a shocking allegation is coming from within the st. clair are a sheriff's office that top brass delayed an arrest so they could get better media coverage. dan noyes has the investigation. >> reporter: this 45-year-old will be arraigned on three felony counts this coming monday. the teacher from broadway high school is oaccused of molestinga 12-year-old girl at a smamath c last summer. >> and he was also associated with a little league team. >> reporter: matt payton was the primary investigating officer on the case. he tells me he knew he was under

arest before the arrest on payton considered him a flight risk. >> there were several things running through my mind as potential hazards and the desire for me to pick him up immediately was very strong. >> reporter: paytoot a 3 oo $300,000 warrant and scheduled the arrest. the surveillance team in place. but the arrest was called off. >> we were going for wait until the following monday because monday was a better press day. >> reporter: payton tells me he was outraged and didn't hide his feelings about the decision even though he thought it came from sheriff laurie smith herself. >> i know for a fact that she was already aware of my investigation previously because the school district was involved. >> reporter: bob powell is payton's attorney. >> to put the priority of having a good press day, and i know the election is coming, it's unfathomable, it's despicable. there is no excuse. >> reporter: i contacted the sheriff to arrange an e-mail,

but they said the assertions are false and the interview request is denied so as to not give any additional kree debs fcredence allegation. so i found the sheriff at an election event. i'm reporting on a complaint that your office delayed the arrest for media purposes. >> that has already been looked at. i think we've communicated with your channel. >> reporter: it's not true? >> no. >> reporter: this detective is on the record on camera, he shows me some texts as well that says that it is true. >> it's not. >> reporter: detective payton provided text messages from the arrest team that friday more than. they request photos of the suspect and answer, got them, thanks. less than an hour later comes word that the arrest is off till monday, sorry, not my call. payton fired off this e-mail to his supervisors later that day. i feel it would be negligent to leave a child molester free for any amount of time. i understand the desire for

positive press, but i don't feel that justifies withholding action. the arrest finally came that tuesday, it received wide media coverage. >> there are reasons sometimes to delay serving an arrest warrant, but media attention would not be one of them. >> reporter: former san francisco police commander headed the sex crimes unit. he is now a professor and co-chair of the usf law enforcement leadership advisory board. >> if it is that straightforward that someone said let's wait for a better press cycle, then that is wrong. and it is not acceptable. and someone should be answering for that. >> reporter: matt payton tells mebullying and retaliation for challenging the delay. he is now on paid administrative leave for trying to document the treatment he received. >> he is on paid administrative leave for allegations that he improperly recorded a conversation with a superior officer. and that is the full extent of it. >> reporter: payton says speaking out now has nothing to do with politics.

>> honestly i despise politics. i just wanted to be a good cop and take bad guys to jail. that's what i love to do. >> reporter: the sheriff's department would not address payton's status saying it is a personnel issue. for the iteam, dan noyes, abc 7 news. now to the latest developments in san francisco's motorized scooter invasion. a crew from public works was out picking up scooter blocking sidewalks. so far the city has con physi cd 450. earlier this week the transportation agency agreed on a pilot program to regulate the scooters. seniors in one san francisco neighborhood will now be able to cross the street without feeling a panic. yesterday the city officially opened a new mid block crossing signal at fulsome south of market. the corner is near living community. and some residents said crossing the street was a frightening

in the way of high clouds out there. and looking at a breezy and cool weekend with spotty drizzle likely tomorrow. so we enjoyed some 80s yesterday, but as we look at our afternoon highs tomorrow, notice that we are in the 70s and that system will allow for those breezy winds. 60s on the coast, 50s around half moon bay. yesterday it was 59. but we had the low 80s inland and as we look towards our beach forecast, you will notice that temperatures are going to stay on the cool side, 58 ocean beach, looking at 59 half moon bay. warmer in santa cruz, we'll call it partly cloudy, ocean temperature has dropped off to 53. so certainly chilly out there. looking at the cindo de mayo festival today with 53, cloudy skies sfwr skies san francisco noontime. low 60s, breezy throughout the afternoon here. and then temperatures dropping back into the 50s. looking for something else on

