black mercedes i should say. we are told by sources with knowledge of the investigation that the officer was not in uniform. he was not in uniform. but we believe he was a plain clothes officer. so he was crossing the veet and suddenly he was hit by the car. now, let's go to san francisco general, because that's exactly where the officer was taken to be treated for wounds. a lot of officers, a lot of motorcycle cops have arrived at the officer in support of the officer, of course. we are told by another source with information about his condition that he suffered injuries, perhaps to his leg and to his elbow and possibly to his back. but that his condition is not life-threatening. let me repeat that. the officers's condition is not life-threatening. he is in serious but stable condition. now, let's come back to the scene here at 29th and

up temporary housing for them. as you can imagine many are in disbelief. this morning a chaotic scene at the summer wind apartments in san jose as a 5-alarm fire forced residents out of their homes. >> i mean, you look there is a fire. there is a fire. which he opened the door. the smokes comes in. >> the investigators believe the fire started in the kitchen of a second story unit before spreading to the third floor. this resident still waiting to see if anything in his home can be saved. >> my tools. i don't care. you know what i mean. the people are the important. >> all 36 units inside the building that caught fire are unhabitable. the red cross estimates 100 residents have been displaced. that number could go up as more families are interviewed. >> meeting with etch eye of the residents, determining needs, and how we can help in the road to recovery during this

out of the plane. abc news reporter ernie has the lafrt. >> airplane engines are not supposed to blow apart like this. >> the number one engine failure, a bowing 737. >> southwest flight 1380 from new york made an emergency landing in philadelphia. passengers said they heard the explosion and saw shattered glass. >> the engine exploded. and a shard from the engine shattered the glass over the exit row. row 14. >> the same debris that shattered the window critically injured a passenger. the ntsb said she later died. >> there is a hole in the side of the aircraft also. >> inside the cabin passengers described confusion, fear and panic. >> there was ash coming through the venleation system. and you know we started dropping. >> the plane landed safely. the engine fuselage and one window damaged. usually a mishappen is contained within the engine housing in an

into the ocean near the town of west port. today the authorities announced theed bood body found a week ago is that of 12-year-old sierra hart. two other members recommend missing. president trump's pick for the supreme court cast the deciding vote against zporting some immigrants. justice neil gorsuch joined the court's more liberal justices in finding the clause too vague to be enforced. the court's 5-4 decision concerns a provision of immigration law making it easier to deport immigrants convicted of crimes. a federal appeals court in san francisco previously struck down the provision as too vague. both the trump and obama administrations had defended that provision. governor brown is lashing back at attacks from president trump over the deployment of national guard troops. in a et tweet this morning the president claimed the governor hasn't come to terms for the national guard to protect the border loop writing the high crime rate would get higher. brown disputed the claims at the national press club in

our reporter explains what's broken and what is a taxpayer to do. >> reporter: the irs collects over $3 trillion in taxes per year. on this mission critical day when taxpayers are scrambling to meet the midnight deadline, the irs computer system is broken. the irs prefers to say certain systems are experiencing technical difficulties. the irs website says it can't accept direct payments. that is money taxpayers owe by midnight. otherwise there are penalties. we have heard from tax preparers that the efiling system is down. that's how more than nine out of ten taxpayers submit returns. >> the irs's it system is old. as a matter of fact it's the oldest one we have in the federal government. >> professor caroline chen teaches accounting at san jose state. >> i believe it's being programmed in language that we actually no longer program in or teach to our computer science majors. >> with the filing deadline looming, the irs computer problem means filers have to revert to paper. >> tax preparers will need to

print out returns, taxpayers themselves will need to print out returns from their turbo tax or whatever other tax software they are using, sign them and get them into the mail by midnight tonight. >> however h and r block said in a statement while the irs system is down we are completing the returns. which will be set as soon as the irs system reopens and will be considered filed on time. the irs declined to do an interview as to when the computers will be back up. >> so what will it cost to replace the irs's ant kuwaited computer system by some estimates over $1.0 billion. in san jose, david louie abc 7 news. president trump filed an extension for his 2017 tax returns. the white house spokes william sarah huckabee sanders says trump like many american also file tax returns by the extension deadline of october 15th. trump has filed for extensions in years past. all right. so here is a question. if you are getting a tax refund what should you do with the

the federal reserve rather is continuing to raise the discount rate. so the interest rates on the short term debt are going up all the time. that's getting more expensive. that you you should be first that should be wiped out that's expensive money. >> i assume all the debts are kind of what you might want to go after first. >> you may have mortgage debt. that payment you get back as a tax refund to pay down the mortgage. if you have a child and you are thinking about sending the child to school, 17 years from now it's very expensive. so you could put away money now and have it earn interest and get the time value of money. when the time comes to pay the college tuition you have been putting towards that versus going to vegas. >> right. is there any room for a splurj in maybe take yourself to a nice dinner >> you have to reward yourself you have to wit 48 hours, look at all the needs. after you think you've taken care of those you should reward yourself definitely. >> do you think most people are putting away for 48 hours. >> the numbers i look at most people put it away in some form of savings, the 401(k), taking

