this happened around 5:30 yesterday evening at south wright road. the victim was the driver left the scene and then called police about 20 minutes later and returned. investigators say st. john told them he couldn't see the victim because it was so dark outside. police say he has been questioned and released pending further investigation. happening today the federal communications administration will appeal net neutrality allowing the speed of content running through their network. that impacts everything from how fast movies would be streamed on netflix to how much companies will charge for online services. opponents say cable and phone companies will be able to control what we see and do online. they are already vowing legal challenges. it is 4:30. if your alarm is just going off, welcome to the day. weather and traffic right now. we start with drew. good morning. we have a mixed bag of temperatures. location is key. the coast is mild inland.

cold in the upper 20s and lower 30s. 29, good morning fairfield. 37 in concord. more mild there, 49 in san francisco. 41 in san jose. clear lake, that is not a mistake, it is 62 degrees there. the reason why we have wind in our hills that's keeping us on the mild side so to speak. 12-hour planner, we have that chilly start. by midday look how quickly the temperatures rise, mild today going back into the 60s. we're taking a look at our traffic maps right now. green is great. here are a couple of problem spots, though. let's go over to oakland where we have an accident eastbound 580 near fruitvale. the accident is facing the wrong way -- the vehicle is facing the wrong way. bumper and debris in lanes in the eastbound direction, which is the reverse commute. san jose southbound 280 near 10th. again, a big rig is pulled over to the right shoulder and a

vehicle is facing the wrong way here. right now it's early enough i'm not seeing a lot of slow traffic in the area. we'll be monitoring these when we come back in a few minutes. a blockbuster media deal is official this morning. disney is acquiring a big piece of 21st century fox. in a $52.4 billion deal those close to the situation think this will help disney's ambitions in streaming media. this acquisition does not include fox television, fox news, or fox sports. disney ceo bob iger was on "good morning america" to talk about the deal. take a listen. >> $52.4 billion according to the press release. that is a huge bet. why are you making it? >> well, we're making it because this gives us the ability to marry the great content of fox with the great content of disney. it gives us a much larger international footprint, and it enables us to use cutting edge

technology to reach consumers in far more compelling ways. we know how important that is in today's world. >> as part of the deal bob iger will continue as chairman and ceo of the walt disney company through the year 2021. i should note disney is the parent company of abc 7. all right, jessica, thank you. san francisco city hall preparing to honor the late mayor, ed lee. >> his body will lie in state in the rotunda from 8:00 a.m. to 7:00 p.m. tomorrow. the public will be allowed to pay their respects to the mayor who died early tuesday after suffering a heart attack. a memorial celebration will be held at 3:00 p.m. sunday at city hall. many dignitaries expected to attend the service. that is also open to the public. this is video of one of london breed's first appearances as acting mayor of san francisco. she attended an event to announce a gun buyback program this weekend. breed made it clear she's working to take care of the city following mayor ed lee's sudden death and is keeping it running as it should. >> the police will be out there. the fire department, when called, will be there, the buses

will run, potholes will get fixed if you call 311. >> says it is too early to say if she would run for mayor but believes her knowledge of what the city needs makes her uniquely qualified and prepared to step into the job. contract talks between the city of oakland and its two largest labor unions are set to resume monday. that news comes as city leaders announced a deal with two other unions. neither of these unions was involved in the seven-day strike that ended monday. the cmea and ibew accepted the same wage proposal offered to the striking workers. that means a 4% raise for the current year and a 1% raise in 2019 that could be doubled depending on city revenues. 4:34. the state utilities commission is scheduled to consider new fire safety rules that could force pg&e and other utility companies to change how they install the equipment, changing the location of poles and wires. regulators became concerned after wildfires in the north bay and other areas of our state.

the cpuc says the changes would be expensive. it would allow utilities to raise rates to make up the money. firefighters finally have a ring around one of the stubborn firefighters, the rye fire is completely contained this morning. that leaves four active fires that crews are still battling to control, and the biggest one is the thomas fire burning in ventura and santa barbara counti counties. it is 30% contained. firefighters are trying to get ahead of the flames by taking advantage of relatively calm winds. the fire has destroyed more than 700 homes. senate and house republican leaders have unveiled a compromised tax bill. they're rushing right now to get it to the president. the democrats are calling on those republicans to delay the vote. abc news reporter gloria riviera is live in washington with details. gloria?

