francisco. that includes your wait at the toll plaza. it's a moderate drive. if you are paying cash you don't have any wait at all ironically, the fast trackers not so much. we continue to track breaking news out of the south bay, a fire at a cardboard factory in santa clara, this broke out on matthews street near della cruz boulevard. take a look at the flames firefighters encountered when they first got to the scene around 1:00 a.m. the santa clara fire department tweeted out this video. everyone got out okay. firefighters say they will be tearing apart piles of cardboard to make sure nothing is smoldering inside and this is now a live look at the scene as you can see they are still actively working on this. abc 7 news reporter matt keller will have a live update for us at 6:30. a new year, same bad air. we are on a streak of spare the air days here in the bay area. >> today marks the 18th just this season. abc 7 news reporter amy hollyfield live for us on treasure island.

they want to emphasize this is an ongoing issue and we have to remain vigilant. reporting live from treasure island, amy hollyfield, abc 7 news. happening today the two suspects in the deadly ghost ship fire are due back in court. derick almena and max harris are scheduled to be arraigned in oakland. last month a judge ruled the two men should go to trial for the deaths of 36 people. each of them faces 36 counts of involuntary manslaughter. prosecutors say almena and harris essentially operated as managers of the property. both men remain in jail despite numerous attempts to have their bail lowered. two people injured by gunfire on new year's eve in the paris are recovering this morning. in san leandro a 22-year-old woman was grazed by a bullet shortly after this toast at a house party. the host told us the victim didn't even know she had been hit. >> everything going fine and then we heard some gunshots like this. actually, she didn't care too

much and then she had gone to toilet and she see the injured -- she got bleeding. >> her injuries did not require a hospitalization. then in oakland just after midnight on sunday a man was hit in the arm by a bullet. every new year's eve police warn against firing guns at midnight. a 38-year-old woman is oakland's first homicide victim of 2018. police responded to a report of a shooting yesterday morning, they found the woman dead inside her home. the east bay times says a man was detained as he tried to leave the house. a new year means new lawyers and two could spell big changes at california schools. one allows tools to donate food to local food bangs and other charities. in the past schools were not allowed to do anything with it other than throw it out because of liability issues. another law requires schools to provide lunch even if students and their parents fall behind on paying. >> i understand that we are all strapped for resources in our

of the day we can't penalize people for not being able to afford to eat. >> some schools have served students a snack in lieu of lunch if their parents were behind on payments. we spoke to san francisco unified, they told us that the district has always provided lunch regardless of whether or not parents had fallen behind. the cannabis business is booming in the bay area. recreational pot legal in california as of yesterday. the line at kind people's in santa cruz averaged 30 to 50 people all day long, giving the owner an idea about what the future holds for his budding business. pun intended. customers can only buy one ounce of flower or eight grams of concentrate per day. >> i think we're going to see at least a twofold increase in the adult use market as consumers, you know, now have the ability to come into the store without going to a doctor. >> recreational marijuana is subject to a new state excise tax of 15%, combine that with city and sales taxes, customers are paying more than 30% in

thursday. here is sue. what if we're traveling through the sunol grade. >> it will be slow through the sunol grade. caltrans has closed off the lower half of the parking lot in mill valley right at bay level. that's through thursday. so here is the slow traffic we are looking at across the sunol grade. traffic slows to 30 miles an hour if you're traveling southbound on 680 towards san jose. zooming in on a replica of the volume of speeds. we do have a slight ace train delay. ace train number 1 rolling into great america about ten minutes hide schedule. no other mass transit delays. former fox news anchor gretchen carlson is getting ready for a new role, she had lead the miss america board of directors now. this comes after a scandal over derogatory and sexist e-mails over former winners. this is the first time a former pageant winner has been named

