it's sunday, december 24th. thank you for joining us. let's start with a first look at the forecast. here's meteorologist lisa argen. >> good morning to you. as you look at live doppler, you see the cloud cover, but despite the green, the system is really falling apart. we have high pressure in control. that's why we're not going to see this amount to anything throughout the day. with the cloud cover we're in the 40s. it's 39 in santa rosa. we are milder with the clouds. even compared to yesterday. 5 to 6 degrees warmer in our

east bay. with the original high pressure still in place, the air quality is not good. so another spare the air alert today. you probably will notice that. so 7:00 this morning, we're still pretty much all in the upper 40s. by 1:00 it's low to mid-50s for everyone. more clouds continue throughout the evening hours keeping us near 50 at 7:00. even by 9:00 tonight, last-minute shopping we're mild in the upper 40s. we'll talk about a sunnier christmas day and the last week of the year in a few minutes. thieves are getting creative this holiday weekend. police are warning last-minute shoppers about a spike in car break-ins. >> reporter: with not much time left to shop. >> it's not that bad. >> reporter: it seems there are bigger concerns this year than

last-minute shopping crowds. police are are warning shoppers not to place belongings in the trunks. >> it used to be to put things in your car. >> there's a number of trunk break-ins. >> it's not fun. especially during the christmas season. >> reporter: the advice from authorities, carry all purchases from store to store. >> you see that in the commercials and it looks like fun, but not in real life. >> it's terrifying i can't run in, take stuff to the car and run to target without being terrified, that's horrible. it tells you there are people that are desperate. it's sad and scary. >> police say despite active patrols, they the want shoppers to be extra vigilant. >> it's literally nothing in the car. nothing in the car. it's not worth it.

federal express says windy conditions have disrupted its flight network. the company is alerting about potential delays. some packages haven't arrived yet. but fedex says most deliveries should make it on time before christmas. a celebration of life was held yesterday to honor the firefighter who died fighting the thomas fire in ventura county. the 32-year-old was from san diego and served as a cal fire engineer for the past eight years. hanna mulens has the story. >> reporter: so many people showed up it took nearly 30 minutes for people to file into the church. a final salute for one of their own. >> it was probably ironic that two days before christmas we're having a celebration of life. i really do believe cory was a gift that was given to all of us. >> reporter: this was personal it for the chief.

>> we are truly a family. >> reporter: cory was one of his brothers, but his heart aches for his widow. >> it's our extended family. >> reporter: his grief compounded by guilt. >> i feel this happened on my watch. >> reporter: 2,000 people turned out to honor cory. >> i was able to see and honor him like that. it was really a beautiful gift. >> reporter: friends say he was born to be a firefighter. >> 15 years old yet he was hiking with the inmate crews. >> reporter: his family was supposed to grow to four, but their unborn daughter taylor will never meet her dad. >> they are going to have a hard time getting over this. at least they know their father was a hero. >> that makes that family just my responsibility for the rest of my life. >> reporter: crews have pulled together for ashley. >> the local fire stations decorated the house because they didn't want her to come home without christmas lights.

>> reporter: firefighters fill the calendar to do yard work. >> we're going to standby that family for the rest of our lives. >> she knew that as she thanked his brothers one after another. >> that was hanna mullens reporting. back here in the bay area, a 3-month-old baby riding bart with her family died after suffering a medical emergency. the infant fell ill yesterday afternoon aboard a train at the pleasant hill bart station. she was taken to the medical center where she passed away. there's no indication of foul play. this morning a vow not to let fear win after word that a popular tourist spot in san francisco was the target of a terror plot. a former marine is now in jail after hatching the plan. >> reporter: saturday holiday

fun goes on at peer 39 after the fbi foiled a planned terror attack at the san francisco destination. >> when i looked at my phone it said that there's a threat of terrorist at pier 39. i'm like, i'm here. >> reporter: trisha was visiting friday when she learned about the alleged plot. fbi agents said 26-year-old everette jamison, an ex-marine, planned to stage the attack around christmas. he's now in jail. >> this is our country. >> reporter: some visitors noticed more patrols. >> there are dangers in everything we do. but i trust in the security i have seen around here. >> reporter: according to a federal criminal complaint, he had radical jihady believes and social media posts that supported terrorism. his family is in shock. an fbi agent was alerted by

