we have some breaking news, a santa clara county judge just demised domestic charges against 49ers ruben foster. foster's wife accused her of dragging her out of the home and punching her multiple times. she later recanted that story and said she falsely accused him. this was just released, body camera video showing an arrest in january of nba player sterling brown. milwaukee's police chief is apologizing for how officers treated brown following a dispute over a parking violation. they tased brown before arresting him. prosecutors never charged brown. he tweeted out a statement today blaming racism for what happened. he hopes situations like this can be prevented in the future and says he plans to take legal action against the police

department. there are new details today on the deadly crash of a tesla model s into a pond in castro valley. we've learned more about what happened before the crash. >> laura anthony live in castro valley with the latest. >> reporter: tesla today released a statement today saying their auto pilot was not involved in this accident. the chp says tesla is cooperating with the investigation, but that statement from the company is separate from the investigation here. while the california highway patrol continues its investigation, tesla has released its own statement about the fatal tesla model s crash that killed a danville man last weekend. a tesla spokesperson now says, quote, we have been able to recover enough data from the vehicle to confirm that the auto pilot was not engaged at the time of this accident. >> we did see the statement that they put out, and really the bottom line for the highway patrol is we still have a long

and thorough investigation to do. >> reporter: danville musician and chemical engineer 34-year-old keith was killed in the crash. his body found by an alameda county sheriff's dive team inside the blue tesla some 65 feet offshore. the car was discovered sunday night off crow canyon road. he hadn't been seen since saturday. the chp says they are still trying to determine if the driver was impaired or may have been speeding. >> they're looking at the vehicle, retrieving data from whatever systems that they can to analyze. they're also looking at damage to the vehicle to see if they can evaluate that and determine the speed. >> reporter: now, tesla's auto pilot has been implicated in at least two fatal crashes and now two u.s. consumer groups are calling the name auto pilot misleading. they're asking for some kind of change. in this case tesla says the technology, whatever you call

it, was not involved in this accident. in castro valley, laura anthony, abc 7 news. the owner of a rare sports car needs your help finding the vehicle after it was stolen. thieves made off with this 1981 deloran. it happened to be parked on a trailer attached to a ford pickup. now that truck and trailer were also stolen. both the deloran and the pickup have nevada plates. a man captured is wanted today for stealing purses from two older women, one in her 90s. they say he ripped the purses away from those women. one victim whose 93 years old was knocked to the ground and seriously hurt. she's still in the hospital. this happened friday at the bank of america. police today were shocked by the viciousness of this crime. >> oh, that's terrible.
