firefighters were first called. >> sky7 flew above observing grove campus a short time ago where students and a teacher from a biology classy treated ob the front lawn. you can see all the emergency vehicles there. just minutes ago, the district explained to us what may have happened. >> abc 7 news reporter katie marzullo on the scene the last hour and live with the latest. katie? >> reporter: dan, kristen abfirefighters and paramedic have been here about two hours treating and evaluating patients in what they call the warm zone on the lawn behind us here we're learning 12 patients total. six decontaminated and taken to a hospital. the other six were decontaminated and allowed to leave. other new information we get right now comes from the school district and that is that the substance that made the 12 people sick was actually pepper spray. and that was something that was circulating on the campus here among parents and students that someone had discharged pepper

spray but now the district is confirming that for us. as for the fire department they say they have a hazmat crew on the scene in the classroom i should say and they are still working on that. we do understand it was a science class as you mentioned. but we were told no science was happening in the class at that time. but these are all new developments. the last two hours has been cray are chaos with people being treateden oh the lawn not allowed to leave even to the hospital because of contamination. and for a period there, the other problem was students who already left were being asked to come back. >> if those students were in the classroom when it happened we want them to come become so we can assess and if necessary did he contaminate them as well. >> reporter: and minutes ago the fire department made me an update which is any students from oak grove high school in the classroom who has gone home who gets this message they are instructed from the san jose fire department to wash their clothes, take a shower, and if they do experience any symptoms

to call 911. live in san jose, katie marzullo, abc 7 news. >> thanks we'll stay on top of that. let's move to a story you'll see only on abc 7. an alameda sheriffs department fired for bribing witnesses of a police beating to remain silent is once again a california police officer. sean osborne was one of three deputies to lose jobs in connection with in 2015 beating of standis love. petrov pch last weaning he was worn in in gust ien a central valley town. his first duty protecting kids as a school resource officer. as melanie wood row explains school officials are surprised to say the least. >> in the may 1st facebook post the police department says we are introducing sean osborne, the newest full-time police officer. he is a 20-year vet of the

alameda sheriff's office and filling in as a school resource officer the remaining school year. in july of 2016 been the alameda county sheriff's office fired deputy osborne. you can see him in this video swinging a gold gain belonging to the victim. it came from a deputy and from these two officer striking the man 40 times and after he led them on a high-speed chase in san francisco in 2015. osborne arrived afterwards. the ails that he gave petrov to a homeless couple who witnessed the beating to silence them. deepts and weaver and santa maria were fired and facing criminal charges. osborne kwas not charged criminally. brian balancinger is the superintendent. he says his vice principle contacted him after calls to the high school from community members outraged about osborne's hire. some commenting on gust ien police department facebook post have. >> it's not the way you want to

ideally learn about something in somebody's background. >> balancinger says he spoke with the police chief and city impairing. >> they confirmed they knew they lost his job yes. again we have been assured they've gone through an extensive background check and that there wasn't something there that would preclude them from hiring him. >> neither of the police chief more the city manager responded to our requests. osborne's attorney told abc 7 news she believes the police department made a good decision to hire him. osborne will fill in as sro through the end of the school year. balancinger says he will work with the police department to hire a new sro next year. in gust ien, melanie wood row abc 7 news. dozens of california counties including marin have now filed litigation against opioid manufacturers and distributors saying they've created an epidemic across the state. the cases are expected to be transferred to a federal court in ohio where hundreds of other public entities have already filed similar suits. abc 7 news reporter chris wynn has the story.

>> reporter: over the past five years drug overdose, most linked to opioids have been the leading cause of accidental deaths in marin county. >> when i was in kmed school we were taut that these were less than 1% addictive when used for pain. we are learning the hard way how wrong thas. >> there have been 12 lawsuit filed against wholesale pharmaceutical and manufacturers. >> we have been doing a lot of work in trying to reeducate our physicians in safe prescribing practices. >> these are the companies named in the suit including san francisco based pharmaceutical distributor mccommitteesen. company executives did not return our request for comment. legal analysts steve clark says the lawsuit sends a clear message. >> what the lawsuits are seeking is both monetary compensation to the counties that have had to expend money for people addicted to drugs or that have been injured as a result of drug
