boy, still crawling, five miles an hour on 205. coming from southbound 580, that's still 13 miles an hour. that's going to take a while to bounce back. it is friday. hopefully we will with those lighter volumes. bay bridge toll plaza still looking okay. stacking up in the left lanes, the cash lanes i should say of the bay bridge toll plaza. no metering lights yet. we should have about 20 minutes until that happens. >> alexis, thank you. surf is up in snn cruz. huge waves prompting a warning for beachgoers. >> abc 7's matt keller is there. how big can the waves get this morning? >> reporter: this could be a really big day. we could see waves ten to 12 feet. this is a good late-season swell. the suf fers are stoked. my goal is just to stay dry. surfers know what they're doing out here. the beach hazard statement is in effect until about 7:00 tonight.

it will impact the west to northwest facing beaches. be aware there could be rip currents and large shore break. people are advised to not turn their back to the ocean. why would you want to? a beautiful day out here. temperatures in the mid to upper 60s. probably surfers will be out here in the next hour or so, enjoying the big waves today. the surfers here in santa cruz know what they're doing. live in santa cruz, matt keller, abc 7 news. >> pretty jealous of your assignment today, matt. thank you. happening today in san francisco, former 49er and raider aldon smith will be back in court. smith was taken into custody one week ago when he showed up to receive an ankle monitor in his domestic violence case. authorities say his blood alcohol level was .4. that is five times the legal limit to drive. smith is expected in court at 9:00 this morning. a judge could order him into a substance abuse facility.

49er linebacker reuben foster has been charged with three felonies including domestic violence. police say he dragged his girlfriend by her hair, punched her in the head eight to ten times and threw her out of their home in los gatos. if convicted, he could face 11 years in prison. his plea hearing is april 30th. the highway patrol and mendocino office will release new information about the southern california that plunged into a river last week. they vanished when driving from portland, oregon to san jose. searchers found items alongside the river in mendocino county. relatives confirm the items belong to the missing family. the eel river is -- >> would you vote to split california into three states? you can weigh in right now by heading to abc7news.com/vote.

>> hundreds of thousands of people have already signed a petition to put the issue on the november ballot. katie marzullo talked to the organizer who says it's the only way forward for california. >> reporter: venture capitalist tim draper is not a fan of the current state of california. >> we pay the highest taxes and get the worst services. >> reporter: he's working on an initiative to divide california into three states. >> we made it so each of the three are as even as possible, as even in population, as even in wealth. >> reporter: he says they've collected more than 600,000 signatures in support of cal three. that's nearly twice as many as they need to get it on the ballot. troy troyson signed the petition on thursday. >> i've had a lot of friends that want to move out of california. instead of doing that, wait for it to be divided up. >> reporter: he said it might make it so democrats don't win every california election. draper said the fresh start

overnight tonight, in the 40s. slightly warmer than we are right now. adding a little heat to the afternoon. the night not so cold. it changes by the end of the weekend. i want to take you back to the central valley. tracy into castro valley, one hour and 31 minutes. believe it or not that has improved dwight a bit. late road work on westbound 3580 that was supposed to wrap up at 4:00. didn't get through until almost 5:00. hopefully this will start to thin out soon. i'm reading some of the comments from drivers. and they were joking you need to leave 24 hours ahead of schedule. northbound 101, highway 85 to the san jose airport, that looks great. northbound 280, highway 1 to san francisco wide open. no delays from the north bay either. southbound ak gross the golden gate bridge looking good.

