impact scale. let me give you an overview of what to expect out of this light storm. may cause a little bit of ponding. that would be the exception. and the breezes, they're going to stay below thing that would cause any damage. some of our better radar returns out in eastern contra costa county, antioch, discovery bay, san ramon valley, coming out through hayward across the san mateo bridge and more developing down to our south and west. so that's why we are going to be dealing with this rain all throughout the afternoon and into the early evening hours. in fact, i'll take a look at your accuweather 12-hour day planner and hour-by-hour look at the rain that will last through tomorrow morning in the south bay. >> mike, thank you. keep track of the rain where you live with the abc 7 accuweather app. this is free to download. this is really cool. based on your location, it will tell you by the minute when the next bout of rain will start. great way to monitor your forecast on the go today. we turn to this story. the man acquitted of killing

kate steinle is appearing in court this morning, likely to be sentenced not for murder or manslaughter but on the lesser gun charge today. abc 7 news reporter amy hollyfield is tracking the latest development. she's live at the hall of justice in san francisco. good morning, amy. >> reporter: good morning, natasha. even after today's court hearing, this man still has a ways to go in the court process. and today, for the first time, the public defender spoke out on what he thinks is really going here. he says he thinks president trump didn't like this conviction -- or this verdict and, therefore, this man is now the victim of political vindictiveness. no matter what sentence jose garcia zarate is given today, he will walk out of county custody because of time served. the maximum he could get for this gun conviction is three years. but now he will be handed over to federal custody. that's because a federal grand jury charged him for being a felon in possession of a firearm. this came after he was acquitted of killing kate steinle. that killing happened in 2015.

that's a verdict that president trump tweeted and called disgraceful. defense attorneys call these federal charges vindictive and a direct result of the verdict. >> it's rarely done. i mean, for the federal government to come back two years later and say, oh, you know, by the way, we're going to charge you with federal gun possession because a jury acquitted you, because the president was upset with the verdict, yeah, it's unprecedented. >> reporter: tony sara has volunteered to represent zarate pro bono in the federal case. he could go to prison for ten years if convicted in federal court before then facing deportation to mexico. the sentencing hearing is going on right now. we have a reporter in the courtroom. the judge is expected to sentence him after both sides make their arguments but then this story will be moving over to the federal courthouse. live in san francisco, amy hollyfield, abc 7 news. >> all right, amy, thank you. happening today, the man

accused of plotting an attack on san francisco's pier 39 faces arraignment on terror charges. everitt aaron jameson is scheduled to be in a federal courtroom in fresno tomorrow. today, rather. prosecutors say he planned to use home made pipe bombs to force people into one spot and shoot them with an assault rifle. the indictment against him says jameson told undercover fbi agents he wanted to attack pier 39 on christmas day, as a show of support for isis. he went into detail about how he planned to assemble the bombs and where he was going to put them. jameson who lives in modesto was discharged from the marines in 2009. we're expected to get more details from san jose police on this case that's shocked a local community. authorities believe they arrested the man behind a sexual assault and robbery of a middle school employee. the suspect seen here in the surveillance video assaulted the woman inside of a classroom at harker academy. it happened just an hour before students were set to arrive. our media partner the "mercury news" reports the victim is a teacher and the school issuing

we have breaking news from santa clara county now. three former correctional officers convicted of killing a mentally ill inmate in the santa clara county jail have been fitnessed. lubrin, farris and rodriguez were sentenced to 15 years to life in prison. handed down this morning. it is the maximum sentence. back in june the jury convicted the three correctional officers of second-degree murder for the death of mike b l tyree. this midday we're learning more about the e. coli outbreak in romaine lettuce. consumer reports says to avoid the lettuce all together. in that case. since there's no particular brand or sell-by date to look for. washing the lettuce does not get rid of the e. coli. 17 people in 13 states have been diagnosed with e. coli infections and one person hasex. former miss america who took on sexual harassment at fox news is taking the reins of the miss america organization after its own scandal. abc 7 mornings averager jessica

castro has more on what this means for the pageant's future. >> hi, natasha, gretchen carlson wants to modernize miss america. she's at the helm almost three decades after the former fox news anchor won the crown in 1989 and carlson sat down exclusively with abc's amy roba robach. carlson feels compelled to help the organization after a recent crisis where the former ceo and top executives were forced to resign amid sexist and lewd comments. >> said the only solution to save miss america was that all board members resign who were aware of these e-mails. now that you're in charge, are you satisfied with who is on that board? >> we are a work in progress on this board. >> so right now, the board is very small. we need to add people to it. but currently, the board is made up, the majority of us, are all former miss americas. and, you know, i find that incredibly empowering in this #metoo movement that some

now your accuweather forecast with mike nicco. >> getting a lot of favorable responses about the wet weather on social media, hopefully you're enjoying it also. does make getting around a little difficult. see the traffic right here on the san mateo bridge not moving too badly. considering that the rain is now finally made it that far south. in fact, mild highs and rain continues. that's my first accuweather highlight. fog will form as the rain slides to the south tonight. look for more fog sunday morning. extended, a stronger storm coming in with heavier rain and

faster breezes monday own tuesday. in the south bay, i know you're going, where is it? it's coming your way. going to take a while. probably until the evening commute. it is on the way. light to moderate rain at noon in the accuweather 12-our planner. slippery commute because of the wetness that's going to be out there. the drizzle to light rain is going to be possible during the evening hours with temperatures in the low to mid 50s. overnight, it could be up to 20 degrees cooler in the north bay. upper 30s to low 40s there. the rest of us in the mid to upper 40s for the most part. some of the rain lingering tomorrow morning in the south bay. that's the big difference from yesterday. with this model. so far, measurable rain from about oakland, redwood city, northward to a quarter inch in santa rosa. the rain, look at los gatos, .04 to nearly 2/3, .75 .75 .75 .75 see the radar returns from, for the most part they're stuck in the santa cruz mountains. radar returns all over the bay. 45 minute flight arrival delays, the average at sfo. everybody else running okay. this moisture is coming up from

the south, why the front is going to slow down and rain tomorrow morning in the south bay. here we are at noon. see the yellows in there. that's some moderate rain within the light rain. you can see it's still pretty steady but starts to move off to the east. i think these clouds that are underneath us are going to let go of drizzle during the evening hours. overnight, you could start to see the clearing taking place in the north bay. where the clouds clear out, that's where the fog forms. there's the moisture coming up from the south during the morning hours tomorrow. it will be around at 8:00 then also should push away from us. rainfall amounts are going to be greatest in the north bay. quart toreer to a third of an i there. up to .2 an inch down in the south bay. if you're headed up to the see ar sierra, snow levels start at 7,500 feet. before 9:00, you'll be fine. the snow level start to drop and snow start the to fall down to 6,500 feet then you can see it's going to be a little treacherous tomorrow morning. 5:00 in the morning, look at all that rain coming in monday. this is going to be the big
