live where you live, this is abc 7 news. forcing their way inside. four men and a woman break into a home in a posh south bay neighborhood. this midday the search is on for the group responsible for the home invasion robbery. >> thank you for joining us. the violent robbery left one person hurt. this happened around 4:00 a.m. this morning. abc 7 news reporter matt keller has been tracking the story all morning long. he joins us live now with new details, matt. >> reporter: we were let in here to get a better look at the scene. the home is right behind me. i just got off the phone with the sheriff's spokesperson, there are still five suspects outstanding. four men and one woman, all

believed to be in their 20s and at least one of them had a handgun during this crime. let's show you some video from earlier this morning. you could see an ambulance leaving the scene. we were told the homeowner was injured. we are told his stable at the hospital. investigators are not saying what took place or what was taken. this is in the fluid neighborhood with homes valued from 3 to $7 million. >> just said it was a home invasion and i asked if they caught the guy and they said no. i said i need to get through to go to safeway. just wave at the officers when you go. >> it's a safe neighborhood, i never heard anything like this happening before. >> reporter: investigators have been coming in and out all morning long. banner avenue is back open but no word when deputies are expected to wrap up their investigation at the home. the sheriff's office is expected to release more details this afternoon. reporting live, matt keller, abc 7 news. >> all right, thank you, matt.

new at 11:00 now, travis force base is back open. abc 7 news learned that the county sheriff was pursuing the vehicle that crashed into the gates. it's believed five people were inside the car, including a burglary suspect under surveillance by santa clara police. all five people were taken into custody by travis air force base police. gates were reopened after an hour. developing news in washington, victory for the gop. within the last hour, the house revoted to pass the gop tax bill which was just approved by the senate last night. president trump will hold a celebration in the next hour at the white house. here's abc news reporter in washington, d.c. >> reporter: it's been a busy 24 hours here in washington. president trump and republicans are ready to take a victory lap to tout this major change in tax policy. take two for the house. >> the motion is adopted without objection, the motion to reconsider is laid upon the table. >> reporter: republicans forced a revote on that sweeping tax

overhaul. an excited house speaker paul ryan making the rounds on morning tv. >> and we are convinced this will grow the economy, all the scorekeepers say it will, it's just a question of degree. >> reporter: the tax cuts and jobs act is passed. earlier this morning, the senate passed the $1.5 trillion rewrite of the tax code along party lines. the largest change in more than three decades. protests in the senate chamber, democrats outraged. >> what a disgrace. that's what this bill is. it's an absolute disgrace. >> the democrats don't like to see tax cutting, they like to see tax increases and they like to complain. >> reporter: the president and gop leaders promising jobs. >> we can't sell this to the american people, we ought to go into another line of work. >> reporter: the tax rate slashed for 35% to 21%. tax cuts for individuals will expire after eight years. americans will see the standard deduction and child tax credit doubled.

america's making $75,000 or less will face a tax hike in a decade. healthy americans will continue to see a tax cut. and to celebrate the first legislative victory, president trump is inviting republicans over to the white house this afternoon. he's expected to deliver remarks, but still no word on when he'll actually sign the tax bill into law. reporting in washington, abc 7 news. >> so what does that victory mean for president trump and the democrats in 2018? jessica castro spoke with rick clyne this morning for some analysis. >> how important is this for him politically? >> i think it's a big moral victory for him and republicans. they were 0 for the years, to close out the year with something that repeals the obamacare individual mandate, opens up the arctic or the alaskan national wildlife refuge, those are big things for republicans. >> democrats no surprise though, very upset about the outcome and vowing to come back at the ballot box in 2018. do you think that's possible for

the democrats? >> this is going to be the grand argument of 2018. it feels like we close out 2017 with laying down the battle lines. i think for democrats, they've seen success in laces like virginia and alabama just last week, where they were able to tap into the voter anger, frustration, what's going on is possible that the tax bill adds to that. it's also possible that people remember why they voted for president trump and the republican majority because of things like this tax cut. >> abc news will have a special report at noon. that's when president trump will meet with members of congress at the white house to celebrate the passage of the tax bill. you can also get the latest updates through our free abc 7 news app and on abc7news.com. marin county sheriff's office is investigating a shooting between a police officer and a man. investigators say that the officer was responding to a report of a suicidal person with a weapon. it happened around 7:30 last night at san clemente and paradise drive. police said the manmade motions towards his waistband and one officer opened fire.

