>> it's all good. >> first you have the astros, now the rockets potentially could go to the nba finals so one game to go, though, it's not over yet. >> that's right. we'll have more coming up but first we have breaking news and we go to t.j. holmes. >> breaking news for our viewers in the west. we want to show you these pictures, aerial shots of a middle school in indiana, what has become a familiar scene, students appearing to be evacuating, running from their school after reports that there has been a shooter there at noblesville west middle school. we want to turn to chief justice correspondent pierre thomas. again, another familiar scene for us. >> reporter: disturbing, a parent's worst nightmare, reports of an active shooter. atf and local officials have gone to the school. we don't have word yet on injuries or how many people may have been hurt but we do know according to the fire department that has responded that a shooter, suspected shooter, is

in custody. so now law enforcement will try to get there, get control of the scene, try to see if there are any injured or people in more dire situations, deal with that situation, get the school under control. we don't know if the entire community is on lockdown, but right now, t.j., law enforcement officials descending on that scene, trying to get that situation under control. obviously trying to reach out to parents to let them know that their kids are okay. >> pierre thomas with the very latest for us there. thank you so much. anything else breaks out, we'll certainly keep you posted on the breaking news we're getting of another school, it appears another possible school shooting. pierre, thank you so much. robin, back to you. disgraced movie mogul, harvey weinstein, turning himself in this morning to face criminal charges of sexual assault. linsey davis is at the nypd's first precinct in downtown manhattan with the latest. good morning, linsey.

>> reporter: good morning to you, robin. a media frenzy out here this morning. this is where harvey weinstein turned himself in. more than 80 women have come forward against him with various allegations. this is the first time that he faces criminal charges, charges that have been months in the making. this morning, harvey weinstein entering a manhattan courtroom in handcuffs, charged with rape, sexual abuse and sexual misconduct, stemming from an nypd investigation into allegations by former aspiring actress lucia evans and one other unnamed woman. cameras were in the court. >> bail is $10,000 bond. >> reporter: evans told the new yorker back in october that weinstein overpowered and forced her to perform a sexual act during a business meeting at his manhattan office in 2004, adding, i said over and over i don't want to do this, stop, don't. while she did not initially report the assault to police,

her accusations are within the statute of limitations in new york. late thursday evans told the new yorker of her decision to press charges now. at a certain point you have to think about the greater good of humanity, of woman kind. recently nypd chief robert boyce oversaw the investigation and called evans' story credible. >> a lot of work went into this. heros are the victims. >> reporter: also, actress paz de la huerta, her case will not be before the court today. she told "vanity fair" that she was raped by weinstein twice after he invited her to his apartment. i was so terrified of him, i did say no and when he was on top of me i said i don't want to do this. she told the new yorker late thursday she will testify in court if asked. in recent months weinstein has kept a low profile. tmz captured this photo of the former producer in malibu on wednesday. it was the last time he had been seen until this morning.

overnight weinstein accusers reacting to the news of his impending news and trial. this tweet, boom. another, can't wait. rose mcgowcgowan, one of the fi to accuse him of sexual assault spoke exclusively to abc news after his plans to surrender were announced. >> justice would be for him to just simply go poof, preferably, behind bars. because we were sentenced to a prison. we were sentenced to years of it before anybody believed us. we had our lives stolen. we had our careers stolen. >> reporter: just this morning rose mcgowan tweeting, we got you, harvey weinstein, we got you. now, weinstein has long denied any nonckoconsensual sex. it is believed he is going to post $1 million cash today.

he is going to be fitted for a monitoring device and prosecutors have asked that he turn over his passport. we are hoping to get the latest details and any possible new information in sight from harvey weinstein's attorney in in case. robin, back to you. >> linsey, thank you very much. we'll have more of amy robach's exclusive with rose mcgowan later this morning. joining us now is the new yor r yorker's ronan farrow who won a pulitzer prize for his coverage of the harvey weinstein allegations. it was a difficult decision for lucia evans to move forward. >> incredibly difficult, robin, as it was for every woman who spoke to the press but lucia faced another layer of life-changing decisions because the day after that first "new yorker" story that reported the first allegations of assault about weinstein, police began to try to contact her and laid out this decision to her.