jamison's dialogue. a big take away that hope others take notice to this radicalism. >> even though this was an fbi informant, this tip could have come from anybody in the public. >> reporter: everette has a hearing scheduled for january 5th. his attorney says his client will plead not guilty to any charges against him. in san francisco, abc 7 news. governor brown has granted pardons to two men who were to be deported pl both men were picked up during immigration raids in october. a 42-year-old of modesto and a 39-year-old of davis were set to be deported tomorrow. in defiance of the trump administration governor brown pardoned the two putting those deportations on hold.

in southern california state officials believe a bottled water giant is piping water that it doesn't hold the rights to. nestle bottles arrowhead spring water. that water comes from the san bernardino national forest. nestle is allowed to bottle more than 8 million gallons per year. however, the desert sun newspaper reports state regulators say nestle piped 32 million gallons last year out of the forest. nestle insists it has valid rights to the water. several people helped capture a suspected robber a few blocks away from san francisco's fisherman's wharf. the suspect tried to run away with the victim's camera. a good samaritan tripped him. two co-workers restrained the suspect until police arrived. both had arrived from australia. one of them hurt his shoulder. happening today san francisco's memorial church will

after cigarette taxes were raises, convenience stores are seeing a spike in crime. thieves are stealing cartons of cigarettes. our sister station in fresno has more on the latest heist that turned into a brutal encounter. >> reporter: video shows the moment the suspect dives behind

the cash register at the beginning of a ten-minute struggle inside this liquor store all for 150 cartons of cigarettes. >> punched him, hit him, sprayed him in the face with some sprays and stuff. zip tied his hands. >> reporter: a lieutenant has noticed the most sought out item is is cigarettes. now that the tobacco tax raised the price, suspects know they are a guaranteed value and easy to resell for cash. >> the robbers in this situation in this incident they never touch the cash register at all. >> reporter: cigarettes were taken recently during a deadly mini mart robbery. thieves were captured on camera carting out boxes of cigarettes. the clerk never fought back, but was shot and killed as the suspects left. two men were arrested on charges of homicide.

despite the serious injury to the clerk in the latest cigarette theft, he was a witness and able to help police solve the crime. >> he described this as scary. doesn't know what's going on. but the good thing was he was able to recognize voices and their body movements and stuff to help identify the people. >> reporter: detectives recovered 35 cases of cigarettes at a home just two blocks away from the liquor store. a man and a woman were arrested for the crime and the female gave police a full confession. officers believe the pair scoped out the mart and figured out where the cigarettes were stored. abc 7 news. a reason to smile this morning for a north bay family that's been through a difficult past few months. they have a new temporary home just in time for christmas. abc 7 has the story. >> it's not christmas. it doesn't feel like christmas at all. >> reporter: the holiday season has been tough for the swan family.

they lost their home in october's redwood complex fire and have struggled to find a place to live. rents are high and housing competitive. >> i haven't wanted to listen to any christmas music or i'm not in the christmas mood. it sucks because my husband loves christmas. now we just want it to be over. >> reporter: just in time for christmas help came in the form of this rv. it was donated through rvs without borders. >> it's so much more of a belief. i feel like we're going to be able to relax and not have to worry about what's the backup plan. >> reporter: the program aes goal is to help the short-term housing shortage and allow fire victims to stay in their communities. >> they need to have some place to call their own so they can rest their nervous system. start to establish their new normal. >> reporter: it's also up to

residents who did not lose their homes to offer up their driveways. many victims can't park on their lots because of the toxic debris. >> those that have undamaged homes can play a very important role. >> it has a queen-size bed. >> reporter: they will park in a family member's yard. their goal now is to save up for a new house. alyssa harrington, abc 7 news. a local family will enjoy christmas together following a sailor's surprise return from overseas. he spent nine months serving our country overseas. yesterday he helped serve his family lunch along with a bigger surprise of his presence inside the shops. he learned friday he would be home just in time for the holidays. >> me missing my boys' birthdays, but christmas, it's a down moment for us.

