bridge. we're tracking breaking news out of the south bay. firefighters have knocked down a fire at a cardboard factory in santa clara. this started at 2:00 this morning near della cruz boulevard. crews are still putting water on the flames. firefighters say they're going to be tearing apart piles of cardboard to make sure nothing is still smoldering inside. the plant manager confirms all the employees are accounted for. firefighters will remain on that scene for the next several hours. our abc 7 news reporter matt keller will have a live update at 5:30. new year, same bad air. we are on a streak of spare the air days in the bay area. in fact, today marks the 18th just this season. amy hollyfield live for us on treasure island. >> reporter: good morning. yeah, it's because we have that stagnant weather that's hanging around over us and that is what is causing this bad air. guess what is the worst offender

when it comes to pollution? this may surprise you. you may be thinking it's possibly cars, it's not, it's fires in people's fireplaces, but no fires are allowed today. those people with asthma or heart issues, they are at risk and they are encouraged to stay inside. if you do go outside they say you should not exercise out there. stay in. and a fire in your fireplace can really impact those people who have those health issues. >> wood burning is the number one source of fine particulate pollution in the wintertime and accounts for 40% of the pollution. on road vehicles are only about 13%. >> with the fires that we had up in the north bay and then down in southern california and then the stagnant weather, 2017 is going to go down as one of the worst years for air quality. we haven't set a record for spare the air days yet this season, but it's not out of the question. here we are on day 18. 30 in one season is the record.

reporting live from treasure island, amy hollyfield, abc 7 news. >> certainly a record we do not want to break. happening today, the two suspects in the deadly ghost ship fire are due back in court, derick almena and max harris scheduled to be arraigned in oakland. last month a judge ruled the two men should go on trial for the deaths of 36 people. each of them faces 36 counts of involuntary manslaughter. prosecutors say almena and harris essentially operated as managers of the property. both men remain in jail despite numerous attempts to have their bail lowered. two people hurt by gunfire on new year's eve are recovering. in san leandro a 22-year-old woman was grazed by a bullet shortly after this toast at a house party. the victim didn't even know she had been shot. >> everything going fine and then we heard some gunshots, like this. actually, she didn't care too much and then she had gone to the toilet and she see the

injured -- she got bleeding. >> the injuries actually didn't require hospitalization. in oakland just after midnight on sunday a man was hit in the arm by a bullet. every new year's eve police warn against firing guns at midnight. a 38-year-old woman is oakland's first homicide victim of 2018. police responded to a report of a shooting in east oakland yesterday morning. they found the woman dead inside her home. our media partner the east bay times says a man was detained as he was trying to leave the house. the cannabis business already booming in the bay area. recreational pot is legal in california as of yesterday. katie marzullo has the story now from santa cruz. >> it looks like gold. >> reporter: sara tripp was a medical marijuana patient until now. she said legally buying pot without a prescription is better. >> i think that it changes because it's more open. i hope that it's easier for people to discuss that it's not

actually happen. >> reporter: recreational marijuana is subject to a state excise tax of 15% combined with city and sales taxes customers are paying more than 30% in taxes at the register. in santa cruz, katie marzullo, abc 7 news. >> state lawmakers will face a growing sexual misconduct candle when they reconvene tomorrow. it will bring gates to increase protections against victims and people who report sexual misconduct. to assemblymen from southern california have resigned after women accused this have of groping and other misconduct. also allegations against another assemblyman and state senator. all four have denied the accusations. a new year means new laws. one allows schools to donate uneaton fruit, milk cartons to other food banks. in the past schools were not allowed to do anything with it other than tost it away in the garba garbage. another law requires schools to provide lunch to students even

if their parents fall behinded on paying. >> i understand that we are all strapped for resources in our school districts, but at the end of the day we can't penalize people for not being able to afford to eat. >> before this some schools had served students a snack in lieu of lunch if their parents were behind on payments. san francisco unified has always provided lunch whether or not the parents have fallen behind. there is can earn this morning over privacy issues related to google's street view technology. stanford researchers are able to make predictions about how people vote based on millions of images captured with street view. those images collected information like car makes and models and 39,000 voting districts. the data was cross-referenced with information from the census bureau which helped researchers accurately predict voting patterns. experts say this image-based project could help fill gaps in current data. let's talk temperatures. it's pretty mild outside this

