california man spent more than two decades on death row released after charges were dismissed. >> let's get to abc news anchor eric thomas life with the story at sanity kwentent. >> the 68-year-old vincenta ben a individuals is froh since bill clinton was in the white house. he met up with family members for a tearful reunion a few feet behind me about an hour ago they let him go. plets show you what was going on. it was tearful, emotional also something he had never seen before obviously, after going in prison in 1993, there were lots of selves with his family after he got out. as you said, he was convicted back in the yerl early 90s in the death of his girlfriend's 21-month-old daughter. he was accused and convicted of sexually assaulting and killing her. the sexual assault posing the basis of the special circumstance they needed to put him on death row.

after appeal by the habeas corpus legal resources foundation they said -- they made this statement late today. >> of course we are elated by the fact that he is released today. he was wrongfully convicted over 25 years ago and we are very grateful this day finally has come. he will not make statements for the press. i don't have any further comment. >> he did not make statements to the media. mr. civitz made the kpen for -- that's sisson. the hapious corpus legal resource foundation is a -- is an implement of the state court system. any handle appeals in cases like this. however, dan, as you mentioned, the d.a. in kern county has not said that she thinks he is innocent, mr. benavides in this case. she has simply said part of the case breck down based on medical testimony about the sexual assault and when that broke down that caused the state supreme

court to throw out all of the convictions and based on the age of the case and some of the specialized medical testimony she wasn't sure she could get another conviction. therefore she decided not to retry the case. that means of course that vincenta benavides is a freeman but that leaves questions about his guilt or innocence. what we know is that based on what happened in the opinion of the state supreme court there was insufficient evidence for him to be on death row. live at san quentin. abc 7 thomas abc 7 news. >> thank you. some 25,000 union works in the university of california system may walk off the job soon. the american frags of state county and municipal employees announced today 97% of the members voted to authorize a strike. the union claims its reached an impasse in contract negotiations after a year of bargaining. they are also calling on speakers to boycott upcoming uc events including graduations.

until the zut is resolved. >> while we are talking about higher education we'll turn to a problem more common than you might think. college students with no place to live. advocates say it's time to think about tent cities to help deal with student homelessness. the numbers cloim everywhere but the issue took center stage at san jose state university this afternoon. abc 7 news reporter chris wynn is on the story. getting a bachelors degree is a riot of passage for many in but at san jose state university there is a growing issue weighing on some. >> i didn't want people to know i'm home zblools this student spent part of his year in college living on the streets of san jose. >> it was painful 37 it was like -- it's like you fear -- you fear your for your life every day. >> a study conducted by the california state university system found 13.2% of sjs students experienced some form of homelessness in 2017. >> it's confusing, embarrassing.

you as a student do not want to be perceived as weak. >> as the price of tuition and room and board go up students are turning to places like the university as library for shelter overnight, some sleeping outside. >> i have several students homeless right now. i have a student here living in a church >> that's why the sjs student housing alliance is proposing a legal encampment on campus similar to the ten city erected at seattle pacific university last year. students proposed the idea to rally this afternoon. sjsu president mary did not attend. but saying sjsu is in active discussion was regional and community stake holders. student experience will guide our work. the university said it created a problem to help students in need and secured a grant to fund a permanent food pantry and emergency housing services. students across campus hoping the university will do more. >> we are encouraging them to work alongside with us.
