she lied because she was upset with foster. >> abc 7 news reporter chris wynn live at the santa carr hall of justice with the story. chris. >> reporter: against the advice of her own attorney reuben foster's ex-girlfriend took the stand saying she made the story up because she wanted to get back at him for breg up with her. she also knitted in court today that this was not the first time she falsely accused someone of domestic violence. the ex-girlfriend of 49ers linebacker ruber foster calmly walked out of the santa clara hall of justice but inside the courtroom alyssa ennis breck down in tears multiple time throughout the testimony in which she admitted to falsely accusing foster of cosmetic violence for punish him for dumping her. on the stand ennis said i was pissed and wanted to end him. legal analyst stephen clark says the testimony seemed to be credible. >> it came off raw, organic and she broke down on the stand and apologized. >> on february 11th.

sheriff's deputies were called out to the los gatos home after searching three 911 calls from ennis who says she was punched one time by foft err. while she was she says he made it up up a was injured the night before following a incident with a woman in san francisco. >> this is obviously a person very troubled. has a lot of issues. and that played out today in this courtroom. and it was very painful toway watch. >> ennis also testified she tried to bring false domestic charges against another exboyfriend when that man tried to break up with her. addressing her initial accusations against foster she said i didn't think it would get this far. she went on to say she wanted to do the right thing. >> when it comes to the defect violence case, it seems that is on life support for the d.a.'s office. >> next week the judge decides whether it proceeds to trial. in san jose, chris wynn, abc 7

news. flames came within a few feet of commutes driving on the peninsula freeway this afternoon. other people saw the smoke from miles away. maybe you did if you were out in this part of the bay area. sky7 flew toward the scene after seeing the smoke ricing in 10 next to redwood city. the fire broke out in dense bushes and trees on the southbound lanes near woodside road. starting near what appeared to be a homeless camp around 1:45 this afternoon. drivers face delays while firefighters try to soak the hot pots. charges haven't been filed against a man accused of a deadly accident in fremont. authorities say the driver was high on pot. his arraignment was supposed to have happened this afternoon. but as abc 7 news reporter laura anthony is live in dublin. there's been a tla. >> reporter: that's right, kristen. prosecutors here need more time to decide the charges that should be filed in this case.

now it appears that he defendant's first day in court will be tomorrow. though his mother and several others showed up at the courthouse. the man accused of causing the crash while under the influence of marijuana will wait another day before making his first court appearance. 21-year-old dang tran is expected to be arraigned on three counts of gross vehicular manslaughter among other possible charges. according to the chp, tran was driving recklessly at a high rate of speed on interstate 880 near stephenson tuesday night when his car caused a chain reaction accident. three people were killed including 39-year-old knowle johnson and two youngsters be 14-year-old kristy and her 9-year-old sister brooke. they were part of a larger blended family. johnson her boyfriend chris and their six daughters were riding in the cadillc when it was struck. >> their baby carolyn was four on the day of the accident.

>> johnson's crossfriend told abc 7 news the family was traveling home from a birthday celebration that included stops at the zoo and santa cruz. >> she put her life and heart and soul into being a mom to the babies. and she was a great friend. i have a lot of years of friendship with her. and it's hard. it's a hard loss. >> counselors were brought into the school in manteca where brook attended. >> it's very, very sad. to lose someone so young. it seems oh senseless. >> according to the chp, none of those killed were wearing seatbelts. one of the children remains hospitalized. in dublin, laura anthony, abc 7 news. oakland police are searching for the driver in a deadly hit-and-run collision. sky7 caught the aftermath of the crash at 98th and bancroft avenues. you can see the while car that rolled and wrapped around a pole. there is a black car with significant damage to the front end. police say one man died at the scene.

and two others went to the hospital with injuries. investigators say the drafr of one of the cars ran off before police arrived. a new california law looks to protect undocumented immigrants in the courtroom. it requires lawyers to get a judge's permission before discussing someone's immigration status in open court. the measure takes effect immediately and will expire in 2022 unless rethorsoned. arrests which immigration and customs enforcement the shot up significantly in california since president trump took office. from october of 2017 through march of this year i.c.e. reported arresting more than 3,400 non-criminals statewide. that's compared to about 1,000 for the same period a year erlier. it is the same story nationwide. a total of 26,000 non-criminals were arrested. that is about double from the year before. governor brown today signed a bill awarding nearly $2 million to a man wrongfully imprisoned for almost 40 years np craig collie was convicted of

says he may appeal the decision. well residents on hawaii's big island are being given free masks this afternoon to protect themselves from breathing all of that volcanic ash that's in the air. this comes after the kilauea volcano exploded before dawn today sending a plume of ash 30,000 feet into the sky. officials expect about a quarter of an inch of ash to fall in the volcano national park and nearby communities as well. in the meantime volcano experts here in the bay area say kilauea is following a well-established pattern of lava flows and both large and small explosions. that's helping emergency officials decide when to order evacuations. abc 7 news anchor eric thomas explains it may help show us what to do in case of volcanic activity here in california. >> reporter: it sounded ominous when the u.s. geological survey provided the update on the explosion on on tillia that

consumer reports look at 2018 models and found 32 out of 44 brands offer some kind of wireless data connection. more cars are also now equipped with cameras usually facing outside the vehicle. but this one in the tesla model 3 faces inside. >> the manual says the camera is not turned on right now. but could be used for potential future features. tesla promises that it will let skpers know before they turn the camera on. >> general motors 2018 cadillac ct 6 with supercruise also has an internal camera mounted right on the steering column. it monitors the driver for signs of distraction. but gm says it doesn't capture or story video. between cameras and sensors cars are collecting all kinds of data about our driving habits. the question is, why? >> a lot of data is being collected to help auto makers prepare for self-driving cars. it's a machine learning process. they're using your data to map the roads and better understand how vehicles and people are going to react on the roads.
