larsen is at james lick middle school with the latest. >> reporter: i actually just spoke to an eighth grade student and her mother just a few minutes ago, most of the students have gone home at this point, but she was in class when she started getting messages from her friends that somebody somethingad that if any parents or kids don't feel well, to please come forward, they don't want to get anyone else in trouble, they just want everyone to be well and healthy. passengers on board a flight from san francisco to honolulu got quite the scare today when an energy covering came off the flight. you can see it there from the window of the plane. one passenger said it was the scariest flight of his life. the plane did land safely. deion lind filed this report just a short time ago. >> reporter: a united airlines flight has landed safely in hawaii after its engines failed

over the pacific. look at this video, this was actually a damaged engine video by eric hadid that he tweet fed from that american airlines flight. it landed at honolulu international airport at 2:42 bay area time. that's a boeing 777. i know these images look pretty scary, but we should point out that this aircraft has two engines and it's actually designed to fly on one engine three hours over water. now to a story you'll see only on abc7 news. a family of a murder victim is preparing to sue the city of san francisco and it's police department. they're claiming the city is responsible because the suspect used a gun stolen from a police officer. abc news reporter vick lee has the exclusive story. >> reporter: the family plans to file this claim tomorrow, one day before the deadline and we did get an advanced copy, the

claim by the way is a precursor to a lawsuit. they are suing the city and the police department as well as the officer who owned the gun. >> he had just gotten off work, it was about 2:00 a.m. in the morning. he did not know his assailants. >> reporter: gable was shot down in august, just a block from his home. police say the shooter and two others had been on a crime scene, two shootings and five robberies in one night. >> that all was enabled solely by a police officer who apparently is a decorated veteran, failing to secure his weapon in his vehicle. and leaving it with ammunition. >> reporter: attorney allison cordoba represents the's coe sell family. the suspect was also wearing an i.c.e. tracking device strapped to his ankle. >> that monitor in fact is the evidence that they are using to

tie him to the three shootings and five robberies that occurred? >> reporter: esquovel's family is suing the department and the owner of the gun. the complaint will be filed tomorrow. >> they want the message to be loud and clear that law enforcement officers need to start securing their weapons properly. >> reporter: and that law applies to both private citizens and law enforcement. >> you have to either lock the firearm in your trunk, or you have to lock it in a container that is out of plain view. >> reporter: san francisco police tell us they are investigating the circumstances involving that stolen gun. the officer is still on duty while the investigation continues. vick li, abc7 news. new details on the death of a 19-year-old woman stabbed and left for dead on a rural east

bay root yesterday morning. that woman has been identified as lizzette cuetsa. here's the story. leslie begins her team coverage. >> reporter: 9-year-old jaden silva said a s.w.a.t. team used his treehouse as a viewing platform to survey the house next door. >> we were scared because we saw a lot of guns and we were scared that they were going to shoot or something. >> they said get out with your hands up, and we know that you're there. >> reporter: jaden's grandmother was home monday afternoon when she was ordered to evacuate, as overs swarmed in. >> there was a lady pregnant. so i don't know the name. they arrested her too first. >> reporter: that was 25-year-old melissa leonardo.

according to her facebook page, she is from los gatos, went to high school in tracey and got engaged to this man, daniel gross. gross is just 19 years old. officers used concussion devices to gain access to the backyard of the home. gross is pictured in this 2016 yearbook from johansen high school. neighbors said that the couple were quiet. the victim, lizzette cuetsa just moved to the central valley a few months ago. she was friends with the two suspects in modesto and she identified them to law enforcement just before she died. i'm leslie llie brinkley, abc7 .

>> reporter: investigators are trying to figure out what took place in the hours leading up to the murder of 19-year-old lizzette cuesta. they say she willingly got into a car with two of her friends, but eventually they dumped her out of the car, she was found crawling on the road in livermore. beaten and stabbed. she was able to tell the responde responders who hurt her. >> probably obtained evidence that may have been destroyed as time went on. >> reporter: within 12 hours, deputies arrested daniel gross and melissa leonardo at a home in modesto. police found evidence pertinent to the case. a motive has yet to be determined. >> it's been very overwhelming

the last couple of days so our investigators are trying to catch up with a tremendous amount of information that they have to deal with. >> reporter: cuesta worked at her father's restaurant. the east side union high school district released a statement saying we are in shock and disbelief regarding this tragic event, our thoughts and prayers go out to her family, friends and loved one. both suspects are being held without bail at the santa rita county jail. a new decision today in the daca debate blocks decisions by the white house to end the immigration program. a u.s. judge found that they cannot end the program by month. er although the court also

determined it duds noes not bel the removal of daca would be unlawful. there's been a sharp decline in the number of immigrant college students applying for financial aid. that's according to the los angeles times. as of yesterday, 19,141 students applied for aid under the california dream act which provides state based financial aid to some undocumented students. nearly 17,000 fewer students have applied compared to last year. the application deadline is march 2. don't look now but it's nearly brush fire season. and experts say it could be a bad one. >> everything changes really quickly. >> the battle to make sure that wildfire season isn't too wild. mild ore today, but we are in for some changes, i'll have your valentine's day forecast coming up. and the benefits of marriage, things you might not have thought of when you decided

the bay area's extended stretch of dry weather is certainly creating some concerns. worries about another drought and a serious fire season. as david louie explains. explai. >> reporter: while they're not on the front line fighting fires, they're setting fires, they're called prescribed burns, carefully coordinated with landowners. they're becoming increasingly important as fire danger becomes a year round phenomenon. along with the lives and property loss remain fresh in firefighters minds. >> the winds is what's really made a lot of those fires

erratic, but these prescribed burns, if we can limit the fuel and limit the continuity of the fuel, we have a better chance of fighting some of these fires and that's what we're trying to do here. >> reporter: cal fire has a policy of doing prescribed burns. this is the natural preserve at the north edge of the uc santa cruz campus. the chap parallel. >> it's a very busy corridor, it's a ridge top, so as far as fire depends, it would be a great place to take a stand around an advancing wildfire. >> reporter: the national interagency fire forecast map shows southern california already at above normal risk, shown in red for significant wild land fire potential. and by april and may, it's forecast map shows how that level of risk advances north

towards the bay area. don't let fields of butter cups fool you, now is the time to be fighting fire with fire. california water wasters may face higher fines under new rules. five fees could be leveed like overusing water. certain activities will be considered crimes, even if a drought emergency has not been declared. some of the wasteful practices include, hosing down sidewalks and driveways, washing a car using a hose without a shutoff nozzle. and hotels not asking guests to reuse fresh may bury

that you have for your valentine's day. we're looking towards the port of oakland and nothing but blue skies overhead. 62 in san francisco, 60 oakland, mountain view 61, 57 in gilroy. highs today came up just about everywhere. and from our east bay hills camera, you can see it's just a bit hazy. one other live picture, this one is a bright one from our golden gate bridge camera, clear and chilly overnight tonight, cooler tomorrow with a few high clouds, that will filter the sunshine and it is turning warmer again by the end of the week, so first thing in the morning, it is going to be chillier than this morning, and one of the reasons why is we're not going to have the wind, that will allow those air masses to fall, we are very dry. we are looking at numbers basically near freezing in some of our inland valleys, low to mid 30s and right around the coast we'll see 30s and 40s. it is going to be clear around the bay area.
