ramon valley high school in danville what she has learned about the incident. >> reporter: hello, dan and kristen. vrgs from the danville police are on scene examining the area of the pool behind me where the boy was found. he was discovered just after lunch in the deep end of the pool, just as a freshman p.e. class bass to begin. >> medical emergency at san ramon valley high school. this is for a student in the bottom of the pool. local county is on scene with cpr in progress. >> the 911 call came in just before 2:00 p.m. at san ramon valley high school. a male student was found at the bottom of the pool unresponsive. while police investigated a deficienter apparently used to try to revive the young man was sitting near the deep end. it was learned that the student was discovered at the start of a class as students lined up to jump into the pool they spotted

wynn spoke with the victim's plm and has more from the east bay. >> allen sunday woke up this morning with a broken heart. >> my wife loved everybody. she would talk to anybody at the drop of a hat. >> the san leandro resident still in shock over the death of his wife. >> i miss her nagging. you know how which haves get. you're not doing that right. that's what i miss most about her. >> 74-year-old kathryn sunday died yesterday morning after sustaining injury in ray accident in san lorenzo in an ambulance and headed to the hop when it collided with an audi and a. the chp multidisciplinary accident investigation team has taken over the investigation with support from the alameda county sheriff's office. >> we're talking to several witnesses, working with the county on the cameras that may be in this area as well as local businesses who might have had security cameras which captured the inclusion. >> family members tell us

kathryn this had a heart attack at home paramedic revived her and were taking her to saint roes hospital. alallen drove separately not knowing it was the last time he would see his wife alive. >> we spent an hour and a half waiting and couldn't find out what happened until they called us from eden. >> as of this afternoon, the audi driver is being treated at eden medical center in castro valley. three others inside the ambulance suffered injured but released from hospital yesterday. investigators have yet to determine who is solely responsible for the crash. in san lorenzo chris wynn, abc 7 news. >> embaeltsed judge aaron persky is breaking silence finally, four weeks before the voters decide whether to recall him from the bench. persky has been widely criticized for giving a six-month sentence to a formerstoneford student convicted of sexual assault. abc 7 news reporter david louie.

>> judge persky has been silent for two careers and he says he was surprised by the black after he sentenced brock turner to six months for sexual assault. this is turner leaving the jail after three months. critics said the sentence was too lenient why speak up now. >> i think judges should zip it and take the heat and criticism. it's only when you get to a point where there is a very real chance that the recall will be successful -- it gets serious for me. >> friends and supporters of the victim in the turn he case collected petitions to recall persky. the election is four weeks away. persky says if he is recalled it might underthe public's confidence whether the judges make tough calls. >> it's whether the public believes that a given judge is willing to risk his reputation,

this morning. he is due back in court next week for a preliminary hearing. foster's former girlfriend first accused him of hitting her but since recanted. she may be called upon to testify about what really happened in february at the los gatos home. the prosecution says it has no plans to abandon the case even if she does not cooperate with the investigation. >> the sacramento county sheriff's office is disputing a report that the golden state killer may have had an you a complic. retired contra costa detect told the sacramento bee says it's possible that a second person may have assisted deangelo with a few early crimes. holz believes if deangelo had an applies. just the incidents involving assault, not homicide. but the sacramento county sheriff says that's not possible saying that deangelo remains the sole suspect. >> a woman is suing an east bay school district for millions of

dollars in federal court after accusing a teacher of sexually assaulting her. that man daniel gonzalez remains in the contra costa county jail. he faces 23 charges including rape. concord police say gonzalez abused adults enrolled in a special needs program run by the mount diablo unified school district. >> union members received a boost day in day two of the three-day strike against the university of california system. members of the california nursing association marched longside their coworkers here at ucsf and at other facilities around the state. more than 25,000 members with the american frags of state, county and municipal employees walked off the job yesterday and will be out tomorrow as well. >> we work with them. we can't do -- nurses can't do our job without them. we all work together. so, you know, we're best in the west. tough treat us that way. >> ucsf say not every registered nurse went out today. but they hired enough

replacement nurses to fill the gap. union members want higher wages and end to job outsourcing. >> recently there were a string of earthquakes in the east bay. but this morning in southern california where they got rattled. two quakes hit both centered just outside of palm springs. the first a magnitude 4.5 hit at 4:49 this morning. the second, a 39.2 hit two minutes later. no reports of any damage or injuries. and earthquake experts at the california institute of technology say today's quakes happened in a complex section of the sand andres fault. geophysicalistis say it's not unusual but could mean something stronger may be in the next few days. >> the probability of a larger earthquake does increase. we estimate that there is a one to two% chance in the next week of having an event larger than today's magnitude 4.5. >> since the quake hit this morning siemsologists say there
