23. san rafael into san francisco on 101, looking great at 16 minutes. a crash at 101 and 280 in san francisco. we'll head there next. we're tracking the latest ruling on daca and a big legal setback for t >> this time a federal judge ruled that new applications have to be allowed for the daca program. abc 7 news reporter matt keller live in san jose. >> reporter: the city is releasing the ruling. saying daca recipients employed here provide critical services to residents. daca was started back in 2012. this latest ruling by a most of them brought to the u.s. as children, the decision to end the program came in september with the trump administration saying it would be phased out over six months. lawsuits followed. the federal judge ruled on a lawsuit filed by the naacp and

princeton university. judge john bates says the trump administration has to resume the program. he gave them 90 days to restate its arguments before its order takes effect. if the ruling stands, it would require the administration to accept requests from first-time applicants. live in san jose, matt keller, abc 7 news. >> thank you so much. developing news in concord where a fire at an apartment building under construction is still smoldering mother than 24 hours after it started. this is a live look from galindo street and concord boulevard. the fire department is worried more of the building could collapse. hundreds of people who live in the building next door have been evacuated. albany high school students who posted racist photos on social media are being rewarded $400,000 from the school district. last night angry parents confronted the school board about the settlement. 13 students and one teacher were targets of instagram posts. high school administrators found

out about the images and says they took inappropriate disciplinary action against the posters. parents say they feel like they've been revictimized. >> we couldn't believe that the district settled with these families, and that's families claim their first amendment right to free speech, not saying it was hate speech or that it was a hate crime. >> i don't think the school should have disciplined them at all. this was speech that occurred spleetly outside of school on a platform not sponsored by school amongst students on a private account. >> in an open letter parents listed demands to the school district including compensating each of the targeted students $80,000. that a new state safety law fines the california state university system has done a poor job protecting students and employees from hazardous materials in labs and classrooms. the chronicle reports a santa rosa lawmaker asked for the audit after allegations of an asbestos coverup at sonoma state

university. the report found all 23 csu campuses are using hazard douse tooerls form instructional resource. sonoma state was among four schools with on going problem. the audit says the chancellor's office repeatedly ignored safety recommendations by the auditor. here are the moments before police arrested a man who they believe shot two dallas police officers and a home depot security guard last night. police say the suspect also fired at them during a chase across dallas. the manhunt started after a shooting at a home depot yesterday afternoon when officers tried to detain a suspect wanted for theft. both injured officers and a home depot guard went through surgery last night. their conditions have not been released. this is new video overnight of the suspected, 29-year-old armando juarez, he pleaded guilty of stealing a car and was wanted for skipping a sentencing hearing in february. the investigation continues into the shooter who killed

people at a waffle house near nashville. lawmakers honored the hero credited for preventing an even bigger tragedy yesterday. a standing ovation for james shaw, junior, who was honored in an emotional ceremony at the tennessee capital. he said he hid behind a door at the restaurant and when the suspect went to reload, he grabbed the barrel of the gun and wrestled it away from him. shaw threw the gun over-the-counter and forced the suspect outside. >> i didn't actually do it to save people. i did it just to save my life. in me saving lives, i saved other lives. that's probably one of the greatest things i think you can do. >> shaw started a gofundme page for the victims, and there is one for shaw as well. we have links to both of them on abc7news.com. it's 6:05 now. happening today the supreme court will hear arguments in the

look at this. eventually this image will restore your faith in humanity. a driver's dash cam captured the moment a chevy malibu crashed into the sidewalk. the people inside the car got out okay in washington, d.c. but there was someone in the sidewalk who got hit and went under the car. that is when this group of strangers quickly banded together and lifted the car off the victim. in all, four people sustained serious injuries. the malibu went on the sidewalk because another vehicle crashed into it. san francisco officials say car break-ins have decreased significantly throughout

outline to propose regulations of a public outcry. the san francisco transportation agency could approve the program by next tuesday. scooters left on sidewalks, drivers zipping in and out of traffic and also riding on sidewalks which is illegal have been causing a lot of problems in the city. san francisco has awarded its first private transit operator per met to cheriot. it serves up to 4,000 commuters a day. the city wants permitted private companies operate in a way that works on public streets. that means having handicapped accessible vehicles that don't block traffic and will train drivers. chariot may move stops and change routes to less busy streets to comply with city rules. we have great news about dark chocolate. a new study says it may make your smarter. abc's dr. jennifer ashton is

they're still spraying water on it. this is 29 hours after it started. it's been quite a battle out here. look at this scare they had yesterday. a five-story scaffolding collapsed. the fire department is worried more could come down. so they are in defensive mode. they're also worried about the residents who live in the apartment building next door. they still have an evacuation order in place for those residents. some tell us it has been difficult. >> affected my life pretty badly. my life is pretty much working for my business. i guess until my living place is well settled down, our business will be affected, too. >> reporter: the fire was called in right before 1:00 a.m. yesterday. this is an apartment building that was under construction at the intersection of galindo and clayton in concord. two people are hurt in this fire. they suffered from smoke inhalation. investigators don't know whether this was arson or an

market, watching comcast stock. the media giant just made a $30 billion bid to buy london tv operator sky. it's a really big deal. stocks are up this morning for comcast. i want to show you here on my computer. they're at more than $33 a share. that is up more than 1% right now. comcast's bid for sky tops the bid made by 21st century fox, and sky already responding this morning, and it's withdrawing its recommendation to shareholders to accept that fox bid that was made earlier after this comcast bid came down just this morning. so stay tuned. it could go to comcast. back to you. attention online shoppers. are some of those reviews you're reading on amazon actually fakes? a new report says yes. despite amazon's attempt to stop paid reviews, they're still popping up for popular items like bluetooth headphones,
