elissa harrington live at notre dame high school in san jose with more on what they're doing there. good morning, elissa. >> reporter: good morning. today's walkout renews the call for stricter gun control and marks the 19th anniversary of the columbine school shooting. i'm here at notre dame high school where about 100 students are expected to participate. i'll show you video from a similar walkout that happened last month inspired by the parkland school shooting. looking at students in menlo park. today students will march to city hall, hold a rally, also hold a moment of silence. the students want to call attention to gun violence and call for stricter, sensible gun control laws. students at notre dame plan to leave their classes at awe round 10:00 a.m. live in san jose, elissa

harrington, abc 7 news. a man who spent nearly 25 years on death rojas been set free from san quentin. >> ben veet tez was sentenced to gegt in 19923 for sexually assaulting and killing a toddler who was his girlfriend's daughter. this week the kern county distict decided not refile charge z because medical testimony about the toddler's injuries and whether she was sexually assaulted fell apart. the da still thinks ben veet tez is guilty of murder. >> i believe he did kill a child, inflicted blunt force trauma on this child. >> they don't have evidence beyond a reasonable doubt that he's guilty, so therefore, he's innocent. >> under state law he's now eligible for services like housing assistance and job training. police took three suspects into custody a short while ago. it happened near sierra road. those suspects were wanted for armed robbery.

they went into a home and barricaded himself for 12 hours. everyone wanted in the case is in custody. police arrested d d andrew mund, a fourth grade teacher. police say he talked online with the undercover officer who was acting as a girl under 16 years old. charges are expected to be filed. prosecutors are asking who might be a victim to contact them. new developments this morning. governor brown named a new head of the veterans home of california in yountville. a hospital executive from southern california is the new administrator. the complex is home to about 1,000 disabled and elderly veterans. it's the biggest facility of its kind in the nation. the brother of stephon

clark, shot and killed by sacramento police, have been arrested. police arrested disrupted a city council meeting and told the mayor to shut up. in a video posted on clark's facebook page, he was seen carrying a dagger and a machete saying, quote, i want the mayor, i want the chief. his girlfriend sought a restraining order against him on wednesday. passengers aboard the southwest jet that exploded over central pennsylvania on wednesday are receiving apology letters and money. passengers receiving a $5,000 check and $1,000 vocher from the airline. the airline says its primary focus and commitment is to help passengers in every way possible. happening today, a record crowd is expected to descend upon golden gate park in san francisco to celebrate the international pot spoker's

houston. this is on twitter. look closely here. look at all those flames coming from the truck. that's the moment the 18-wheeler burst into flames. still looking for information on how many vehicles were involved in the crash and how the driver of the semi is doing. a controversial statue will remain in san francisco's civic center. city board voted to overturn a decision to move the early day statue into storage. it shows the native american man at the feet of a cowboy and a catholic missionary. last week the historic preservation commission sided with people demanding it be removed. opponents call it racist and the demeaning. a s after months of delays, city college of sfrachb has finally received the first payment for its program that provides free tuition to all city residents. "the examiner" reports the

significantly. yesterday 65 and comfortable. 72 today, still pretty comfortable. hayward and redwood city about six degrees warmer. in san francisco, three degrees warmer at 64. that's close to average, this high pressure dominating our forecast. this clockwise flow pushing the storm track well to the north and the low well off to the east that brought the rain to southern california yesterday. trying to break out the microclimates. we need to. a six-degree spread from 71 in milpit milpitas, gilroy at about 77 degrees. a little narrower on the peninsula. 66 at millbrae. everybody else around 70 degrees. narrowest at the coast because of hazy conditions and breezes prevalent. low 60s for you, mid 60s downtown, south san francisco and sausalito. 78 in ukiah and along the east bayshore. how about upper 60s to low 70s.

however, the damage is done, you are back beyond highway 4 and a new accident southbound 101 near cass tanya, slowing from about east washington in petaluma in the southbound direction. happening today, a federal judge will hold a hearing to decide whether stormy daniels's lawsuit against michael cohen and president trump will be delayed. the adult film star is asking a non-disclosure agreement regarding an alleged sexual encounter between her and mr. trump be resolved. attorneys for the president and cohen will ask to delay the suit due to the on going criminal investigation of cohen. the president has long denied any allegations of an affair with daniels. apple is working on a new way to make your iphone more intuitive. the company received a patent for technology to automatically adjust the brightness of other phones. the new tech uses sensors to detect the light of your

50s to mid 60s. >> we have a car up in smoke, no kidding. no pun here. it's at the san mateo bridge toll plaza. if it looks hazy there, that's why. it's in the eastbound direction near the toll plaza. apparently the person in the call has a fire extinguisher, so fire has been called, but in the meantime they're trying to get the fire out. you can see slow traffic in the westbound direction as well, 22 minutes from 880 towards 101. overall, your traffic looking pretty good. we'll check on an accident leaving petaluma, southbound 101 in a few minutes. richmond police still investigating a deadly shooting outside a convenience store. police were outside the scene at the stop and shop on carlson boulevard. in this video, you can see the car has shattered windows. it is right outside the store. richmond police have been very tight-lipped on what's happening

