clear and chilly tonight. another chilly start to tomorrow. temperatures will be warming up up to ten degrees above average. i'll show you that in the accuweather seven-day forcast. exonerated 27 years later. a san jose man has a free free e today. katie marzullo explains. >> reporter: these are photos of glen payne leaving the hall of justice on friday. he is surrounded by the attorneys and volunteers of the northern california innocence project. >> this is the first case that in the california state court has been reversed on the basis of microscopic hair comparison. >> reporter: payne was convicted of kidnapping and molesting a 2-year-old neighbor girl in 1991. his conviction in large part due to expert testimony about two strands of hair. >> he made a statistical analysis as to how important that hair was. then that number was used to argue that it's so unlikely that

that could happen that he must have been the perpetrator. >> reporter: the innocence project argued it was bad science. a judge dismissed all charges. >> it was really an honor to work on the case and help to try and get his conviction reversed. >> it's why i went to law school, to you know correct the wrongs that inevitably happen in the justice system. >> reporter: payne was actually paroled in 2005 but his freedom was hampered by the fact he had to register as a sex offender. >> for him it's just an enormous relief to finally as he says to not have to live with this anymore. >> the innocence project told us glen is spending time with his elderly mother while looking for housing and work. his father died while he was in prison. in san jose, katie marzullo, abc7 news the worst flu season in recent memories that taken another turn for the worse. state officials announced another 23 people have died because of the flu in california just this week alone. that brings the total number of

deaths in the state up to 97. the department of health reminds to you take action to stop the spread of the flu. wash your hands, cover cause of and sneezes, and stay home if you are sick. remember, it's not too late to get vaccinated. you can kind a complete list of resources and advice on our website, abc7news.com. a u.s. customs and border patrol vehicle parked on the cal campus led to fears of an i.c.e. raid. the university and mayor of berkeley quickly sprung into action yesterday. but as it turns out customs at were actually invited to ever ka us to help people register for the global entry program which helps to speed up air travel. abc7 news reporter katie utehs spoke with the mayor. >> reporter: someone snapped this picture of a u.s. custom and border protection vehicle

parked on the uc berkeley camp us and sent it to a latina activist group. they tweeted urgent, i.c.e. has been confirmed on the northwest side of uc berkeley. the mayor says the fear of a raid is real. >> we do know it's going to happen at some point. it is a sad reality. >> reporter: cal's undocumented student program sent out note offers its offices to students if they felt threatened. uc berkeley explained the situation with a tweet saying in part, they were invited to speak about the global entry program. floss raid. the global entry event was hosted by the office of the vice chancellor of finance. >> i just think it shows just heightened sense of concern in our community. >> reporter: the undocumented student program says the global entry program has agreed to notify them ahead of future campus visits. there will be additional global entry interviews in february and april. in berkeley, katie utehs, abc7 news. pleasant ton police are

searching for a bank robber this. man was caught on camera at chase bank on stone ridge mall road after 10:00 yesterday modern. police say he gave the theary note commanding money. the investigators are looking for a newer model toyota camry that may have been connected with the robbery. time now is 8:05. online scammers have found a way to rip you off using bitcoin as payment a. woman in southern california is speaking out after being threatened by someone posing as a hit man. she received an e-mail demanding $2800 in bitcoin or she would be killed. she realized it was a hoax and went public with her story. >> i switched from being upset about it to, i need to get this word out. >> the fbi receives about 800 complaints a day on its website, ic 3.gov. velgors believe that represents

about 15% of the online scams that are taking place. bitcoin is a virtual currency going directly from person to person on the internet. this is no bank involved and you can track or stop the payment. which is a perfect tool for scammers. a san jose man is under arrest this morning, accused of sexually assaulting two teenage girls after meeting them on snap chat. officers say napoleon manzano claimed he was 17 on snap chat but is actually 21. police say he took a 13 and 14-year-old girl to his house, gave both of them alcohol and marijuana and then sexually assaulted them. anyone with information about the case is asked to call san jose police. an update in the sex abuse scandal that rocked the u.s.a. gymnastics program. the entire u.s.a. gymnastics board of directors has resigned after an ultimatum from the u.s. olympic committee. on wednesday former national team doctor larry nassar was sentenced to up to 175 years in prison for sexually abusing

