>> the letter released by the ntsb today shows the company drew criticism from the agency because of information released in an investigation. the i-team investigated a crash in mountain view that killed mawalter hwaun. i rode to the scene in a same model. right after that report, tesla issued a statement confirming auto pilot was on at the time but that huang had his hands the wheel for six seconds. today's letter says this past friday night in a phone call, he warned elon musk about releasing information in an ongoing investigation. then came tuesday's i-team report with the widow, brother

and lawyer who have filed to sue tesla. >> i try not to cry in front of my child. because they feel afraid. >> unfortunately, it appears that tesla has tried to blame the victim here. >> after that report, tesla released another statement that read, the only way for this accident to have occurred is if mr. huang was not paying attention to the road, despite car providing multiple warnings to do so, adding the reason other families are not on tv is their loved ones are still alive. and that statement, according to the ntsb's letter led to another phone call from the ntsb chairman last night in which he informed elon musk the agency was removing the company from participating in the investigation. it is unfortunate that tesla by its actions did not agree by the party agreement wrote robert sumwalt. it does not serve the public

interest. tesla's firing back, writing this afternoon, it's been clear in our conversations with the ntsb that they're more concerned about press headlines than nationally promoting safety. the company accuses federal investigators of releasing partial bits of incomplete information to the media, in violation of their own rules, at the same time they were trying to prevent us from telling all the facts. tesla says they're going to make an official complaint to congress about the ntsb. an attorney for the family told me that tesla feels more concerned about blaming mr. huang and less concerned about the safety of drivers using the auto pilot system. i'm posting this all on abc 7 news.com. online you'll find the videos of the stories that dan and the i-team have done about this crash. we will send out push alerts when news breaks.

the santa clara district attorney's office has charged rubin foss toter with multiple felonies. wou we have more on the disturbing charges. >> reporter: rubin foster did not enter a plea today. that has been delayed until the end of april. and tonight he remains out of jail on $75,000 bail. inside this santa clara county courtroom, a stoic rubin foster faces the seriousness of allegations against him. >> we do not care who the perpetrator is, their status in the community or anything of that nature. we are here it to try to get you justice. >> reporter: two months ago, police responded to foster's home in los gatos after his girlfriend flagged down a stranger to call for help. >> her boyfriend beat her up. two weapons, an ar-16 and we're

still getting further. we do have history here. >> reporter: prosecutors released new details saying foster dragged her by the hair, threw her out of the house and punched her in the head leaving her with a ruptured eardrum. police found an assault weapon and magazine. both of which are illegal in california. >> in is beyond a simple domestic violence case. the d.a. has alleged multiple strikes. he is facing two strikes under the three strikes law. >> reporter: richard sherman was there to support his teammate. foster has not been cut from the 49ers organization. they said they will ten continu follow the serious matter. rubin is aware that his status is under scrutiny. the judge ordered foster who have no contact with the victim

but will return on april 30th for a plea hearing. foster is the fifth niners player since 2014 to be arrested on charges involving violence against women. the others were tremaine brock last year. his case was dismissed. ahmad brook in 2015. bruce miller in 2015. and ray mcdonald in 2014. none of those players is currently on a team. in all, according to data compiled by usa today, 17 49ers have been arrested in twifl, second only to the new york jets with 18. a situation had been improving in contra costa county until last night. freeway shootings without clear motivation. there were two incidents in the span of two hours last night. laura anthony is live in walnut creek near the scene of the first of those shootings, laura? >> reporter: well, after a year's long string of shootings,

finally, the numbers were way down. this year there were nine shooting incidents until yesterday. it happened twice in a matter of hours on two separate highways, about seven miles apart in contra costa county. the first shooting came at 9:45 wednesday night on interstate 680 near treat boulevard after two drivers got into an altercation on the freeway. >> the vehicle threw bottles at him. and then the victim's rear window shattered out. he thought his car had been struck by a bottle. he drove home and about 11:00 at night he discovered a bullet fragment in his vehicle. >> reporter: a short time later near the port chicago exit there was another shooting incident, also allegedly caused by road rage. >> it is a very busy corridor. >> reporter: karen is a contra costa county supervisor whose

district includes 680. thanks to local funding from the city of pittsburg and money from the state, a stretc of road now has cameras, but she would like to see a similar system along 680. >> we need to all be working to the. because our constituents don't care which jurisdiction or agency has responsibility. they just want to feel safe in their cars. >> reporter: in the meantime, drivers say they'll try to keep cool cool even when someone else isn't. >> i don't really think about somebody shooting. that's something to be aware of, your surroundings, both sides. >> reporter: in walnut creek, laura anthony. abc 7 news. alameda police are asking for your help in solving the first murder of a the year. a 61-year-old restaurant owner has died from injuries she received on webster street last year. eric? >> reporter: we're going to show you surveillance video in just a minute.

it's hard to tell from that exactly how many people were involved. but alameda police tell us they're looking for at least two attackers in the incident that happened outside this restaurant last friday night. they don't have a good stripgs of those assailants, but they know the victim was brutally beaten and died days later. you'll see the struggle that changed this case from attempted robbery to homicide. this surveillance video from a nearby business shows the attackers beating cindy lie and a 28-year-old man who tried to help her. it happened last friday night around closing time. both victims were rushed to the hospital. >> the female victim sustained serious traumatic injuries and succumbed to her injuries on tuesday april 10th. >> reporter: the male was treated and released. employees didn't want to go on camera, but they did say lyonned

t -- lee owned the restaurant here and another with her husband in oakland. they vow to find the killers. >> since this occurred, we've devoted every investigative resource to exclusively to this investigation. all of our investigators led by our violent crimes unit have been collecting and analyzing evidence. >> reporter: if you have any information, you're asked to call alameda police in alameda, eric thomas, abc 7 news. new developments emerged today in the search for a missing family bound for the bay area. highway patrol investigators confirm a suv carrying four people plunged into a northern california river last friday. the family from southern california vanished while driving from portland, oregon to san jose. searchers found items alongside the river in mendocino county and the items were confirmed to have belonged to the family. the river is running very fast right now, so divers plan to look for bodies once the water is calmer.

