after being hit by a car on interstate 580. it happened near high street just after 9:00 last night. chp closed three westbound lanes. all lanes were reopened about midnight. investigators have not said yet what led up to this crash. it's 4:30 if you're joining us right now. let's get a quick update on weather and traffic. lisa, what do you say? >> it is cooler this morning, no clouds to speak of. there's still just a little bit of a breeze out there keeping us from dropping into the 30s. i think we'll see 30s this morning. cooler locations already in the upper elevations in the east bay. 47 in san jose. that does translate to numbers anywhere from three to nine degrees cooler, and we will be looking at a rebound with temperatures where they should be for this time of year. look at all the sun. 6:37 the sun comes up. low 60s inland by noontime. the same around the bay.

upper 50s at the coast. by 4:00, flirting with 70 degrees around the bay and inland. should be a beautiful day today. hopefully the commute smooth sailing. >> unfortunately we already have heavy traffic, we have overnight road work on westbound 580. that was scheduled to wrap up about 4:00 a.m. it was a little later. 205 down to six miles an hour. at 580 up to 14 miles an hour. according to caltrans, that road work did clear. quick check outside at walnut creek. looking good heading towards highway 4. next update around 4:40. >> only on abc 7 news, tesla's response to the i-team interview with the widow of tesla owner walter long. it was the last straw for the

national transportation safety board. the ntsb released a letter showing the agency criticized tesla because of statements the company made in response to two i-team investigations. walter wong after his tesla model x hit a safety barrier. his car was on auto pilot at the time. it is unfortunate that tesla by its actions did not abide by the party agreement. uncoordinated releases of incomplete information do not further transportation safety or serve the public interest. wong's family claims tesla blamed him for the tragedy. the chp is investigating two shooting in the span of two hours that closed parts of two freeways. the first shooting and 680 in walnut creek near treat

boulevard. officers say someone threw bottles at the victim's car, the victim thought a bottle broke his window but later found it was a bullet fregment. another shooting apparently triggered by road rage. after funding from the city of pittsburg and funding from the state, a stretch of highway has camera. one supervisor would like to see a similar system along 680. >> we need to be work together because our constituents don't care which jurisdiction or which agency has responsibility. they just want to feel safe in their cars. >> we should note no one was hurt in either shooting. new developing this morning in a deadly police shooting in fremont. fremont police officers shot a man at the intersection of fremont and nicolette last thursday as they say he pointed a gun at them. now our partners report that while the fremont police department has plenty of video,

none of us will be released to the public. some of that comes from police video cameras, cameras inside patrol cars and surveillance cameras from a nearby gas station. we're just two days away from former fbi director's james comey first sit-down interview with abc's george stephanopoulos. the interview comes as comey gets ready to believe his mom our. >> in that book he likes president trump to a mafia boss. >> in his book describes president trump as a deeply flawed person and leader. he criticizes his presidency as a, quote, forest fire, and shares what he says happened before he was abruptly fired last year. the former fbi director is sharing his story. james comey comey comparing president donald trump to a mafia boss at a last-minute dinner. >> he called me at my desk at lunchtime and asked me was i free for dinner that night.

>> reporter: comey claims it's at that dinner president trump said i need loyalty, i expect loyalty. he said the demand was like sammy the bull's induction ceremony. a few months later the fbi director was fired by the president. in one excerpt from the book, comey writes this president is unethical and untethered to truth and institutional values. his leadership is transactional, ego driven and about personal loyalty. he also expresses regret about how he handled the hillary clinton e-mail investigation. writing, i'm sorry i couldn't do a better job to explain to her and her supporters why i made the decision he made. he says he urged john kelly not to quit, that the country needed principled people around the president, especially this president. the white house says it doesn't intend to comment. >> comey's first tv interview will be right here on abc 7. george stephanopoulos will ask him about his tenure at the fbi

including his controversial firing by president trump last may. you can watch it during a "20/20" special this sunday at 10:00 p.m. president trump issued an executive order to review the u.s. postal service operations and finances. mr. trump wants a task force to study the postal service's pricing in the package delivery market. the president accused amazon of not faring its fair share of postage to ship packages. the task force will have 120 days to submit a report with recommendations. a federal judge ruled the justice department cannot require local police departme s departments -- jeff sessions said departments could receive grants by agreeing to cooperate with immigration authorities. the justice department says it will likely appeal that decision. good morning to you. we're waking up to clear conditions, just enough wind out there to keep most of you in the

we're into the 80s for the foreseeable feature. i've got rain to talk about in my next outlook. hopefully you have from light. >> unfortunately we have road work that looks like it's going late. if you're trying to get out of tracy, i know that is typically a tough commute this time of day, it is even tougher right now. check this out. down to 6 miles an hour. i was thinking we would improve. we have not. we're slowing down even more. 208 to 580, six miles an hour. a couple other sources i looked at. they were supposed to have this done at 4:00. they still have some lanes closed. i'm working to get to the bottom of this. it sounds like that started on 205 and goes all the way up to greenville road as you approach the altamont pass area. not great news. ace rail is an option or telecommuting or delaying the trip just a bit. here is a look at the cash lanes

facility in santa rosa. >> the attorney who filed a class action lawsuit over these deaths is changing her complaint to a wrongful death lawsuit. abc 7's melanie woodrow has more. >> reporter: billed at a luxury retirement facility. >> it was a beautiful version of hell. >> reporter: the villa capri residence burned to the ground. sharery says her 92-year-old mom barely made it out alive. this is bu dough in the hospital after the hospital. >> that's all we have is each other. >> reporter: she passed away two months later. >> she never had a good day after that she was in so much pain, just in agony. >> reporter: two other residents also passed away after the fire, both related to the two women related to nearly oh.

>> reporter: kathy allen's mother-in-law passed away next month. she says the three employees who were there when she arrived didn't know what to do. >> we asked them specifically do you have an evacuation plan because we wanted to help out. they said they were waiting for their director. >> they wrote, quote, all of our communities have evacuation orders. >> reporter: all she's seen is a one-page document with where everyone should mean and names of point people some who no longer worth there. she filed a wrongful death lawsuit on behalf of plaintiffs. oakmont senior living says they were prevented from entering to shuttle more residents to safety. >> we were not stopping anybody from helping save lives that night. >> reporter: steber in says one of the biggest blows has been their response to her lawsuit.

i reads, plaintiffs failed to take adequate precautions that would have avoided and diminished her injuries and damages and didn't react in a reasonable manner or as a reasonable person would have in like or similar circumstances. steber in says oakmont is blaming victims like budow. >> who can't see, can't hear, hasn't been out of bed in two years. to blame her is upsetting. >> reporter: last month a judge granted her request for an expedited trial. it's been set for august, just ten months after the fire. >> they blew it so massively and the jig is up. people know now that this is not the place that it was pretending to be. >> reporter: we reached out to oakmont's attorney for a response and did not hear back. melanie woodrow, abc 7 news. about 100 lawsuit blaming