that man is receiving treatment. the officer who ohmed fire is on paid a mrtive leave. one person is in custody this morning after police searched a home in san jose. this was a big operation involving a police robbery unit, s.w.a.t. team, and other officers. they were investigating several violent carjackings and armed robberies. officer arrested a man yesterday. we are less than two weeks away from the legalization of recreational marijuana in california. and there are still a lot of questions on people's minds. how will it be regulated and how will kids be kept from using it? abc 7 news reporter amy hollyfield is live in oakland, that's under way right now, good morning, amy. >> reporter: hi, good morning, natasha. yes, this brings about a lot of opportunities that need to be discussed and a lot of challenges. while we were inside what we learned was a lot of people have a lot of questions. it's a new frontier, and the people in this room all have different questions and concerns

about the legalization of marijuana. one local elected official at this alameda county summit is ready to discuss thousand keep kids from using it. >> how can we put forth an education awareness effort that really hits at young people so that we diminish their desire to want to use cannabis before they get to be adults? >> reporter: state officials say one of their focuses is getting people licensed to sell it. >> the risk is is making sure we get people from the unregulated market into the regulated market. so that's going to be the challenge for all of the licensing authorities this year. >> reporter: one attendee of today's summit as her eye on the environment and who will manage the hazardous waste. >> i want to see who is going to be leading the regulations if they're going to be leading those regulations in a way that makes scientific sense. environmental sense. >> reporter: it's a lot to cover for a one day summit. the organizers are opening people will learn and network

here to help everyone get ready. >> people have a lot of questions. a lot of questions. and so we're hoping that this helps to clarify some of those questions. >> reporter: this morning the focus is on licensing and regulating. the whole afternoon will be dedicated to what this means for young people. a lot of ground to cover, considering that this is going to be legalized in a week and a half. reporting live in oakland, amy hollyfield, abc 7 news. >> all right amy, thank you. staying in the east bay now, berkeley police officers will be allowed to keep their pepper spray. that's the ruling from last night's city council meeting. the move rejects the recommendation from a civilian commission board. there were concerns that wind and volatile crowds could prevent officers from pepper spraying one person. the city overturned a 20-year-old ban on pepper spray in september in response to a series of political protests that turned violent. this keeps happening. police say it needs to stop. people pointing lasers at planes. who incidents were reported just

last night at oakland international airport. the pilot of a fedex plane says he was hit with the laser two miles from the airport. chp says lasers are extremely dangerous, they can cause blindness or temporary vision loss. so far, police have not made any arrests. the thomas fire burning in southern california is now the second largest in our state's history. firefighters have been able to make some progress, but heavy winds are expected to pick back up again today. about 272,000 acres have burned in the thomas fire. that is nine times the size of san francisco. full containment is expected by the enof the first week of january. we're learning new details about the deadly amtrak crash in washington state. still ahead, what went wrong in the seconds before the train went off the tracks? also, new controversy over popular brand of workout clothing, the lawsuit filed against lululemon. good morning, i'm mike nico, did you sleep through the latest storm system? here's some of the totals that it left behind, and they are not impressive.

we have new developments this morning in the amtrak crash that derailed in washington. the national transportation safety board says the emergency brake was not activated by the train's engineer, it was triggered automatically when the train derailed. the train was going 80 miles per hour in a 30 mile per hour zone

at the time of the crash. it went off the rails and on to interstate 5 on monday morning. the engineer of the amtrak train is still hospitalized right now. everything is under scrutiny, including cell phone use. >> it's protocol for us to look at all of the cell phone records of all the crew members whenever there is an accident of this type. >> the crash killed three people and more than 70 others were hurt. there is a new poll shows most san francisco voters want the city to repair roads and strengthen public transportation including b.a.r.t. and muni. they feel companies like uber and lyft should be paying for the repairs. a survey shows 59% of voters support imposing a new tax on ride hailing and food delivery services. a boston arch bishop who resigned amid the sex abuse scandal has died. the vatican confirmed the death this morning. he died in rome where he previously served as arch priest. law resigned amid allegations