seven athletes. u.s.a. gymnastics must cooperate with an investigation into why previous reports of abuse were overlooked. abc7 news reporter alyssa harrington spoke to gymnasts in san jose, where the past two olympic trials were held to hear how the community is moving forward. >> reporter: gymnastics classes are as popular as ever at california sports center in san jose but parents like melanie admit the sex abuse scandal involving dr. larry nassar weighs heavily on their mind. >> it is a great sport. i do worry about it. i constantly keep an eye on her making sure everything is going as planned. >> reporter: david peterson has been in the industry since the 1980s and he has met some of the elite athletes who confronted nassar, including aly raisman. >> i have been appalled and flat out sickened by the activities and behaviors that occurred under this one individual. the fact there may have been people either covering up or hiding or somehow doing this at the top, the areas that we don't

work in, is just as appalling. >> reporter: larry nassar was sentenced to up to 175 years in prison but the amount of time it will take for u.s.a. gymnastics to regain trust remains to be seen. in a you tube video, former olympian and gold medallist shawn johnson east blasted the organization that oversees the sport she loves. >> i think gymnastics is the best sport in the entire world. but if i had a daughter right now, i wouldn't put her in it. that makes me really sad. >> reporter: peterson hasn't seen a decline in enrollment for his youth programs but is getting more questions from parents, especially about policies and procedures. and he says they follow the n.b.a. rule, never be alone with a minor. >> get to know your coach. ask the questions that are appropriate. and stay visible. don't assume everything is going to be taken care of by people that are in the trusting hands of their activities or their sports. >> reporter: in san jose, alyssa harrington, abc7 news.

woodrow explains it prompted chp to further step up dui enforcement. >> reporter: the kfl highway patrol is focused on enhanced enforce men patrols for impaired drivers. out of four crashes involving chp officers three of them involved drivers suspected of being under the under the influence. one of the crashes was fatal. >> it's been a tough month. >> reporter: andrew cam leery, a husband and father, was killed when a suspected drunk and possibly high driver slammed into his patrol car on the shoulder of i-880. his partner was injured. they were on a maximum enforcement patrol looking for drivers under the under the influence. >> galvan ayes you and makes you have a sense of mission of what you are doing. >> reporter: three weeks later chp officer martin lund wick was investigating a crash on highway 4 in concord when an alleged intoxicated driver crashed into

his motorcycle breaking both his legs. the chp tweeted, rain or shine, bringing the officer some of his favorite grub. last friday night a chp officer was investigating a traffic collision in san jose on southbound highway 101 when he was struck by a vehicle send him over an embank men. >> another foot and he could have been killed. >> reporter: the drive of that vehicle was also arrested on suspicion of dui. two chp officers and a civilian suffered minor injuries following a pursuit and crash on the a street offramp from the north bound 880 in hayward. the enforcement continues through at least super bowl weekend. abc7 news. governor jerry brown announced a plan to put 5 million zero emission cars on the road by 2030. brown's $2.5 billion plan would expand subsidies to help people buy those cars and build 250,000 electric vehicle rnl chaing

dementia care center. >> when we came back to the car we realized that it was broken into and we had lost a lot of our costumes. >> six sets of 12 costumes totaling $20,000 again. >> my costumes are hand made, priceless. >> reporter: this is where it happened in the middle of the day at the corner of bush and larkin. there is surveillance video available but because of a tree blocking the view you can see anything. >> this is a tragedy because people don't know what it's worth and yet they have to wreck other people's things just to get at it. >> reporter: while they know the chances of getting their costumes back are slim she is seniors have a strong message to whoever did this. >> don't do that again. just lucky i didn't catch them. because i would have used a sword on them. high pressure builds and pushes the storms to the north. so we will see clear conditions tonight and into tomorrow. very sunny conditions as well. hourly temperatures in oakland, if you are headed to the jack london square for the fan fest today. it starts at 10:00 a.m. we will be in the 50s throughout the afternoon. but it is still pretty chilly in the next hour, only in the 40s. highs today will be mainly in the upper 50s to low 60s. look for partly cloudy conditions in the north bay. santa rosa, napa at 58. san francisco 58 as well. notice more suchlk as we head farther south. that's where we will see some numbers in the low 60s can. san jose, 61. even 62 in santa cruz tonight. and tonight, overnight lows will be in the 40s and 30s once again with clear skies, especially this the north bay. napa at 37. milder in san jose. 45 degrees for you there. now, i talked about the warmup. so here is what you can expect over the next seven days in san jose. we will be near average today but notice tomorrow we are going to warm up.

a little dip on monday. and then by the end of the work week, 70 degrees expected in san jose. that's a good ten degrees above normal for the beginning of february. we had a lot of rainfall in january. so we are above average, even about 144% of normal for the month of january. but season to date, still below average. anywhere between 60 to 75%. and what we could really use is snow. right now, snowpack is only 29% of average statewide. unfortunately, we are to the going to see any of that in the next seven days. here's the accuweather seven-day forcast. a chilly start this morning. temperatures in the low 60s by this afternoon. sunny and milder tomorrow. that minor dip comes in on monday. then check it out. tuesday near 70 degrees inland. dry throughout the week. get your sunscreen and sunglasses out. you can put the umbrella away. you can get your car washed. because we will be mere 70 degrees as well towards the end of the work week.