>> all news. >> all morning. the resignation of minnesota senator al franken becomes effective today. sending the state's lieutenant governor to the upper house of congress. franken resigned on december 7th in the face of more than a half dozen accusing him of sexual misconduct. he had been in the senate since 2009. when he beat his republican challenger by slighter more than 300 votes. minnesota lieutenant governor tina smith will be sworn in today. there is a youtube star named logan paul and you might hear about him today. he is apologizing after posting a video showing an apparent suicide victim. that video of course it's too graphic. this is a different video from paul's account. the controversial video was taken down, shot in a forest in japan nicknamed the suicide forest due to the high number of suicides that take place there. the video shows paul and several people showing the body of a man hanging from a tree. it led to this apology. paul posted a lengthy statement

starting off by saying that he's sorry. he goes on to say that he did not create the video to get views. paul says he did it to raise awareness for suicide and suicide prevention, but realizes now the video was a mistake. new this morning south korea is welcoming talks with north korea about its participation in the upcoming winter olympics. in a new year's speech kmg says he is willing to send a delegation to the games in south korea. the north korea leader declared hope for a peaceful resolution with our southern border. south korean officials are posing a meeting next week. this would be the first high level talks between the two countries since december of 2015. researchers at stanford are using google street view technology to predict how you will vote. "the new york times" reports researchers pulled information about what kinds of cars we drive from 50 million google emergencies. they cross referenced the information from census data and were able to determine how people in certain neighborhoods voted. they found people in republican

we do have slow traffic coming out of the altamonte pass and also on the sunol grade. reports of a big rig fire by the coliseum, we will update that in a couple of minutes. santa clara firefighters remain at the scene of a big fire at a cardboard factory. >> firefighters are going through and tearing piles of cardboard apart to make sure nothing is smoldering inside. matt keller is live on the scene for us. good morning, matt. >> reporter: this is a tough fire, natasha, because those flames are burning inside these giant piles of cardboard here at the manufacturing plant. firefighters are actually using thermal imaging, a camera, and also firefighters on ladders to guide these streams of water to the hot spots. check out the video of what firefighters encountered when they arrived on the scene after they got the call around 1:30 this morning. this is the california paper board corporation by manufactures cardboard on matthews street. all of the employees are okay. it is burning in the stacks of cardboard in the storage area on the outside of the building.

overhead high voltage lines made it extra dangerous for the first firefighters on the scene. >> one of our biggest concerns was basically making sure those lines were shut down before we got too aggressive or put ourselves in a position to be underneath them because roughly four to five of the poles themselves were exposed to heavy fire when we showed up on scene. >> reporter: get this, firefighters say the fact that fire happened after the holidays is a good thing. that's because all the cardboard went out and the company is at about a third of the normal amount on site. that's still a lot of cardboard here. once they're done putting water on it firefighters will have to take those piles of cardboard apart to make sure nothing is smoldering inside. so that could take a long time today. reports live in santa clara, matt keller, abc 7 news. happening today the chp expected to announce the charges for the man accused of killing an officer on christmas eve in hayward. a suspected impaired driver hit and killed officer andrew camilleri while he was sitting in his patrol car on 880.

camilleri's partner also got hurt. the suspect's name has not been released. he is still in the hospital and will be booked once he's released. a newly refurbished streetcar derailed after colliding with a truck in san francisco. it happened at third and mission bay boulevard around 8:30 last night. muni says the truck made a turn in front of the streetcar, the truck ended up on its side. fortunately no one was hurt. develop news out of the east bay. two suspects on the run after police say they robbed a pleasant hill gas station. this happened last night between 6:40 and 7:10 at the mobile gas station on oak park boulevard. surveillance cameras captured these mamgs of the suspects. police say they both have handguns in their waist bands. they got away with cash, food and some cigarettes. truck driver making deliveries lost control on a busy san francisco street hitting two pedestrians and a car with a family inside. the stent shut down 21st avenue and geary boulevard for several hours yesterday evening. the family of five inside of the car have minor injuries, two pedestrians on the sidewalk were