do you want to spend potentially the next several years of your life being shredded on the stand as the star witness in this case? and she wrestled with that for months. i stayed in touch with her during that difficult process. a lot of sleepless nights for her, but she ultimately said, robin, i can't pass up a chance to help many, many other women in her view. >> thinking of others, not just herself. >> absolutely. >> many months gotten to this point. there's no way that you could have thought, anyone could have thought it would have led to this. >> when i first began speaking to harvey weinstein's accusers, they were correctly terrified. they feared retaliation and feared for their physical safety and we know he was hiring all sorts of intermediaries to threaten them. most importantly, robin, they never believed they would be heard. now we live in an era that survivors speak on an issue about someone that powerful and they're heard. >> the difference of what you're saying now, when women and men come forward with these accusations for the first time they are being heard and they

are being believed and it is being looked into. with your reporting how strong a case do you think they have here? >> you know, i can't handicap legal proceedings that are still to play out. what i can say, these are serious charges. i can say that i've been in touch with many of the law enforcement officials involved and they moved very carefully and spoke to many, many potential witnesses and they believe lucia's case is very strong and the other woman who is involved in the charges today also has a strong case in their view. >> they took their time to gather the evidence and everything. >> a lot of work went into this. >> we'll talk about the legal issues with dan abrams in just a moment. big picture here, does it change in hollywood at all? >> i think that there is a change in the culture where women and, as you say men as well now, can speak about this without as much fear of blacklisting and retaliation and seeing actresses like some of the ones that were mentioned like mira sorvino or annabelle

sciorra flourishing after speaking about this. that said everyone involved in a story like this agree there is a long way to go. very unclear even if there is success on the part of the prosecutors in this case whether harvey weinstein will spend, you know, any time behind bars, what the repercussions will be for him and it's unclear whether predators who still have not been brought to task in the most powerful corners of that industry are hearing this message fully. >> yeah. ronan, thank you so much for being here and for your ongoing reporting. >> thank you, robin. good to be here. >> let's get to michael. >> thank you, robin. let's bring in our chief legal analyst, dan abrams. good morning, dan. >> good morning. >> as we heard ronan say a second ago, very serious charges here. in addition to the testimony what other evidence could prosecutors produce? >> i think there will be two areas. number one is what did they say, what did she say contemporaneously. was there anything she told friends at the time or anyone else, any notes she took. those are the sorts of things that can be very helpful in bolstering an accuser's case.

the other thing is going to be how many other women are allowed to testify. the question we've been talking about in connection with the bill cosby case. is a judge going to say this is similar enough conduct to say this is effectively his m.o. and, therefore, admit the testimony of other women who aren't even necessarily the subject of this case. >> and this alleged incident happened in 2004. but no statute of limitations problem. >> that's right right because in new york state they changed the law in 2006 to say no statute of limitations for this kind of crime. you say, wait a second, this happened in 2004 and it's 2006. why does this apply? in 2004 the statute of limitations was five years. the law was changed within that five-year period and so that effectively means that they're just extending the statute of limitations. that is not the same as going back and changing the law to target a particular individual. >> all right, so with that being said with the bigger picture do you think you'll see prosecutors bring more cases like this or charges? >> i do.

instead of the standard being do we think we can win this case beyond a reasonable doubt, a lot of prosecutors are just going to say do we believe it? do we believe this woman? and as a result, if we do, we're going to let a jury decide. and that is an enormously different standard than saying, we are convinced we're definitely going to win this as opposed to saying it's important enough. we got to put it out there and let a jury decide. >> really quickly, how much time could harvey weinstein face? >> he could face up to 25 years in prison. so, and i don't -- i think if convicted, he will serve time. >> significant amount of time. thank you so much. >> just the thinking changing. >> oh, absolutely. >> that's fundamentally -- >> not just in hollywood but with prosecutors across the country. >> that's true, thank you. we want to turn to that cancelled summit with north korea. overnight pyongyang signaling it is sill open to negotiations after president trump sent mixed messages saying he too would still be willing to sit down

while also threatening military action. jonathan karl is tracking it all. good morning, jon. >> reporter: well, the june 12th summit is off but the north koreans issued a statement overnight saying that they want to try again. north korea called president trump's decision to pull out of the summit unexpected and very regrettable. and urged him to come back to the table. we are willing to sit down with problem, the statement said, adding that north korea is, quote, willing to give the time and opportunity to the u.s. with a generous and open heart. earlier before president trump abruptly canceled the summit, north korea set off a barrage of explosions before visiting journalists claiming to destroy its nuclear test site in a gesture of goodwill. but the white house wasn't buying it, releasing this letter from president trump to north korean dictator, kim jong-un, whom the president addressed as his excellentsy. we greatly appreciate your time,

patience and effort, the president wrote, but due to north korea's tremendous anger and open hostility i feel it is inappropriate at this time to have the long-planned meeting. >> if and when kim jong-un chooses to engage in constructive dialogue and actions, i am waiting. >> reporter: but he issued a dark warning in his letter to kim. you talk about your nuclear capabilities, but ours are so massive and powerful that i pray to god they will never have to be used. >> our military which is by far the most powerful anywhere in the world and has been greatly enhanced recently, as you all know, is ready if necessary. >> reporter: could that mean war? >> mr. president, does the breakdown of this summit raise the risk of war with north korea? >> well, we'll see what happens. >> reporter: and as president trump pulled the plug on the summit, he left open the possibility to get it back on track writing in that letter, cecilia, if you change your