care of bills they have. and then you've the g the percentage of people that don't. and it's a problem because only one out of three people have enough money for retirement in the future. so that's a time bomb that's going to explode process. we have to -- that's why i say put it away for a couple of days. and then put it to good use after that. >> if you get more than, say, $500 back in your refund maybe it's time to reevaluate. >> you need a good financial adviser. if you get more than $500 you have taken too many deductens. what you should do is talk with the tax professional and rethink. . because that could be used for cash flow, paying down credit cards, putting more money into the 401(k) plan and other investments. >> right. an if you buy that trip to vegas you might feel good for a while. >> you'll still have the bills. >> exactly. >> you'll have some debt. thanks for coming in we appreciate the tax day advise. >> thanks for having me. >> good advice. ama if you get $500 bucks dinner

is on you. starbucks says it's closing 800,000 stories in the united states for one afternoon next month to do racial bias education for employees. this move comes of course after the highly publicized video showing two black men arrested in a philadelphia starbucks. the two men were there for a friend when an employee called police on them. starbucks says the closures will take place afternoon of may 29th. the company employs 175,000 people. let's turn to the weather forecast. gorgeous day but what's to come in spencer christian is tracking it in accuweather. dan we'll start with the gorge day. we have mainly sunny skies on doppler 7 and cool to mild across much of the bay area. this is the view sort of from mount tamm looking down to the bay under mostly blue kai skies. 58 in san francisco. low to mid-60s at oakland, mountainen view and gilroy.

65 at half moon bay. this is a nice view over the bay. it's 61 degrees at santa rosa. 62 at livermore right now. and at the golden gate bridge. traffic is flowing freely under mainly blue skies. niece are the forecast features. rain returns late tomorrow into the evening hours and overnight, perhaps into early thursday morning. warming trend begins friday. probably good news for many us. and warmer this we could. feeling like summer. overnight look for increasing clouds with low temperatures mainly in the mid-to upper 40s. however up in the north bay valleys it's a little bit chillier with low temperatures in the upper 30s. then tomorrow under increasingly cloudy skies in the early part of the day but becoming bright are in the afternoon we'll see high temperatures ranging from up are 50s at the coast to right around 60 degrees near the bay shorlen. inland locations warm up to the low to mid-60s. and the rain coming our way, well it comes tomorrow night. and it ranks one on the impact

scale. a storm of light intensity. light rain and showers less than a third of an inch of rain to likely in most locations. snow levels will be down to 3,500 feet as a bit of cold air accompanies the storm. forecast animation starting the noon tomorrow shows the surge of moisture push on shore off the north bay late afternoon early evening. later in the evening and during the nighttime we see it spread to other parts of the bay area. pretty much out of here before the commute begins on thursday. we may have wet spots lingering on the roadways. but not raining during the morning commute. notice most electrics receiving one thirtd of an inches of rain from the system. mainly lit rainfall. then the big warm-up starts free. three-day warm-up. highs in the mid-to upper 70s. saturday get a bit warmer. low 80s in the inland areas. perhaps even a draeg or two warm

at 5:00. and here are the other stories making headlines at 4:30. the gates opened for a's fans celebrating the 50th year at the coliseum. sky 7 is live above the stadium as fans head in to grab prime seats two and a half hours before the game. the a's gave away 200,000 free tickets. they expect about 70,000 people to show up. and an engine exploded op a southwest plane 32,000 feet above philadelphia. abc news video tweeted video from inside the plain. the plane was able to land and one person is dead identified as jennifer reareden an executive with wells fargo in new mexico. seven others were hurt. abc 7 news tweeted that 15 people were injured in an explosives fire in san jose. four of them were hospitalized. people were trapped on the third floor. many had to be rescued. 100 people have been displaced. new at four the san francisco

board of supervisors voted unanimously to regulate the scooters flooding the city. katie utehs is live at city hall to tell us what the vote means. katie. >> reporter: ama, supervisor aaron peskin says the scooter saga could have been avoided. the city felt blind-sided when scooter companies rolled out the products before the city could pass regulations. >> they have behaved like a bunch of spoiled brats. >> aaron peskin is scolding the scooter companies that inundated the san francisco sidewalks. he introduced an ordinance in early march but the scooter companies laufrmd before the regulations made their way through city hall. >> byrd and a couple of other companies conducted themselves in a brash and immature manner. hopefully they'll belly up to the bar and we will work it out. >> without objection the ordinance passes unanimously on the first reading. >> supervisors voted nanszly monday to regulate. forwarding the ordinance to the
