we have scattered showers across the bay area. let's get you to street level. around napa, dry creek road, it's wet. from san francisco to dailey city, foster city, as you take a look at the inland east bay. it is slippery out there, take it easy. south bay getting some showers now, from santa clara to sunnyvale. as you take a look at what's to the north. this is an indication of how cold the air is, we have mixed precipitation in the hills above lake county, this cold storm is going to continue to come through here, and as it does, we may be even seeing some snow in our higher peaks. it's a level 1 system, snow level between 3,000 to 3,500 feet. i'll be back with an hour by hour look at how long these storms are going to last and when the next storm moves in.

a high surf warning is in effect and why at maveric, the waves caused big problems to a couple of boaters. >> reporter: you can see, there's some surfers out there right now, but the same big waves that attract these surfers are not necessarily good for boaters. and a couple of guys found that out the hard way as they were out this morning checking out some of the maverick surfers practicing for the contest when it starts. >> two individuals were very lucky. >> reporter: one look at the 19 foot boston whaler smashed on the jetty shows how fortunate they were. at 10:00 a.m. the men were out watching surfers practice in 22-foot waves, one of those waves flipped the boat. >> no negligence, there's certain days where mother nature is command.

this afternoon they called it a good fight. >> it's not a victory, but it is an common ration, which i'll take. >> reporter: their troubles began october 17 when they expected their mother's burned home despite it being in a restrict evacuation area. as seen in this body cam video, santa rosa police arrested the brothers and then took them to jail and they paid $1,000 bail on charges of not obeying orders to leave. last week evan vowed to take the case to a jury. his brother marcus pleaded guilty gauds because he could not afford to go to jail. he received probation and 180 hours of community service. >> victims have a right to see what they have lost. >> reporter: in the north bay, where this case has been polarizing, the boys have received both criticism and praise. the district attorney's office says they were warned three separate times to stay away, that's why the da's office

pressed the case forward. >> we wanted them to take responsibility for the inconvenience and the chaos they could have caused by going into an evacuation zone that's not safe to enter. we wanted them to get back to the community. >> reporter: in court this morning, the da's office reduced mark's sentence to not guilty following 40 hours of community service. after a lot of hard work, evan took essentially the same deal, call it a compromise. >> we can do this again, yes, would you fight this fight again? yes, would you go into that restricted zone again. >> absolutely. >> reporter: after today, at least, at least their legal heat is over. amazon out with a list today of the cities still in the runninger to its new headquarters. the bay area won't be landing the retail giant. >> it's unfortunate due to the

two pieces of legislation were introduced today in washington and in sacramento in wake of the me too movement to confront sexual violence. taxpayers could no longer pay sexual harassment settlements for members of congress. the legislation would require house members to pay settlements out of their own pockets and at the state capital in sacramento, a move is under way to give more rights to victims of sexual harassment by extending the statute of limitations from one year to three. >> we know that from what has happened something will change, we can't have all this attention to a systemic problem and then have it die down. >> the bill was introduced by a bipartisan group of lauz makers in sacramento. many say they weren't even aware that there was a statute of

performance or battery life. ceo tim cook says the company will have the option to turn off options to extend battery life. apple has come under fire after it was revealed they had been slowing the performance of iphones with older batteries. the company recently offered a discounted 29 replacement battery to some customers. a peninsula man has found what appears to be a popular hangout for mountain lions and he has some amazing video to prove it. check it out. dave kent set up a camera at a hiking trail that's frequented by mountain lions especially at night. kent believes there are two mountain lions featured in his video. one big cat finds the camera and just curiously flings it around. good evening, everyone.

take a look at live doppler 7, tonight's commute, definitely including some wet roadways, i'm going to take you to street level radar here, heading into lark spur, we do have some wet roadways, as we continue to sweep around the bay area, from richmond to the bay area, it is wet, slippery, from half moon bay to redwood citi, sea port road. and as you go from hayward to union city, very wet roads from alameda to san leandro. we are seeing scattered showers now beginning to move into san jose west, heading east. in the sierra nevada, snow levels are pretty high. but that's going to be changing, right now 80 reporting snow, heading towards truckee, i do not advise trial. the snow level is going to drop pretty low, winds are going to be howling and that means white

of a training mission, a call came in about two swimmers in trouble, two minutes later a drone was over the boys with a self containing rescue pod. the boys were shaken up by they're okay. without the drone, it could have taken life guards three times as long to reach those boys, might have been too late. fatigue is often a big cause of drowning at sea. crews in turkey -- lifted the boeing 737 with cranes, this is a time lapse of the effort there. one of the two pilots told investigators the plane's right engine suddenly started to speed up, which pushed the plane toward the sea. miraculously, no one on that plane was injured. 162 passengers and six crewmembers were on board the flight that originated from ankara, the turkish capital.