mind, please do not hesitate to call or write. that's what he wrote to kim jong-un. >> and we will see if that happens. okay, jon karl, thank you. that summit had been on shaky ground for so long and when he called it off, it was a complete bombshell to all of us in washington. we'll see if it happens. >> see if it happens. that's right. we turn to something that is happening. a stormy memorial day weekend across the midwest and southeast. if you're planning a backyard barbecue, you may have to move the party inside. millions in the path of torrential rain as that tropical system strengthens. ginger has been tracking it all. good morning to you, ginger, with the news that everybody doesn't want to hear. >> nobody wants to hear because it's not just annoying, this could be dangerous rain and i'll show you why. right here just near the yucatan peninsula, watching this disorganized area of thunderstorms, broad low pressure. now we're at the stage where we call this thing likely for development as a subtropical or tropical storm. if it's named, it's alberto, the first of the season. what i can tell you is that heavy rain through miami on saturday.

by sunday it moves up, bands of it, to central florida, right through the panhandle, tallahassee included. the heaviest will fall east and northeast so mobile bay, hattiesburg in there as we head through memorial day itself and early next week. >> all right, ginger. as we watch that holiday travel under way looking live at the new jersey turnpike. more than 36 million expected to hit the road this weekend. eva pilgrim is at a gas station in the bronx here in new york. good morning, eva. >> reporter: good morning, robin. this is what so many people are expected to do this holiday weekend. they're going to be filling up. so a little bit of what you can expect as hit the road. well, as far as the traffic goes, the worst time to drive is obviously going to be 3:00 and 6:00 p.m. as we all know, that is when a lot of people are going to be hitting the road getting off work. we know how it goes. congestion-wise, the worst cities, l.a., chicago, even seattle, those big cities are expected to see almost double

the normal amount of volume here in new york, we are expecting to see three times the normal amount of traffic and we have been warning you repeatedly about gas prices. we're expecting to see some of the highest gas prices we've seen on memorial day weekend since 2014. the national average this morning as we wake up, $2.96. that's almost $3. here in new york we are looking at $3.45, robin. >> we'll keep an eye on that. thank you, eva. cecilia. >> it's going to be busy out there. millions are also taking to the sky this holiday weekend. lines are already growing at airports this morning. our senior transportation correspondent david kerley is on the tarmac at washington's reagan national. it is going to be busy there too this morning. david, good morning. >> reporter: very busy already on the tarmac as i see a united aircraft coming in and this is going to be the busiest day of the memorial day weekend. the big three airlines are telling us 8.5 million passengers between now and tuesday, all leading up to a busy summer season and the airlines are saying 4% more of

that disturbing video showing him getting tased. >> a lot of people have seen the video now. >> uh-huh. >> help us understand what was going through your mind when you came out of the drugstore and you saw the police officer. >> you know, i came out, didn't initially see him until literally i got in front of the car and i seen him. still tried to approach the car trying to get in. he came up to me, confronted me. >> how you doing? you got a driver's license? where's it at? where's your driver's license? back up. >> reporter: it was 2:00 a.m. on this january morning. sterling brown parked illegally outside this walgreens is approached by an officer wearing a body camera. >> you don't see the issue here? hold on. >> don't touch me. >> you don't see the issue here. you're not parked across three lanes? >> from there it was back and forth dialogue. >> what was being said mainly? >> i mean, you know, he told me to back up.

you know, he told me to get away from the car and all that and i'm asking what is going on. what are we doing? i mean, i'm double parked. but he called backup and backup came. from there it was -- they surrounded me. >> reporter: six police vehicles arrived on the scene. >> all i wanted was one extra then they bring the whole cast in. >> what was your thought when you saw the number of police officers, a number of police cars that showed up for a parking violation? >> i felt like it was unnecessary. the officer, you know, he said that he only wanted one squad car, but they all came and from there it was just stay calm and try to get out of the situation. >> police were saying you were resisting, that you were being combative. the video proves otherwise. >> exactly. everybody thought i was combative, thought i was being aggressive. but i get mad every time i watch it, you know, because i was defenseless pretty much. >> reporter: the confrontation escalated resulting in the milwaukee bucks guard being tased, handcuffed and arrested.

>> taser, taser, taser. >> ah! >> my hands are behind my back and they still tase me. after that i'm still on the ground ten minutes still wet, face to the ground, knee in my neck and i was, okay, how do i get out of this? how do i get home and see my family? >> why do you think it escalated the way it did? >> i mean, they wanted to control the situation. they wanted to show their force, their power. >> physically, mentally being tasered like that, i mean, how did that impact you? how did it affect you? >> physically it was -- initially i mean you could hear it was a shock like it came out of nowhere. like i tensed up instantly. >> reporter: the milwaukee police chief now condemning that use of force. >> our department conducted an investigation into the incident which revealed members acted inappropriately. >> reporter: hours after being released from a night in jail he returned triumphantly to the court. >> great pass. finds sterling brown.

