clouds, 51 to 56 degrees. the morning commute, guess who will tell you all about it, hi, sue. the east shore freeway, the solid stream of headlights moving at the limit. if your travels take from you the upper portion of the east shore freeway, hercules through san pablo and el cerrito, berkeley into the mcarthur maze, you're looking at about a 26-minute drive and that's through the toll plaza. no delays here except for a few minor cash paying folks. that's not a bad commute. quiet up there. we do have existing drive times for you in a few minutes. mike told us yesterday the winds will be worse in southern california and that is proving to be the case. we're talking about gusts topping 50 miles per hour in some areas that's fanning the flames for the wildfires burning out of control. the rye fire burned 7,000 acres near santa clarita.

the skirball fire and the thomas fire has grown to more than 90,000 acres. that's near santa paula in ventura county. a live look at the flames this morning in ventura. abc 7 news reporter john gregory has the latest. >> reporter: the thomas fire continues to threaten homes here in ventura county along the 101 freeway along the coast. you can behind me homes threatened by the fire. this is la conchita, a small coastal community, maybe a couple hundred homes right along the freeway and they are being threatened by the fire. big flames coming up along the hillside. one bit of good news, we've had some wind up here but nothing like the intense santa anas we saw on tuesday and that's good news for firefighters and residents. this area is under a mandatory evacuation though there are some folks who are standing by and watching things. the 101 is shut down in both

directions as well. so there's no traffic on the freeway. they will let you evacuate but they won't let you back in. firefighters keeping a very close eye on this fire as it gets very close to those homes. this area has seen its share of tragedy. in 2005 they had a landslide here that claimed the lives of ten people. they've seen this sort of thing before and have dealt with it. now they're dealing with these fires. so far no homes lost but it is very close and firefighters keeping a very close eye on the situation here. that is the latest from la conchita. i'm john gregory for abc news. >> and let's stay in la conchita. this video -- and you'll see why -- is getting a lot of views. that's a man putting his own life at risk to save a wild rabbit, captured by a photographer just off the road there, the man knelt down, stopped the rabbit in its tracks, gently picked it up and held it in his arms in an effort to get it to calm down.

5:03 now. out of the east bay, the city council will meet behind closed doors again. the strike is going into its third day now. 3,000 city workers not going to work today and that means all nonemergency city services will remain closed. they want a two-year deal with a 4% raise each year. mayor libby schaaf says that would lead to job losses. city services include building permits, libraries, head start, senior citizen programs as well. all of those will remain closed today. we have new details about a carjacking suspect as well who was shot and killed by a san francisco police officer. new information is emerging about that officer. reporter vick lee has information you'll see only on abc 7 news. i'm not saying what that young man did wasn't wrong. it was wrong for what happened but it was not justification to blow his head off. >> reporter: chandler is a community activist in the neighborhood. on friday she and her friends were at the scene of the

shooting here at the alice griffith housing development. at about 10:30 in the morning police say o'neill carjacked a state lottery the suspect drove and the shooting occurred on the 1,000 block of fitzgerald avenue. from sky 7 you can see a patrol car with its side windows shattered and blood and clothing near the vehicle. police at the scene said an officer fired at least one round. chandler says her good friend saw it go down. >> he was running trying to get out of this gate and the officer in his police car blew the window off with the gun. the first shot shattered the window and hit him in the head. >> reporter: a source with knowledge of the investigation gave abc 7 news the same scenario and also that the suspect was not armed. we're also learning that the officer graduated from the police academy just three days

before the shooting. police also detained four others who were seen in a gold suv traveling with a stolen van. abc 7 news has learned all four have since been released from have since been released from custody. investigators have reviewed vests for further evidence. a town hall meeting is scheduled for today. the location and starting time have both changed. it is now set for 6:00 p.m. at the true hope church on gilman avenue. moving on now, if you are tired of sitting in traffic on the bay bridge every single day, listen up to this. there is a new plan to sol that have congestion and it involves building a new bridge. >> you can see the proposal to cross the bay at interstate 238 to 380. matt keller is live with the push this morning. good morning, matt. >> reporter: good morning, reggie and natasha.

we have bridges here in the bay area but would another bridge help you get to work sooner? that's under consideration. the hope would be it would decrease traffic on the bay bridge. the freeways leading into the eastern span consistently make the list for the worst commute in the bay area. senator dianne feinstein says the solution could be an additional bay bridge south of the current one, a proposal that could connect interstate 238 with 380. the bay area will be voting on regional measure three, a toll increase. east bay residents need to get something if they're paying more says one congressman. >> so they need to see a benefit specifically through those corridors for what they're being asked to spend more money in tolls. >> reporter: the idea for a new bridge is not new. it's been studied several times, 1990 and updated in 2010. a new bridge wouldn't be enough. they say voters expect b.a.r.t. tubes, bike lanes, and more.

