forecast. breaking news from the abc 7 news live desk. >> we want to get back to the major b.a.r.t. delay. people can expect the commute to take a little longer. abc 7 news reporter amy hollyfield is live at the south hayward b.a.r.t. station where maintenance vehicle derailed overnight. amy? >> reporter: jessica, there is a lot of activity out here on the track. they are very busy trying to get this fixed. look behind me at the trouble spot. this is where the maintenance truck derailed and did some damage to the third rail. we are in between -- we're on the warm springs line and in between union city and south hayward. look at this video we just shot of workers headed out to the track with what looks like their replacement parts. this looks like it's going to be pretty cut and dry. not like they're having to order parts. it looks like they've got what they need. they're headed out there to get the job done. i did ask one worker how long do

you think it will take. he said probably about an hour. if this is your commute area, you need to go ahead and plan extra time into your commute this morning. they are single tracking through here. we've seen some trains go by. they're going by slowly. there are delays. no official word of when this is going to be repaired and both tracks will be up and running. but it looks like it's going to be at least another hour. that's the estimate we're hearing. so, again, prepare for some extra time in your commute if you use this area. we are between union city and south hayward. they are single tracking through this area. reporting live in hayward, amy hollyfield, abc 7 news. amy, thank you for the update. first the cover of vanity fair, now james franco is getting erased from a school. >> they're painting over a mural he painted. he faces a number of accusations from women who say he behaved inappropriately.

matt keller live at palo alto high school. matt? >> reporter: good morning, reggie and natasha. conflicted feelings here on campus. james franco is obviously a big star. but he's come back to palo alto high school since he graduated in 1996. now the sexual misconduct claims have come out against him. what's a school to do? this school pabted over his mural. the movie star painted one on the school's student center in 2014. according to the school newspaper, the voice, kim deoreo decided to have workers paint over it because it's the most visible. the future of his paintings inside the media arts center will be left up to that community. he's come back several times to speak and taught a film class here in 2015. franco has publicly said the claims are not accurate. reporting live in palo alto, matt keller, abc 7 at the live desk.

i'm tracking a muddy, watery mess in palo alto. abc 7 news was on kipling street near loma verde avenue. no word on damage. firefighters were able to help out objen scene. the crews are on the way to fix it and the water has been shut off. i.c.e. will not arrest undocumented immigrants at courthouses unless they're wanted for crimes or pose a threat to public safety. >> this promise was made yesterday. i.c.e. agents need approval from a supervisor before making an arrest. i.c.e. is responding to critics who say agents unfairly target undocumented immigrants in family court or small claims court. courthouse immigration sweeps discourage undocumented people from working with the court. many fear their immigration status will be used against them. a large housing project at

the naval shipyard in san fancisco. they admit the contractor hired to remove radioactive waste falsified soil samples. we told you about this fraud on monday. tetra tech said the soil was safe. there's still remnants of an old research lab for nuclear warfare. they wanted to build 12,000 housing units at the shipyard. people say this confirms suspicions they've had for years. >> we need this mess cleaned up and i mean today, not tomorrow. >> i think the hope is that we will all be dead before they can sell their next $1.2 million condo. that's a problem. >> redevelopment plans have been put on hold for the next year. san francisco interim mayor is done with politics when his successor takes over in june. he told the chronicle this is it for his political career. he was chose tone lead the city until a new mayor is elected in june. farrell feels free from political infighting. he's focused on the city's most

testing digital screens above the fare gates. this is the start of a pilot program. if you use the civic center station, you may have seen them. you see them at the top of the screen there. b.a.r.t. passengers hope that if they change trains, they hope they make the decision before they pay the fare. if it turns out to be useful, b.a.r.t. will expand to other stations. sue, i think that would be good to know if you need to run downstairs to take the train or

new developments at the live desk on the sexual assault allegations against charles in charge star scott baio. his former co-star nicole eggert returned to los angeles to file a police report against him. her comment came after baio appeared on gma to defend himself yesterday. he said if she thought what happened was assault, she should go to the authorities.

