the week. a new analysis of the bill finds in a decade 70% of middling income americans would see a tax hike while 76% of the wealthiest would receive a tax cut. it is 4:30. if you are just joining us let's get a quick update on weather and traffic starting with meteorologist mike nicco. >> we will go back to live doppler 7. i put the clouds into motion. you can see they're going to encroach our neighborhoods from north to south today. let's jump into my accuweather 12 hour planner. temperatures not nearly as warm as they have been. 37 to 44 this morning, 56 to 58 at noon and becoming mainly gray at 4:00, 54 to 58 and by 7:00 we will start tracking light rain in the north bay. more on that next. here is sue. we're headed to the bay bridge toll plaza for our first look at 4:30. a couple cars paying cash at the left hand lanes. otherwise looking good. just a heads up that tollbooth 14 that was taken out a couple

weeks ago by an accident at the toll plaza that is still out of commission. that lane is still closed. so far we haven't seen a lot of damage done by that as far as a backup. a little bit of slow traffic out of the central valley. your ace train number 1 did leave on time this morning i'm watching a developing story this morning, investigators have now revealed the amtrak train that derailed in washington state was speeding, going 80 miles per hour in a 30 mile per hour zone. three people were killed and dozens injured on a track that was just recently upgraded. this morning we are hearing the who a heroic stories of those who rushed in to help as the train dangled over a busy freeway. maggie rulli is live with more on this story. >> reporter: jessica, good morning. just behind me you can see that bridge where the train derailed, crashing on to cars below on this highway during a busy

morning commute. now investigators are trying to figure out exactly what caused this horrific incident to happen. an early morning commute interrupted by chaos. >> amtrak 501. emergency, emergency. >> reporter: amtrak train 501 had just left seated and was heading towards portland. the ntsb saying preliminary findings show the train was traveling at 80 mile per hour near the curve where the speed should have been reduced to 30 miles per hour. >> they are requesting all possible units. >> reporter: 13 of its cars careened off both sides of the overpass, crashing directly on to interstate 5 below. >> that train is derailed. >> my car just started shaking really, really badly. >> reporter: daniel and his girlfriend were on their way to work when they saw the derailment. he rushed in to help. >> people were in shock and a lot of them initially when they got out of the train they just went and they sat down with their heads -- with their -- you

know, their faces in the palm of their hands. >> the crash happened on a new line for amtrak. this train carrying its first paying customers. just last month in the nearby town of lakewood mayor don anderson warned about the possibility of a crash. >> when there is an accident, this project was never needed and dangerous. >> reporter: a federal report following a 2015 amtrak derailment noted a culture of safety lapses at amtrak. >> so this positive train control idea is something mandated by law long ago but amtrak has been very slow to implement it. >> reporter: crews have been out here working through the night and in this freezing rain. one official told me when he first got to this scene he didn't know what to believe. it almost seemed unreal, like someone just took toy train cars and started tossing them around. in dupont, washington, maggie rulli, abc 7 news. >> maggie, thank you. happening today the city of santa rosa will consider banning

landlords from evicting low income residents following the north bay fires. they have received multiple reports that some landlords may be evicting lower income tenants in order to rent to insured residents displaced by a fire. the city council will discuss a ban on those evictions at 2:30 this afternoon. steady progress is being made on the thomas fire in southern california. containment now at 50%. the fire has grown to 423 square miles and has reduced more than 1,000 homes to rubble. cal fire says that weather conditions are improving for firefighters with lighter winds and higher humidity. the fire started two weeks ago yesterday. east bay firefighters who have been on the front lines of the thomas fire are headed home right now. the alameda county fire department posted this photo. crews from six departments have been down south since december 5th. san jose firefighters are also battling the thomas fire. they got a special thank you for actor rob lowe. he says crews saved his home in santa barbara county.