>> reporter: good morning, jessica. president trump says americans could see more money in their pocketbook very soon. the irs isn't guaranteeing that just yet. president trump is making big promises. >> if congress sends me a bill before christmas, the irs has just confirmed that americans will see lower taxes and bigger paychecks beginning in february. >> reporter: president trump touting his tax plan at the white house as congressional republicans announce they are not there yet but much closer to a deal. here is what the house and senate have agreed to so far. drop the corporate tax rate from 35% to 21%. cap the mortgage interest deduction at $750,000, middle ground between the senate and house versions. repeal the obamacare individual mandate that requires all americans to have insurance. and lower the top individual tax rate from 39% to 37%. a new analysis predicts it could

add more than $1.5 trillion to the nation's debt. >> the public knows about this bill. they don't know all the details but they smell what's going on. tax cuts for the wealthiest, no help for so many in the middle class. >> reporter: gop lawmakers are aiming to vote on a final version next week. democrats are hoping to push that vote back because they want the newly elected senator from alabama, doug jones, to be able to cast his vote. house majority leader mitch mcconnell says he see no, sir reason to delay. gloria riviera, abc news, washington. and in accuweather a bit of a breeze in our hills right now. good morning, everybody. in our north bay hills the wind from, say, 15 to 30 miles an hour. in our hills today a little breezy but closer to the surface. winds remain rather calm. temperature wise, good morning, san jose, 41. 38 in cupertino. the same in sunnyvale. it is a chilly start for many parts of the region.

from the live desk this morning, roy moore refusing to concede defeat to democrat doug jones in the alabama senate race. he says there are uncounted votes that could still swing the race. in a video released just last night moore says this contest is a battle for the heart and the soul of the country. >> many do not share the vision of those who built this country. today we no longer recognize the universal truth that god is the author of our life and liberty, abortion, sodomy, and materialism have taken the place of life, liberty, and the pursuit of happiness. >> on tuesday they elected jones with 50% of the vote to moore's only 48%. it was a special election to fill the senate seat vacated by attorney general jeff sessions. moore continues to deny claims that he had any sexual encounters with under aged girls in the 1970s and 1980s.

reggie? harvey weinstein is denying new sexual harassment allegations from selma hayak. she says weinstein threatened to kill her at one point. she says he made outrageous demands on the production of "freida" including insisting she film a scene with full frontal nudity. he would turn up at her door at hotel after hotel, location after location. weinstein says the allegations are not accurate and denies that he pressured her into doing the sex scene. allegations of sexual misconduct, the great american baking show from its schedule after one episode. celebrity judge is accused of inappropriately touching and groping four women when they worked at a manhattan restaurant. he has denied some of the accusations. curry and anthony spice adams

additions. >> the mountain lion cubs are calling the oakland zoo home. they're really cute. this is apparently a major get for the zoo. having mountain lions on display is very rare. both of the cubs are male. they were found separately in orange county. look at their faces. wildlife researchers believe they may be siblings and will do dna testing to determine that. the trail opens next june. the baby cats are in quarantine right now. more teens are saying no to alcohol, tobacco, and drugs. there is one big exception. >> a man attacks a truck driver after they get into an accident. then the rampage goes from violent to bizarre. >> from a galaxy far, far away to an east bay field. a local family lays out a unique welcome mat to the rebel alliance. first this morning's "tech bytes." in today's "tech bytes," target's same-day delivery service. >> so the chain is paying more than half a billion in cash for shipped, a company that specializes in grocery

good morning. time now 4:54 a.m. here is your hour-by-hour forecast. starting off chilly in the 30s in our coldest spots. by lunch time that sun really effective at warming us up, will top out in the mid and upper 60s later on today. enjoy. okay, the next story will seem like i'm making it up but this actually happened. fairfax, virginia, police say the man you see without a shirt here rammed his pickup into two other vehicles yesterday. he then attacked one of the drivers. and the craziness doesn't stop there. for some unknown reason the shirtless suspect jumped a metal barrier, removed the rest of his clothes, as you can sort of see there, jumped back onto the highway and on a moving flat bed attacked the driver with a cutting tool.

police later found the suspect in a drainage ditch. what is happening? authorities are trying to determine if drugs were a factor. going to go ahead and say probably a yes for that one. 4:55 now. drinking, smoking, and drug use has declined among american teenagers. researchers say the percentage of teens using marijuana is on the rise. monitoring the future report found that marijuana use among 12th graders increased to 37% up 1.5% from last year n. addition only 14% of high school seniors see great risk in seeing marijuana every once in a while. the survey shows that nearly 28% of eighth graders have in the past year. good morning. we're in this pattern of chilly starts but nice afternoon. that's how today will show up.