overnight, baio released a statement to abc news saying he's pleased eggert took his advice. and more on this story on "good morning america" at 7:00 this morning. you can tune in to hear what eggert said to reporters before catching her flight to los angeles to make that report. jessica, thank you. 6:15 now. new at 6:00, an important warning for women with breast cancer. therapies like chemo and radiation can be toxic to the heart and cause heart fail ir sometimes years down the line. this warning is coming from the american heart association. they should take steps to minimize risk like developing more targeting raildiation. you can read the message in the journal of circulation. check out this close call in boone county, illinois. the deputy pushes others out of the way after a car comes close to hitting them on the side of the road. they posted this video on

facebook reminding drivers of the move-over law. basically, drivers have to move over for all vehicles displaying flashing emergency lights. 6:16. sue, you've been tracking this issue all morning long. where are the b.a.r.t. delays standing. >> this overnight maintenance vehicle derailed at 3:20 this morning. between the fremont and warm springs line, they're single tracking in the south hayward and union city stations to get around this. crews are trying to repair it. we have some new information for you that looks like the estimated time for all this to be cleared up now. b.a.r.t. is tweeting 8:00 a.m. that's going to gum up the rest of your commute on b.a.r.t. this is a small section of the system. it's only between those two stations. south hayward and union city. not quite the very southern. pretty far south on the line. the rest of the lines, the richmond and the pittsburg bay point, dublin, pleasanton, sfo, they're all running on time with 52 trains in the system now and the ac transit buses are helping

weekend, it's going to be rather warm according to mike. no chain requirements. it should be a straight shot. noo noort star, a three hour drive. sugar bowl, straight shot on 83. base up to 56 inches. sierra at tahoe, 83 inches with a three-hour drive. 88, all the roads are wide open and expect to be for the remainder of the weekend much that is your toyota tahoe report for this thursday. richmond's mayor is not holding back. he's unhappy with how people were told about a big fire in his city this week. there's a dispute over the warning system that tells residents to shelter in place. richmond fire captain said it's his department's responsibility to notify the county when there's an alert and the contra county sheriff's office said it worked as designed. but the richmond city mayor is voicing frustration. he said it took an hour to get the first alert out.

>> announcer: now a commuter alert. >> all right. we're taking you to a live shot of sky 7 over the b.a.r.t. track. you can see those sparks just flying as they're trying to repair that track. what happened was at 3:20 this morning, a track maintenance vehicle derailed and damaged the track and so they've been needing to single track through this. this is on the warm springs fremont line. it's just between the two stations of south hayward and union city. so that's where they're single tracking. ac transit buses are there to help with getting you through that area. b.a.r.t. has now said 8:00 a.m. before this portion of the track will be reopened. residual delays right now, right now major delays, which means over 20 minutes. the rest of the system, though, is running on time. he will volunteers who hauled large animals away from danger during the north bay fires reunited last night and

many of the animal owners came to say thank you. if they lost their home, they would rebuild, but if they lost their animals, they wouldn't be able to cope. this is something the volunteers understood completely which is why they risked their own lives going house to house to get the animals out of harm's way durin >> we were on vacation out of country when the fire started and we couldn't get back in for four days. people we didn't know came and rescued our animals. >> these months later, dozens of volunteers came together in petaluma to meet the people whose animals they saved. the group has also formed a nonprofit now. they hope that they'll be better organized for the next wildfire. happening today, a free tax help will be available for those who need it. for the 16th year, low to moderate income residents can have taxes prepared for free through the earn it, keep it, save it program.

>> we've been watching this all morning. it's 6:30 and it's still an issue, sue. >> they just reported five to ten-minute delays on the warm springs line. that's a definite improvement from a major delay. you can see crews working on the tracks. a maintenance vehicle right there, you can see it, it derailed and damaged the track at about 3:20 this morning. so they have been single tracking. they're trying to get the vehicle off the track now and get that out of there to resume normal service. much better. five to ten-minute delays between union city and south hayward. single t area and also extra ac transit buses to help you get through. we'll be back in a couple of minutes to update this. it looks like it's coming along nicely. mike? >> i've got good news for commuters sue. look at the lack of fog on doppler 7. it is definitely warmer with 48 to 52 at 7:00. the accuweather 12-hour planner, great afternoon to be outside. it starts at lunch with 65 to 67

degrees. 69 to 65 at 4:00. high clouds, sunshine but the clouds will be thin enough that you want to grab the glasses. they'll also be around at 7:00 keeping us mild, 57 to 60. we do want to go back to the major b.a.r.t. delay that we've been following. crews working to get a maintenance vehicle off the tracks. amy hollyfield is live at the scene at the south hayward b.a.r.t. station. amy? >> reporter: jessica, b.a.r.t. is saying they think they'll be finished with the repairs at 8:00 this morning. they have a ways to go. they're throwing a lot of resources at it. look down there on the track where they are working. we have seen a big piece of heavy equipment go down there to help them. we've seen several employees. i also want to show you video that we shot of what looks like the key replacement pieces that they were taking out there. because they've got to replace the third rail. that is what was damaged when this maintenance truck derailed this morning.

