new developments tonight on a story we've been following closely six months. three elderly residents died since evacuated during the north bay wildfires. attorney who filed class action lawsuit over the deaths is changing it to wrongful death lawsuit. melanie woodrow broke the story. >> reporter: oakmont senior living billed as pleasant community. >> vision of hell. >> residence burned to the

ground. says mom barely made it alive. >> i'm feeling awful. >> reporter: in the hospital after the fire. >> all we have is each other. >> reporter: passed away two months later. >> never had a good day after that, in so much pain, i mean, just in agony. >> reporter: two other residents passed away after the fire, both related to two women who rescued nearly all the residents. >> all i could think about is getting them to safety. >> reporter: mother-in-law passed away last month. three employees at villa capri didn't know what to do. >> asked them do you have evacuation plan, wanted to help out. they said no, waiting for director. >> reporter: e-mailed abc7 news saying all have evacuation plans. >> wasn't told if they do.

>> one page document with where everybody should meet and name of point people, some who no longer work there. filed wrongful death on behalf of plaintiffs. law enforcement prevented them from entering the area but santa rosa police say no road blocks. >> not stopping anybody from helping save lives that night. >> reporter: biggest blows is response to the lawsuit. plaintiffs failed to take adequate as reasonable person would have in similar circumstances. say they're blaming victims. >> who can't see, can't hear, afraid, cognitive dysfunction, hasn't been out of bed in two
