will be cloudy and dry at 4:00, 54 to 58. by 7:00 we will have light rain developing in the north bay, temperatures in the low 50s. sue says it's been pretty quiet so far this morning. >> we have a couple of accidents but none of them are blocking at least at this point. we will knock on wood for that. back to the san matteo bridge, we're getting a little busier with the taillights headed westbound across the causeway and up on the high-rise over towards foster city for about a 16 minute drive from the tolls over towards the peninsula. here we go with the east shore freeway, also a nice solid ribbon of head lights between university avenue and the macarthur maze, no metering lights yet. we will check back with the bay bridge toll plaza in a couple minutes. we have been watching a situation in -- okay. if we come here to live desk, we have been watching a situation all morning long in washington tate. this was the scene overnight, you can see the train still the way it was left there, the train

that derailed yesterday morning and actually just within about the last hour or so they were able to get some of those train cars up and out of the highway. i want to give you the latest. the ntsb is saying that the amtrak train that derailed was going 50 miles an hour over the speed limit when it went off the tracks. the train was going 80 miles per hour in a 30 zone. the president of amtrak says positive train control, the technology that can slow or stop a speeding train, was not in use in that particular stretch of track. at least three people were killed and dozens of others were injured. all but one of the trains 14 cars jumped the tracks. >> there was one person who -- in the car in front of us, they -- they were -- they were catapulted to the front of the car and they wre -- they were pretty badly injured. they were unconscious, but still breathing. but what i could see from the

window was that we had disconnected from the other -- the back portion of the train. i could see that someone had been cat bulleted from the train on to the ground. >> officials say it is still too early to tell why the train was going so fast. a major investigation still under way this morning. i will let you know as soon as we get updates. developing news this morning, a suspect td robber has life-threatening injuries after a security guard shot him in downtown san jose. it happened just before 8:30 last night at the wall greens at first and santa clara streets. an investigation is under way. morae alligations of sexual abuse at a south bay high sch l school. >> we are expecting to hear the story of two more former students who say presentation high school did not do enough to respond to the allegations. matt keller is live for us in san jose. >> reporter: good morning. students here at presentation high school will be taking finals today, but later this morning more alligations of sexual misconduct are coming out

about the prestigious catholic school. this press conference will be taking place at 11:00 this morning. attorney robert allert says a mother will come forward to discuss the sexual abuse of her daughter in 2014. a student from the 2006-2007 school year will discuss her story of sexual misconduct by her math letter and a letter will be released alleging the high school responded to three sexual misconduct allegations by placing a higher priority on the school's reputation. all of this comes after two graduates came forward to accuse their alma mater not taking alleged sexual abuse seriously. >> our entire investigation team has been astounded, shocked and frankly dismayed. >> reporter: the school principal says presentation never covered up or condoned any instance of sexual abuse and conducted investigations more than 25 years ago and more recently for the newer claims. today's press conference will

take place in san jose. reporting live in san jose, matt keller, abc 7 news. reporting live in san jose, matt keller, abc 7 news. the law that allows berkeley police to use pepper spray during violent protests may be repealed. according to sf gate city council members are expected to vote today. their move follows pressure by the city's police review commission. this law was just approved in september. members believe that since factors like wind and volatile crowds can prevent officers from specifically pepper spraying an agressor they should not be allowed to use a deterrent at all. this is what it looks like inside of the city of pittsburg surveillance headquarters. they will need mormon torse because the city counsel has unanimously voted to install freeway cameras to try to stop freeway shootings, katie utehs has the story. >> reporter: surveillance cameras will be installed along stretches of interstate 80 and 84 in be couldn't

costa free ways. >> the city of pittsburg has had cameras on our streets since 2005. >> reporter: city council voted for pittsburg pd to be the hub for the county wide data collection. take a look inside, you can see the setup that's already in place for pittsburg's current program. the data collection will come from shot spotters, cameras and license plate readers. >> we will have eyes on the freeway basically in real time. >> i, too, have concerns about privacy. >> several people raised concerns about privacy. >> there was a lot of vagueness about where all of this data is ending up. when you're dealing with mass bulk surveillance, as i stated, 99% of the data that's being collected here at least has nothing to do with any crime. >> law enforcement will be allowed access to the system information on a need to know criminal investigation basis. >> reporter: caltrans is funding the surveillance project with

