san francisco to mark the release of a man held by i.c.e. >> the undocumented san jose father will be free after months in jail. alyssa harrington live in san francisco with the immigration about-face. alyssa? >> reporter: good morning. while i'm outside the i.c.e. headquarters in san francisco, where a rally is expected at 9:00 a.m. to celebrate the release of fernandez carillo. he was arrested last fall as he dropped his daughter off at a daycare. since then, his family and other supporters have been holding rallies and working tirelessly to get him released. he has been living in the united states illegally for about 15 years. a judge, however, ruled he should not be deported because it would not be safe for him to return to mexico. in a statement, carillo's wife said i am relieved today to know that we can live freely without fear as we deserve. he was being held at a detention center in richmond. the government did have the opportunity to appeal this

ruling. but it did not. again, he will be released to family this morning. reporting live in san francisco, alyssa harrington, abc 7 news. now, a live desk update from abc 7 mornings. new overnight, president trump tweeting about no deals to save daca. i want to show you the tweet september out this morning. saying daca is dead because the democrats didn't care or act. now everyone wants to get on to the daca bandwagon. no longer works. must build wall and secure our borders with proper border legislation. democrats want no borders hence drugs and crime. this comes after the easter outburst he had on -- he also -- the deadly tesla crash on highway 101. federal investigators say they're unhappy that tesla released information about the crash. now on friday, tesla said the model x was on autopilot moments before it hit a barrier.

san rafael where the chp says a body was found yesterday morning. it was in the slow lane just north of i-580. the investigation had shut down two northbound lanes of 101. officers are working to get a description of the suspect's vehicle. >> interstate 880 back open following a sideshow. you can see the video posted on twitter. cars spinning doughnuts, smoking their tires at 9:00 last night. this is southbound near the oakland alameda coliseum. some of the participants got out of the cars, lit fireworks and sprayed graffiti. lrnd 11:00 last night, oakland p.d. tweeted these photos saying they towed two cars that will be held for 30 days for attempting to help start a sideshow. they did not say if the incidents were related. recovery continues in the north bay after the october wildfires. >> pg&e crews will be in the coffey park to build underground power and gas lines.

san francisco at 50. more on the big rain coming, next. here's alexis. >> good news, mike. the biggest trouble spot of the morning was a vehicle fire on southbound 880 in the san lorenzo area at a street. the two right lanes were blocked for about 40 minutes. just got the all clear from chp. we have four miles of residual delays that remain. 12 miles an hour approaching that scene. hopefully that will be going faster than it is right now. good news in the south bay. northbound 101 at 680, our first crash of the morning. we have the all clear for that one. next traffic update at 6:20. thanks, alexis. highway 50 near lake tahoe is back open following a pair of explosions. look at this. a blast created a large crater in the highway in front of the hard rock cafe in state line, nevada. they're blaming a faulty underground power switch. the nevada highway patrol closed -- fearing more explosions. no reports of any injuries.

a charter school in georgia is apologizing after students were on stage with black face. this shows what was meant to be a black history performance. students holding dark masks recited the poem by lawrence dun paragraph. parents were offended. >> when the theatrical messages were woven in the fabric of buffoonery and cooper i of this country, i did not feel the image was powerful. it was a poor and inappropriate decision. happening today, the young texas man, the son of an affluenza case is expected to be released. ethan couch was sentenced to two years in jail for violating terms of his probation. that was all couch got for a deadly drunk driving accident that killed four people in 2013. his case got national attention when his lawyers claimed the

then 16-year-old was too rich and too entitled to know right from wrong. couch and his mother fled to mexico when video emerged showing him drinking and doing dru drugs. a man trapped under a sfaul entree. about one to two feet in diameter, it fell on him. he was able to call 911 and guide firefighters where he was. they pulled the tree off of hip. his injuries were nonlife-threatening. the election commission is calling on the mayor of san francisco to fund a new voting effort. officials want to switch to an open source voting system. he would be -- an open source voting system means the software to tabulate the ballots would be open to public view. it would cost between 11 and $28 million to implement it according to a new consultant's

inland east bay, some of the warmer temperatures here. livermore to 74 in antioch. san ramon and concord. let's go over to the peninsula. 50s along the coast. but mid to upper 60s for the rest of us. 65 in san mateo. the last stop in the south bay. 72 at san jose. gilroy at 68 in los gatos and milpitas. my seven-day forecast. about the same tomorrow. cooler wednesday, closer to average and then the rain rolls in thursday. it becomes pretty heavy friday. that's why the storm bumps up from a light to a moderate. >> i'm going to highway 4 on the eastbound side of the highway. i am seeing backup. we've got a multicar crash reported. that was briefly blocking all lanes. i believe that's off on the side now. i will keep an eye on the westbound side. we have onlooker delay there. still residual delays southbound 880 if you're traveling toward the hayward area.

