toll plaza. maybe take a picture of this because it's not going to look that good for long. those metering lights will come on about 5:20 this morning. that's when things start to stack up through the maze. some delays starting to build on the central valley, westbound 580, tracy to dublin, southbound 680 dublin to mission boulevard looking great at 14. 101 to cupertino also great at 16 minutes. an update on earlier issues in the south bay up next. we're tracking the latest ruling on daca and a big legal setback to for the trump administration. >> a judge ruled that new applications have to be allowed for the daca program. abc's matt keller live in san jose. >> reporter: reggie, the city of san jose has been a big supporter of daca, helping dreamers file their paperwork and also filing lawsuits on their behalf. now the federal courts are helping them out as well. this comes as a federal judge made a ruling that the trump administration has to reinstate

the program. it started in 2012 under president obama. daca protects about 700,000 undocumented immigrants from being deported, most of them brought to the u.s. as if the ruling stands, it would require the administration to accept requests from first-time applicants. the decision to end daca came in september with the trump administration saying it would phase out the program over six months. lawsuits followed including one from the city of san jose. leaders here have also offered scholarships to help dreamers fill out their paperwork. live in san jose, matt keller, abc 7 news. >> albany high school students who posted racist photos on social media are being awarded more than $500,000 from the district. >> for the first time parents are confronting the school board bout the settlement. abc 7's kate larsen was at last night's emotional school board meeting. >> that's what those images meant to you, they meant money?

>> parents are furious over lawsuits the district settled to the tune of $400,000 and counting. that money is going to students who posted racist images of other students on instagram last year. >> images of herself compared to a gorilla and her friends with nooses tied around their necks. >> it was comparing her to an animal. >> 12 students and a teacher were targets. after albany high administrators found out about the racist images, they along with the school district took inappropriate disciplinary action against the posters, one of whom was punched in the face by another student. >> there was a lot of ruckus. they were escorted, almost berated through a crowd of students. >> it should have been handled in a more structured way. >> reporter: the attorney representing six of the students suing the albany unified school district, his clients were involved in the instagram

photos. >> i don't think they should discipline them at all. it was outside of school amongst students on a private account. >> in an open later a group of parents listed demands, including each of the students targeted by the instagram posts $80,000, the same amount some of the instagram posters are receiving. kate larsen, abc 7 news. developing in concord, a fire at an apartment building under construction is still smoldering more than 24 hours after it started. this was a live look right now. you can see it for yourself by galindo street and concord boulevard. the fire department is worried more of the building will tumble. hundreds of people who live in the building next door have been evacuated. abc 7 news reporter amy hollyfield is at the scene. a new state safety finds the california university system has done a poor job protecting

students and employees against hazardous materials in labs. allegations of an asbestos coverup at sonoma state university. sonoma state was among four schools with on going problems. the audit says the csu chancellor's office has repeatedly ignored safety recommendations by the auditor. >> i want to show you brand new video coming in overnight of the suspect accused of shooting two dallas police officers and also a security guard. police arrested this man, 29-year-old armando juarez late last night. he pleaded guilty for stealing a car and wanted for skipping a sentencing hearing in february. police say he tried to fly when they tried to stop him. he made national headlines and

that is when a manhunt started, eventually ended in a neighborhood. both injured officers and that home depot guard, by the way, went through surgery last night. their conditions have not been released. i will keep my eye on things this morning. back to you. the investigation continues into the shooter who killed four people at a waffle house near nashville. >> the hero is credited for preventing an even bigger tragedy. >> james shaw, junior, was honored in an emotional ceremony at the tennessee capital yesterday. he said he hid behind a door in the restaurant and when the suspect went to reload, he grabbed the barrel of the gun. he threw the gun over-the-counter and forced the suspect outside. >> i didn't actually do it to save people. i did it just to save my life.

was trapped under the car. people banded together to lift the car off the victim. four people sustained serious injuries. none of them is considered life-threatening. the malibu went onto a sidewalk after another vehicle bumped into it. >> it gives you heart and hope that everyone banded together. a new campaign officially under way to ban plastic straws and other disposable foodwear. an ordinance a was introduced that would require restaurants to use reusable items. one business ahead of the curve is san francisco's taco licious. the restaurant estimates it used more than 600,000 straws at its five restaurants. >> they're so little, no one thinks about an impact. it's such an easy thing to do to start drinking your margaritas,