the toll authority meets on december 20th. reporting live on treasure island, matt keller, abc 7 news. there are some new developments this morning with the data breach. we know uber paid the hacker $100,000 through a bug bounty program and in making the payment learned his identity and made him sign an agreement he wouldn't do any more damage. the hacker is now identified as a 20-year-old man from florida who lives with his mother. he got his hands on the personal information of 57 million customers. as part of the deal uber made the hacker deleted all the data from his computer. happening today pg&e will answer to san francisco supervisors and explain what caused a gas explosion on mission street. no one got hurt, however, that explosion ripped through an apartment building and caused major damage last monday. several families have been displaced. city supervisors are hosting a public hearing at 2:30 this afternoon at city hall. they'll get an update from pg&e on its investigation and then discuss public safety and emergency response protocols.

developing news this morning, there is a push by some supervisors to split up the san francisco municipal transportation agency. such a move would need to be put to a vote. next tuesday is the last opportunity for supervisors to introduce the measure so it could qualify for the june 2018 ballot. the proposal would create two agencies, one would handle parking in streets and the other its buses and light rail trains. residents in yuba city will weigh in on how the oroville dam repairs are going. crews are fortifying the hillside. last night federal officials said they're not concerned about a few cracks in the freshly laid concrete. not everyone is convinced. people in oroville question the dam's safety. the damage to the dam forced 200,000 people to evacuate in february. let's take a look at temperatures across the north bay where it is freezing cold in some areas like rohnert park and ukiah with 32 degrees.

a former doctor to the usa gymnastics team will face charges. larry nasar pled guilty. prosecutors are pushing for a 60-year sentence. he's accused of sexually molesting girls 15 years and younger. they included maroney, reisman and gabby douglas. >> a missing woman who disappeared following a tinder date. how investigators are piecing together the clues. >> reporter: in this morning's "gma first look" a family and community mourning the loss of sydney who went missing. her date and roommate aubrey trail being called persons of interest by police. >> we believe that aubrey trail and bailey bosswell were two of the last people known to be with

protesting being touched is metcalf who chairs pennsylvania state government committee calling it offensive and discriminatory. we looked up the biography of the lawmaker that he suggested was gay, the guy you see on the right, matt bradford. bradford is married and has four kids so we assume he is not gay, not that this matters because it's ridiculous. metcalf hasn't commented, by the way. "time's" person of the year issue, a former uber engineer and san francisco lobbyist both among the women on the cover. they're being recognized for breaking the culture of silence. that lobbyist is adama iwu. she spoke about the cover. she says that she was chosen after writing an open letter calling for an end to sexual harassment in the state capitol. >> it turns out women were really angry, and i think now is a good time to be angry. it's not a momentary thing.

this is something we will continue to push for. >> the other women on the cover, ashley judd, taylor swift, former uber engineer susan fowler and isabel pascual am "time" has named them and everyone else who has come forward the silence breakers, including at least two men as well. >> very brave. all right, so let's switch gears and talk about how the weather is shaping up this morning. >> a lot of nice weather. i have more days than can you handle coming up. it is the rain season. anytime we have two weeks without rain it's cause for alarm. here is a look at live doppler 7 and it is bone-dry this morning. take a look at temperatures. 66 in concord and 67 in haywood. those are the three i'm watching for possible record highs today. warmer in places like san jose and morgan hill, santa cruz, 71. ukiah 70.

66 in places like san mateo. 66 at half moon bay. through your 12-hour planner at 9:00. you can see a few 40s out there around fairfield, concord, san jose and petaluma. as we head to 2:00 when the heat starts to peak, you can see a lot of low to mid-60s around, even some upper 60s around mountain view, san jose. this model say iing even warmer. low to mid-50s by 9:00. on our way down to about mid to upper 30s inland. low to mid-40s around the bay and upper 40s in san francisco. low to mid-60s at the coast. upper 60s to near 70. we'll be flirting with record rains, dry air, a few more high clouds. that's about the only change, sue. let's go to the san mateo bridge. we're getting busier but not bad at all.

