gate i think about. we can see all of that fog. this morning, 40s and 50s. 50s at the coast to near 70 inland by noontime by the afternoon, the low clouds and fog and the sea breeze kick up. upper 50s to another 60 at the coast. mid 70s inland. above average but cooler than yesterday of. we will talk about easter sunday and the week ahead in just a few minutes. tesla confirmed auto pilot was engaged when a car slammed into a collapsed safety appearier killing an apple engineer on highway 101 last week. the i-team's dan noyes broke the story earlier this week and that is latest. >> reporter: 38-year-old apple engineer and father of two walter wong died one week ago on his way to work when his tesla model x slammed into a collapsed cushion basically like hitting a brick wall. cess la says auto pilot was engaged. wong's hangs were not defected on the wheel for six seconds

driver in a prius hit the smart cushion at 70 miles an hour. he walked away with minor injuries. an attorney and consultant from safe drive.org tells me tesla bears responsibility for the failings of its auto pilot and automation poses new problems for caltrans. >> we can imagine a day when all of our cars are in automated mode doing down the road and he this all fail in the same place on the freeway. that raises the question at what point is caltrans responsible to fix the road to accommodate automation. >> reporter: tesla says if you are driving a car equipped with auto pilot hardware you are 3.7 times less likely to be involved until a fatal accident. for the i-team david noise nbc 7 news. >> wong's family has no comment on the release. they are in the process of hiring an attorney and making funeral arrangements. the california dmv has received one application so far to kubt driverless testing. the name of the applicant hasn't been released.

driverless cars will become street legal in california on monday. the dmv requires someone to monitor the car but they have to be riding in it. an independent autopsy of the shooting death of an unarmed black man in sacramento kprikts the police report. the family of stephon clark has hired a forensic pathologist to investigate. he found police shot clark eight times. six of those bullets hit him in the back. police had said that clark charged at them. he also said clark survived several minutes after the shooting but police waited to give him medical aid. hundreds of protesters rallied in sacramento last night. they marched to the golden 1 center where the war will play the king tonight. there will be extra security at the arena today. protesters have rallied outside kings games twice already blocking fans from getting inside. some pushed past fencing set up to protect fans on game nights.

former warrior matt barnes asked his old teammates to join a rally hours before the game. coach steve kerr says his players are free to participate. >> i mentioned to our players yesterday that if they wanted to be part of anything that's going on that it's something that they should discuss. >> the march went on for more than three hours. there were no arrests. now to news involving the wife of the pulse nightclub gunman, noor salman's family says she is returning to her east bay home to be ryu nighted with her 5-year-old son after a florida jury found her not guilty of aiding in the attack. abc7 news reporter katie utehs spoke with her neighbors in rodeo. >> reporter: a florida jury acquitted noor salman the widow of the pulse nightclub killer. >> we knew from day one she was

innocent. and thank god it came out. >> reporter: prosecutors argued that salman knew about her husband's guns and his obsession with muslim extremist videos. they also toll a jury she was aware of salman's intentions. but her attorney insist she was a simple woman with a low iq who was abused by her husband and knew nothing about his plans. >> this was a case where the more we learned the better noor salman looked. >> reporter: a person who claims they were a juror says otherwise. a statement sent to orlando % media reads in part, she may not have known what day or what location, but she knew. however, we were not tasked with deciding if she was aware of a potential attack. the charges were aiding and abetting and obstruction of justice. the couple's 5-year-old son has lived with his grandparents since salman's arrest. >> he comes every day and says hi to everybody. >> reporter: family says salman is heading back to the east bay to ryu night with her son.

neighbors hope she can start a new life. in road yae, katie out a as, abc7 news. a bay area attorney is turning the tables on a law firm basically accusing the law firm of running a criminal enterprise. katie marzullo has the story from san jose. >> reporter: michele burnel had to make changes at her heir hardware store beforing a sued for violations with the americans of disabilities snookt the signs used to be up here and we had to lower them. >> reporter: randy and tanya moore of mission law firm in san jose filed that lawsuit. it was one at least five in mountain view, 1400 across the state. like most, burnel settled out of court for $20,000. >> i was thinking it was illegal. >> reporter: this attorney had a similar thought when the moores sued her parents over the mountain view restaurant, one violation being the front door was too heavy. but they fought the case and they won. and she is now suing the moores