$3.5 million over three years. in pittsburg, katie utehs, abc 7 news. surveillance video shows the danger officers face while monitoring a sideshow in oakland. a chp helicopter was assisting police during the sideshow when officers say more than one person behind green lasers at the helicopter and at cars in the sideshow. that can temporarily blind a pilot or a driver. anyone arrested will face state and federal charges. a man taking photos of san francisco's twin peaks was robbed at knife point. it happened on twin peaks boulevard saturday night. the 32-year-old victim says he was taking photos when two men approached him from behind. one suspect pulled out a knife and demanded his bag, which contained camera equipment, his cellphone and wallet. the robbers believed to be in their early to mid 20s took off. police are still looking for them. i was talking to sue and she says she has a new accident to tell us about.

the south bay. a little warmer down here. by noon we will be in the low and mid 60s in the afternoon hours, mid 50s during the evening hours. temperatures will top out around 59 to 64 degrees, tonight not quite as cool but look at all that, green that means rain is on the way. did you just say i could get exercise by shopping? i thought that may be what i heard. >> i like that. should we try that? >> yes. >> let's check outside. we have this accident it's in the san lorenzo area, san leandro, westbound 580 under the 150th overcrossing. they have tried to move that off to the right hand shoulder but chp is talking about doing a traffic break which means that traffic will be stopped temporarily to move that accident out of the way. i'm not seeing any slow traffic according to the sensors, they are all green at this point in time. tracy into dublin you are looking at a 40 minute drive up and over the altamonte pass. not bad on westbound 4 to concord, san rafael into san francisco a 17 minute drive. just under 20 minutes for some

of your drive times. we have mass transit issues, we will update in just a couple minutes. airlines flying in and out of atlanta's international airport should expect flights to be on time today following that crippling power outage. delta airlines says most passengers who were stranded in atlanta were rebooked on other flights that left yesterday. the carrier canceled 400 flights monday. the ceo of georgia power apologized for sunday's day long outage. he blamed a faulty gear that started a fire that knocked out electricity to the world's busiest airport. a major study leading to disheartening results when it comes to preventing dementia. >> what is that? we are learning new details from a navy pilot who says he saw something from out of this world and he is not alone. if you love checking out and he is not alone. if you love checking out christmas lights this is

of someone else's front porch. look at that, the victim saw what was happening. ran after the car as it was driving off. this happened yesterday off apian way in union city. since we have such a clear view of her why not show it. if she looks familiar call police. she probably stole $300 worth of items. a southern california homeowner is crediting his doorbell for alerting him about a fire that was happening just outside his home. he had no idea. this potentially saved three people's lives. in terrifying scene in riverside county recorded by a home surveillance system. it features a doorbell that has a motion detector. so the flames triggered the detector and that meant the homeowner received several alerts on his phone app when the fire broke out. he and his fiancée were sleeping. >> we took down our smoke detector because we just repainted the entire house. so without the ring system in place and me getting these alerts i probably wouldn't have woken up.

>> okay. so also never take down your smoke detector. there is another lesson. the couple and his brother escaped unharmed. the cause is under investigation. it's 5:15. after disheartening news about dementia, according to a study that was published there is not a single thing at this point that can definitively prevent you from getting alzheimer's over 80 years old. diet, drugs, could go any training exercise, vitamins, it doesn't work for everyone. it does suggest that these things can be helpful. exercise, managing diabetes, controlling high blood pressure and cholesterol at midlife. >> in today's gma first look we are learning more about the arrest of sarah palin's son. track palin reportedly beat up his own father during an argument and sara frantically called police. here is lindsey davis. >> reporter: in this morning's gma first look police describe a chaotic scene at the family home of the former governor of alaska and 2008 vice presidential nominee sarah palin.

