a son, a brother, husband, and a father to a senseless act. >> a chp officer looking for impaired drivers on christmas eve is killed by a suspected impaired driver. tonight we're learning more about the man accused in a devastating crash. good evening and merry christmas. i'm dan ashley. ama daetz is off tonight. officer andrew camilleri of tracy died just before midnight. the governor ordered flags flown at half-staff on state buildings in his memory. abc 7 news reporter melanie woodrow is in the newsroom tonight with more on the man investigators say is responsible for a christmas eve tragedy. melanie? >> reporter: dan, the chp says the driver will likely be facing serious felony charges related to the crash that took this officer's life. tonight we're learning more about that 22-year-old driver from people who know him. 33-year-old chp officer andrew camilleri leaves behind a wife and three children. christmas eve officer camilleri and his partner, officer

jonathan velasquez, were on a maximum enforcement patrol on the side of the 880 freeway, looking for driving under the influence when the chp says their vehicle was hit by one. thinking person, a 22-year-old from hayward, chose to drive while under the influence of alcohol, and also drugs. and this needs to stop. >> the driver of this red cadillac is in serious condition at a hospital in castro valley, where officers are standing guard, waiting for him to be treated and released, which have enough evidence and enough statements that have been made today to allow us to charge this individual when he gets released from the local hospital with some very serious felony charges. >> in hayward, friends and neighbors visited the driver's home. off camera they told abc 7 news their condolences go out to officer camilleri's family as well as the driver's family. they say the 22-year-old driver is married and recently had a baby. the chp is not releasing the

driver's name until he is booked. outside the chp hayward area office, there is a bouquet of white roses. officer camilleri was with the chp a year and four months. he planned to open presents with his children christmas morning. >> this is not the way we wanted to celebrate christmas day. >> his partner, who is in the driver's seat and wearing a seat belt has been released from the hospital. in hayward, melanie woodrow, abc 7 news. governor brown commented on officer andrew camilleri's death, issuing a statement, saying, quote, anne and i are deeply saddened to learn of the tragic loss of officer camilleri. we join his family, friends and the entire california happy in mourning his death and in honoring his sacrifice. a couple hours ago, the chp golden gate division chief ernie sanchez tweeted on behalf of his division following officer camilleri's death. sanchez expressed immense gratitude for the outpouring of

support and wrote his ultimate sacrifice will never be forgotten. as people express their condolences and gratitude for officer camilleri, we created this badge in his honor. you can share it from our abc 7 news facebook page. the chp says the driver who caused that crash is suspected, as you heard here, of being under the influence of alcohol and marijuana. and that's a real issue for people concerned that drivers won't be tested for pot impairment as the drug becomes legal next monday. now at 11:00, katie marzullo has the story from san jose. >> the driver who caused the crash in hayward that killed a chp officer is accused of being under the influence. >> marijuana is suspected, yes. >> a drug that in less than a week becomes legal in california. >> there will be some significant challenges. >> state assemblyman evan low is concerned because there is still no standard test or tool for law enforcement to determine if a driver is imbaird pot. >> it's important, i think, that we have some type of baseline

demonstration on the books with respect to impairment. >> any kind of intoxicated driving is wrong. that includes prescription pills. it includes alcohol. and yes, it definitely includes cannabis. >> buddy's cannabis in san jose will start selling recreational marijuana on january 21st. they'll be talking with customers about how to use responsibly. >> a lot of folks are coming in to experience how to use cannabis for the first time. we'll talk about the effects and also talk about some of the risks and dang aers with it. and we includ it in written form that goes out with ever transaction. >> california will charge a 15% excise tax on marijuana sales. some of that money is supposed to go towards education and research which could lead to a test similar to blood alcohol level content for pot. katie marzullo, abc 7 news. let's move on now. an alameda county's sheriff's department shot and wounded a man who investigators say tried to attack deputies with a machete. it happened this morning at a home on princeton street near

hayward. the deputies are responding to a domestic violence call. deputies say a woman called 911 saying her husband attacked her. when they arrived to arrest the man, they say he went after them with a machete. one of the deputies then shot and wounded him. he is expected to survive. the red cross tonight is helping four people who need a place to stay after a fire in san francisco. fire crews were called to a home in bernal heights around 1:00 this morning. flames also damaged two neighboring homes. no one was hurt, and investigators are trying to figure out what caused this fire. it's always bad, but somehow seems even worse on christmas. well, a california man who was set to be deported back to cambodia today is thankful he is back home in modesto for christmas. 42-year-old mone neff is one of two men governor brown pardoned over the weekend for committing crimes in the u.s. he has been awaiting deportation in a texas jail since october. that's when federal agents

arrested him during an immigration sweep. >> it is a miracle. it's what i call the coincidence that i'm here on christmas. a church theme today, it's welcome home. so it's amazing. it's a miracle. >> neff served nearly two years in prison in 1995 for weapons, gang, and possession of stolen property charges. he says he's since stayed trouble-free, is not the same person as he was, and is grateful for the second chance. glide memorial church capped off a its christmas tradition of sharing by feeding thousands of people in san francisco. abc 7 news was in the tenderloin district where about 500 volunteers helped to prepare and serve ham and turkey dinners. some started work just at the crack of dawn. and by the end of the day, volunteers had dished up about 5,000 meals, including breakfast, lunch, as well as bag meals. meantime, salvation army volunteers spent christmas

morning preparing meals for house-bound residents in san francisco. they boxed and hand-delivered 4500 meals. today's delivery is the only outside contact some recipients will have on christmas day. they'll be all by themselves, many very hungry too without this help. abc 7 news was at the salvation army's south of market center as more than 400 volunteers picked up those meals to take them to those in need. nice christmas gesture. some warriors fans received a christmas surprise at today's game. coming up, how the team made this christmas unforgettable for a local group of kids. and now that all the gifts are open, you might be one of the millions of americans who will be returning a present or two just ahead. when to head to the store to get the most out of that return. let's go to drew tuma tracking the forecast. as we move past christmas day, it's been a wonderful day. merry christmas. >> merry christmas, dan. and we found ourselves really dealing with a lot love cloud cover. stubborn to find peaks of sunshine. tuesday afternoon more in the way of sunnier skies. satellite showing you still have a fair amount of cloud cover overhead. and you will see a little moisture around gilroy. live doppler 7 showing you the returns. but not reaching the ground. and we're not anticipate anything showers the next 24 hours. the picture outside, live look from our exploratorium camera atop pier 15. it's a quiet night out there. but it will be a rather chilly night. the accuweather highlights will show the coldest spots will dip into the 30s, mainly away from the coast. well will find warmer afternoons on the way. specifically wednesday and thursday of the upcoming week. temperatures will bounce above normal for this time of the year. this month, it's only rained

three nba finals. let's go to oracle. all these kids want for christmas is a warriors victory. lebron james did not have a monster game, but does get around kevin durant for that monster dunk. draymond green had 12 point, 12 boards and 11 assists. the cavs were led by kevin love, who was hot from outside. he had 31 points and 18 rebounds. great sequence here. triston thompson is denied by draymond. durant throws it down for 2 of his team high 25. the game was tied with 1:40 left. durant misses, but the warriors get the rebound, and klay thompson puts golden state on top. k.d. swats the ball away. lebron thought he was fouled but nothing was called. free throws made the final. warriors, 99. cleveland, 92. k.d. says playing on christmas is extra special. >> it's just so much joy in the arena today because it's christmas. and we all feed off of that. and the spirit just moves us