under the rico act. >> i have never seen it used in this area of the law before. it's primarily used for mafia and drug traffickers. >> reporter: she believes the moores lied in the days against her parents. >> which is basically alleging mail fraud and wire fraud. >> this is a factually frivolous case. >> reporter: john o'connor is defending the moores. he said his clients have been helping remove barriers for disabled people. >> congress wants private enforcement of the disability laws. that's what this law firm does. it saves the taxpayers money. edon't have being buildings of enforcement personnel. >> reporter: the moores filed two motions to dismiss the case. the second was rejected earlier this month. the case moving forward into the servicery phase. in san jose, abc7 news. part of an east bay road closed about a year is back open. this is redwood road in march of 2017 after part of it buckled due to the wet weather.

the road is a link between castro valley and the oakland hills as well as moraga. alameda county posted this picture yesterday of the road work wrapping up. according to the county, the repairs cost about $1.2 million. a transient called the bart simpson tagger was arrested this wee by san francisco police. 27-year-old tyler ross was taken into custody tuesday after witnesses say he tagged a building near the transamerica pyramid. mrs. say ross is responsible for this graffiti that has popped up throughout the city. officers say spray cans were found on him after his arrest of the the paint on his hands matched the paint used in the vandalism. state health officials are warning consumers not to eat recreational caught muscles and kplams from the county. they have a toxin that can cause illness ort in humans and cannot be removed through hooking. health warnings are in place in

sunni around schwarzenegger's first words after waking up from heart surgery are "i'm back". a spokesman for the former governor said he's in good spirits. there were complications on thursday while schwarzenegger was undergoing a planned procedure to replace a heart valve. surgeons had to perform emergency open heart surgery. he is now in stable condition in a hospital in los angeles. a troubled san francisco mcdonald's is now closed to make way for affordable housing. new video shows the restaurant at haight and stannion shut down yesterday. it will soon be demolished in january the board of supervisor voted the buy the property. the mcdonald has been considered a blighted nuisance property due

taxi medallions cost a quarter million dollars in san francisco but there is a big question. are they still worth it as companies like uber and lyft take an increasing share of passengers. the taxi medallion's value is decreasing. >> reporter: own one of these used to be a symbol of success for san francisco cab drivers. now it's more like the opposite. >> i know what's going to happen i never to it. >> reporter: do you feel like a sucker? >> i should, i am. >> reporter: it used to be that taxi medallions were in limited supply, a license essentially to run your own business. in 2010 the city decided to raise some money by selling 700 medallions at $250,000 each. that was before uber and lyft flooded the streets. >> worth nothing. >> reporter: nothing? >> nothing. >> reporter: he figured he could make money with this medallion, lease it eventually sell it. now, et cetera saddled with the

economic hardship of paying close to $2,000 a month on the mortgage for it. >> i blame the city and the state, too. >> the hard working blue collar taxi drivers that have served the community here for many many years have been left holding the bag. >> reporter: jonathan i don't have he have represents the san francisco federal credit union custom made a deal with the transportation agency to finance those loans. one of six has foreclosed. this week, the credit union filed suit for $125 million. >> no one is suggesting exactly what the mta should have done, just that they needed to have done a whole lot more than they did. >> reporter: the city has no comment on the suit thus far except to say they are reviewing it. for drivers, the reviews about owning a medallion have been in for a long time. >> nobody will buy it are you kidding me. who wants to buy a medallion for $250,000 these days. still ahead on abc7

good morning gilroy, 47. it was 84 yesterday in morningan hill. so points south very, very warm. and just maybe two or three degrees cooler today. not much of a cooldown for you. but at the coast how about ten degrees cooler. you were in the 80s today santa cruz, 72 today. it is a 47 right now in santa rosa as well as fairfield. 46 in novato. the cool spot is napa at 44. 52 for our friends in the east bay. today, upper 50s. south lake right now it's in the mid to upper 20s from truckee to the tahoe valley airport. many folks have skiing on their minds for the week ahead. some kids off of school. still plenty of snow there. in the afternoons, spring skiing the temperatures cool off just a bit each day. rain returns by the end of next week. highs today from the upper 60s in san francisco, 66. half moon bay. yesterday was 72. 77 fremont. palo alto, 80, and s and s