a look at the taillights on the causeway. no delays at the toll plaza either. you're looking at about 15 minutes across the bay over towards hayward. golden gate bridge looks beautiful this morning. four lanes in your southbound direction, two lanes northbound. clear over the waldo with not a delay in sight. ace trains are running on time, a great which to avoid that. a look at your drive times. golden gate bridge from the marin side to san francisco six minutes. the bay bridge, no metering lights yet. we'll check that. that might have changed in the last minute or so. there is your san mateo drive time across the span. a great time if you have to commute at 5:21 in the morning. not bad at all, guys. anheuser-busch looking to go green with tesla's all-electric semitrucks. "the wall street journal" reports the subsidiary is buying 40 of the tesla semis. it will use the trucks for shipments to wholesalers. tesla ceo elon musk gave the

breezes, the low to mid-60s. a nice day to be outside for lunch. still in the low to mid-60s at 4:00 and then 47 to 53 at 7:00. we'll talk about the weekend forecast. if you have outdoor plans, you're going to like it. here is sue. we have a thumbs up commute so far this morning. it looks worse than it is. it's just filling in nicely on the east shore freeway but traffic is moving well into berkeley. we did check the metering lights were turned on at 5:23. delays building behind the toll plaza as well. overall green is good. some typical areas of slowing out of westbound 4 and the central valley on westbound 580. let's take a look, 42 b.a.r.t. trains on time. sausalito ferry with a half day shutdown meaning the first boat is at 12:55. the first boat is at 1:55. your morning bay ferry from mare island and vallejo 6:10 and 6:30 will be a bus this morning.

at the live desk, powerful winds are bringing extreme fire danger in southern california. ucla has canceled today's classes because of the wildfires burning so close to campus. here is a live look at the thomas fire burning. it has grown to 90,000 acres. it's raged through the night just 5% contained. evacuation orders and a state of emergency still in effect impacting thousands of people. reporting veronica miracle from our sister station in los angeles has the latest from ojai. >> reporter: overnight conditions proving to be treacherous for firefighters. winds whipping flames in every direction. at one point we were completely surrounded by a wall of flames that were reaching hundreds of feet into the air. explosions from trees bursting into flames as firefighters worked to protect homes in the area. firefighters not shying away

from this danger but digging their heels and making sure these structures are protected even as a fire rages around them. now we were concerned about high winds tonight. we haven't seen extreme gusts, but the winds are certainly pushing the fire in almost every single direction. it's an extremely precarious situation out here. at one point we had to run to get away from some of the ember that is were falling from the sky and even as conditions remain terrible for the firefighters, they're staying put this morning. i'm veronica miracle in ojai for abc news. >> and look at what news helicopters are capturing, an explosion near a home near the thomas fire in ventura county last night. it's not clear what exploded there. you can download the abc 7 news app and get breaking updates on the southern california fires. 5:32. no libraries, no after school programs, no senior centers.

>> also no meter maids. possibly the only welcome part of a strike by city workers in oakland. we're entering day three of this impasse with city hall and the unions. abc 7 news amy hollyfield live in oakland. >> reporter: good morning. they're going to try again today. the city council is set to meet at 1:00 even though yesterday's two and a half hour meeting behind closed doors didn't change a thing. these workers will be on the picket line for a third day today while those talks are happening. they don't buy it when the city says they can't afford their demand. they see the building boom and think there is plenty of money. the mayor says if she gives them the salary increases they'd want they'd have to lay off 188 city employees in order to pay for it. she is also still calling the strike unlawful. >> i continue to be disappointed the unions have started a strike when we have not reached impasse.

>> the city is investing a lot of opportunity in filing charges against us to try to get a court injunction to bring us back to work. >> reporter: the union calls the threats to lay off people an intimidation technique and they say the employees do have the right to be on strike, that this is lawful. 3,000 workers on strike, city services will be shut down today. police and fire and dispatchers will all work. everyone else will be on strike. live in oakland, amy hollyfield, abc 7 news. normally payday is a reason to celebrate. for some employees at observing unified it's turning into a real headache. more than 2,800 employees had their monthly paychecks accidentally pulled from their bank accounts yesterday and compounding the problem some employees were paid double when the district tried to reverse its mistake. work letters have to return the payment. the district is taking the blame for that error. the embarrassing error comes as leaders have a plan to slash

$5.5 million from the budget. parents and teachers packed a meeting to fight the cuts. the board said the money would come from the central office but the plan would eliminate funding for school supplies. a meeting to discuss the cuts will take place at 7:00 p.m. at the committee room at la escuelita elementary. this morning the preliminary hearing continues for two men jailed in connection with the deadly ghost ship warehouse fire. the first two witnesses took the stand for the prosecution. both were ghost ship residents. aaron marin said musicians and deejays brought in amplifiers and a projection screen inside the warehouse on the day of the fire. that could be relevant because the equipment may have blocked access to rooms that were potentially lifesaving exits. >> big screens which blocked everyone from getting out in terms of the scare case has nothing to do with my client or the co-defendants. that's the people who came up and placed these items there.

