live where you live, this is abc 7 news. >> smoke, flames and tragedy ingulf an alameda home early this morning. an elderly man is dead after his house caught fire. and neighbors tell abc 7 news this may have been accident waiting to happen. thanks for joining us, i'm kristen sze. this morning's fire broke out near a crude ecrowded stretch o and businesses in alameda you're probably familiar with. let's show you. one block from busy park street on eagle avenue at oak street. a neighbor spotted the flames and called 911.

tiffany wilson spoke with a woman, she's live in alameda. >> reporter: kristen, the neighbor told me she stepped outside to be nosey then realized something was truly wrong. see the destruction behind me. that doesn't compare to theews s owner has died. the sound of cracking glass first alerted jill rydman to the fire. >> i went out to go see and be nosey and make sure everything was okay in the neighborhood then i smelled smoke. >> reporter: she rushed to call 911 knowing her elderly neighbor was likely still inside his home. >> panic time. >> reporter: firefighters arrived shortly before 6:00 a.m. the house was completely engulfed in smoke and flames. >> during the fire attack, the body of an elderly male was found. >> reporter: authorities are not releasing his name, but neighbor jackie marriott knew him well. she says he l e s he lived in h his entire life. >> older guy, 93, 94. lived on his own. wasn't too well all the time anymore. couldn't remember things. but he had a friend of ours who

lived there during the week with him and helped him cooking and doing bits and pieces. he wasn't there this weekend. he'd gone away. >> reporter: she says his caretaker and her friend worried something like this might happen. >> leroy would be cooking and fall asleep while he was cooking and set fire to his kitchen before. >> reporter: marriott is heartbroken over her neighbor's death. >> something happening to somebody that way, not a nice thing to think about. makes you feel sick inside. >> reporter: firefighters are still on scene conducting the investigation in this block of eagle avenue is still shut down. firefighters say they're being very methodically to determine exactly how and where this fire started. live in alameda, tiffany wilson, abc 7 news. >> thank you, tiffany. developing news, cal trans crews are working to finish repairing the bay bridge toll plaza severely damaged in a fatal accident over the weekend. this is a live look at the toll plaza now where grief counselors are on hand today as toll takers grieve the loss of one of their

own. a truck crashed into a booth on saturday leaving a mother dead. abc 7 news reporter amy hollyfield is live at the toll plaza. a amy? >> reporter: hi, good morning, kristen. look behind me, toll booth number 14 is still closed and will be for a while. but they really had a lot of debris to clean up in the other toll booths as well. they said it took most of the weekend. it was very time consuming. they got it done this morning and so it was a slower commute than usual, but it could have been worse. right before the morning commute started today, drivers got a surprise. three lanes that were expected to be closed opened up. leaving only one closed rather than four. >> we knew that having four toll booths out would have a very adverse effect on traffic. so everybody involved worked very hard to, again, sweep up all the debris, make sure the road was completely free of debr debris. >> reporter: they had a lot to clean up. look at the wreckage left behind

after a truck crashed into is a toll booth saturday morning. the toll worker inside the booth was killed. 46-year-old sisi han leaves behind a husband and 10-year-old daughter and grieving co-workers. >> it was right at shift change, so some were in the process of leaving, others were arriving. a lot of them saw it and they were just devastated by it. >> reporter: her toll booth was destroyed. officials don't know when this lane will re-open. shutting down a lane just adds to the congestion at the bay bridge. here's what it looked like this morning. officials are recommending you take public transportation for the time being to avoid this backup. or gi yourseve yourself extra t >> it's going to have to be rebuilt. that's hard to say. going to be looking at that today about putting some kind of an emergency contract. we may have more details later today. >> reporter: the driver has been identified as 28-year-old daniel burke. chp officers belief he was under the influence. they say it looks like he didn't slow down, there were no skid marks. he will be in the hospital for a

49-year-old oakland resident. officers say they don't know yet if drugs or alcohol were factors in the crash. they're asking anyone with information to give them a call. new developments this midday in the deadly warehouse fire that left 36 people dead in oakland, one year ago. a preliminary hearing was scheduled this morning for derek almena and max harris who were charged with 36 counts of manslaughter. but after appearing briefly in court, the hearing was continued to wednesday. among the 36 victims, alex vega, he was just 22 years old. his mother appeared in court today. >> feels like it happened yesterday then at the same time it's been an eternity. i haven't seen my son in a year. it it just happened yesterday. >> sat durday marked one year since the fire. a vigil time place over the weekend which brought out family and friends. buzzing cell phones. that will be the hot topic among sacramento lawmakers today in the wake of the north bay wild fi wildfires. a commifi wildfires. a committee on emergency management will take a look at hue people were notified of when

the fire started raging back in october. sonoma and napa counties did not send out warnings through the wireless emergency alert system. such an alert would have pinged every cell phone connected with a cell phone tower. the fires are blamed for 44 deaths everyo s and destructiony 9,000 homes and buildings. now your accuweather forecast with mike nicco. >> good morning, i have good news and not so good news moving forward as far as our king tides go. see we're looking from mt. tam down on mill valley, one of those areas that always floods, park and ride. we get our highest of the king tides this go around today at 12:04 so during lunch, so i wouldn't be surprised if there's floodsing occurring now and a couple hours afterward. aother king time tomorrow at 12:52. last one for this round, wednesday at 1:43. the good news is king tide has moved past our beaches so the coastal flood warning is over. but i want to look ahead to what's coming our way. look at that.

