law enforcement to bring charges against him. house republicans have drafted a temporary funding bill hoping to keep the government open for six more weeks. it would include defense spending, but democrats have already said they won't approve it. they're still hoping to protect young immigrants brought as children. the debate isn't expected to begin until next week. without a new bill, the government would run out of money thursday night. another shutdown they say is unlikely. a week after calling for unity and bipartisanship in his state of the union address, the president went to a factory in ohio to promote his tax cuts. but he veered off topic. he chastised democrats for not applauding during his speech. he went as far as to suggest democrats the lack enthusiasm was like an act of treason. >> they were like death. and unamerican.

>> the 34-year-old deputy leaves behind a wife and 7-year-old twins. four others were also injured. the suspect was killed. investigators looking into sunday's deadly amtrak crash have recovered an event recorded. the device should review more when the reason for the crash, but blame is also being put on a trash switch. david curley has more. >> reporter: federal investigators say the amtrak engineer apparently realizing the switch was set wrong hit the brakes but he could not stop this head-on collision. >> it was bodies everywhere. the seats came up off the floor. >> reporter: the rail cars in the amtrak engine are being removed. but they're more interested in the switch on the rail line just a couple hundred yards back up the track. rail crewscsx apparently didn't follow policy leaving the switch in the wrong position. late saturday or early sunday csx turned that switch and moved

one of its great trains from the main line to a sideline. and it was not switched back. and when amtrak 91 arrived heading south of miami, it was diverted to the same side track and in less than 700 feet slammed into the parked freight train. that switch should have been flipped back to the main line. >> put it this way. that switch should have been lined so that amtrak could have continued southbound as planned. >> reporter: the signal light system is also out the night of the crash. ironically it was installing elements of positive train control, a safety system that would have prevented this accident. david curley, abc news, cayce, south carolina. the consumer financial protection bureau is dragging its feet into the massive data breach at equifax.

the driver accused of killing an nfl player in indianapolis has been deported twice before. they say he's a native of guatemala and living in the u.s. illegally. and allegedly crashed in to edwin jackson and his uber driver as they stood on a highway shoulder. test shows the blood alcohol level was nearly three times the legal limit. the winner of last month's powerball is suing to maintain her privacy and have a designated trustee be the public face of the winning ticket. she's also requesting to be exempt from the state's right to know law. she says she made a huge mistake in signing the back of the ticket in her own name, rather than the name of a trust. the lombardi trophy is now in philadelphia. >> the eagles brought it home and showed off for hundreds of fans at the airport. there were also fans cheering as buses brought the team into the city.
