it's saturday, may 5th. thanks so much for joining us. i'm chris nguyen. let's start with a first look at the forecast. lisa argen is tracking the conditions. question start owe start ou doppler 7. the clouds will allow for a cooler weekend. there is a system offshore that will allow for a stronger offshore flow, a few clouds around and cooler highs. it is 58 in concord, 55 in police a pleasant hill. and so if you are spending time cindo de mayo in san jose,

mid-60s with some sunshine at 11:00. by 3:00, partly cloudy, mid-70s, a cooler afternoon. and by 7:00, we still have partly cloudy skies. the rest of us will enjoy some filtered sun through noontime with 60s around the bay and by the afternoon, we will see a little sun. but it is going to be cooler. around the bay just upper 60s with mid to upper 50s at the shoreline. so we'll talk about how long this cooling trend lasts and a look at the first full week of may coming up. a bay area couple burned out in the north bay wildfires is now in danger in hawaii. they moved to the big island after the october fires, but their new house is in the path of kilauea. katie utehs has the latest developments. >> reporter: a stunning view from the sky. then this destructive look from street level as hawaii's kilauea erupts. a family who relocated to the big island from santa rosa following the north bay fires

shared this video. they never expected to be in the path of a natural disaster again. accompanying earthquakes are registering more than 2,000 miles away. >> magnitude 5 was here. >> reporter: and then later friday, the largest so far. a 6.9 magnitude quake. >> this is the beginning of the big earthquake. >> reporter: uc berkeley seismology equipment is in the hills behind the botanical garden and it can detect earthquakes worldwide. >> our instruments can measure anything that is magnitude 5 or 5.5 or greater. >> reporter: kilauea has been active since the '80s, but rarely threatens homes. >> could something bigger come, yes. do we know, no. >> reporter: toxic gas is a big concern. some 1800 have been evacuated. katie utehs, abc 7 news.

united and hawaiian airlines are allowing passengers to change flights without paying a fee. and a speed climber has undergone surgery after falling. a medical helicopter air lifted him to a fresno hospital yesterday morning where he was operated on and is now recovering. he runs a climbing gym in concord. this morning a 15-year-old girl is recovering after being bitten by a small rattlesnake. it happened on mount davidson court in the dana hills neighborhood just before 5:00 p.m. yesterday, police and firefighters were called to the scene and paramedics treated her on the spot before going to the hospital. happening today, you can turn in your gun and get cash no questions asked.

a gun buy back event is being held near the police department on maple street. anyone who surrenders a handgun, shotgun or rifle will get up to $100. people giving up assault weapons will get to $200. put the unloaded weapon in your trunk and drive up to the event. more details at abc7news.com. and gilroy's police chief is explaining how he became a victim and how he violated the law and his own department's policy. the chief's truck was stolen from modesto junior college parking lot on april 27. he says the decision to leave his badge and gun in his personal vehicle when attending a junior college graduation ceremony was made when he saw metal detectors at the event entrance. he did not want to draw attention to his job as a peace officer, so he left his gear in the truck but not in a lockbox as required by state law.

disgusted. >> reporter: she is reacting to stunning news about the murder of her friend, martha moxley. moxley's case drew international attention. michael skakel was convicted bludgeoning moxley to death with a golf club when she was 15. but on friday the connecticut supreme court reversed the conviction which had been upheld by the same court just two years ago and ordered a new trial. justices ruled that skakel's former defense attorney failed to produce evidence. her childhood friends say that she was one of a kind. >> i don't think that she ever met someone who didn't become her friend. >> reporter: robert kennedy jr. wrote a book about it. >> i'm very happy.

you know, michael's been through a nightmare. he's innocent. he should never have gone to jail. and we're happy that he's finally getting some justice. >> reporter: the decision comes as a blow to moxley's mother. >> i'm so convinced that he is guilty. i don't think that there is any question about it. >> martha didn't deserve this. >> reporter: christine hopes moxley's family can endure another trial. skakel was released in 2013 after spending more than a decade in prison. cornell barnard, abc 7 news. for the first time ever, nasa launched an inter-planetary mission from the west coast. a rocket destined for mars lifted off near santa barbara. >> three, two -- >> the rocket is carrying the mars insight lander which can dig into the surface of the red planet, something nasa has never done before.

a shocking allegation is coming from within the st. clara sheriff's office that top brass delayed an arrest so they could get better media coverage. dan noyes has the investigation.

