storm. here's abc's david wright. >> reporter: the white house is racing to explain this tweet from real donald trump that appeared to admit for the first time that the president knew his former national security adviser had committed a crime. i had to fire general flynn because he lied to the vice president and the fbi. now the president's lawyer insists he drafted that tweet for trump. another white house official admits it was sloppy. the issue is significant, because former fbi director james comey gave sworn testimony that the president urged him to go easy on flynn. >> i took that as a direction. i mean, this is the president of the united states with me alone saying i hope this. i took it as this is what he wants me to do. >> reporter: comey did not back

down, and trump ultimately fired him too. >> i think what we're beginning to see is the putting together of a case of obstruction of justice. >> reporter: the president tweeted, i never asked comey to stop investigating flynn, just more fake news covering another comey lie. he also attacked the fbi, tweeting after years of comey with the phony and dishonest clinton investigation and more, running the fbi, its reputation is in tatters, worst in history. and trump also raised questions about a top investigator fired last summer by the special counsel after allegedly sending anti-trump tweets during the campaign. >> this president has been obsessed with this investigation, always saying there's nothing there, but each week another shoe drops. >> reporter: a rare public

appearance by another top trump adviser. >> you've been in the news the last few days. to say the least. >> reporter: son-in-law, jared kushner. sources familiar with the investigation say he's the very senior member of the transition team who, according to the flynn court documents, directed flynn to reach out to foreign governments during the transition, something flynn later lied about. the special counsel continues to build his case. now, with michael flynn's help. >> if there was coordination between the trump campaign and the russians, i can't think of a person who would know more about that than flynn. >> reporter: as for former fbi director comey, he is now shooting back, taking to instagram to post a montage of fbi agents hard at work. he writes, the fbi is honest. the fbi is strong. and the fbi is and always will be independent. a quote from his opening statement to the senate select committee. david wright, abc news, the white house. >> david thank you. we saw jared kushner there. he was making a rare public appearance at a forum on the middle east in washington. he acknowledged there are many stumbling blocks to achieving peace between the israelis and palestinians. however, his father-in-law has had a history of accomplishing

things other think is impossible. >> we do think it is achievable. and we think there is a lot of reasons why this is a time why it should happen. >> president trump may decide today whether to keep the u.s. embassy in tel aviv or move it to jerusalem. the palestinians say jerusalem is a deal breaker, and kushner said at the forum that the president has not yet made a decision. president trump was notably absent from last night's kennedy honors. not only did the president and first lady not attend the performance, they also canceled the usual white house reception. the white house says that that was done so that honorees could enjoy it without any political distraction. and today congressional leaders will start the process of combining the tax bills that were passed separately by the house and senate. mow the senate's version was passed over the weekend in the middle of the night.

no democrats voting for it. among the differences between the bills that must be reconciled is the mortgage interest deduction. it's capped at $5,000 in the house. but in the senate, it's $1 million. and there's difference in how the bills treat the medical expense deduction. separately, senate majority leader mitch mcconnell says there will be no government shutdown this week. some democrats said they would try to force a shutdown unless congress resolved the future of d.r.e.a.m.ers program. alabama republican senate candidate roy moore has some new momentum in his campaign just over a week before election day. a new poll has moore up six points against democrat doug jones. another poll shows jones ahead by three points. an overwhelming number of alabama republicans, 71%, say

they don't believe the sexual misconduct allegations against moore. the idea was repeated by some members of a group called bikers for trump. who held a rally to support him. >> how many times he ran for office, and we haven't heard anything. >> we do not need a man that is not in support of our second amendment rights. >> a few weeks ago, senator mitch mcconnell said moore should end his campaign because of the allegations against him. now he says he'll let alabama voters decide if moore should be in the senate. and there are new developments this morning in the sexual assault case of a former swimmer from stanford university. brock turner's legal team is appealing the verdict saying that what happened between turner and a woman at a party was consensual. here's abc's marci gonzalez. >> reporter: brock turner whose six months sentence sparked outrage across the country is appealing his conviction. the former star stanford university swimmer served just three months behind bars. now more than a year later, his attorney filing this appeal, claiming the actual evidence

does not support any of the three convictions. saying turner, who maintained the encounter was consensual, did not get a fair trial. >> she was completely unconscious. >> reporter: the district attorney argued the then 22-year-old victim referred to as emily doe was intoxicated when he sexually assaulted her. two students say they witnessed him on top of her and chased him away. the victim read a powerful statement in court that went viral, in part telling turner you tried unyieldingly to save yourself, your reputation at my expense. the distinct attorney telling abc news turner received a fair trial and was justly convicted. nothing can ever roll back emily doe's legacy of raising the awareness of sexual assault. the judge who issued turner's controversial sentence is facing backlash, but if this appeal is granted, it will be presided over by a different judge. marci gonzalez, abc news, santa