he took a photo and served them dinner. on instagram he writes thank you to all the crews from all over the country who stood tall and saved my town. four teens face charges in connection with flare gun attacks in a san ramone neighborhood over the weekend. home security cameras show bright flashes from flares that were randomly fired at seven homes and several cars. police say the most extensive damage was shattered windows. three of the four teens arrested live in san ramone. an off duty police officer accused of firing his gun inside a san francisco hotel may have been suffering a mental health episode according to his attorney. phil sanchez is out of jail on bond. he is accused of firing several shots inside the four seasons hotel on sunday morning. he surrendered to police two hours later. no one was hurt. today marks one week since the passing of san francisco mayor ed lee and the city's political world is still wondering who will run to replace him next year. there are at least two supervisors whose names are circulating as possible

candidates, mark ferrell and jane kim. mark leno turned in his papers last thursday and angela elioto did so yesterday. another possible candidate david chu. alex clemens says anyone thinking of running for mayor has to have a clear vision for the city. >> they need to address homelessness, how we ensure we remain a beacon of civil rights to the world. >> the special election will take place on june 5th of 2018 and the deadline to file is next month. let's take a look at temperatures in san francisco. we have microclimates here, look at sunny side, 43 degrees, west portal 53, along the coast from ocean peach to lake merced 47, park presidio 48, the castro the mission at 47, bayview 51. coming through the ferry building and heading to the

financial district it's about 49 degrees right now. it's not too breezy as we look from our east bay hills camera. on the roads some sprinkles in the north bay, otherwise it will be dry all day. mass transit cooler this afternoon and if you are going to be on the bay it will be breezy tomorrow. everything is pretty good today. look at these temperatures, the lack of sunshine in the afternoon hours definitely going to dim the sun, the clouds will, and that will keep us down around a 59 to 62 degrees, could be warmer in places like san jose at 64, morgan hill and santa cruz at 63. tonight's temperatures mid to upper 30s in the north bay with a little bit of clearing, the rest of us in the low to mid 40s with that rain on the way. we have also got breezy conditions. by 7:00 tonight about 10 to 20 miles per hour, by 11:00, 15 to 25 and then by the time we get up tomorrow morning, about 20 to 30 and that will be the case throughout the day. we will take a look at that rain that's going to accompany these winds coming up next. here is sue. any leftover congestion,

construction, something? >> we have some leftover road work, yeah. we have southbound 6 pleasant hill and red gear road, that has been picked up, everybody is moving at the limit through walnut creek. richmond san rafael bridge, we do have the left lane closed for some road work there but i'm not seeing slow traffic. that's only for the next few minutes. same with northbound and southbound 880 between high street and 238, various lanes closed there, also until 5:00, we will check back in a few. recreational pot becomes legal in california in your two weeks. now there is a push to give voters a big say in how it's sold and used in san francisco. >> bay area traffic just keeps getting worse but would you be willing to spend $100 billion to fix it? >> and

advisory about 3 inches of snow at the pass level. that will be the big story in my accuweather seven-day forecast for tahoe. for us i will take a look at our storm impact scale for today and tomorrow's rain. a trump administration is publicly blaming north korea for a ransom ware attack that affected hundreds of thousands of computers worldwide. the wannacry cyber attack happened in may, it affected more than 230,000 computers in hospitals, schools, businesses and homes all around the world. homeland security officials say evidence points to the communist nation and are vowing that north korea will be held accountable. a plan is in the works to give san francisco residents a greater say in marijuana. fever wants to put the measure on the ballot in june. the board of supervisors would appoint five members of the commission, the mayor would pick

four. fewer says the community has to have a say in regulating cannabis when it becomes legal for recreational use on january 1st. the state's minimum wage is going up 50 cents to $11 an hour, many various cities already exceed that minimum wage. new parents with take 12 weeks unpaid leave of maternity and paternity leave. and california will become a sanctuary state. that restricts federal officers from enforcing immigration laws. christmas is on a monday this year and that means you have an extra weekend to get your holiday shopping done. is that what it means? >> sure. pleasanton stoneridge shopping center says with so many shoppers waiting until the last minute this saturday is expected to be the seventh busiest shopping day of 2017. so what will we be buying? well, a lot. surveys find shoppers plan to buy about 15 gifts this year, clothing and gift cards rank highest, followed by electronics, toys and books.