>> reporter: this 45-year-old will be arraigned on three felony counts this coming monday. the teacher from broadway high school is accused of molesting a 12-year-old girl at a math camp last summer. >> and he was also associated with a little league team. so he was around children constantly. >> reporter: matt payton was the primary investigating officer on the case. he tells me he knew he was under investigation before the arrest on payton considered him a flight risk. >> there were several things running through my mind as potential hazards and the desire for me to pick him up immediately was very strong. >> reporter: payton got a $300,000 warrant and scheduled the arrest. the surveillance team in place. but the arrest was called off. >> we were going to wait until the following monday because monday was a better press day. >> reporter: payton tells me he was outraged and didn't hide his feelings about the decision even though he thought it came from

sheriff laurie smith herself. >> i know for a fact that she was already aware of my investigation previously because the school district was involved. > reporter: bob powell is payton's attorney. >> to put the priority of having a good press day, and i know the election is coming, it's unfathomable, it's despicable. there is no excuse. >> reporter: i contacted the sheriff to arrange an e-mail, but they said the assertions are false and the interview request is denied so as to not give any additional credence to the allegation. so i found the sheriff at an election event. i'm reporting on a complaint that your office delayed the arrest for media purposes. >> that has already been looked at. i think we've communicated with your channel. >> reporter: it's not true? >> no. >> reporter: this detective is on the record on camera, he shows me some texts as well that says that it is true.

>> it's not. >> reporter: detective payton provided text messages from the arrest team that friday morning. they request photos of the suspect and answer, got them, thanks. less than an hour later comes word that the arrest is off till monday, sorry, not my call. payton fired off this e-mail to his supervisors later that day. i feel it would be negligent to leave a child molester free for any amount of time. i understand the desire for positive press, but i don't feel that justifies withholding action. the arrest finally came that tuesday, it received wide media coverage. >> there are reasons sometimes to delay serving an arrest warrant, but media attention would not be one of them. >> reporter: former san francisco police commander headed the sex crimes unit. he is now a professor and co-chair of the usf law enforcement leadership advisory board. >> if it is that straightforward that someone said let's wait for a better press cycle, then that is wrong.

and it is not acceptable. and someone should be answering for that. >> reporter: matt payton tells me he has faced bullying and retaliation for challenging the delay. he is now on paid administrative leave for trying to document the treatment he received. >> he is on paid administrative leave for allegations that he improperly recorded a conversation with a superior officer. and that is the full extent of it. >> reporter: payton says speaking out now has nothing to do with politics. >> honestly i despise politics. i just wanted to be a good cop and take bad guys to jail. that's what i love to do. >> reporter: the sheriff's department would not address payton's status saying it is a personnel issue. for the iteam, dan noyes, abc 7 news. now to the latest developments in san francisco's motorized scooter invasion. a crew from public works was out picking up scooters blocking sidewalks. so far the city has confiscated 450.

earlier this week the transportation agency agreed on a pilot program to regulate the scooters. there is game five of the nba playoff series. that means kendrick lamar concert will need to be pushed back one day. the star is expected to perform to a sell out crowd. today and tomorrow the world's best pro surfers will be in the central valley 100 miles away from the nearest beach for competition. the founder's cup will take place on a manmade lagoon designed by kelly slater. the 148 surf ranch is a one of a kind high tech wave pool, it uses 15 million gallons and is 2,000 feet in length. the machine made waves allow surfers to ride for 45 seconds each and every time, that is double the length of anything that they would find in the ocean.

saturday morning, live doppler 7, a lot of cloud cover out there and we have live pictures to show you. but also want to show you an incoming system that will really influence our weather today and tomorrow. this rides over the big ridge that is drifting off to the east. taking the heat with it. a stronger onshore push and cooler temperatures for the next few days. here is a look at sfo on, you can see the low clouds cover. 51 in san francisco, 53 oakland. mountain view 56, half moon bay in the low 50s. gilroy 55. emeryville, temperatures in the mid-60s today. average high in oakland is about 67. 49 santa rosa, 52 in and it will be breezy along the

shoreline. we have coastal fog, high clouds and a breezy and cooler weekend. spotty drizzle tomorrow morning as the system pushes to the north and east of us. and then we'll look at a warmer monday unfortunately. so tomorrow looking at temperatures very similar to today. but maybe even a few degrees cooler. so we have some 70s inland, but we do have more sunshine after a lot of low clouds and fog. now, this is tomorrow and as we go in to monday, look at the oranges come back into play in the inland valleys. that is the warmest numbers in the low 80s and by tuesday, it looks like another system will want tole could l cool us off. today at the coastline, it will be cool with clouds. a few peeks of sun and upper 50s from ocean beach to half moon bay. santa cruz about 70 degrees. so so it will be a nice afternoon, but on the cool side in san francisco with some sunshine throughout the afternoon for the cindo de mayo festivals with mid 50s. upper 50s by noontime.