>> i was so emotional. i was just so touched. >> the uso provided this video. he expects to be home for the next nine months. hundreds of kids now have new bikes they can pedal around san francisco. all thanks to santa clause and his helpers at the fire department. abc 7 news was inside the toy program warehouse where the site of 300 new bikes and riding toys brought a smile to so many faces. two of the new bike owners tell us where they plan to ride. >> to the store. >> maybe to the park. >> i grew up in the mission district. didn't have a lot. single mom. we just want to give back and make sure that every kid has toys and just fun stuff. >> the kids also received free helmets to wear while they ride their new bikes.

they also made friends with the firefighters and volunteers. final orders are coming in for another holiday dinner tradition that some consider little pockets of love. abc 7 news was in west oakland where sales were brisk. it's a time-consuming process to produce them. but you'll hear no complaints from the chefs. >> i think it's a blessing to be able to share the traditions with people. we're keeping them alive. this is a pretty hispanic tradition. tomales go back to when the spanish came to mexico. >> some say is it started as part of the mexican celebration that commemorates a search for shelter before the birth of jesus. others say it developed into a tradition as families gathered for the holiday.

45 at delta. 44 in concorde. 46 in san jose. good morning to you with 43 on the coast at half-moon bay. good visibility. look for cloudy and cool conditions this morning. a possible sprinkle today. otherwise we'll look for sunnier skies for christmas day with milder conditions numbers rebounding back into the 60s not only tomorrow but for much of the workweek. so hour by hour, starting right now, you'll notice the clouds continue to advance. this is 2:00 in the afternoon. and then by the evening hours, 10:00, we still have the clouds that will keep us up in the 30s and 40s. clouds thin out and we have sunshine by early in the morning and then by the afternoon maybe a few more clouds. but overall the numbers will be allowed to climb to above average readings. lows tomorrow morning a little cool for livermore with the clear conditions. 37 and pretty much all week long

not much of a fluctuation with numbers in the 40s. if you're headed to the mountains, we have 20s to speak of starting out. but by the afternoon, 50 degr degrees, cloudy today. tomorrow a few more peeks of sun. by tuesday, 53 degrees with more sunshine. bay highs today in the narrow range. the cloud cover allows for temperatures to stay rather uniform with 55 here in the city. also in oakland, 56. 57 in san jose. upper 50s in the north bay. for tomorrow we'll have a few clouds in the 30s and 40s. then by the afternoon, 59 with more sunshine. by 4:00 we're in the 60s around the bay with numbers around 60. and the seven-day forecast feature iing the dry weather continuing into pretty much the end of the year. now looking at the clouds today,

it's great to have you with us. we're starting this half hour with a quick look at the weather. here's meteorologist lisa argen. >> temperatures once again are a little milder due to the cloud cover. we have a weak system to the north of us. it will be influencing our weather today. it's 45 for you right now in mountain view. 44 in concorde. 43 in brentwood.

temperatures a degree to 5 degrees milder. but with that milder weather we still have that lid on the atmosphere and that dome of high pressure that allows for the poor air quality. poor air quality everywhere except the south central bay. keep that in mind. no wood burning today. look iing at your planner allow for temperatures to be in the low to mid-50s for everyone. plenty of cloud cover. for santa and then tomorrow look for more sunshine on christmas. president trump has launched a twitter attack on fbi deputy director andrew mccabe. mccabe has come under fire from congressional republicans. the president's tweet said, quote, how can fbi deputy director andrew mccabe, the man in charge, along with james comey of the phoney hillary her 33,000 illegally deleted e-mails be given $700,000 for