pieces of mail. of that 169,000 will be packages like you see behind me. >> reporter: there was a line at the main post office in san jose but customers were in good spirits. >> we were here earlier in the afternoon and the line was out the door so we had some -- an appointment and other errands to run so we came back now. >> i had an emergency last week, i had to go out of town, so it's kind of put a drink in my plans, but here i am. >> reporter: these customers got in under the wire. tuesday is the last day for first class mail to arrive by christmas, on wednesday you will have to upgrade to priority mail, on friday you will pay a premium for priority express. >> until somebody figures out how to e-mail a sweater we're going to deliver it. >> reporter: and, yes, the post office does deliver on christmas day. in san jose, katie marzullo, abc 7 news. you can't e-mail a sweater, he says. we're going to mail it. >> all right. i'm just still working on that gift card for you, though. so it's in not red lobster that leaves me olive garden.

will be in the north bay through midnight, you can see scattered lighter showers ahead of the storm for the rest of us. midnight to 4:00 it moving out of the north bay, moves into the heart of the bay. from 4:00 it moves into the south bay and starts to exit your neighborhoods by 7:00, but notice there are still scattered showers possible, especially near the coast through 9:00 and those will flad as we head up towards noon. fast moving storm so don't expect a lot of rain. in fact, by 4:00 in the morning from about the dumbarton bridge northward it will be pretty wet, the south bay will get the rain during the morning commute. we have a couple hundredths up to 1500 hundredths of an inch of rain. it's going to be chilly like it should be, thursday and friday in the 50s, barely 60 saturday into sunday. i will take a look at our next chance of rain for christmas coming up in the next weather. here is sue. all right. let's go to san rafael. we have light conditions southbound and northbound, if

your commute takes you from novato into san rafael and on to southern marin through mill valley into the golden gate bridge you are looking at a 22 minute drive from roland boulevard. coming out of tracy a bit of slow traffic. let's take a look at your commute this morning, mabart is running on time. the san francisco bay ferry the 540 and mare island and 6:00 a.m. vallejo will be a bus and a time change for the golden gate ferry, that 8:45 and 9:15 are now five minutes later. guys? >> thank you, sue. this morning we are learning new details about the plan to raise $100 billion to ease traffic congestion around the bay area. >> we first told you about this idea yesterday and the first thing you should know is part of the plan calls for you to spend $3 more at tolls on bay area bridges. civic and business groups say that it will take a regional approach to help ease our traffic. >> bay area residents look at traffic at a crisis level and so they want their regional leaders

we've been in search of wet weather it seems like for weeks. actually, it has been. here is a look at my chances for rain the next seven days. 40% of us get rain today, 60% of us tomorrow. we go through the weekend dry and on christmas day and tuesday we've got another chance of wet weather and i will show you an hour by hour look at that coming up next. in san francisco even the trash is high tech. these recycling systems are making their in union square in morning. they are solar powered an wifi connected. sensors inside alert collectors when the bins are full. they also have unique compaction technology that makes room for five times the amount of trash a typical bin its size can hold. the city hopes these systems will help it save money and protect the environment. en a east bay family is getting an early nice holiday

commuters getting up out of the central valley and the dublin pleasanton area. drive times, highway 4 into the mcarthur maze just over 15 minutes, bay bridge minor delays all the way into san francisco. about 29 minutes or so, 28 minutes to get all the way into san francisco. once you are into the city the sfo traffic is moving nicely south on 101. a lot of people talk about this. when the hall of presidents attraction at walt disney world reopens today it will have a new addition. >> from the beginning america has been a nation defined by its people. >> after a year long renovation president trump joins the audio animatronic lineup at this attraction. the hall of presidents was first envisioned by walt disney as a way to honor the presidents. disney is the parent company of abc >> he fought cancer twice. i have to give you a hug.