low 50s 3:00. so grab the jackets and also on the peninsula, low 60s to low 70s. a la carte is today with the cloud cover and then tomorrow by the afternoon, we're in the 60s. it is a breezy day. is highs around the bay with some clouds at times actually for the most part we'll call it partly sunny, 76 in concord, 70 fremont. so average numbers in the low 70s peninsula and with that breeze, it is feeling cool in san mateo, 71 in san rafael. tonight looking at upper 40s to low 50s, even some drizzle along the shoreline. so it will be another gray start. the fog will be widespread for your sunday morning and then we'll clear it out with temperatures once again cooler than where we have been. this weekend 70s in-land, upper 60s to near 70 around the bay. 50s at the coast. download our accuweather app and you will notice the sun by late

and we are looking at temperatures by 11:00 to be in the upper 60s in the warmer locations, low 70s. in fact the cloud cover wants to thin out through the day, but it will take the bulk of the day to see some sun. and you will see the north bay a little brighter at times with 70 in concord, and right through the afternoon we'll work to decrease the cloud cover. but it will be another cool day for you on sunday. we'll detail that and talk about when we'll see a return to more warmth around the bay in the extended outlook. now to president trump and his personal attorney and the payment to stormy daniels. a story in the "new york times" says the president may have known of the payment to the adult film star months before he publicly denied it. tara palmyra has the details. >> reporter: a new report raising questions about when and when president trump knew about the six figure payout made by michael cohen to stormy daniels.

the new york times citing two people familiar with the arrangements reporting that mr. trump did know about the payment several months before denying having any knowledge of it on air force one. >> did you know about the $130,000 payment to stormy daniels? >> no. what else? >> do you know where he got the money to make that payment? >> i don't know. >> reporter: according to the paper it is not true when trump learned of the payments, but these new denials come as he tries to clean up the damage by another one his attorney. >> ruddy just started a day ago. >> reporter: rudy giuliani dropping that bombshell on fox news that trump repaid cohen for the $130,000 hush agreement made to cdaniels. >> the president repaid it. >> reporter: the next day trump backed up giuliani in a tweet. but by friday, he undercut giuliani's claims. >> he is learning the subject matter. he'll get his facts straight. he's a great guy. >> reporter: even standing behind those denials on air force one.

attack. 50 years ago people's park was the site of anti-war protests. now takes haven for the homeless and drug users. but soon uc berkeley plans to build housing for both the homeless and students. it is a controversial plan given the site's history. eric thomas has the story. >> reporter: peoples park was born in the late '60s out of opposition of government policies, it was part of the free speech movement. the co-founder says it always will be. >> probably the only place in the country that you can go sign up and have a rally and say what you want. >> reporter: that is why he opposes plans to build university housing on the site. but students and neighbors say the park is more synonymous with crime and homelessness now than free speech. >> it is pretty dangerous oftentimes get a lot offal alerts saying that there is armed robberies that happened. so it gets the students especially at nighttime. >> reporter: currently only a small percentage live in the few

housing spots. the university says this plan would change that and more. >> we can put up student housing, we can meet the university's responsibility to work with the city and address the homeless situation, we can take a major step in terms of combatting crime and revitalizing that neighborhood. >> reporter: uc berkeley currently has about 8,000 student beds on campus, this is part of the plan to double that. the people's park plan calls for building enough housing for 1,000 students on the three acre site as well as up to 125 permanent housing units for the homeless. the money would come from private developers working with the university. berkeley's mayor is on board. >> the people that passionately disagree with this, i've heard from some of them, but i think the majority of the city is ready. >> reporter: but some of the homeless worry that they are being blamed for problems in the park and this is a plan to move them out. >> you can say that it is a bad park all you want, but if you

breezy conditions. a stronger onshore push and that means more gray in the morning. today and tomorrow. but then by monday, another ridge of high pressure builds in and it is sunny and warmer. golden gate bridge right now, see the flag, it is a little breezy out there. but we will get into some sunshine. but not a whole lot because there is a system to the north of us that is allowing for the cooling trend. you can see the cloud cover right here offshore and it will influence our weather for the next two days. so we'll look at our computer animation and you notice hour by hour the clouds try to thin out, but look at the clock, it is 2:00 and we still have a good amount of gray. but by the later afternoon hours, we're working into some clearing. and then it all comes back overnight tonight. so we will be looking at the cooler numbers. it is milder to start though with all the cloud cover. look at that 57 in gilroy, 51 san francisco. mountain view at 56. and another shot with all the

cloud cover here from our east bay hills camera. santa rosa, 49. mid-50s for you in fairfield. 58 in concord. both airports yesterday we were well into the low 80s. average high should be low 70sr. we're close to that. coming down about four degrees today. but then look what happens on monday, another ridge builds in and we warm up temporarily. cooling back on wednesday, looks like the warmest days will be at the end of the upcoming workweek. so 76 today in san jose, so we'll thin out the clouds. low 70s in sunnyvale. on the peninsula, a little breeze throughout the afternoon with 70 for you. and this is about average for mountain view and redwood city. 70 in palo alto. upper 50s at the coast. a lot of cloud cover, but it will be getting a little brighter in the afternoon. 73 novato. east bay, mid-60s in berkeley.