former fox news anchor gretchen karlsson is getting ready for a new role. she will lead the miss america board of directors after a scandal about former winners prompted several pageant officials to resign. this is the first time a former pageant winner has been named as head of the organization. karlsson was crowned in 1989. she has become a prominent voice against workplace sexual harassment. her lawsuit against roger australia led to his departure in 2016. new details about a nasty fall carrie underwood took. she's warning fans she might look a bit different. in a blog post underwood says that fall in november outside her home required her to get 40 to 50 stitches in her face. she says she is grateful it wasn't much, much worse. after the incident underwood's publicist said she had multiple injuries including a broken wrist and cuts. south korea welcoming talks with north korea about its participation in the upcoming winter olympics. in a new year's speech kim

orleans at 25, look at that, minneapolis, 10 below. it's 0 in st. louis. even 13 in atlanta, those people are freaking out. here is a look at what's going on back here at home. in walnut creek where it's 45 degrees right now, mostly cloudy, mild, highs remain, but so does that little -- that logo just won't go away, that's the winter spare the air logo, the summer one you may recall is blue. tonight thicker clouds, a few light showers out ahead of at least our first of two storms, that's coming through our extended forecast. highs today about 63 to 66 degrees, even with the lack of sunshine out there. places like ukiah and santa rosa may hit the upper 60s. tonight a mild night. low to mid 40s in the north bay, mid to upper 40s for the rest of us, even a 50 in san francisco. here is our storm, the pattern is changing, the moisture coming up from the south, right now it's up too high in the atmosphere and will evaporate before it reaches the ground. you may see an active radar on

here in santa clara. about a half hour ago firefighters stopped putting water on the cardboard piles outside of this manufacturing plant, but probably in the last 15 minutes or so they started up again. they were evaluating what to do when they stopped the water streams, but apparently they found something that they didn't like and now they're putting a lot of water on it. we're counting six streams out here on matthews street on that cardboard. there are also liquid propane tanks they're keeping an eye on. they're putting water on those just to be extra safe as well. here is new video that was tweeted out by the santa clara fire department. it shows the huge flames firefighters encountered when they arrived on the scene around 10:00 a.m. this is the california paper board corporation by manufacturing cardboard on matthews street. all the employees are okay. it's burning in the stacks of cardboard on the storage area on the outside of the building. it could have been a lot worse. >> well, the stacks themselves are the normal height, they are about 15 feet, it's four foot

stacks, that's as high as they go, but the amount that was accumulated in the yard was about a third of the normal amount based on the holiday weekend and not normal operations as far as what they're used to. >> reporter: four to five poles of high voltage lines were hit. eventually the power was shut off here. once firefighters are done with the water the hard work will begin. firefighters will have to take those piles of cardboard apart, make sure nothing is smoldering inside and that could take several hours today. a newly refurbished history streetcar derailed after colliding with a truck in san francisco. this happened at third and mission bay boulevard around 8:30 last night. muni says the truck made a turn in front of the streetcar and you can see what happened, that truck ended up on its side. no one got hurt. the chp expected to announce the charges for the man accused of killing an officer on christmas eve in hayward. a suspected impaired driver hit

and killed officer andrew camilleri while he was sitting in his patrol car on 880. camilleri's partner was also hurt. the suspect's name was not been released. he is still in the hospital and will be booked once he is released. developing news out of the east bay, two suspects on the run after police say they robbed a pleasant hill gas station. this happened last night between 6:40 and 7:10 at the mobile gas station on oak park boulevard. surveillance cameras captured these images of the suspects. police say they both had handguns in their waist bands. they got away with some cash, cigarettes and food. a truck driver making deliveries lost control on a busy san francisco street hitting two pedestrians and a car with a family inside. this accident shut down 21st avenue and geary boulevard for several hours yesterday evening. the family of five inside the car had minor injuries. two pedestrians on the sidewalk, though, were hurt. a 79-year-old man underwent surgery for internal bleeding. he is in critical condition. a 66-year-old man is recovering

from a broken rib and a punctured lung. >> as soon as i looked back and saw that my kids were okay, they weren't dead, like i -- i ran -- i got them out of the car and then i ran over to see the guy that got hit because he flung about 10 to 15 feet. >> police say the truck driver tried to make the turn on a red light. he has been detained. it's unclear fell be facing any charges. police are looking for the driver who hit and killed a woman crossing 98th avenue in east oakland. this scent happened at 5:00 a.m. yesterday morning near sunnyside street and the car kept driving, leaving the scene of the accident. the pedestrian has not been publicly identified. police closed the intersection for eight hours to conduct the investigation. north bay fire victims are being victimized again and this time it's by fraud. some property owners in mendocino county say they've received fraudulent bills from what it says is a state sponsored fire debris removal program. authorities say if you get one of those bills, don't pay it and notify the da's office right away. this is all a scam.