the agenda? in mountain view, a la carte from 10:00 to 6:00 today and tom, looking at partly cloudy conditions, 60s to low 70s with a light wind. and slightly breezier tomorrow, but we'll get in to more sunshine after the push of low clouds and fog in the morning hours. so in terms of the highs today, temperatures cooler than yesterday. you will notice the clouds around. 62 downtown, upper 50s at the coast, 71 in san rafael, redwood city for you you head inland, we have the mid-70s from livermore to san jose. so five degrees cooler than yesterday. and overnight lows with the cloud cover perhaps some drizzle along the coast, it will be patchy. so a little damp to get your sunday going. 51 oakland, some upper 40s in the north bay. and the accuweather 7 day forecast showing 70s inland, so cooler for you. 70 at the coast. mid and upper 50s shoreline through the weekend.

that trump has spoken to the gun lobby. the nra spent more than $30 million to help elect the president in the 2016 election. former president george h.w. bush has been released from the hospital after fighting off an affection. the 93-year-old was admitted on april 2 shortly after funeral services for his late wife barbara bush. the former president suffered a blood infection and was in the intensive care unit. bush's doctors say the former president is doing well and his spokesman says he is happy to be at home. time is 5:35. happening today, san francisco will honor the late mayor ed lee by plantsing a tree dedicated to him on what would have been his 66th birthday. hiue,lymi fa ceremony. the magnolia tree will be planted on a newiaed mn city hall. mayor mark ferrell says the tree will serve as a reminder of lee's enduring legacy of positive change. lee died in december of a heart attack. 50 years ago, people's park

was the site of anti-war protests, now a haven for the homeless and drug users. soon uc berkeley plans to build housing for homeless and students, but it is a controversial plan. story. >> reporter: peoples park was born in the late '60s out of opposition of government policies, it was part of the free speechco-founder says it a will be. >> probably the only place in the country that you can go sign up and have a rally and say what you want. >> reporter: that is why he opposes plans to build university housing on the site. but students and neighbors say the park is more synonymous with crime and homelessness now than free speech. >> it is pretty dangerous oftentimes get a lot offal alerts saying that there is armed robberies that happened. so it gets the students especially at nighttime. >> reporter: currently only a small percentage live in the few

housing spots. the university says this plan would change that and more. >> we can put up student housing, we can meet the university's responsibility to work with the city and address the homeless situation, we can take a major step in terms of combatting crime and revitalizing that neighborhood. >> reporter: uc berkeley currently has about 8,000 student beds on on campus, this is part of the plan to double that. the people's park plan calls for building enough housing for 1,000 students on the three acre site as well as up to 125 permanent housing units for the homeless. the money would come from private developers working with the university. berkeley's mayor is on board. >> the people that passionately disagree with this, i've heard from some of them, but i think the majority of the city is ready. >> reporter: but some of the homeless worry that they are being blamed for problems in the park and this is a plan to move them out. >> you can say that it is a bad park all you want, but if you are around long enough, have the

and we'll call it a little breezy coast side, a cooler day today. tomorrow though we'll see more sun after that fog burns off. it will be thick to start out with some drizzle and mist and then by monday, it looks like high pressure is building back and we'll see return to more 80 degree temperatures. so as we look at our roof camera, another nice vantage point here, we'll see sunrise at 6:03. and temperatures around the bay area pretty mild, but the cloud cover is with us. and that means that it will take a while for it to thin out. here is live doppler 7 and it is mostly cloudy skies. and you can see a little bit more enhancement here off the coast. and this is the system that won't bring us rain, but it is pushing to the noorth. a stronger onshore push tomorrow. maybe mist and drizzle. and knocking the temperatures down. but also clearing us out better by your sunday afternoon.
