interested in it. with two years left on his term, someone needled to fill the seat. that fell on the board of survivors, they couldn't vote for themselves. they nominated three popular politicians and one largely unknown candidate. city administrator ed lee. he reportedly did not want the job. he was on vacation with his family when the call came teflt urging of community leaders, he finally gave in. supervisors voted 10-1 to name lee mayor. the one no vote came from outgoing supervisor chris daly who created quite a ruckus in the supervisor's chamber. >> as i hold the office of -- >> mayor for the city and county of san francisco. >> mayor for the city and county of san francisco. >> the appointment was also seen as a huge victory for the

asian-american community. he was sworn in as the first chinese american mayor in the 160-year history. >> people don't trust you, you have no role working in government. that will lead to more civility and more believe by the people here. >> lee hit the ground running earning accolades for his ability to bring the city together. ♪ >> the grassroots movement was launched. run, ed, run. he was swayed by political insiders, igniting a fierce debate over his broken promise. lee ran and won in november 2011. by the 2015 election, any bad feelings seemed to subside. he faced no substantial challenger and was reelected with 56% of the vote.

sierra lamar went missing on her way to school, her convicted killer was formally sentence in the court this afternoon. chris has more on that sentence and what the defense team tried to do. >> that sentence, life in prison without the possibility of parole, was handed down by the judge this afternoon. but not before the defense team made one more attempt at getting a new trial. >> outside the santa clara hall of justice, a resilient family reflects on more than five years of heart ache. >> just hard to believe that this happened. i wake up every day thinking, it's a dream. it is reality. >> in the spring of 2012, sierra he lamar went missing while heading to school. the disappearance triggered an investigation.

late this afternoon, antolin garcia torres was sentenced to life in prison without the possibility of parole for killing lamar. >> i think about her all the time. what has been taken from me as a mother. >> her body has never been found. something that continues to haunt those involved with the case. earlier this morning, a last-ditch effort to request a new trial. garcia torres' attorney, questioned the credibility of the investigator in the case due to allegations of mishandling in another case. the judge denied it, allowing family members to share their impact statements. sierra's parents addressing torres face to face from the witness stand. >> after what he did. not saying, not telling where sierra is and what happened. eats away at him while he's in there. >> garcia torres' attorney said he plans to appeal the sentence.

in san jose, abc7 news. san jose police are investigating a shooting that left a man with nonlife threatening injury. it happened just before 1:00 this afternoon on the city's ift side. this is video from sky 7 you're looking at. police say the victim suffered from a single gunshot wound and was taken to the hospital. so far no suspects have been identified. new details about the driver accused of killing a tool the suspect, daniel burke, made spontaneous comments to medics that he drank alcohol and smoked marijuana before the collision. they noted his pupils and the smell of marijuana. it killed c.c. hahn. burke faces seven felony counts including vehicular

in morgan hill, 45. richmond and oakland will drof to about 40 degrees. it will still be rather chilly. and on to tomorrow. another hazy, bright, mild mildd we'll see low to mid 60s.s. air quality will be poor in some areas. we'll have two more spare the air alerts. air quality will improve significantly on friday and it will be even better on saturday as some areas will have good air quality by then. next thursday and friday, we'll have a chances of rain. the precipitation will be to our north. on thursday, we expect the rain to move into the air.