that wasn't part of the warehouse. >> ghost ship founder derick almena and associate max harris face 36 counts of involuntary manslaughter. the verdict in the kate steinle murder trial has caused a lot of outrage for some people after the defendant, an undocumented immigrant, was acquitted. now one of the alternate jurors in the case is speaking to abc 7 news in defense of those who deliberated behind closed doors. phil van stockum said his fellow jurors made the right decision to acquit jose ines garcia zarate of murder based on the evidence the prosecution presented. why did the jury not settle for involuntary manslaughter? the reason the prosecution had to prove that garcia zarate in the act of committing the crime was brandishing, meaning waving, a weapon. >> it wasn't just a ricochet, it was a bad ricochet. if he intended to make that shot, he was a terrible shot and got really lucky. >> he acknowledges it was not easy to see the steinle family in court.

>> people aolice the dogs were unleashed when they went on attack in the crocker neighborhood last month. the dogs weigh about 70 to 80 pounds. one had a pink collar and the other a gray collar. >> residents will rally against plans to add 16 cell phone towers in the small town. they will protest at 6:00. the city manager was going to approve but that was delayed for more public input. this is the second time they have tried to add towers there. they filed a lawsuit beautiful finally withdrawing its application. >> san francisco transportation leaders are looking at a proposal that would cut late night cable car service. the mta wants to end runs at 11:45 at night. it operates until 1:00 a.m. currently. the line runs to van ness avenue

and california street. a lot of local people rely on the car to get to and from work. b.a.r.t.'s board is expected to set the prices for the new ebart service. it will serve antioch and pittsburg. it's up to decide how much a trip will cost by the board. the potential price from antioch to san francisco's embarcadero center is $7.50. from pittsburg it would cost $6.85. something startling for you. more than 8 million people, 8.7 million to be almost exact, under a red flag warning from san diego up to los angeles and even more out in the high desert as you head to arizona. the winds continue pushing up around 40 miles per hour. we saw some gusts from 50 to 80 during the overnight hours. it comes down a little bit during the day down to 20 to 30

but then you can see by 5:00 friday morning it picks up again pushing around 45 to possibly even 50 miles per hour. this is going to continue through the weekend, unfortunately, as long as we're locked in this pattern, so is southern california. that's why they'll continue to be breezy. temperatures are warmer this morning. we'll go inland where we have 33 in danville, san ramone, dublin and pleasanton. 42 in pittsburg. the warm spot at 48. concord, 44. 41 in san carlos. 45 in observing. 52 in san francisco. let's talk about your commute. breezy on the water. san pablo bay down to the bay bridge. mass transit chilly this morning but mild this afternoon and breezy in our hills during the morning commute if you're driving. let's look at more on the commute with sue. after we look at our traffic maps we have several slow spots

starting out in the central valley at livermore and tracy up into livermore, i should say. a real problem on isabel or highway 84 leaving isabel both directions are closed between concannon and vineyard due to an accident there. a lot of folks take that to avoid highway 680. so, unfortunately, that is not a good route for you this morning. you'll want to continue on 580 to take 680 southbound. that with be your best alternate route and that is always jammed as well. up to dixon we have a problem with a big rig accident. several lanes blocked after weber. slow traffic to midway and back to davis. if you're expecting folks from sacramento this morning give yourself plenty of time. a major victory for same sex marriage. the nation that just gave it its blessing. caught on camera the minor car accident that turned into an armed showdown. it's 5:40. we keep u

getting married so the first same-sex weddings will happen in january. a national poll last month found 62% of australian voters support same sex marriage. it's 5:46 now. today the last day of open enrollment for medicare coverage. the time seniors can add or change coverage to their prescription drug plans. coverage is offered by private insurance companies which are under contract for medicare and medicaid services. medical marijuana for your pets. one test is being done by university to see if pot can help dogs with arthritis and epilepsy. scientists say the united states needs to relax its rules so further testing can be done to see how effective marijuana really is on pets. currently there is very little data on whether pot works as a treatment on pets or potential harm it could cause.

we have some slow traffic coming out of the central valley that's fairly typical. what is new is the sig alert on isabel or highway 84 both directions closed at concannon and vineyard. a lot of people take that as an alternate to 680. 680 is definitely not a good alternate for you that morning. but you can't get through on highway 84. you're going to have to slog that through unless you want to take 580 over to 880 and that's really not a great alternate for you either. up to davis we have an accident, multilanes blocked. a big rig involved there. they are working to clear that out of lanes. it is back beyond midway and up to santa rosa reports of an accident north 101 near river road. a couple of lanes are blocked. it looks like sensors are green. that is a little bit out of the commute area in the northbound direction. we'll come back and check on this in a bit. we are tracking breaking
