the whole thing started here in the bay area during the 2016 season when 49ers quarterback colin kaepernick started to kneel during the playing of the star-spangled banner. he said it was to protest the unarmed killing of black people by police. >> i think there's so much more to it than just a player standing or a team employee standing. we want to take a broader approach. >> reporter: york says any real solution would have to take social justice matters into a account. but many fans and some owners disagreed. they call the protest an insult to the flag and to the veterans of the armed forces. former 49ers team executive andy dolic said that's unfortunate. >> having this out there as a debate i think is very healthy. but putting it as an overview that you have to do this on

behalf of the league to show patriotism seems to be in question. >> reporter: everyone who comes out on the field must stand otherwise the team will be fined. one team, the new york jets is already rebelling. chair chairman says if the players want to deal they'll pay any fines. finally, this oakland raiders fan told me if the league has to pick between free speech and game attendance he knows which one they'll choose. >> it's all about business and the nfl does have an image to protect. >> reporter: as we know colin kaepernick has been unable to land with a team since this all started back in 2016, and he's currently suing the league and the teams for collusion in keeping him out of a job. live at the oakland colosseum, eric thomas, abc 7 news.

we have some breaking news, a santa clara county judge just demised domestic charges against 49ers ruben foster. foster's wife accused her of dragging her out of the home and punching her multiple times. she later recanted that story and said she falsely accused him. this was just released, body camera video showing an arrest in january of nba player sterling brown. milwaukee's police chief is apologizing for how officers treated brown following a dispute over a parking violation. they tased brown before arresting him. prosecutors never charged brown. he tweeted out a statement today blaming racism for what happened. he hopes situations like this can be prevented in the future and says he plans to take legal action against the police

department. there are new details today on the deadly crash of a tesla model s into a pond in castro valley. we've learned more about what happened before the crash. >> laura anthony live in castro valley with the latest. >> reporter: tesla today released a statement today saying their auto pilot was not involved in this accident. the chp says tesla is cooperating with the investigation, but that statement from the company is separate from the investigation here. while the california highway patrol continues its investigation, tesla has released its own statement about the fatal tesla model s crash that killed a danville man last weekend. a tesla spokesperson now says, quote, we have been able to recover enough data from the vehicle to confirm that the auto pilot was not engaged at the time of this accident. >> we did see the statement that they put out, and really the bottom line for the highway patrol is we still have a long

and thorough investigation to do. >> reporter: danville musician and chemical engineer 34-year-old keith was killed in the crash. his body found by an alameda county sheriff's dive team inside the blue tesla some 65 feet offshore. the car was discovered sunday night off crow canyon road. he hadn't been seen since saturday. the chp says they are still trying to determine if the driver was impaired or may have been speeding. >> they're looking at the vehicle, retrieving data from whatever systems that they can to analyze. they're also looking at damage to the vehicle to see if they can evaluate that and determine the speed. >> reporter: now, tesla's auto pilot has been implicated in at least two fatal crashes and now two u.s. consumer groups are calling the name auto pilot misleading. they're asking for some kind of change. in this case tesla says the technology, whatever you call

it, was not involved in this accident. in castro valley, laura anthony, abc 7 news. the owner of a rare sports car needs your help finding the vehicle after it was stolen. thieves made off with this 1981 deloran. it happened to be parked on a trailer attached to a ford pickup. now that truck and trailer were also stolen. both the deloran and the pickup have nevada plates. a man captured is wanted today for stealing purses from two older women, one in her 90s. they say he ripped the purses away from those women. one victim whose 93 years old was knocked to the ground and seriously hurt. she's still in the hospital. this happened friday at the bank of america. police today were shocked by the viciousness of this crime. >> oh, that's terrible.

i had not heard that at all and something i've heard about in this area. >> it's despicable to think about older women getting targeted by criminals for money. >> police have a picture of the car they think the suspect is driving. they believe it's a chevy malibu white with tinted windows. well, our rather dreary weather pattern continues. we've had lingering low clouds throughout much of the day. and the bigger picture you can see active weather all around us. thunderstorms and lightening streaks to our north and east of the sierra. that is our next storm, a light storm. ranks only one on the storm impact scale. so on friday we can expect this storm to bring us scattered light showers and mainly a nuisance event, not a big storm. as we're going to the memorial day weekend we'll see showers, clouds giving way to sun on saturday. warming up big time on sunday.