no reports of the fraudulent activity in sonoma county. fire victims there should still be on alert. in developing news with recreational cannabis legal in california customers may not have to go to a dispensary, they could get their weed delivered right to their front door. the proper rx collective in oakland delivers medical marijuana to customers and it wants to expand to regular users. proper rx was formed to serve patients who are marginalized with unequal access to medical marijuana. >> people don't have cars, some people are not mobile, some people aren't able physically able, so having a delivery service that is able to come straight to their door is really beneficial. >> the company still needs to get all the proper permits in order to legally deliver recreational pot. if proper rx gets the green light there will be a one ounce limit per customer per day. concord city council members will discuss the possibility of implementing district based elections. >> it is in response to a threat

from a malibu based attorney. according to the east bay times he sent letters to cities demanding they conform to the california voting rights act or face a lawsuit. the attorney claims at large voting systems are discriminatory and prohibit protected classes like latinos from influencing the outcome of an election. fremont and martinez received similar letters. martinez began transitioning to district based elections earlier this month. small businesses in san francisco hurt by the central subway's year long construction delay are getting much needed help. abc 7 news was in chinatown yesterday where the first checks went out from a compensation fund set up under late mayor ed lee. the san francisco examiner reports 15 businesses received more than $82,000. merchants along union square and fourth street will also be compensated. the central subway will run from chinatown through south of market and is expected to open next year. let's open the weather window on 280/17 in san jose. looks like a gorgeous morning for you quite out there.

this milder air. most of the cloud cover at about 15,000 feet. we have to wait for the deeper moisture to get in tonight and tomorrow and bring us that chance of showers and thunderstorms. it's a 1 on the scale even though you throw thunderstorms in here because the rainfall amounts will be light, the winds will be light and there's just not expecting a lot of damage from this, no flooding whatsoever. now, you could have some moderate to heavy intensity rains that won't last very long out of these storms tomorrow through thursday morning. during the commute tomorrow you can see showers develop by 9:00 and just scattered showers throughout the day, even though a clap of thunder and small hail possible. as we head towards thursday morning you can see the best chance of showers starts to move into the north bay. thursday night into friday another storm is coming in, but it's also going to be light on the storm impact scale and right now i'm keeping the weekend dry but that could change as signs are starting to show some rain for sunday. hi, sue. good morning. let's go to the bay bridge toll plaza.

we have the metering lights that were turned on at 5:35 this morning stacking things up in the center fast track lanes, but the cash lanes are moving right on through as are the commuters in the hov lanes there headed into san francisco. so those delays will start to build at the bay bridge toll plaza. right now you are looking at about a 30 minute or so drive from hercules along the east shore freeway all the way into san francisco. we've got some red sensors coming out of livermore and -- pardon me, i should say out of the central valley into livermore. drive times, a little bit of a delay at the bay bridge because the metering lights have been turned on. once you get to san francisco still a breeze headed towards sfo, that is your destination from san francisco under ten minutes. apparently google street view is revealing a lot more about us than we originally thought. next at 6:00 what stanford researchers are finding out. if weaning yourself off your phone is your new year's resolution, stick around, we have some tips that could set you up for success.

phone from time to time and as soon as i get home i have to check it. yeah, that's okay, we sometimes head to areas that are out of phone service so that's good, too. we have a nice flow of traffic across the san matteo bridge. it's getting a little busier for a 20 minute drive across the flat section up towards the high-rise and over towards foster city if that is your ultimate goal, foster city or san matteo from hayward it's looking pretty good. elsewhere we will take an overall look at your traffic maps, still with slowing, that's typical up and over the altamonte pass. no stalls or stents, it's pretty quiet. weather wise it is also, but that's going to change quickly. tomorrow and with a second storm so the first storm starts ending thursday around noon, as you can see that rain across the north bay. we will look to the west and that next storm starts coming in during the evening commute thursday. we could have moderate intensity showers during the overnight hours and into friday morning and a lot of snow hopefully heading to the sierra.

i got my fingers crossed for that. now some incredible video showing the rescue of a badly hurt mountain biker from over the weekend. the biker fell and suffered several broken bones and a head injury outside of walnut creek. this happened saturday. the contra costa sheriff's office helicopter called to airlift the victim from a remote trail to a waiting ambulance about a half mile away. a fire captain and flight rescue technician helped guide the injured biker from the trail to the ambulance where he was taken to the hospital. nothing fun about a labor lasting 48 hours but it certainly came with a big reward for a san francisco couple. here is why, an adorable bundle of joy was the first area baby born in 2018. just two minutes after midnight at ucsf medical center. his due date was december 31st but it wasn't easy. samantha powell's contractions started on saturday. doctors and nurses put on new year's hats to finally welcome in the baby.