from our live desk this morning, the u.n. security council will meet today at russia's request. the topic of discussion will be the threat to international peace from possible air strikes by the u.s. and its allies shortly after president trump met with his national security team yesterday. the white house said there has been no decision yet on military action in syria. his team will continue to consult with allies about a final decision. meanwhile earlier this week, the president suggested a strike could be imminent in response to a suspected che s attack by the assad regime in syria. robert mueller has strong support to expand his investigation according to a poll by abc news and "the washington post." he's gone beyond the issue of possible collusion with russia. the investigation has shifted to the alleged hush money paid by president trump's long-time attorney michael cohen to porn

star stormy daniels. 58% of those polled support the investigation. 35% oppose it. the margin is even wider when people were asked about mueller business activities.ent trump's a plan to pay city contracted workers in san francisco a minimum wage of nearly $17 an hour is on hold. according to "the examiner" the board of supp visor's budget and finance committee postponed a vote on the proposal last night because of cost concerns. the committee agreed to work out a compromise in two weeks that would benefit airport employees, non-profit workers and in-home care providers. if it goes through, the minimum wage for city contracted employees would go up to $16.86 on july 1st. an effort the now under way in sacramento to slash the tax rate on legal marijuana says. yesterday eastbound assemblyman rob bonta proposed a plan to lower the tax from 15 to 11% and suspend cultivation taxes for three years.

his chest. according to prosecutors, kyle plush was found in this odyssey tuesday, "the cincinnati enquirer" reporting he was kneeling on the third seat trying to get tennis equipment from thing ba when the seat flipped over, onto the floor of the cargo area trapping him upside down. plush managed to call 911, but said he couldn't hear the dispatcher. police started looking for someone in disstraes in the area but didn't find him. ten minutes later, according to police the teen called 911 again with his location, the school parking lot. police say another dispatcher who took that second call did not pass on the information to the officers on scene. we'll have more on this tragedy coming up at 7:00 a.m. with your gma "first look," geo benitez, abc news, new york. happenng today, the woman who accused bill cosby of drugging and assaulting her in his home is expected to take the

witness stand in the retrial. at the time of the alleged incident in 2004, andrea constand was a women's basketball administrator at his alma mater, temple universe tiff. cosby says the encounter was consensual. his first trial ended without a verdict. a san francisco bus driver pleaded not gill toy the felony charges after police say he drove a high school swim team while he was drunk. last friday aaron freedman picked up swimmers from martin luther king junior pool in the bayview. he honked the horn and cursed at other driver's. they also say he hit a light pole at 24th and geary boulevard. no students were hurt. in-n-out is suing an australian restaurant, accusing them of trying to mimic offering and misleading consumers. in-n-out has no presence in

if you're getting tired of the back and forth, we do have a more spring-like week ahead, which means we'll be getting a little of this and a little of that, starting with the fog off the coast. our winds will keep it cool and breezy at the shoreline. tons of sun out there, 50 in the city, 40 in danville, los gatos. 44 with fremont. cloverdale 42, 38 in ukiah, 42 in vallejo. we will be looking at the cool morning, then the warmup today, the warmest day of the week will be tomorrow, and then looking at the rain returning by midday friday in the north bay. we're bringing in our storm impact scale. it's a one for the system sunday night into monday. a quarter inch, maybe a third inch, maybe a half inch towards ukiah. here is the timeline on it. about 2:00 on sunday. we've got the rain from the marin county coastline through cloverdale and sonoma. we're looking for this to move through and stay with us on monday. another round of rain bringing the breezy and damp conditions

boulevard. seeing slowing on the sensors on the southbound side. we're launching sky 7 to the scene. that pedestrian reportedly does have major injuries. quick check of the bay bridge toll plaza, it looks like they have flipped on the metering lights. overall pretty friday light but things are starting to fill in. next traffic update at 5:40. the brutal death of an east bay business owner has the family in shock. >> police are looking for people who beat and killed a restaurant owner closing up for the night. abc 7's amy hollyfield is live in alameda. amy. >> reporter: high, jessica. alameda police call this selfish and vicious and say they've dedicated every resource to this case. 61-year-old cindy le was beetd ten to death friday night in front of the family restaurant here in alameda. we have surveillance video of the attack. police say two men were trying to rob her. they beat her and a 28-year-old