there. i want to let our viewers know that our news room has been calling throughout the newscast. still waiting for an update. this is important because nearly five months went without a homicide in richmond. now police have been dealing with four so far in just this past month alone. so we are watching for any updates. i'll let you know as soon as those come in. matt? >> thank you, jessica. happening today, relief for those of us who travel across the richmond-san rafael bridge. >> the third lane of the eastbound side of the bridge will finally open at 2:00 p.m. today. abc 7's amy hollyfield is live in my hometown of san rafael. >> reporter: good morning, natasha. a lot of excitement about this lane. they're already setting up for a ribbon cutting ceremony. several dignitaries will be here. this ceremony set to start at 9:00 this morning. this is for eastbound traffic as people leave marin and head home

to the east bay. that backup is known to stretch all the way to highway 101 and clog neighborhood streets. so marin residents are just as happy as commuters are about this opening. the lane will be limited. it will only be open from 2:00 to 7:00 every day. that's because they still want to have a shoulder when they can for emergencies. this lane is three years in the making. so there is a lot to celebrate here today now that it is finally going to be open. do keep in mind, people who drive in the lane when it isn't open will be subject to getting a ticket. live in san rafael, amy hollyfield, abc 7 news. new details about the judge in the brock turner case. judge aaron persky is speaking for the first time about the campaign to e are call him. persky spoke with the mercury news and says he supports the movement to improve how the criminal justice systems treats sexual harassment victims. that recalling him does not help the cause. the campaign has been fighting to remove persky for handing

down a six-month sentence to brock turner. critics say it was too lenient. a measure to recall persky will be on the june ballot. persky says if the recall is successful, don't cry for me or the judges of slount but cry to some extent for the criminal justice system. two men charged in the ghost ship fire are due in court. derick almena and max harris are charged with ignoring obvious safety codes. the fire in 2016 killed 36 people. both men remain in jail. they're scheduled to go on trial on july 16 pgt. alme almena's wife has given an exclusive interview, micah allison says she doesn't know why her husband is charged with involuntary manslaughter in the deaths of those 36 people. >> i don't believe what happened that night is the fault of derick or max. >> whose fault is it? >> i think it was a terrible

minutes away from my accuweather forecast. temperatures compared to 24 hours ago, everybody is warmer, especially inland. look at fairfield and antioch and concord, eight to 11 degrees warmer. that's where the warmth is going to be spreading from east to west. it's still chilly in some neighborhoods this morning. let's start on the peninsula where we've got 40 in menlo park. then you go up to san bruno, it's 50. most of us in the mid to upper 40s. mid to upper 40s east bayshore. 48 in san jose. 50 in concord. san ramon 42. san rafael 49. san francisco 50 where we've got this gorgeous view. there it is, sun coming up over treasure island. that is actually the bay bridge, not the san mateo bridge. a look at the commute planner. it's really patchy. it's out there but not a big deal. glowing shine on the bay. it will be much calmer than yesterday. mass transit cool to mild to even warm this afternoon.

split. hopefully this afternoon we'll see a difference. these are the fast trackers, these are the cash lanes. you're seeing some slowing approaching the toll plaza. give yourself a little extra time. it's about a seven-minute drive across the span once you're on the span to get towards marin county. earlier accident out of lanes now, this is southbound 101 near kastania. they finally reopened the new highway configuration. it's a beautiful drive. good luck with that. it's nice to see that work finally paying off after all these years. new developments in san francisco's effort to confiscate those illegally parked dockless scooters. they took 159 more scooters off the sidewalks yesterday, that's on top of 130 scooters picked up in the last two weeks. the scooters were deployed

throughout the city last month by three companies. mountain lion sightings are on the rise in the bay area. a suspected citing in san mateo caused two schools to shelter in place. a parent reported seeing one near fern wood and 36th avenue. no mountain lion was found by police and wildlife officers. a mountain lion was recorded by a home security camera in the san jose in the eastern foothills of the alum rock area. neighbors have been alerting yeech other on social media. >> we love to walk in the evenings because we have beautiful views. right now we're steadfast and we just stay more or less around the grounds. >> wildlife engs perts believe mountain lions may be leaving nair habitat in the undeveloped hills in search of food for their cubs. a tattoo could one day save your life. how medical researchers are using these. nasa releases stunning new images from the hubble space telescope as it celebrates a

these are students in menlo park who took part in the walk out inspired by the parkland students. this is also to protest gun violence and to call for stricter gun control, but it's also to mark the anniversary of the columbine shooting on april 20th, 1999. it's been 19 years. students want to call attention to gun violence but also remember all those lives lost in columbine and other mass shootings. what we know is planned this morning is they will hold a moment of silence, then make speeches on the steps of city hall. again, this is a national walkout. several schools in the bay area are also taking part and it begins at 10:00 a.m. live in san jose, elissa harrington, abc 7 news. this was the aftermath of a wild day in the north bay. police say this man in handcuffs, 47-year-old matt

hermsmire stole a beer truck. the truck driver was inside the store when he jumped in the truck and took off. the truck had gps so police tracked it down within minutes. at one point the man ran across highway 101 before finally being taken into custody. the commissioner of the philadelphia police department is apologizing to the two men arrested at starbucks last week for how he handled the incident. >> my apologies to them, the police officers and everybody else in the city. i kpat bated the situation with my messaging, real simple. >> originally the commissioner said his officers didn't do anything wrong. he says she should have said the officers acted within the scope of the law. new this morning, north and south korea have set up a hotline between their leaders ahead of their summer next friday. this is the first ever phone line between the two countries that are still technically at
