty to 36 counts of manslaughter. we're following two developing stories nationally right now. former trump national security adviser michael flynn needed guilty to making false statements to the fbi about his contacts with a russian diplomat. under the deal, flynn pledged to cooperate can w. robert mueller's wide ranging investigation into the election meddling. he becomes the first senior white house official to do so. we'll have flynn's reaction to that plea deal as well as what is coming from the white house a little later in this newscast. and the senate appears to have enough votes to pass a sweeping gop tax plan. that proposal is expected to be voted on this evening. senate republicans have secured 51 votes needed to advance the controversial plan. and we'll have a full report

it is something that has not been heard since the cold war. today the state of hawaii tested a warning siren for a possible nuclear attack from north korea. this comes only a few days after the rogue nation tested and intercontinental ballistic missile with a range that could not only hit hawaii, but the entire u.s. mainland. these tests will occur the first day of every month. today is december 1, world aids day. and in the aids community, it is a significant date. one for looking both forward and backwards. >> and as wayne freeze mdman reports, it brought a visitor. >> reporter: this is 36 years later, castro street where on this 29th world aids day,

now half moon bay. bay shoreline virtually every location is in the upper 50s. a few locations inland in the low 60s like santa rosa, concord. here is the view from the abc 7 good floor toplo floor explorat and forecast feature, chilly again inland. weekend sprinkles or isolated showers are possible. mainly north bay or near the coast. and we'll have crisp sunny days early next week before a little bit of a warm-up late in the week. here is your 12 hour planner for tomorrow. early morning hours by 7:00 or so, a few clouds, but skies will be mainly bright. a little chilly inland with temperatures at that hour in the upper 30s. as we get into the midday, we'll see an increase in clouds and that increase will continue through the afternoon hours. and that is when we'll have a chance of sprinkles in the north bay. temperatures in the low 60s in the mildest locations. and after sunset, temperatures

acquitted by a san francisco jury yesterday in the death of kate steinle. jose ines garcia zarate is wanted for supervised release violation and is also wanted on an existing federal detainer. he was convicted yesterday on the charge of being a felon in possession of a firearm. that comes with a three year sentence. federal prosecutors are going after a penalty enhancement charge and that could put him in federal jail for 10 to 20 years. president trump continues to tweet about the steinle case today calling the exoneration a complete travesty of justice. blaming former president obama for a weak border. and renewing his call to build a wall between the u.s. and mexico. some say the jury in the steinle case should have handled the gun before reaching a verdict. so coming up, laura anthony will talk to a gun exert wpert who s us how hard it is to pull the

experiences, from our own lives, our own backgrounds. >> reporter: jurors were not allowed to see an interview with zarate in custody, but jurors did see a videotape of his interrogation in which he both confesses to shooting steinle, but the circles back to his claim that he founds gun and it went off. >> in this particular case we're dealing with someone who appears to be just our impression from him a fairly vulnerable person. somebody who is easily led and misled. and nothing of what we saw in this interrogation is unique to this case. >> reporter: and they would spar over the direction of a ricochet bullet, the gun stolen from the carve a feder are carve a federal agent. in the end the defense attorney said they had different theories from the same evidence and it would be up to them to decide. >> it's your job to create doubt

fbi and promising full cooperation with the special counsel. a confidant of flynn says that flynn said he is prepared to testify that as a candidate, donald trump directed him to make contact with the russians initially to coordinate the fight against isis in syria. >> my hope is general flynn will tell everything he knows and why he was having these contacts with russians, who directed these kasktd contacts. >> reporter: it stems from his contacts with kislyak. on on december 28, the obama administration imposed sanctions on russia for their election meddling. in court prosecutors say and flynn confirmed after being contacted by kislyak the next day flynn coordinated with a senior official and other transition officials at mar-a-lago to discuss what if anything to communicate to the russian ambassador about u.s. sanctions. flynn says the transition team did not want to escalates the situation and immediately called with that message. two days later, russia announced

it would not issue retaliatory sanctions. that same day president-elect trump tweeted great move, i always knew he was very smart. >> there appears to be a lot of evidence that people around the evidence have had interactions with the russians. >> reporter: in a statement the white house said the false statements involved mirror the faufls stateme false statements which resulted in his resignation. and nothing implicates anyone other than mr. flynn. flynn faces up to five years. leaving the court -- facings same chants he once led against hillary clinton during the rnc convention. a close confidant says he felt abandoned by the president and because grossiwing concerned ov legal fees. serena marshall, abc news.

the dow dropped by as much as 350 points after abc news broke the news that flynn was prepared to testify against president trump. but the market did quickly rebound. the dow finishing down 40, closing at 24,231. the nasdaq dropped 26 closing at 6847. and s&p 500 lost 5 to close at 2642. the senate is on the verge of passing a gop sweeping tax overhaul. several holdouts today thrilled though that there is support behind the controversial bill after a slew of revisions to win their votes. >> maggie rulli with the latest. >> reporter: senate republicans are closing in on a victory. >> the fact that we would be sitting here talking about even the possibility of a unanimous vote, we're close. >> reporter: after intense back and forth negotiations, the party's lawmakers appear to have a deal hovering above the 50 votes needed to pass the gop new tax plan without any yeas from the democrats. >> i believe that it will help

the economy. i think it will help a lot of working people. most people will benefit from it. perhaps not everybody. but most people. >> reporter: the plan includes a huge tax cut for big cooperations. republicans say the benefits will ultimately help the middle class. democrats are loudly objecting. >> they said that it would lower tax for the middle class. well, it won't. they claim it will create jobs. experts tell us the exact opposite. and they are once again telling families to place their faith in tired trickle down economic theories. and we have seen how that works. it doesn't. agencies say that it will add to the debt and likely give big tax breaks to those earning more than $100,000 a year while most americans earning less than $75,000 a year are estimated to pay more in the next ten years. tax bill still needs to get

turkish airlines is working to identify the passenger who prompted one of its flights to make an emergency landing. officials eordered a flight to land in sudan after passengers detected a wi-fi network titled bomb on board. the airline says the nefarious network was created and named on board the aircraft. even a inspection turned up nothing. a similar incident happened on a 1we69 airline southwest airlines flight in 2014. time for ask fenney. michael fenney is here.
