this may be the first lawsuit for self-driving cars. it will most certainly not be the last. a motorcyclist and self-driving chevy bolt collided and now the blame game is on this morning. thank you for joining us. now, gm is blaming the motorcyclist. the motorcyclist himself says the car company is responsible here. and we also have the police accident report revealing who they think is at fault. abc7 news reporter amy hollyfield is live for us on 11th and howard. >> reporter: hi. this is where the technology is being developed. and we talked to people who work in this area. they say they see the cars rolling out of here every day, being tested.

now, they will be tested in court. the motorcycle driver oscar nilsson says the self-driving chevy bolt started to change lanes so he moved up. but the bolt then veered back into the lane knocking him down. he is now suing. >> i would too, sure. i definitely would. good for him. thank god he didn't die, you know. but, yes, they shouldn't be on the streets, period. >> reporter: accidents like this one make those who aren't too sure about self-driving cars even more nervous. >> we got a lot of pedestrians, a lot of bikers, i'm one of them. and i think for emergencies someone should be behind that wheel at all times. >> reporter: there was a backup driver in the car that collided with the motorcyclist in san francisco, but as he went to grab the wheel, it was too late. the police report blames nilsson for passing whether it wasn't safe. gm does, too, saying it believes the motorcyclist merged into

lane before it was safe to do so. his attorney calls the move unpredictable and dangerous. gm says as it tests this car, safety is its first priority. some people we talk to say we will one day be able to trust these cars. >> the way ai is going, technology is headed, i don't think there's any doubt. i think it's just a matter of time. i'm really looking forward to flying cars. >> going to be accidents, there's going to be bumps along the way, but eventually it will get there and it will be a great thing for humanity. >> reporter: i spoke stot attorney bringing this case. he and his client did not want to go on camera but they're looking forward to getting it in flo front of a jury. live in san francisco, amy hollyfield, abc7 news. >> a lot of people tracking that story. thank you. new at 11:00, a former stanford student is being sentenced this morning for a deadly wrong-way crash on highway 101. zachary katz was convicted on manslaughter and dui charges for the 2013 crash.

highway patrol investigators claim his car hit a taxi, setting off a chain-reaction crash in san francisco. a taxi passenger died after being ejected from the cab. the cab driver and the other passenger were also hurt. we have a crew in the court right now. we'll have an update later on the abc7 news app. and sky7 spotted this crash in san leandro this morning involving a police cruiser. this was the scene near tudor court and warden avenue. the black car ended up in the front lawn. now, at the time -- at this tirnlgs rather, we do not know what led up to this crash or how the other vehicles involved. we do know no reports of any injuries so far. developing news from hayward. two highway patrol officers and a driver are recovering after being involved in a crash after an early morning chase. investigators tell us chp chased a suspect through a red light and that's when they hit another car. it happened when the officers exited interstate 880 at "a" street. the chp says officers face tough

decisions during high-speed chases. >> and the officers take all that into account, traffic conditions and whether conditions when they engage on these pursuits. they weigh all these factors. >> reporter: the suspect drove away after the crash. this morning's chase follows the chp launching the enough is enough campaign. it's an attempt to stop drunk drivers. a chp officer was killed in hayward during a dui crackdown on christmas eve. this is the biggest scandal in gymnastics history. former team doctor larry nassar sentenced to sexual abuse of minors. tonight "20/20" takes a closer look. jessica castro from abc7 news mornings haze a preview. >> disgraced gymnastics dr. larry nassar is behind bars. his trial caught national attention as more than 100 women testified in court with scathing

words against nassar. one of those victims was kyle stevens, a former family friend who described years of abuse and how nassar fractured her family. abc's elizabeth vargas sat down with stevens and 18 other accusers to hear their stories. >> what was really amazing as i sat with these 19 women is how incredibly similar each and every story was. i asked them, as a group, show of hands, how many of you suffer from anxiety, panic attacks, depression? the majority of them were raising their hands. the good news about this, and what's extraordinary about our hour tonight is, when you see them come together and draw strength from each other. >> do they feel like the judge got them? she was very outspoken in this case. >> oh, yeah. you should have heard the reaction from the big group when i said, what about that judge? by the way, i told them that the judge's nickname when she was in the military was barracuda. and they all laughed. we're not surprised.