out in tracy, solano county, vallejo, up toward middletown and clear lake and lake county. yeah, we got a hard freeze coming for some of us. and that's going to spread across the rest of our neighborhoods in my accuweather seven day forecast. see you with those details in a second, kristen. >> it sounds good. thank you, mike. the investigation into the trump campaign's possible ties with russia. president trump's attorney is floating a new legal defens claiming by definition the county can't be guilty of obstruction of justice. abc news serena marshall reports. >> reporter: president trump responding to the guilty plea of former national security adviser and now convicted felon michael flynn. >> well, i feel badly for general flynn, i feel very badly. >> reporter:ter: heading to uta this morning he tried to shift the attention to his former rival. >> hillary clinton lied many many times to the fbi, nothing happened to her. flynn lied and they destroyed his life. i think it's a shame. >> reporter: there's no evidence clinton ever lied to the fbi.

former direct james comey testified before congress last year she had not, but trump's latest defense of flynn comes after a saturday tweet from the president's account claiming he fired flynn because he lied to the v. spvp. and to the fbi. that is new. and critics charged it was an admission the president knew flynn lied to the fbi before he allegedly asked comey to go easy on flynn. president's lawyer, john dowd, later claiming he was actually the one who wrote that tweet, but then sunday more tweets including "i never asked comey to stop investigating flynn." and now that same trump lawyer saying the president cannot be guilty of obstruction of justice in his role because he is the chief law enforcement officer of the united states. >> i think if there's an obstruction case here to be made it's going to be a puzzle and that comey firing is going to be one piece of it. >> one piece of a puzzle that is far from being complete. on capitol hill, democrats say this is the beginning of an obstruction of justice case and republicans point to flynn's

this midday we're learning more about a medical milestone. the first of its kind in the u.s. a baby has been born from a transplanted uterus. the successful birth is now raising hope for thousands of women. you saw it first on "gma." here's abc news reporter diane miseto. >> reporter: what you're watching is a medical milestone. for the first time in united states, a woman has given birth thanks to a uterus transplant. >> all of us have tears in our

eyes and this little boy will stay with us for our entire lives. he's one of us. >> it was beautiful to watch. >> reporter: born last month, the baby boy was delivered via v section after his mother, born without a uterus, received a transplant at baylor university medical center in dallas last september. the whole is part of baylor's uterus transplant trial. she suffered from absolute uterine factor infertility or aui, affecting 1 in 500 women where the uterus is nonfunctioning or nonexistence. approximately 1 in 4,500 females in the u.s. are born without a uterus every year. >> it was very special to look in the eyes of the mother. she was told when she was a teenager that she would never experience this moment. and then all of a sudden, you see this happening. you think everything has a meaning. >> reporter: the little boy is the ninth baby born in the world from a transplanted uterus, joining the eight other babies

than it will be today. all right. let's take a look at those temperature. ukiah 46. you were in the 20s this morning. that's a nice rebound. the rest of us, pretty much in the mid 250s to near 260. we've got hayward and concord at 60 and 61. novato 63. santa rosa, 62. same thing in napa, northerly winds downsloping going from higher elevation to lower elevation off the mountains. when it does, it compresses that air mass. that's what heats it up a little bit, also what creates so much dryness outside. why you may have a scratchy voice or dry hands and lips today. winds are down a little bit from where they were this morning in the east bay hills. they're out of the north-northeast at 21 miles per hour. that's going to bring us a sunny, breezy and very dry day. tonight's our first chance of frost. a better chance tomorrow night. aisle really getting concerned. another 14 to 16 days on our medium-range models, no rain in sight. in fact, the pattern looks a lot like it did during the drought. i'm show you coming up in a second. 59 to 60 at the coast. 60 to 64 degrees for the rest of

us this afternoon. outside of the breezes, it's kind of a nice day. now the breezes are fastest. above 1 is,000 feet. that's where they could gust up to 45 to 50 miles per hour. worst-case scenario, some power outages. more unlikely, just very noisy from a lot of leaves blowing around and maybe garbage cans getting pushed over. here's a look at the golden gate bridge, 10 mile per hour wind. look how clean that is air is. picture perfect day there. temperatures in 12 thundershower day planner, mid to upper 50s at noon, upper 50s at 4:00. breezes keep us in the h40s through 12:00. drop quickly to the mid 30s and mid how 40s in most neighborhoods. wednesday morning, wooee'll hav our best chance of a freeze, protect the plants, the pets and the pipes. the pipes. ou know them. hre's a look at the high pressure. look where our jet streams are, well to our north and well to our south. that's why my accuweather seven-day forecast, absolutely no chance of rain. look at that, hardly a cloud to be found out there.

we're going to start off in the 30s and 40s the next couple of mornings and will bring us to highs in the upper 50s to middle 60s then by thursday, we'll be pretty back -- pretty much back to average then friday, saturday and sunday temperatures just a little bit above average. >> all right. that all sounds good. you are starting to sound a little better but take care of yourself. >> thank you. >> chicken noodle soup. >> thanks, mike. >> i won't breathe on you. today oes's morning money report, oakland plans to meet today in a last ditch effort to avoid a vistrike. two yun runions are threatening walkout tomorrow. this is video of a walkout several years ago. oakland and the unions are locked in a contract dispute over a wage increase. which city services will be impacted if the strike happens. you're looking at two designs the city of san jose will unveil today in an effort to increase its housing

development. user designs for emergency sleeping cabins, also commonly referred to as tiny homes. the goal is to offer safe housing for the homeless. we'll post a link to these images on abc7news.com. facebook is coming for your kids. the social media giant launched a messaging app today called messenger kids. the free app is aimed at kids under 13 who can't yet have their own accounts under facebook rules. the app won't let children add their own friends or delete messages. only parents can do that. parents also control their child's contact list and can remove contacts at any time. the app is available on apple devices, versions for android are in the works. first they took the ballroom by storm and now "dancing with the stars" is ready to hit the road and the cast is headed here to the bay area. a sneak peek