>> reporter: with a bruised face and a rattled spirit he savored this victory against the brooklyn nets. >> i can only imagine the emotions you must have been dealing with but to go back to work and get back on the court. >> i couldn't let it hold me back so had to channel it and definitely did. i used it as energy and fuel for the game. we had a good game that night. i had a good game. we won. you know, we moved on from there. >> there are always a group of people who say, well, you know, you parked in a handicapped place. if you had complied to everything that the police say, this would not happen. how do you respond to people that no matter what the situation, that is the first thing they jump to. >> whether i was parked illegally or not, it shouldn't have led what it led to. i could have got a ticket and paid however much money. that should have been it. >> reporter: sterling brown is now taking legal action, hoping to bring about change. >> the civil suit, what do you hope to accomplish with that? >> really just hold, you know,

the officers accountable. hold future officers accountable and have the city make a commitment to, you know, to people in the community saying that they are going to try to change some of the ideas and thoughts and policies and try to help, you know, as many people in the community not get involved in the situation like this. >> in your statement you mention those who were in a situation with police officers. >> uh-huh. >> and the outcome was different and that you feel that you're speaking out for them. what did you mean by that in your statement? >> i mean, this happens from coast to coast, you know, it's something that is being shown more now that technology has advanced and it's something that's been happening for years and people's stories have not been told. people's stories have not been heard and i feel like, you know, me doing this helps a lot. >> part of the reason why the story is being told is you're a rookie in the nba. you're a wealthy young black man.

you said that you want to -- you know there are many who don't have the resources or the platform. >> right. >> you want to be their voice too. >> yes, definitely, definitely. i feel like it's my responsibility and it's something that i hold, you know, dearly. >> sitting across from you a few weeks ago, sitting across from the two young black men who were arrested at starbucks, daunte and rashon, how do we change? here we are in 2018 and we're still talking about this. >> what we can do is keep fighting, you know, keep bringing attention, keep, you know, putting pressure on the police departments and the officers and the mayors and everybody to try to make change. >> and, again, this happened in january. the video, the body cam video was just released a couple of days ago and the police had said that he had been aggressive and when you watch the video, it's lengthy, never was he aggressive, even the police chief saying that it was inappropriate, the behavior of

in the courthouse behind me, harvey weinstein arraigned on charges of sexual rape and assault. while more than 80 women have accused him of various allegations, this is the first time that he faces criminal charges. these charges stem from allegations made by two women, actress lucia evans and an unnamed woman who came forward in recent months. evans told the new yorker in october that weinstein overpowered her and forced her to perform a sexual act during a business meeting at his manhattan office. weinstein is posting $1 million, being fitted with a monitoring device and will surrender his passport. the case is adjourned until july 30th. rose mcgowan tweeted this morning, we got you, weinstein, we got you. he entered a not guilty plea and says he experts to be exonerated. an exciting announcement for

>> oh, my gosh. >> reporter: it happened in march and thankfully no passengers were on board but it's not the first time. look what happened to this car in new hampshire just last year. a driver in an unfamiliar city says she followed her gps onto the tracks narrowly escaping getting hit. new york's long island railroad says so far this year it's confirmed 21 incidents involving confused drivers turing onto tracks. some claiming they were following gps. what do you think it is about railroad tracks that has people so confused? >> the motorists have told us the gps told them to make the turn and it's unfortunate that you turn onto the tracks versus parallel roads. >> reporter: here's the likely issue with navigation devices. a gps tells the driver to turn right meaning at an upcoming street but at night or in low visibility, the driver may think this is the turn, a railroad crossing turning onto it without a clue. we had to see for ourselves. so we're trying to get to a business that's right after these train tracks here -- >> turn left. >> it tells us to turn left.

there we go. we easily could have turned left right onto train tracks. watch again. this is the moment the gps tells us to turn. there's the crossing signal. the tracks right in front of us. if you are distracted, if it's dark out, if there's low visibility, we easily could have gotten on those tracks. and that fireball in march, we went to the scene. so this is where she was supposed to make that left, instead she thought the gps meant this left, the railroad track. you can see how close this is to the road so this is what they've done, they've added new markings, new reflectors down there and new reflectors up here four feet high. the long island railroad telling us these safety features will soon be installed at all of its nearly 300 crossings. they say they're also working with gps app developers in hopes of making those directions more clear. basically you want it to say something like make a right after the railroad. >> right, anything that could get the motorist's attention.