sexist comments about former contestants. 2013 miss america is the subject of multiple e-mail, changes including things about her weight. >> having someone bully you, demean you, degrade you in any way is not okay. stand up for yourself because it does matter. >> reporter: hagan signed a petition calling the behavior by the board members despicable. he said he was under stress from a full year of attacks by two miss americas and made a mistake of words. the outgoing president apologized saturday saying his comment does not reflect his values or that of the organization. the organization president and chief operating officer said in a statement that he inappropriately responded to an e-mail and apologized to the

contestant involved but the article implies complicit participation on my part in a year's-long e-mail communication which is grossly misleading. the e-mails were exchanged in 2013 and 2014 and predate my employment altogether. millions of americans are traveling to grandma's house and many other places this holiday weekend. but in some parts of the u.s., icy conditions and flooding are making it hard to get anywhere. elizabeth hur has more. >> reporter: a pre-christmas winter storm is reeking havoc in 12 states. in maine cars were sliding into ditches. two good samaritans stopped to lend a hand. >> figured might as well try to pull them out. had some spare and might as well do a good holiday deed. >> reporter: this man having fun with ice.

>> it looks like my window is closed, but in fact it's just icy. >> reporter: icy conditions not just in boston but also in the rest of the commonwealth. state police closing a stretch of i-95 near foxboro for an hour saturday morning after numerous reports of spin outs and car crashes. salt spreaders out in full force to deice roads. in missouri heavy snow bands. blinded drivers causing multiple accidents including this jackknifed semitruck. snow even covering parts of oklahoma. that storm system causing severe flooding in arkansas and tennessee. up to 4 inches of rain reported in parts of the volunteer state. in nashville, strong winds toppled the city's official christmas tree, the 30-foot spruce sprawled across the plaza with lights still on. heavily damaged it was cut up and hauled away.

and in memphis, severe winds disrupting traffic and threatening to delay holiday package deliveries. the winter storm complicating efforts for 120 million people who are expected to drive to malls this weekend picking up last-minute holiday gear. abc news, new york. for those who work in the airline industry, the holidays can be tough. especially when it comes to spending time with loved ones. but one pilot was determined to see his family for christmas after being apart from them for 17 holidays in a row. that's pilot juan fehrman saying hi to his parents aboard a flight as they made a layover in british colombia. he flies all over the world.

their time together is special, especially during the holidays. today is the last day of curb side donation drive in san francisco. in a few hours, staff and volunteers will be collecting hams, groceries, clothes and you can donate from 9:00 a.m. to 1:00 p.m. on golden gate avenue. an entire lane is closed to traffic to allow people to easily drop off donations. abc 7 news was of at the clubhouse in mountain view where children of military families were treated to lots of toys. the northern california chapter teamed up with the wine country to bring santa and the toys to the kids. it can be hard for children from military families during the holidays if one parent is deployed or isn't home for other reasons. that's why organizers wanted to help. >> that's what it's all about. smiles on the kids' faces.

>> a few thousand toys were distributed yesterday at the clubhouse. the holidays will be merrier for hundreds of families thanks to the generosity of its police and fire departments. 750 families took home toys and makings for christmas dinner. youngsters got their pick of brand new bicycles too. 400 were given away to kids for christmas. >> you see people that's not really able to do for their kids and it's all over the bay area. so it's a good thing. >> for a number of families, the yearly giveaway is essential. they would not otherwise be able to afford the food or the gifts. still ahead, not just one but two of the bay area's most holiday light homes are saying good-bye this weekend. but first the time is 6:3737

as friday, which was the airport's busiest travel day of the year. the 49ers face a big test this afternoon. the jaguars come to le vice stadium with one of the top defenses. the game kicks off at 1:05 this afternoon. tomorrow the warriors face the cavaliers for the third straight year on christmas day. rick quan has the details in sports. >> good morning, maybe it was a case of looking ahead to their christmas day rematch with the cavaliers, whatever the reason shs the warriors came out flat last night and never recovered against the nuggets. let's go out to oracle. this was the play of the night for golden state. he had just 7 points last night. kevin