her 28-year-old son, an army veteran, arrested in alaska saturday night on assault and burglary charges. according to court documents obtained by abc news, sarah palin called police just after 8:30 p.m. saying her son was freaking out and was on some type of medication. charging documents state track palin went to the house to confront her father todd to get his truck but his father told him not to come in. todd told police he went to the door with a pistol to protect his families. that's when track broke a window, got his father on the ground and began hitting in the head. we have much more coming up at 7:00 a.m. facebook is cracking down on what's known as engagement bait. it's a tactic designed to artificially inflate a business' reach on the algorithm. spam posts that try to get likes, clicks and shares will be demoted in users news feeds.

if someone's post says like this if you are an aries. facebook claims it's algorithms can tell the difference between spam and sincere posts. there is new details in a jaw dropping story first reported by "the new york times" over the weekend. >> the pentagon's secret program investigating reports of ufos. now the pilot that spotted what he believes was an alien spacecraft is recalling this out of this world encounter. >> look at that thing. it's rotating. >> so we showed you this video of that sighting back in 2004 taken off the coast of san diego. the pilot is now retired commander david fraver. he says nothing in his 18-year career as a navy pilot prepared him for what he is saw. he says i've seen pretty much everything that i can see in that realm and this is nothing close. i have never seen anything in my life, in my history of flying that has the performance, the acceleration. keep in mind this thing had no wings. >> they're just going to leave

chance of rain. we will talk more about that coming up. here is sue with another new accident. >> we have a new accident, this one is actually a big rig blocking lane number two in the santa cruz mountains of 17 southbound. it's past bear creek and right now just looks like it might be moved off to the shoulder. we were seeing some slow traffic in the southbound direction, so heads up there. they are in the process of scooting that off to the side of the road. bart has 44 trains right now, no delays. morning ferry, golden gate ferry, the 8:45 and 9:15 will be now until further notice at least running five minutes later. that's the new departure time change. the san francisco bay ferry, the mare island boat and 6:00 a.m. vallejo boat will be replaced by a bus due to mechanical issue. we will come back and look at the bay bridge toll plaza in a few minutes. an update to a story we brought you as breaking news yesterday morning. arson investigators believe a series of fires at homeless en cramp mts in san jose may be linked. we had coverage of the latest

richmond police department. >> reporter: richmond police were the ones who are trying to pull him over. we are here to get more information about why they were looking for this officer. here is a look of the crime scene, this is from sky view 7, this happened in the hilltop mall parking lot in richmond around 1:30 yesterday afternoon. investigators say the man who was pulled over shot and killed himself. the car is licensed to antonio cacatian. he is an officer for the san francisco police department. the sfpd tells the chronicle he was under investigation that involved multiple jurisdictions. no other details were given. we will continue, though, to follow this developing story. okay. amy, thank you. investigators have revealed the amtrak train that derailed in washington state was speeding. it was going 80 miles per hour in a 30 zone. three people were killed and dozens injured on a track that had just been rectlupgraded.

this morning we are hearing the heroic stories of those who rushed in to help as that train dangled over the freeway and abc news reporter maggie rulli is live in dupont, washington, with more. maggie? >> reporter: jessica, good morning. just behind me you can see that bridge where the train derailed crashing on to cars driving on this highway just below us now. authorities here are desperately trying to figure out how this horrible accident could happen. an early morning commute interrupted by chaos. >> amtrak 501. emergency. emergency. >> reporter: amtrak train 501 had just left seattle and was heading towards portland. the ntsb says preliminary findings show the train was traveling at 80 miles per hour near the curve where the speed should have been reduced to 30 nerps. >> they are requesting all possible units, there's bodies on the freeway. >> reporter: 13 of its cars careened off both sides of the overpass, crashing directly on to interstate 5 below.