in a separate characteristic the search continues in mendocino county for three children missing after a suv plunged off a cliff last month. two women and three children all from the same washington state family were killed. a body found near the scene this weekend has not been identified. emergency call records from washington state show one of the mothers sent a text saying she was so sick she might have to go to a hospital. the suv was found two days later. the chief executive of backpage.com has agreed to plead guilty money laundering charges and cooperate with prosecutors after federal agents seized the online forum. prosecutors call back page a quote online brothel. colin farrell will testify as part of plea deals he reached in california and texas. he could face prison sentences of up to five years in each state. back page's founders face charges after being indict bade

live where you live. this is abc 7 news. more than $2 billion and almost a decade of work. when will san francisco's transbay transit center finally be complete? we're still holding our breath. >> the project is months past the original deadline. once it's finished, the transit center will bring 11 systems together in one location. >> it will feature a bus plaza, retail places and a park. leanne ma lynn d lyanne melendez gives us an update. >> reporter: the board of directors was told decision still have to be made about the downtown rail extension tunnel, 1.3 miles long, taking cal train and high speed rail all the way to the trans-bay transit center, completion date? >> as early as 2029.

>> reporter: so here's what needs to happen to meet that deadline. what has yet to be decided is the route it will take once it enters san francisco. the mission bay alignment? or the pennsylvania street alignment? the mission bay alignment shown here in green would go past the warriors arena and at&t park onto second street and ending up at the transit center, the pennsylvania alignment would go past the potrero hill, and the existing fourth and king train yard, making a left on second street and finally to the transit center. the selection will depend on the cost of each alignment. in the end, it will be city hall and its supervisors who will decide which will better serve san francisco. the good news is that phase one will be completed as early as this summer. think buses for a moment.

they will pick up thousands of people. >> operations for buses in august of this year. >> reporter: we found out phase one was supposed to be done by december of last year. because it wasn't, an additional $2.5 million will now be spent to oversee its completion. in san francisco, lyanne melendez, abc 7 news. one san francisco leader is denying accusations that officials are trying to outlaw scooter services. the city has spent more than a month working on guidelines for scooter permits. the comments come after bird, one of three rental firms operating in the city claims supervisors plan to ban the scooters in an emergency action. many residents have complained to city hall about scooters being ridden on sidewalks and left blocking entrances to buildings. well, the ferries that cross

borderline aggressive at times when you have to be. >> reporter: as the house goes up, dead and dying trees are still coming down. by march, a few more houses are under way. on easter, the neighborhood holds an egg hunt. the next day, pg&e starts 15 miles of underground trenches for new utility lines. now six months after the fire, this santa rosa city map shows 38 coffey park homes under construction. 32 more have permits to begin construction. one of those belongs to dana hanson. the ironworker. a woman saw the report and gave him the tools that belonged to her son who passed away. dana is putting them to good use. that first house to start construction is on track to be finished next month. though some neighbors are moving on, many still plan to stay. >> it's still your home, and it's just part of you.

a real tragedy is under investigation in ohio. a teenage boy suffocated inside a mini van after calling 911 more than once. the 16 year old was somehow trapped in a honda odyssey on a school campus on tuesday. he called 911 and told the dispatcher where he was, but responding officers didn't find him. >> i looked in the van. i didn't see anybody in it. >> the 911 operator who took the second call was put on leave for

not relaying all the information he was given. it's not clear how he got trapped. the monterey county teacher who accidentally fired a gun inside a classroom while teaching gun safety has resigned. seaside teacher dennis alexander submitted his resignation last month effective at the end of the school year. he was pointing the gun at the ceiling to make sure it wasn't loaded when it went off. a bullet fragment grazed a student's neck. you see it there. alexander who is also a reserve police officer and seaside city council member is on administrative leave. community college students will be guaranteed admission in uc schools if they do well in courses that uc faculty help develop. applicants may not get into their first choice but will be admitted into one of the nine undergraduate uc campuses. from a storm to sun, and back again. back again. enjoy the blue skies while you ♪ ♪

the rollercoaster ride on the market continues. today it's a good thing. the dow gained almost 300 points, the nasdaq 71 and the

s&p added 21. stock in bed bath and beyond tanked today, dropping 20% after the home goods store gave a poor forecast for its future performance. even though fourth quarter performance was strong, sales growth has been down for eight of the last ten quarters. in case you haven't finished your income tax returns, tuesday is the deadline to file them or get al get an extension. officials say they'll handle more than 18 million tax returns. 2 million will mail their returns, but 90% of taxpayers in california now file electronically and been fit from that. >> you'll traditionally siee a refuld quicker. >> if you do mail them in, california officials urge you not to use staples or paper clips. those could delay getting your

refund and you don't want that. google has been sitting down with community groups on the impact of megacampuses. >> one group delivered a list of demands to mountain view headquarters. david louie was there as the group silicon valley rising showed up. >> reporter: plans are still vague on just what google is going to create on 20 acres of land west of san jose. parcels are still being purchased for a complex that will draw 20,000 workers. >> there is a lot of fear about what google is going to draw to san jose and others desire to get actual details and see action. >> reporter: she is campaign director at silicon valley rising, a coalition of faith and labor groups. they showed up at headquarters with a list of demands, they include an affordable housing fund, an agreement to hire local workers and support for local