that he and others had covered up for pedophile priests. he was 86 years old. well new at 11:00 now, judge dismissed a lawsuit by a man who claimed michael jackson molested him as a child. he says he first met the pop star when he was five years old. he testified during the singer's criminal trial that he spent the night many times been but said under oath jackson never molested him. then in 2014, four years after jackson died, he filed over seven years. the judge did not rule on the credibility of those allegations, but said since the two defendants in the case are corporations, they cannot be held liable for the man's exposure to jackson. meanwhile, lululemon protected a store manager who sexually harassed co-workers and sexual assaulted one of them. he was relocatd after numerous complaints about him. a female co-worker says the

reached deals with sony music and universal music. uploaded to the video platform. bloomberg reports that youtube is promising stronger releasing. forget about telling your hamburger order to a cashier. one lets you do so with facial recognition. cally burger just added the kiosk. you're asked to attach your face to the account and in the future the system will automatically pull up your orders. eventually you'll also be able to lidge a credit card to the system to pay with your face as well. historic building that was at the center of a bat until oakland has a new owner now. they bought the old building at telegraph and broadway from uber. uber bought it in 2015 with plans to bring in 2rkz 500 workers and develop retail and office space. well opponents claimed it would lead to gentrification and uber scuttled the plan. the building is known as uptown station, no word on the purchase price. now your accuweather forecast with mike nico.

>> hard to believe it's already time to move on from our latest wet weather system that moved through this morning. hi everybody, here's a look from the east bay hills camera. and you can see the water a little angry on the bay today. we have a small craft advisory because of the gusty winds and choppiness. you can see the clouds are clearing out for the most part, hardly any radar returns to the green. you have to look up to the north and a few of these may try to slip into lake and mendocino counties, maybe even the northwest corner of sonoma county, i think for the most part, we're dry and remain dry for a while. look at the temperatures, low to mid-50s. not bad from middle to late december. step out into the winds and it feels about five to ten degrees cooler than that. so dress accordingly if you're heading out this afternoon. gorgeous shot of the marin headlands. we're going to enjoy wonderfully clean air coming almost straight from the arctic, and that's why it's going to be bone dry with sunshine and breezy conditions today. more like it should be for this time of year. frosty valleys, tonight the winds may keep us from reaching

freezing levels, but for sure friday morning and saturday morning we're going to have some frost and the christmas storm still being fickle. one storm says it's going to rain, the other day says maybe not. i'll show you the latest in a second. here's todays temperatures, about 56 to 59 degrees. some of the white caps on the bay because of the gusty winds, this is from our emeryville camera. gorgeous shot, isn't and. 12 hour accuweather planner, 49 to 53, no more 60s in the forecast. 4:00, about 52 to 54, then the stars return at 9:00, 42 to 47 and tm be breezy in the hills, but inland and the valleys cooler. 40 bied any night, 44 for the rest of us. destination, police stations like santa rosa, concord, some of the areas could drop down near the freezing mark. mid to upper 30s from fremont, palo alto southward and out towards the coast. all right. since the last computer model

run, which was about four hours ago, this one's being a little more aggressive with th wet weather. this is 7:00 christmas morning. rain moving southward across all of our neighborhoods during the day and by the time we wake up tuesday morning, it's just about over. now that's the most aggressive model with the rain and also the most aggressive with the timetable. right now, i'm not convinced that we're going to get enough to put a storm track on it, but, this time tomorrow, that may change as we go through a couple more cycles. we'll keep an eye on that. the thing you need to know is it's going to be freezing cold the next couple of mornings. heater will be running a lot, but it'll be dry before traveling all across the state all the way up until christmas day. >> that's good news. i was excited to see the wet roadway. are we behind on the rain totals? >> so far behind. even with the couple of hundreds we had this morning, we're going to be only up to five or 10% of where we should be. >> yikes. okay. good to know. thank you, mike. appreciate it as always. this is our favorite video