who was trying to help. he survived but cindy was killed. she was the oldest of nine, one of her brothers says he still can't believe she is gone. >> she always care about me and she care about her community. she loved a lot of people. >> reporter: this happened on webster street in alameda friday night at 10:30 outside the family restaurant, pho anh dao. police have not made any arrest or released a suspect description but say they have dedicated their entire investigative team to this case. reporting live in alameda, amy hollyfield, abc 7 news. >> amy, thank you. developing news in oakland, a pedestrian died after being hit by a car on interstate 580 near high street just after 9:00 last night. chp closed three westbound lanes on the interstate while they were investigating. all lanes have been reopened. they were reopened about midnight. investigators have not said what

led up to this crash. chp investigating two shootings in the span of two hours that closed parts of two freeways in contra costa county wednesday night. we first brought you the story saturday morning. it happened on 680 near walnut creek near treat boulevard. officers say someone through bottles at the car and the victim thought a bottle broke his window but later discovered it was a bullet fragment in the car. a short time later on highway 4 near the port chalk highway exit, there was another shooting, apparently triggered by road rage. after funding from the city of pittsburgh and money from the state, a stretch of highway 4 does have cameras, one contra costa county supervisor says they'd like to see a similar system along 680. >> we need to all be working together. our constituents don't care which jurisdiction or which agency has responsibility. they just want to feel safe in their cars.

>> an investigation still on going, and we should note that no one was hurt in either shooting. >> tess lar response to abc 7 i-team interview with the widow of walter huang is apparently the last straw for the national transportation safety board. the agency has kicked tesla off the probe for releasing investigative information before it was vetted and confirmed by the ntsb. the ntsb released a letter, because of statements made to our investigations. 38-year-old walter huang died after his tesla model x hit a safety barrier on highway 101 last month. his car was on auto pilot at the time. the ntsb chair says it's unfortunate that tesla did not abide by the party agreement. uncoordinated releases of incomplete information do not further transportation safety or

serve the public interest. tesla plans to make an official complaint to congress. >> it's been more than one week since fremont police officers shot and killed a man after they say he pointed a gun at officers. now there's word there's void i don't of the shooting from police body cameras, patrol cars and nearby surveillance cameras. the shooting happened last thursday. our partnes report that while the fremont police department does have the video it just mentioned, none of it will be released to the public. the department says that's because the video is considered evidence. san ramon police identified an armed robbery suspect who held up a credit. the suspect is 42-year-old matthew gordon, a transient who frequents the bay area and washington state. police believe he's responsible for oefrl other armed bank

robberies in the area. anyone with info is asked to call san ramon police. we're two days away from james comey's first sit-down interview with abc's george stephanopoulos. >> the interview comes as comey is set to release his brand new memo memoir. in that book he likens president trump to a mafia boss. comey talks about meeting president trump to worn him about the now infamous steele dossier, the alleging of his encounters with prostitutes in moscow. >> i started to tell him that the allegation was that he had been involved with prostitutes in a hotel many moscow in 2013 during a visit for the miss universe panel into and that the russians had filmed the episode. he interrupted very defensively and started talking about it, do i look like a guy who needs hook ers

right now. they're on their way to a scene that sounds pretty serious. we have a pedestrian hit reportedly by a taxi. that driver kept going. a hit-and-run situation on el camino real in millbrae right around sfo. clearly they're not to the scene yet. we'll go back to them in about ten minutes. they should be there by then. we also have a new crash on state route 238, the connector to southbound 880. four vehicles involved here. it's stacking up quickly. if you're moving from castro valley towards the san more wren sew area, two right lanes blocked, lanes three and four. with that many vehicles involved, probably will take a while to clear. chp was just dispatched to the scene. we don't have too many details at moment. ace one and three on time today. a great alternate out of the central valley. b.a.r.t., 49 trains in service, no delays. vta, normal service and no delays for you.

san francisco launching a new program today to protect its youngest pedestrians. it's called street smarts. the program recreates a cityscape, complete with moving cars, bike lanes and intersections, and the realistic set is used to teach children how to cross the street safely and how to avoid getting hit. the city plans to unveil its set today. coming up, a glass of wine at dinner? how about two or three? how much is too much? >> what happens when you combine