and memorial day it's going to ehot in some places. i've gill you details a bit later. we have new details now on what killed two whales in san francisco bay. this one surfaced on friday. scientists determined the 45 foot juvenile whale was killed after it was hit. a second whale also suffered a painful death. scientists say it died because of severe entanglement. santa rosa is like many california cities. it has a homeless problem. an estimated 2,000 homeless there. >> abc 7 reporter wade freeman was in santa rosa as the police department delivered another deadline to the homeless in the city. >> hello park ranger. anyone in the tent? >> reporter: in santa rosa they handle ito often it almost seems like a drill. this encampment the latest front line in

endless effort to help the homeless. this camp formed about a month ago when another camp closed. it is roughly one mile long but hardly the last mile based on previous experience. >> can you anticipate where they'll go next? >> i can't. >> reporter: the departure cannot happen soon enough for residents like bill petty. he rides his black along the trail. last week eight people lined the path and one of them attacked him. >> it's a no-win situation, but this can't happen. >> reporter: as to what does happen we've shown you many times before from the remnants of had hill last august. >> it's not the best environment. >> reporter: amanda freedman, when we last saw her in august she had made it to a homeless shelter but has moved out twice since then. we asked what happened. >> no one's going to kick me out

a story making headlines as we approach 4:30. nfl owners with a new policy requiring players to stand on the field during the national anthem. players will have the option to stay in the locker room. 49ers owner abstained from the vote partly because the lack of player involvement in the decision making process. less than an hour ago charges were dropped against ruben foster. sunglasses thief in san francisco may have struck again last night. business owners believe it is the same man who broke into multiple businesses last weekend. we may know by the end of the week if san francisco police chief william scott will return to los angeles to become the new chief of the lapd. he's reportedly one of the three finalists for that job. abc 7 news reporter vick lee in the newsroom now with the story.

>> first of all, larry, we know that police chief scott left on a trip to los angeles today. the same day the mayor of l.a. began holding what appears to be his final interview. so far chief scott has deflected all of the questions surrounding his possible depar char. >> in early may rumors began swirling that chief william scott may be a candidate for lapd's top job. this after police chief charlie beck announced his retirement at the end of the career. scott is reportedly one of the top three finalists. the mayor says he's had final interviews with all three. on monday he said he would decide soon. >> i want to do it right but not fast. and i expect probably in the next ten day tuesday announce a decision. >> in december 2016 he gave an exclusive television interview to abc 7 news. he told me he had no plans to apply for l.a. and apply for the top job there when then chief

beck retired. >> the mayor and the police commissioner had put the confidence i'm going to come here and give it my all as long as they will have me here. that is my intent. >> now there is plenty of uncertainty for chief scott. mayor leave has passed. the police union has a new president, but the friction is still there. >> the members as a whole have not felt connected with the current chief, with the command staff. >> and the make-up of the police commission has change. there are now four vacancies on the seven-member commission that supported him. not even enough for a quorum to hold meetings. today a supervisor's committee held a hearing to interview potential candidates. still it'll be at least two weeks before the board can vote on new commissioners. in the meantime no one knows if chief scott will stay or leave. the supervisor.

meeting. it will be a sham. >> what i want is i want toment transparency. >> former fbi director james comey tweeted that facts matter. he said the president's attacks on the fbi will do lasting damage to the country. meanwhile, president trump took credit for firing comey saying he did the country a service. abc news, washington. well, for a second straight day the environmental protection agency barred reporters from attending a summit on toxic chemicals. politico says it was blocked from entering today as were reporters from at least two other publications. yesterday journalists were barred from the summit which included embattled scott pruitt. the epa claims they barred the reporters because of space limitations. residents of the big island continue to deal with the dangers posed from the kilauea

volcano. by the way, these are live pictures from the big island right now. i've got a friend who's in the area and says where you're seeing these lava fountains homes used to exist there just a few weeks ago. they've been kplocompletely ove by the lava. while this goes on we're getting a striking time lapse sequence of the eruptions. it shows the glow from fissures as they pushed out lava overnight monday into tuesday. the camera's lens causing the volcanoic glow pushing up through the clouds, taking on a white bluish color instead of the familiar lava red. fewer americans are heading out on vacation this summer. we're going to tell you why. >> plus how about a staycation? we'll have inidedeas for your sr weekends. it looks like clouds are staying around.

well, nearly a quarter of americans won't go on vacation this summer simply because they can't afford it. that's according to a new bank rate.com survey. 24% can't afford a vacation. and 11% say they're simply too busy at work. just 51% of those surveyed say they plan ongoing on vacation this summer. and only 30% of those who get paid vacation say they'll actually use up all of their vacation this year. well, if you don't have a lot of time or a lot of money a staycation might be a possibility. you've got ideas all over the bay area. let's start in the south bay. let's say i'm into mysteries. what do you have? >> well, if you're into mystery where recommend starting off at the winchester mystery house. they have 110 rooms out of 160