ordered white house counsel don mcgahn to fire mueller one month after he was appointed special counsel. "the times" reports he thought mueller had conflicts of interest. according to "the times," the president ultimately backed down when don mcgahn threatened to resign, saying the move would have a catastrophic effect on mr. trump's presidency. >> certainly there's an argument to be made that you add this piece to the other pieces in the puzzle and this is one more potential problem for the president. >> reporter: the president's white house attorney on the russia/ty cobb said, we decline to comment out of respect for the office of the special counsel and its process. the president has publicly insisted ousting mueller isn't on the table. >> mr. president, you sought or thought about or considered leading to the dismissal of special counsel? anything bob mueller would do that would lead you fin that

thought? >> i haven't thought about it. >> there's no solution. now they're saying, oh, well, did he fight back? you fight back, oh, it's obstruction. here's the thing, i hope so. >> reporter: democrats are sounding the alarm. senator mark warner, top democrat on the senate intelligence committee, says firing the special counsel is a red line the president can't control. abc news, washington. staying with politics, an immigration plan that president trump will send to congress on monday is already being rejected by democrats, immigration advocates border security, including that border wall. democrats say they won't support that. then the plan would eliminate the visa lottery system and limit family migration, which

immigration advocates are blasting. from san oe jjose two teena are on the run but a third person was arrested. this is video of the police arresting the third suspect near interstate 680. that's where officers say the trio crashed following a short chase. authorities say all three robbed a woman at gunpoint and then carjacked a man's white kia. no word on the victims' conditions. b.a.r.t. is considering making you pay more to park during peak commute times. that idea is receiving mixed reaction at a b.a.r.t. board of directors meeting. some members worry it would directly impact working class passengers. they may have to pay up to $15 a day to park and use b.a.r.t. increasing the number of available parking spaces is seen by b.a.r.t. as a way to increase their revenue and reach long-term capital investment goals. coming up, the reason pg&e wants to take a marina out of the district. a convenient way to make

welcome back. pg&e wants too remoo to remove from the marina district. this is in an effort to clean up contaminated oil. two factories sat on what is now the east harbor marina. g&e wants to demolish that marina, dredge it out and make it a shoreline with a fishing pier. auto break-ins have reached an all-time and a new article shows the numbers. officials from the district attorney's office said of 81,000 online reports of auto break-ins over the past seven years, only 13 cases net an arrest. 13. sfpd proposed a plan with more street officers in mission and terrible stations to help curb this problem. if you think it seems crowded at the san jose airport, you're right. the silicon valley journal reports terminal "b" is filled

to capacity. there's a $1 billion fix in the works. the aviation director hopes to expand the terminal over the next six years. the project will be funded by existing capital improvement funds and revenue bonds. next friday a new business company will make the maiden voyage for an alternative to drive to lake tahoe. tahoe convoy will use charter buses rented from tech companies that will shuttle people to north and south shores of lake tahoe. the buss will drive up on friday night and return on sunday night. tahoe convoy says it will even get passengers to tahoe faster than driving during highway closures because it has priority shuttle access. tickets will be $49 each way. er for apple's new home pod started today. launch date set for february 9th. the speaker can play music and podcasts, read you the news and control other connected devices in your home with siri. it will go head to head with

let's see what it's done to this month. all of us at a surplus, 111% of average in santa rosa, which will drop over the next six days when it doesn't rain. san francisco leading the pack at about 144% of average. if you go all the way back to october 1st, oh, didn't make much of a dent. san jose only 63% of average to san francisco. at the airport on peninsula, it's 73% for our highest. we need more rain. the only thing we'll have in the air for moisture is fog for the next couple of days, like we're still seeing aas we look north . let's see what it's doing to our temperature. you can see the fog is stick thick. san ramone, it was about 42 degrees there. 47 in livermore with thick fog. morgan hill at 49. 43 in santa rosa, where the fog is still hanging on. around the bay, low to mid-50s already. you can see the fog, the haze out there. and a few cumul cumul c

developing. it will be dryer and cooler than average. cooler tonight, fog forming and even more in our east bay valleys and some may travel into the bay tomorrow morning and sunday morning. then we'll just have high clouds and sunshine and above average highs. for today, kind of a tale of two areas of the bay. in the north bay we'll see the thicker, high clouds. the south bay we'll see a lot more sunshine. no rain is coming out of these clouds. what we'll watch over the next couple of days, through the weekend, this high pressure rolls in and that will bring us increase in sunshine and also an increase in the temperatures. now, today, you can see down in the south bay, san jose, 60. 58, morgan hill to santa cruz. thicker sunshine with temperatures dropping down to 55 in santa rosa. the thickest clouds are around lake port at 50 to 51 degrees. a look from the east bay hills. you can see the clouds have cleared out here. the fog is starting to lift. we're about 48 to 52 as we head towards noon. mid-50s at 4:00.

the urban forest kicks off their planning season for 2018 this upcoming weekend. they're planting sidewalk garden in the bernah heights neighborhood this weekend. i spoke to the executive director and he told me the organization is doubling its efforts in 2018, hoping to plant more than 2,000 trees. that's nearly twice compared to previous years. >> the past we've needed about 40 volunteers for each planting. and now for tree planting, we need about 80 volunteers for every two -- every two weeks, which is a lot more people. >> you can sign up to help online. it is free. also this weekend for cyclists, the sf bicycle coalition is offering a free workshop specifically for you to learn how to ride at night or in any type of weather. it's saturday january 27th from 4:00 to 5:00 p.m. at the anza branch public library.
