and that breaking news is at sfo where the wing of a plane hit a concrete post. you can see just that in this picture taken by someone at the airport. an airport spokesman says passengers were onboard the air lingus flight that had just arrived from dublin, ireland. >> no one was hurt. and you can see the wing there. that plane was being towed to a gate when the wing hit the post. >> sky 7 was over the scene just about 30 minutes ago. you can see some paint on the concrete post. this is not affecting most flights at the airport, but air lingus may see some delays as a result. also developing right now the domestic violence charges against 49ers star ruben foster have just been dismissed by a judge. >> live with the latest on this, chris. >> reporter: dan and christian, a very big win for foster this afternoon. the 49ers have just released a

statement saying he'll have the opportunity to rejoin the team tomorrow. but he's not in the clear just yet. after months of uncertainty 49ers lean backer ruben foster walked out of court today breathing a sigh of relief. a judge in santa clara county dismissing the domestic violence charges that were brought against him this year citing insufficient evidence. steven clark was in court for the decision. >> the judge wanted to make that statement. this wasn't just because she recanted. it was because her story never made sense in the first place. >> reporter: this after his ex-girlfriend alissa ennis initially told authorities he ha draggedher, punched her 8 to 10 times in the head and locked her out of their home in february. turns out she made it up as part of an extortion plot for breaking up with her. she cried several times during her two hour testimony and blamed her previous injuries on

a fight she had with two women in san francisco following a road rage incident. she also admitted to falsely accusing another ex-boyfriend of domestic violence back in 2011 when that man tried to end their relationship. clark says the judge's ruling was based on the totality of the case. >> based on what ms. ennis said and the other forensic evidence that was available to the court, there was not enough evidence, and it was not consistent with what her initial statements were. >> reporter: foster still faces an assault weapon possession charge in connection to a rifle that was found the morning police responded to his home. but that charge has been reduced to a misdemeanor. foster returns to court on june 6th. chris wynn, abc 7 news. >> now, just about a half-hour ago the general manager of the 49ers released a statement about him. john lynch says foster will have an opportunity to rejoin the team tomorrow. lynch went onto say, quote, it's been made clear to ruben his place on the team is one that

abc 7 news that it's a quote, active incident. we have new information for you this evening following last weekend's deadly crash of a tesla model s in castro valley. tesla claims its controversial auto pilot was not being used when this tragedy happened. laura anthony is live with more from the highway patrol office in castro valley. >> reporter: hi, dan. this was sort of unusual because this new information actually came from tesla, not from the chp here. we did talk with them. they said while tesla is cooperating in the investigation, this information about the auto pilot is simply separate from the chp investigation. while the california highway patrol continues its investigation, tesla has released its own statement about the fatal tesla model s crash tat killed a dan vil man last weekend. a tesla spokesperson now says, quote, we've been able to recover enough data from the vehicle to confirm that the

autopilot was not engaged at the time of this accident. >> we did see the statement that they put out, and really the bottom line for the highway patrol is we still have a long and thorough investigation to do. >> reporter: danville musician and chemical engineer keith leon was killed in the crash. his body found by an alameda dive team inside it tesla some 65 feet offshore. it was discovered sunday night off crow canyon road. leon hadn't been seen since saturday. chp says they're still trying to determine if the driver was impaired or may have been speeding. >> they're looking at the vehicle and retrieving data from whatever systems they can to analyze. they're also looking at damage to the vehicle to see if they can evaluate that and determine the speed. >> reporter: tesla's autopilot has been implicated in at least two fatal crashes and now two consumer groups are calling the

name of the technology misleading and asking for a change. new developments on a story we first brought you yesterday about a string of brazen smash and grab burglaries. over the weekend a would-be thief was caught on camera using a hammer to try to smash his way into an optometry store in san francisco. he hit another store that same night. since reporting that story we've learned that the same man may have hit another store. in just the past few minutes the sheriff's department confirms the serial thief was arrested yesterday, and investigators say he may have been responsible for nearly a dozen burglaries. melanie woodrow has the story. >> reporter: n video shows who appears to be the same serial sunglasses thief breaking into sunset focus optometry in san francisco just before 3:30 a.m. on tuesday. just before two days of break-ins at stores on union

street. >> they saw him smashing through my window, and breaking the door, broke the door flame and the glass fell out and landed on the floor. they came in and started stealing frames. >> reporter: the man was determined to smash the glass at union's street eyes in disguise. when that didn't work he tried to push his arms through the glass and unlock the door. using a hammer to break the glass and take off with sunglasses. in this december surveillance video you can see a man repeatedly throwing a brook into sea cliff optometry. police arrested benjamin chase and an accomplice. he used his real name when he cased her store last month. >> complete said his

tra transition day. monday for memorial day it is going to be warm to hot. the hour by hour time line coming right up. the city of alameda has not seen new market rates, multifamily housing for more than 40 years. after years of waiting alameda had a groundbreaking today to mark the start of a new development. more than 800 residential units will be built, and already people are wondering how this will impact traffic. abc 7 reporter lyanne melendez takes a look. >> reporter: the entire air base was officially closed in 1987. the economic impact of that closure was felt almost immediately. it took years to recover and just as long to come up with a plan to develop the site. tonight the wait is over as alameda broke ground. >> 800 residential units and

roughly 100,000 square feet of retail space. >> reporter: this will be mixed housing including affordable housing for very low income households. it will be called alameda point. the mayor trish arara touched upon one of the biggest concerns here, congestion. >> the posy is not sufficient. we have to solve that problem. >> reporter: there are only two options to get to and from alameda. the sit developers say the only way to make this work is to create a less car dependent lifestyle. >> the sitcity has a pretty rob strategy including $30 million for a new ferry terminal and putting into place bus service. >> reporter: those shuttles will run every 30 minutes during peak time. the ferry will be located at alameda point. the project will give alameda a

nfl players kneeling during the national anthem say they are calling attention to racial injustice. but many owners believe it disrespects the flag and today they took action to stop it. eric thomas is live at the oak lntd colosseum with reaction. eric? >> reporter: and dan those players say it's about freedom of speech. fans and some of the owners say it's about patriotism. the nfl says it's going to penalize some of those teams whose players kneel during the national anthem by hitting those teams in the pocketbook. taking a knee in protest started with former 49ers quarterback col colin kaepernick in the 2016 season, and his team was the one that decided to abstain from voting on the policy. >> i think there's so much more to it than a player standing or a team employee standing.

we're going to see some spotty drizzle. not going to be as expensive as today. we will see some cloud cover as well. upper 40s to mid-50s. so tomorrow morning just make sure you have a light jacket and give yourself some extra time. for the afternoon temperatures will remain below normal, breezy at the coast, upper 60s and barely making it to the low 70s inland. you may see some peeks of sun, but over the the pattern is going to be cloud cover. and then we bring in our storm impact scale. it's a light level one system for friday. bringing a scattered shower possibility, light amounts, less than .10 of an inch. i don't think it's going to make it to the bay area until friday morning's commute. spotty scattered showers through # a.m. this trend carries over to the early afternoon, and then you're fine and good to go for later on that. i don't think the model is
