a judge has overturned california's right to die law. yesterday a judge threw out the 2016 law allowing termny ill patients to end lives. the judge said the laurms acted illegallily because they pass to do in a special session. the state has five days to appeal. joining me is dan diaz, the husband of brittany menard ha inspired this law when she moved to oregon to end her life after a brain cancer diagnosis. it's so hard to talk about death especially in your situation. thank you for coming in. i know this is a passion for you. but it's hard for many people. first, the discussion before we went on the air you expect the state to appeal. >> yes my home
4:15 pm
general becerra's office has stated they will be appealing. specifically they put a stay on the recent rulings so the law remains in effect so that termly i feel individuals can access this piece of legislation that for two years has been in the books and been working fine. while the legal wrangling continues, that patients have this option at end of life. >> you vowed to support the law to help other californians. onthe legal maneuvers was your next step. >> the promise that i made to brittany is that i would work on this legislation so that no terminally ill individual would have to leave their home like we did after being told you have six months to live. that's the promise i intend to keep. my focus now will shift back to california. i've been to 12 different state
4:16 pm
houses since brittany died many process when brittany died oregon mt. abwashington and the washington allowed this. since three years ago we have passed in in california be colorado, d.c. and a month ago in hawaii. my efforts continue. and you know working on this in state's across the country. >> still, only a handful of states have decided to go for this legislation to allow people the right to die. why do you think that's the case? >> it's -- it's somewhat frustrating because nationwide 70% of the population agrees with brittany, that a terminally ill individual should have the option. here in california, the number is 76%. it basically boils down to it's been the status quo but then also part of that is the opposition which is a minority -- they're clearly in the minority -- has been influenced a lot by religious believes. and i'm catholic.
4:17 pm
so while the church -- the leadership of the church might have their position of being opposed to medical aid in dying, support amongst catholics for the practice, support there is also 70%. it's a matter of time for legislators to accurately represents constituents. >> your position would be that the right to die is an extension of health care opens would say the -- the potential for abuse is too draet. how do you answer them? >> at this point, between oregon which had the law for 20 years, between oregon, vermont, washington and now california, we just published our first annual report -- we have 40 years of data which would absolutely refute all of the false narratives that the opponents like to throw out there. and they talk about abuse and coercion and slippery slope. and after 40 years 'worth of daytime rowe data and 20 years out of oregon not a single case
4:18 pm
of that. it's unfortunate that they'll go to the tactics. their campaign is based on fear, whereas brittan and what she was enduring at end of life, that's the reality of what a terminally ill faces. there is no reason they should suffer needlessly. >> dan appreciate your time coming in and getting a chance to talk to you. this is a certainly a subject we follow as the court proelgd proceedings continue thank you so much >> thank you appreciate the time. >> amama larry thank you so much. let's turn to the weather now let's get over to spencer christian to a look at the latest. spencer. live doppler 7 shows lots of clouds over the bay area. the clouds increase overnight. breezy out there right now as well. not very gusty but wind generally between 10 and 18-mile-per-hour. this is a sfru the east bay hillsing looking west. you can see clouds at various levels clouds increase overnight. breezy tomorrow cool cooler than average. little bit warmer at then of the week. and let's look at forecast animation starting at midnight.

experience this post partum depression or anxiety. yet many downplay symptoms and don't get treatment. >> ama the first thing a lot of people don't recognize that they have symptoms of depression. 3/4s of the women who experience post partum depression won't seek help never see a doctor. never discuss the symptoms. i think part of it is they don't recognize what the symptoms are. there is also a huge expectation once you have a child it's the happyiest day of your life. there is a lot of pressure to say yes i feel fine, everything is great. i'm doing a good job with my myy newborn. i think the medical community deserves a little bit ever responsibility if we don't ask the questions and give them the tune to tell us everything is not perfect. then they're not going to start the conversation on their own. >> there is a lot of bounceback, the term you are supposed to bountback to your life and everything is perfectly fine. what are some of the symptoms that people should watch out for. >> well the most obvious is
4:41 pm
you've had a change in mood. you can recognize that yourself but it's not easy to do. so if you have people telling you that they recognize that as well and questioning that, that's a good opportunity to ask yourself and look at yourself in the mirror and say is there something off here and then seek help. some classic symptoms people don't recognize are decreased sleep. they may have trouble sleeping. they may have loss of appetite. or just anorexia, feeling not like eating at all might notice weight loss on top of that. maybe the final thing to look out for is things that you typically had interest in doing you no longer show the interest in. so things that give you enjoyment you don't want to do those. don't want to go for the walks or have the conversation. or meet your friends out. if those are things that you commonly do and all of a sudden you find yourself not finding time for them or not find being enjoyment with those things then you should ask if that's formal. >> not feeling like ourselves. how can we reduce the stigma of the post partum mood disorders.