tenured professor and can't beee fired. she was acting in a private capacity speaking about a public matter on her personal twitter account. more than 50,000 people have signed a petition calling for her removal. attention online shoppers. are some of the reviews you see on amazon fakes? . despite amazon's attempt to stop paid reviews. they're popping up for popular items like bluetooth headphones, speakers and diet pills. "the washington post" owned by amazon ceo jeff bezos reports vast report appear to violate the prohibition on paid reviews. rebecca jarvis says there are things you can look for. >> look for the dates on the reviews. if you see a huge influx of reviews that are positive on the same day, that can be a giveaway

that they're paid. if there's reputation over the language, somebody says, i used this at the gym. that can be a giveaway. >> inauthentic reviews made up less than 1% of all reviews on amazon last month. we take forceful action against reviewers and sellers by suppressing reviews that violate our guidelines. take a look at your screen. we're hearing from the high school student who went viral after this goose attacked him on the course. the bird went wild last weekend protecting a nest on the golf course near detroit, chased after the high school player during a tournament. >> i think father goose was probably sitting in the pond behind me just watching over his wife or whatever, and as soon as we got close, he started flying toward us. >> the course has warning signs posted, roped off the area around the nest. >> what is even happening in what we're looking at?

more cooling. clouds return tonight. that means our lows tomorrow will be about the same as this morning. limited rain in the extended. dramatic drop in the temperatures. check out all these 50s around san francisco, from 59 downtown. the mission in south san francisco may get to 60. the rest of us going to have a very hard time. let's take a look at the east bay microclimates. oakland 64, richmond 62, union city and fremont 68. that's pretty close to average actually. santa rosa, now, these temperatures are a little bit below average. 67 there, novato 69. sonoma about 71. into the east bay, we're in the mid 70s for the most part. antioch 77, the warm spot. along the peninsula we'll have temperatures in the 60s. notice on the other side, on the coast, half moon bay 56, pacifica 54. last stop in the south bay. mid to upper 70 pete dass in sunnyvale.

overall, light volumes. develoing news this morning, hundreds of people still out of their homes after this massive fire in concord. >> we showed you flames 24 hours ago as they were happening. this morning firefighters are still monitoring that site. abc 7 news reporter amy hollyfield live in concord. good morning, amy. >> reporter: good morning, natasha. we still have fire. can you believe it? look behind me at this flare-up that just started. we've been seeing smoke all morning. this is the first fire we have seen. firefighters still putting water on this fire. this is about 28 hours after it started. no sign of this backing downey time soon. firefighters are worried that the situation is still dangerous. look at this scaffolding that collapsed yesterday. no one was hurt when this happened. it created a scare. firefighters are still being very cautious on the scene. >> we do anticipate potentially further wall collapses. at this point in time we're in defensive operations.

here is a look at the fire when it was really raging. they got the call just before 1:00 a.m. yesterday. this was an apartment complex that was under construction. this is at the intersection of galindo and clayton in concord. the building is a total loss. damage is estimated at $55 million. officials still have an evacuation order in place for the apartment building next door. this is the fifth fire at a housing complex under construction in the east bay in the past two years. three of those have been ruled arson. they don't know yet whether this was intentionally set or if it was an acciden. they are still investigating. they say they will have another update for us at 4:00 this afternoon. live in concord, amy hollyfield, abc 7 news. a peninsula community demanding answers in millbrae after gunshots terrorized the neighborhood during a wild party at an airbnb rental. >> you can hear it.

sunday morning a neighbor called police twice about loud music and noise. san mateo county sheriff's deputies came but there was nothing they could do until that gunfire erupted. party goers ran before authorities got there. last night residents urged the city council to make changes. >> if you feel this is important, please applaud. thank you. >> we are going to be looking at it very quickly because we cannot have this happening again. >> the city council said it will consider more formal regulations at its next meeting. airbnb told abc 7 news negative incidents like this are extremely rare. the company released a statement that reads, we have zero toll lance for this type of behavior and have permanently banned the guest from our platform. santa rosa police are looking for two men who tried to lure a 10-year-old boy into their band around 4:30 yesterday afternoon on brush creek road between badger and fistor drive.

two men am approached him and offered candy to get in. the child hid until the van left the area. it's described as a work-style van with silver trim. a three-hour standoff with police ensued yesterday afternoon after investigators say a man ran back to hide inside his home on coronado way. sky 7 captured dramatic images of s.w.a.t. officers smashing windows, even sent drones in to try to get the man to surrender. he was taken into custody without injuries. police believe the suspect was hiding in the attic. the company accused of falsifying soil tests is planning to hold a news conference to defend itself. the chronicle reports tetra tech ceo sent a letter insisting the work was done strictly by the book. tetra tech said the firm would