>> oh, my god, that train is derailed. >> my car started shaking really badly. >> reporter: daniel and his girlfriend were on the way to work when they saw the dera derailme derailment. he rushed in to help. >> people were in shock and a lot of them initially when they got out of the train they just went and they sat down with their heads -- with their -- you know, their faces in the palm of their hands. >> reporter: the crash happened on a new line for amtrak, this train carrying its first paying customers. last month in the nearby town of lakewood the mayor warned about the possibility of a crash. >> when there is an accident this project was never needed and dangerous. >> reporter: a federal report following a 2015 amtrak derailment noticed a culture of safety lapses at amtrak. >> this positive train control was mandated by law was amtrak has been very slow to implement it. >> reporter: crews have been out

here working through the night and in this freezing rain. one official tells me that when he first got to the scene he could not believe what he saw. he says it was unreal, like someone had just taken toy train cars and started tossing them around. in dupont, washington, maggie rulli. happening today at the house the set is vote on the most sweeping tax overhaul in a generation. if this passes the measure will go to the senate for a vote and that could happen as early as today. no republican senators oppose the bill and only a small group of house republicans are expected to vote no. this bill could be on the president's desk by the end of the week. a new analysis of the bill found in a decade 70% of middle income americans would see a tax hike while 76% of the wealthiest would receive a tax cut. while 76% of the wealthiest would receive a tax cut. it's will be held at the intersection of san bruno and cherry avenues.

that's where a car hit 29-year-old carly flynn while she was crossing the street. her parents say she was walking home from starbucks at the bay hill shopping center. police believe a white midsized suv hit flynn. the city of santa rosa will consider bang landlords from evicting low income residents after the north bay fiers. city officials have received reports that some landlords may be evicting lower income tenants in order to rent to insured residents displaced by the fires. the city council will discuss a ban on those evictions and they meet at 2:30. study progress is being made on the thomas wildfire burning in southern california. containment now at 50%. the fire has grown to 423 square miles and reduced more than 1,000 homes to rubble. cal fire says weather conditions are improving for firefighters there with lighter winds and higher humidity. the fire started two weeks ago yesterday. east bay firefighters who have been on the front lines of the thomas fire are headed home.

afternoon and breezy tomorrow on the bay. your temperatures today with the increasing clouds about 59 to 62 degrees, it will be around 63 to 64 san jose, morgan hill and santa cruz. tonight we are looking at mid to upper 30s in the north bay, low to mid 40s for the rest of us, but look at all that rain that's coming our way. it's going to bring gusts with it, too. we will be around 15 to 20 at 11:00 tonight but overnight it will be pretty noisy with gusts up to 30 miles per hour. we will talk more about that rain, the wind and here is acci left lane by treasure island westbound on 80. you can see those brake lights starting on the incline section and around the curve towards the island. it's supposedly in the clearing phases, left lane near treasure island, we will check back with the bridge, but behind the toll plaza metering lights have been turned on for a couple minutes now and you are backing up towards the overcrossings.

our wet weather is right now. it is going to rain a lot of this moisture out up in the pacific northwest. in fact, rainfall amounts or rates are about a third of an inch an hour. we won't see that unfortunately. we do have a little bit of yellow, lake, mendocino counties at 7:00, scout showers for the rest of the north bay during that time. as we head towards midnight that solid line moves all the way up to the border with the bay with scout showers for the rest of us. from midnight to 4:00 the heart of the bay, inland, east bay gets wet and the south bay gets wet from 4:00 through 7:00, maybe 8:00. so at some point everybody is going to be wet or have slick streets during tomorrow's morning commute. by 9:00 we will see showers over the cost but even those will made fade away as we head toward midnight. >> tomorrow morning everybody is wept except for the south bay. by the end everybody is wet with

i want to pass along breaking news in the east bay. ac transit lines are being detoured right now. the transit agency just sent out this tweet saying that lines 72, 72 m and 72 r are on detour and not stopping and it's all because of police activity. this is between ashby avenue and 67th street. this is the berkeley oakland area. we're working to find out exactly what is going on, what that police activity is and our entire news team is working on that. i will pass along details as soon as we get them. this morning we are learning new details about the plan to raise $100 billion to ease traffic congestion around the bay area. >> we first told you about this yesterday. the first thing you need to know, part of the plan calls for you to spend $3 more on tolls on bay area bridges. civic and business groups say this will take a regional approach to help ease our traffic. >> paris residents look at
