today's not a holiday for the highway patrol but tragic loss of one of our own. >> 33-year-old chp officer dies in line of duty after suspected drunk driver slams into his patrol car on east bay freeway. we hate to begin on christmas day with such a tragedy. just before midnight in hayward, not far from interchange with highway 92, all lanes southbound

closed nine hours. live coverage on the story. chris nguyen is in castro valley but start with jonathan bloom at alameda coroner's office with what we know to date. >> reporter: we've learned that officer's body was brought here after he died at scene last night. seen chp officers come and go and crime lab as with the. autopsy likely to be performed tomorrow. and then procession of officers will likely escort the body to funeral home. other officer in the car was injured as was the driver. police say that driver may face felony charges. this is not the way we wanted to celebrate christmas day. >> 33 years old. been with the highway patrol a year and four months before the accident. >> impact so severe it turned

staying in east bay, alameda county sheriff's deputy shot and wounded domestic violence suspect overnight, off princeton street near hayward. say the deputies went to the house just before 2:00 after woman called saying she had been attacked by husband. they arrived to arrest the man he went after them apparently with a machete. one of the deputies shot and wounded smokt wounded the suspect, expected to survive. >> fires are not allowed today. see the smog. doesn't want go away. today is spare the air day. so is tomorrow. if you plan on sitting around the fireplace with fire tonight, that's illegal. look at weather with drew tuma.

upset several news hosts like bill o'reilly. but poll collected found 66% of the democrats prefer happy holidays and 67% of republicans say stores should only say merry christmas. on the campaign trail candidate trump promised to bring back the phrase. politics aside, he's not first president to say merry christmas. his predecessor used the phrase every year. >> merry christmas everyone, merry christmas, merry christmas, merry christmas. >> reporter: past presidents used happy holidays from old english meaning holy days. only federal holiday based on religion. memorial church tapped off sharing with christmas meal.

volunteers dished up ham and turkey with all the trimmings. live as people with need of hot meal came for holiday lunch. served about 5,000 people. breakfast, lunch and bagged meals. church has been helping the community more than 50 years. salvation army hard at work preparing meals for san francisco this christmas morning. about 4,500 meals boxed and hand delivered to residents who couldn't get out for age or illness. at south of market center as more than 400 volunteers picked up meals and worked out delivery routes. visits are only contact some recipients have on the outside world on christmas. that's all for now. i'm dan ashley, raiders game is up next. for drew tuma and all of us,