charged with sexual assault. gonzalez is accused of attacking a minor he met through coaching. officials do not believe this case involves any students there. police arrested gonzalez yesterday at his home in morgan hill. he worked at schools in morgan hill and gilroy. the alleged incident did not happen on school grounds. the fundraising battle between two of the candidates in the san francisco mayor's race is heating up. according to the examiner, london breed raised more than $300,000 since announcing her candidacy last month. she's almost on par with former senator mark leno. he received more than $400,000 in contributions last year. they removed interim mayor breed and replaced her with mark farrell. it was labeled racist and sexist. a special election will be take place june 5th. 6:33 now. a showdown between president

trump, the house intelligence committee and tfbi over a memo. the hand picked fbi director is expressing concerns over its accuracy. here's reporter serena marshall. >> as the white house decides if they will release controversial gop secret memo, overnight the leading democrat on the house intelligence committee tweeted there were material changes to the memo. currently being reviewed by the white house's legal counsel. the chairman and architect of the memo, congressman nunez's spokesman dismissed them as minor edits. the president's hand picked fbi director publicly challenged the white house over the controversial four-page memo which purports to show an abuse of authority. saying the bureau was only given a limited chance to review the memo and "we have grave concerns about material omissions of fact that fundamentally impact the memo's accuracy." the fbi's public warning came

only after director rey and deputy attorney general rod rosenstein met privately with chief of staff john kelley at the white house on monday. after the safety the yooup, the president was overheard telling a fellow republican 100% about releasing the memo. yesterday he kept his decision to himself. serena marshall, abc news, washington. san francisco's district attorney will toss out or reduce thousands of criminal convictions for marijuana going back decades. d.a. george gascon says more than 5,000 will be reversed and the records expunged. his office will take another look at nearly 5,000 felony convictions. the move is allowed under the ballot measure that legalized the use of recreational cannabis. gascon says many of the convictions no longer make sense. >> i believe that long ago we lost our ability to distinguish the dangerous from the nuisance. it has broken our pocketbooks, the fabric of many of our

communities and we have not been any safer for it. >> people who have been convicted of violent felonies will not be eligible. happening today, possible help for marijuana merchants. san francisco supervisor's committee will hold a meeting considering a public municipal bank in the city. right now, cannabis businesses are operating on a cash-only basis because of federal laws against the drug. banks are reluctant to take their money out of fear of legal trouble. the meeting begins at 10:30 a.m. at the city hall board chamber. the winter second snow pack survey will occur today. last month, they found virtually no snow in the sierra nevada mountains. it was 3% of normal. after recent storms, electronic sensors show snow levels currently about one-third of normal. today's snow pack survey happens at 11:00 a.m. we go back to the b.a.r.t. delay. it's improved somewhat.

tuesday and wednesday. >> all right. thank you, mike. abc 7 news learned that seismic movement on the hayward fault most likely caused a massive water pipeline break in hayward over the weekend. a rupture occurred along the hayward fault ripping the street on highland boulevard near margaret drive. the seismic creep created a large sinkhole on sunday. you can see the video of the fast-moving river of water, mud and rocks that resulted. this picture shows you where the fault is relative to the pipe's failure. >> it's moving about a fifth of an inch per year. that doesn't sound like much, but in 40 years, that's getting close to ten inches of motion. and so ten inches of motion is enough to stretch some pipes. >> the last big one on the hayward fault was 150 years ago. experts say, yes, we are due for another one. renewed concerns about how the u.s. will defend itself from a north korean missile attack

after an interceptor missile test missed its target. this is video from similar tests last year. the interceptor was reportedly launched from a test site on kauai. it's not publicly acknowledging that it actually failed. only that a test took place. they compared the launch to trying to hit a bullet with another bullet. cnn reports that officials are trying to determine what went wrong. a judge is ordering the woman known as the serial stowaway to undergo a psychiatric evaluation. >> police say 66-year-old marilyn hartman was taken into custody at o'hare airport over the weekend. that follows her arrest two weeks ago when she got on to a flight to london without a ticket, made it all the way there and had to be sent back. the judge ordered her to stay away from chicago airports after that. she has a long history of trying to catch flights without paying, including at sfo, san jose. coming up the search things you need to know before you go.
