rounds at woods he never dropped it and then police then fired 26 rounds. today, san francisco district attorney said that the use of force in that case was not only excessive and unnecessary. but under current law, there was nothing he could do to charge the officers. >> the conflict that i have, is that i don't necessarily believe that the use of force was necessary. right. but the law doesn't necessarily care about whether it was necessary or not. >> reporter: in that case, the police argued that they feared for their safety and the public's well-being. the same applied to this shooting, when witnesses say this 45-year-old man holding a knife confronted police. this video doesn't show the moment that he was shot. but you can see when police arrived and you can hear how it unfolded only 30 seconds later. >> get on the ground. put that down! put that down!

sky 7 was over the scene in interstate 580. you see them looking through a homeless encampment, the person's name is not released. the highway patrol said there's no threat to the public. >> another whale has washed ashore. the third since friday. the marine mammel center said that the gray whale carcass was reported friday. and then another one washed ashore on tennessee valley beach. both of them died from ship strike injuries. >> it was a rude awakening for several san jose residents following a string of dumpster fires. one of the fires slightly damaged a fraternity house across from san jose state. abc 7 news has more on the investigation. >> reporter: sky seven was above san jose early this morning as

flames shot out from several dumpsters and trash bins in the south downtown area. fire crews say they responded to at least nine trash fires in the neighborhood. >> an isolated dumpster yeah, but nine others that is a bit much. you know. and that's, i'm quite sure that deliberate. >> damage was minimal and isolated inside garbage bins. the most significant happened at had this fraternity house across from the campus. >> i don't think it was an attack on the fraternity. but it's sad to have it happen to someone's house. flames started to spread on to the side of the house before being quickly put out by firefighters. a nearby dumpster was set on fire and pushed up against the building. the fire knocked out power to the house, not the best thing to happen a day great graduation. >> it's a bummer, we had to worry about showering and my family is in here right now, trying to figure out how to get ready for the ceremonies and

everything. we have good friends around the area. we will call them to help us out. >> a campus alert was sent out to students warning them about the arson. >> the biggest concern is that someone will get hurt. >> san jose firefighters say that arson investigators are looking in to the cause and possible suspects. in san jose, carlos, abc 7 news. >> warriors coach steve kerr does not like the new rules about the national anthem. it was ruled that the teams will be fined in the players do not stand for the anthem, but the players could stay in the locker room. steve kerr called it typical of the nfl. >> they are playing to their fan base and you know, basically trying use the anthem as nationalism, scaring people, it's idiot i can. but that is how the nfl has handled their business. people in high places are trying

latina students in a high school said they would perform better academically if their teachers understood them better. they blame a lack of cultural sensitivity to low achievement scores. we talked with student leaders demanding change. >> reporter: nearly 3 out of 4 students at the high school are

latino. that makes them the majority, a group of students are lead ago campaign to boost diversity among the teachers claiming there's racism and it's impacting the student performance. >> they are connecting with the white students more than the students of color. which leaves a disparity with the students and the grades as well. >> reporter: he is leading the diversity training leadership. they have been passing out flyers and gathering signatures on a change.org petition to put pressure on them. the latino students score lower in math and language exams. the school policy and state education regulations require diversity training for teachers. lincoln high school said his door is open to discuss student led proposals. in the past, the students convinced him to diversify the

cloudy across the entire bay area and unseasonally cool again. in to see air a we are seeing thunderstorms, some of those thunderstorms have been produced some hale in the nevada area. and you will notice, it's very intense thunderstorm activity along with the hail being reported, at least there's rain associated with the thunderstorms so that of course alleviates the fire danger to some degree. the thunderstorm threat continues for not just to see sarah, the northern california mountains tomorrow. lightning, hail, if you are traveling, keep that in mind, temperatures as you will notice in just a moment, here in the bay area. remaining on the cool side. a view from the abc 7 camera, watching the sea lions and visitors, it's overcast. and san francisco, 63, and you are sucked in on the golden gate bridge. most areas have been in the ifs and 60s, you have to go to antioch to get up to 71.

concord, 61 degrees. really, we are in the cool spell like we have been for most of the month of may. i want to show you where the temperatures are going. nowhere near cool for the second half of your holiday weekend. livermore's high is 77, and still below average for friday and saturday, and coming up above form. enjoy the heat, temperatures will fall again the middle of next week. the wind is not blowing much here, it is gusty out toward the delta right now. close to 40 miles an hour. spotty showers, and clouds lingering in to saturday. it will turn sharply warmer on sunday and monday. tomorrow morning, do not leave home without an umbrella. there's damp roadways, temperatures in the low to mid 50s. and a few showers and they continue tomorrow through the afternoon and early evening hours. so, it's going to be another cool day, upper 50s through the
