investigation. >> reporter: his conviction in large part due to expert testimony about two strands of hair. >> he made a statistical analysis as to how important that hair was. then that number was used to argue that it's so unlikely that that could happen that he must have been the perpetrator. >> reporter: the innocence project argued it was bad science. a judge dismissed all charges. >> it was really an honor to work on the case and help to try and get his conviction reversed. >> it's why i went to law school, to you know correct the wrongs that inevitably happen in the justice system. >> reporter: payne was actually paroled in 2005 but his freedom was hampered by the fact he had to register as a sex offender. >> for him it's just an enormous relief to not have to live this anymore. >> reporter: he is spending time with his elderly mother while looking for housing and work. his father died while he have in prison. in san jose, katie marzullo,

about it to i need to get this word out. >> the fbi receives about 800 complaints a day on its website, ic 3.gov. investigators believe that represents about 15% of the on line scams that are taking place. bitcoin is virtual currency going directly from person to person on the internet. this is no bank involved and you can't track or stop payment, which is a perfect tool for scammers. 5:06 is our time. a san jose man is under arrest after sexually assaulting two teenage girls after meeting them on snap chat. the man claimed he was 17 years old on snap chat but he is actually 21. police say he took a 13 and 14-year-old to his house gave them marijuana and alcohol and sully assaulted them. anyone with information about the case is asked to call san jose police. now to an update in the sex

good morning, everyone. time right now is 5:11. we are taking a live look outside. the bay bridge from our emeryville camera. thanks for waking up with abc7 news. francis dean lawson returns in a little bit with a full accuweather forecast. the roads have been especially dangerous for chp officers. the most recent accident was yesterday morning in which two officers were injured during a chase in hayward. also in hayward, an officer on christmas eve another officer was opinioned under a car after being hit on highwa 4 on january 15th. and a few days later an officer was hit in san jose n. three of those crashes officers say driving under the under the

influence is believed to be the cause. as medically woodrow explains this has prompted chp to beef up enhanced enforcement. >> reporter: they are enhancing patrols for impaired drivers. out of four crashes involving chp officers three of them involved drivers suspected of being under the under the influence. one of the crashes was fatal. >> it is ban tough monday. >> reporter: christmas eve, a husband and father was killed when a suspected drunk, and possibly high driver slammed into his patrol car on shoulder of 880. the officer's partner was injured. they were on a maximum enforcement patrol looking for drivers under the under the influence. >> it galvanizes you and makes you have a sense of mission of what you are doing. >> reporter: three weeks after the officer's death another officer was investigating a prior crash on highway 4 in

concord when an allegedly intoxicated driver crashed into his motorcycle breaking both of his legs. last friday night a chp officer was investigating a traffic collision in san jose on southbound highway 101 when he was struck by a vehicle, sending him over an embank men. >> another foot or so over and he could have been killed. >> reporter: the driver of that vehicle was also arrested on suspicion of dui. two other officers and a civilian suffered injuries following a pure suit and crash from noshl i-880 in the enhanced enforcement patrols continue at least through super bowl weekend. jerry browne vowed to put 5 million zero emission cars on the road by 2020.

responsibility for the attack. afghan officials say the attacker used an ambulance to get through a security check point telling police officers he was transporting a patient to a nearby hospital. president trump is back in the united states this morning after returning from davos, switzerland. he is facing serious questions about reports that he sought to fire robert mueller last june. the president is denying the claim. however, multiple news outlets confirmed the president wanted mueller out. abc's chief white house correspondent jonathan carl has the story. >> reporter: appearing before a gathering in davos switzerland of some of the world's richest and most powerful, the president took credit for an american comeback. >> america is open for business, and we are competitive once again. >> reporter: but his message was overshadowed by news back home, a report first in the "new york times" that last summer he had sought to fire special counsel

robert mueller. >> did you seek to fire mutualer. >> fake news, folks, fake news. >> what's your message today. >> typical "new york times" fake snurs. >> reporter: the president's denial, but it was confirmed he sought to have him dismissed in june, one month after he was appointed to the job. why didn't it happen? john mcgahn refused to ask the justice department to carry out the president's wishes, threatening to quit himself. the president's desire to push mueller aside wasn't exactly a secret. at the time, chris rudy a long time friend of the president's went public warning him not to do it. >> i think he is considering perhaps terminating the special counsel. i think he's weighing that option. i personally think it would be a significant mistake. >> reporter: a couple months later, trump deny even thinking about firing mueller. >> i haven't given it any

bills. happening today, representative jackie spear is looking to hear from you at a town hall meeting. people can share their thoughts about the state of the country one year after president trump took office. today's meeting begins at 10:00 a.m. at ingrid b. lacy middle school in pacifica. it's part of an ongoing series of town hall meetings hosted by spehr in the bay area. a group of california cannabis growers is suing the state over large scale pot farms. the california growers association filed the lawsuit this week. it claims state officials are in violation of proposition 64 which calls for growth sites no bigger than one acre. new rules adopted by the department of food and agriculture lets he groers apply for multiple one acre licenses. the group says the limits are necessary for small scale farmers to compete in the rapidly growing industry. >> if the marketplace is saturated and every shelf is full, it's going to be much harder for these businesses to