atmospheric river. more on that, next. here's alexis. >> we have a crash reported on eastbound highway 4. west of pa cheiko. i am having a hard time believing it's not on the westbound side. through the concord area. folks have driven through the area -- at least lanes are blocked on the westbound side by emergency crews. definitely seeing a solid backup there. still working to confirm how many lanes we had blocked and seeing how serious that crash is. hearing from our partner, roadwork on westbound 37 at 121 in the sears point area. that is adding about 15, 20 minutes to your drive on westbound 37 if you're leaving from vallejo. perhaps we're heading a little further north and taking an alternate this morning. next traffic update at 6:40. now, breaking news from the abc 7 live desk. a f an update out of los angeles. authorities successfully rescued a 13-year-old boy who fell down a drainage pipe near griffith park. he's alive, able to speak, i

want to show you these live images coming to us from colleagues in los angeles in the area where they were able to locate that teen boy. it's unbelievable. appears to be a highway there. you can see the first responders that were able to pull this boy out alive safely. this is where the l.a. crosses the freeway. it was a really long night for first responders looking for jesse hernandez. he was playing with friends yesterday afternoon inside of a wooden shed. abandoned maintenance shed. a plank broke. he plunged 25 feet into a pipe that feeds into the los angeles river and this morning, he was located right near that freeway. >> we were able to give him a cell phone to contact his family members. as you can imagine, they are overwhelmed with joy. >> the fire department says now the boy does have to undergo

some decontamination. he fell into nasty water there. he'll be checked out at a local hospital. but doing well and talking this morning, reggie. >> usually this doesn't end well. >> so glad he's okay. >> what a relief. thank you. a car crash in san jose overnight leaves hundreds of people without power. >> reporter matt keller on white road for us where crews are working to get the power back on. hey, matt. >> reporter: good morning, natasha. si since i last saw you, we got an update. pg&e is on the scene. you can see lines coming off that pole. at one point, close to 2600 people had no power in this neighborhood. but that number has gone down significantly. right now, pg&e crews are working on south white road to get the remaining electricity back online. what a scene overnight. here's what one neighbor says she heard. >> we had just gone to bed. out of nowhere we heard a loud boom a and sirens. since it's usual that it passes by a lot, we thought it was

something normal. as soon as we heard the loud boom, our whole lights went out at home. >> reporter: check out the video from shortly after the crash at 1:15 a.m. police tried to stop a stolen vehicle with two people inside it in the area of allenwood drive and south white road. that vehicle didn't stop and crashed into a power pole at white and leaf court. two men were arrested. one was taken in a patrol car, the other in an ambulance. they were booked on auto theft. 39 customers are still without power here in this area. they're hoping to get it restored by 11:30 this morning as crews continue their work. reporting live in san jose, matt keller, abc 7 news. >> matt, thank you. 6:33 now. confirming the car crash that killed a family in mendocino county was likely intentional. they were driving their suv with six adopted children one week ago when it went off a 100-foot

cliff. three children are still missing. the speedometer was pinned at 90 miles per hour. >> the vehicle came to a stop most likely in that pull-out. and then accelerated off the cliff. >> there's a lot of people online saying that they were beautiful people. at some time they may have been. but that is not what we saw next door. >> investigators are addressing rumors of a suicide note found in the family's home. they say no such note was found but they're evaluating items found during the search including red flags. they're not elaborating on that. >> happening today, a driver charmed in a hit-and-run crash is set to be arraigned. mark dennis faces one count of murder, four counts of attempted murder and assault with a deadly weapon. dennis got into a physical altercation with the five victims last wednesday. he drove on to the sidewalk and plowed into them. this was the 24th and illin streets. one of sthe menoi later died ate hospital. >> how a sheriff's patrol car

hit a woman during a vigil for stephon clark. it happened on saturday night. video shows it hitting the woman and pulling away. the sheriff's office says their vehicles were surrounded by protesters who broke a back window and started denting one of the vehicles. the woman hit has been released from the hospital. the sheriff's office is conducting an interrible nal ref the incident accepting applications for the h-1b advice as. a lot of them use the visas to attract tech workers from overseas. 85,000 people will be chosen in a lottery-style drawing. the visas will allow them to live and work in the u.s. for at least three years. employers have to sponsor the applicants. the trump administration says applications will be scrutinized and rejected for even minor errors. china will impose a tariff on more than 100 american-made goods, many from california. the move in retaliation for president trump's new tariffs on chinese steel and aluminum.

the 15% tariff will include fruits, nuts, wine, pork and aluminum. the increase is expected to hit california companies especially hard because many of those products come from here. another sign of recovery in the fire zone of sonoma county. the santa rosa press democrat says much of the park severely burned in october is now open again. park crews have repaired trails, retaining walls and rebuilt culverts. if you visit, you should know that there are going to be burn scars visible. you also see wildflowers and new leaves on the trees and bushes. happening now, bill cosby back in court nor jury selection in his retrial. this is new video into the abc 7 newsroom showing cosby arriving at the courthouse in pennsylvania. more than 180 potential jurors have been summoned to appear for screening. his accuser andrea constant, a former temple university basketball administrator will take the stand again. he's accused of assaulting her at his suburban philadelphia

updated location. we've got a multicar crash. two out of the three lanes are blocked. we're seeing significant delays. some of this, typical two miles an hour as you get close to that collision scene. i will keep an eye on that. tough going right now. a quick check of the bay bridge toll plaza. we're looking at typical volumes there. metering lights at 5:18 this morning. drive times, westbound 580 tracy to dublin. in the yellow. dublin to mission boulevard in the yellow at 25. northbound 85. won cupertino looks good. struggling to keep crossing guards at schools across the city. critics of the program say low pay and split shifts are causing the shortage of guards. the sfmta pays guards about $18 an hour. they work 75 minutes in the morning and 75 minutes in the afternoon. they don't get any benefits. city supervisors plan to address the issue at a meeting later