52 of them got out of their enclosure yesterday. humans were evacuated. the staff was able to round up all but three baboons. none were hurt. the three are on zoo property and expected to return to the pack soon. baboons are known to stick together. an injuried turtle found behind the redwood city target for is recovering. it has a three inch crack in her shell sp may have been hit by a car. shell cracks are often fatal but with treatment the shell can be restored. the turtle is getting pain medicine, antibiotics and regular soaks in clean water. officials say she is a western pond turtle, nature to the bay area and probably was not a pet. still the come, democrats in congress are pushing for new legislation to protect the special counsel amid reports the president allegedly ordered the firing of robert mueller. also, flu season is getting worse across the country. coming up,

has the latest. >> reporter: as president trump returned to the white house -- he was in no mood to answer any questions about the russia probe. in davos, too, he dodged. >> mr. president, did you seek to fire robert mueller? >> fake news folks. fake news. typical "new york times" fake story. >> reporter: but overseas that line of attack. >> it wasn't until i became a politician that i realized how nasty, how mean, how vicious, and how fake the press can be. >> reporter: didn't go over so well. the notion of fake news got booed. abc news has now confirmed the president did seek to fire mueller last june, one month into the job, until, according to the times, white house counsel don mcgahn threatened to quit. at the time, the president made no secret of his wish to be rid of mueller and the investigation. the president's long time friend

chris rudy certainly had that impression and said so last june. >> i think he is considering perhaps terminating the special counsel. i think he's weighing that option. >> reporter: but at the time, trump denied that was the case. >> i haven't given it any thought. >> reporter: any attempt to fire mueller could be a factor in an obstruction of justice case. >> i can't say that i'm surprised but i'm deeply disturbed by this president seeking to do something that to me is tantamount to authoritarianism. >> reporter: congress how now move to protect mueller by blocking the president's ability to fire a special counsel, just in case. >> now, in light of the president's intent becoming clear, i hope that that legislation would be taken up and passed immediately by both houses. >> the important thing though is the president hasn't fired him. the president has let him continue to go and go and go and did. >> reporter: david wright, abc news, washington. happening today, representative jackie spehr is looking to hear from you at a

town hall meeting. people can share their thoughts about the state of the country one year after president trump took office. today's meeting begins at 10:00 a.m. at ingrid b. lacy middle school in pacifica. it's part of a series of town hall meetings hosts by spehr in the area. merrick ferrell is taking a break from his venture capital gig to focus on the city. he is the managing director of thayer venture as firm that invests in tech companies. the examiner reports he will be on sabbatical until his stint as mayor until june. the city requires him to serve as mayor full time and prohibits him from working a private job. time now is 8:33. disturbing new numbers from the cdc on the flu epidemic. it's getting worse especially among children and baby boomers and the flu season still hasn't reached its peeks. we have the latest on the efforts to fight the ep emkick.

>> reporter: this morning, new numbers from the cdc show the percentage of patients dieing from the flu and pneumonia going up. among the victims, this healthy 47-year-old mother sp bride to be tying suddenly this week in bam pam after coming down with influenza. >> you can't describe the loss, the hole that you feel. >> reporter: in tennessee, 33 yearly father craig childress. >> he didn't go to the doctor. he thought he could tough it out, i guess. he didn't get the flu shot this year. >> reporter: the cdc says 49 states are reporting widespread flu activity, which is impacting the elderly the most. baby boomers also getting hit hard. and so far, 37 children have died from the virus with experts estimating the actual number may be twice that that we know about half of those pediatric deaths have no underlying medical conditions. they are otherwise healthy children. >> reporter: doctors warning sometimes a robust immune system can actually work against a

patient. >> a lot of times the biggest issue with the flu your body's response can be very aggressive. >> reporter: hospitals across the country so far treating nearly 12,000 people with the flu this season sill not ott its peak. some hospitals have been so overcrowded they have had to divert ambulances. still doctors say anyone with severe symptoms should not hesitate to seek medical attention. on a lighter note, the girl scout cookie countdown is on. sales start on monday. cookies arrived at the san francisco marin food bank yesterday. the food bank shared this video of 13,000 cases now waiting for girl coutts to pick them up this weekend so they can start selling. the food bank partnered with the girl scouts more than 20 years to provide temporary space for the cookies? >> 70% of the sales stay in the bay area to support the girl