hurt. a 79-year-old man underwent surgery for internal pleading, he is in critical condition. a 66-year-old man is recovering from a broken rib and a punctured lung. >> as soon as i looked back and saw that my kids were like okay, they weren't dead, like i -- i ran -- i got them out of the car and then i ran over to see the guy that got hit because he flung about 10 to 15 feet. >> police say the truck driver tried to make the turn on a red light. he has been detained. it is not clear fell face charges. police are searching for the driver who killed and woman crossing 98th avenue in east oakland. it happened at 5:00 a.m. yesterday morning. the car kept driving southbound on 98th leaving the scene of the accident. the pedestrian has not been identified. police closed the intersection for eight hours to conduct the investigation. some north bay fire victims are being victimized again and this time it's by fraud. some property owners in mendocino county say they have received fahd lent bills from a state sponsored fire debris removal program.

authorities say if you get one of those bills, don't pay it and notify the da's office right away. this is all a scam. no reports of this fraudulent activity yet in sonoma county. authorities say fire victims there should be on alert. in developing news with recreational cannabis now legal in california customers may not even have to go to a dispensary in the near future, they could just sit at home and have the weed delivered to their front door. the proper hx collective in oakland already delivers medical marijuana to customers and wants to expand it to users who are using recreational pot. proper rx was formed to serve patients who are marginal liesed with unequal access to medical marijuana. >> people don't have cars, some people are not mobile, some people aren't able, physically able, so having a delivery service that is able to come straight to their door is really beneficial. >> the company still needs to get all the proper permits in order to legally deliver recreational pot.

if proper rx gets the green light there will be a one ounce limit per customer per day. >> happening tonight concord city council members will implement district based elections. according to the east bay times an attorney sent letters to cities demanding they conform to the california voting rights act or face a lawsuit. the attorney claims at large voting systems are discriminatory and prohibit protected classes like latinos from influencing the outcome of an election. fremont and martinez received similar letters. martinez fan transitioning to district-based elections earlier this month. small businesses in san francisco hurt by the central subway's year long construction delay are getting some much needed help. abc 7 news was in chinatown yesterday where the first checks went out from a compensation fund set up under the late mayor ed lee. the san francisco examiner reports 15 businesses received more than $82,000. merchants along union square and fourth street will be compensated.

get a tweet from them in five seconds. >> mike nicco, how are you? >> doing great. ringing in the new year with a few clouds out there on this second day. those aren't thick enough to cause us anything other than limited sunshine and poor air quality today. my next accuweather highlights, sprinkles and mild conditions overnight and several weak storms ahead. the first one, i'm standing right in front of this, you can see that low pressure to our southwest and that counterclockwise flow that's hurling this moisture right now at about 15,000 feet. you can see radar returns off the coast, not reaching the ground, but it will moisten the atmosphere and allow the showers and thunderstorms that develop tonight and tomorrow to reach the ground. here we are at 4:00 tomorrow morning, starting off the commute pretty quiet. by the end of the commute you can see some showers starting to develop especially along the peninsula and points southward, possibly up across the higher elevations of marin county. during the day you can see the waves of showers, even some embedded thunderstorms.

now, the storm is a 1 on our storm impact scale which is light because overall we are not going to get a lot of rain, but you could get a burst of moderate to a burst of heavy rain, but it won't cause any flooding, won't cause any damage. 7:00 still some showers around. as we head into the overnight hours and thursday morning it mainly goes to the north bay before thursday night into friday we get more rain. so the evening commute wednesday will be wet with up to a tenth of an inch, residual moisture left over thursday morning, we could get about a tenth to a quarter of an inch. those two commutes are what i'm looking at for troubles. our next storm thursday night into friday will be a one on our storm impact scale. let's take a look at the san matteo bridge westbound getting a little busier over towards is san matteo and foster city as you take your way along the causeway. eastbound that's the direction that the head lights are heading we have reports of a ladder in lanes and the chp had to do a real quick traffic break to get that out of there.
