breaking news just in, 49ers legend dwight clark has passed away. that news is just coming in fm his official twitter account. good afternoon. thank you for joining us. i'm ama daetz. >> i'm larry beil. sad, sad news. his wife kelly sent a tweet at 3:39 saying i'm heartbroken to tell you today i lost my best friend and husband. he passed peacefully surrounded by many of the people he loved most. i'm thankful for all of dwight's friends, teammates, and 49ers fans who sent their love during his battle with als. dwight a two-time super bowl champion best known for the catch, this iconic play with joe montana rolling out to his right, throwing in desperation in the 1982 nfc championship game and dwight hauling it into the end zone that hailed him as an icon for life for the 49er family. dwight was honored last season as his als started to ravage his

body and all those close to him knew that the end was coming. we didn't know how soon it was but he had moved with his family, his wife, to montana for his final days to try to be at peace. said good-bye to so many of his teammates. i have to say the times i spent with dwight clark one of the things you always felt with him was he always made you smile. he had the funniest stories, the funniest jokes. he was just a tremendous man, a football player. a business man. broadcaster. dwight clark gone too soon at the age of 61. >> what a loss. we have just learned san francisco's police chief will not be going back to los angeles. that announcement was made just a few minutes ago by mayor garcetti. he was one of three finalists for the role. instead garcetti promoted

assistant chief michael moore to the post. the 36-year veteran will succeed charlie beck. scott has deep ties to the los angeles police department. when he left the force in 2016 to become the sfpd chief he was lapd's highest ranking african-american officer. a deputy chief who spent 27 years with the force. moments ago garcetti called scott a visionary leader doing great things in san francisco. we're working on getting reaction from chief scott right now and will bring that to you as soon as we hear from him. one of the most anticipated supreme court decisions was announced this morning. in a 7-2 vote they sided with a baker. this case and what it from over. >> reporter: oh, larry, this is just the beginning of many similar case that is will go before the supreme court, one involving a florist who did not want to provide flowers for a

same-sex wedding. now justice anthony kennedy led the majority saying the issue, quote, must await further elaboration, meaning the baker case was very narrow. ironically the rainbow flag was raised outside of san francisco's city hall for pride month on the day the supreme court ruled against a gay couple who wanted a colorado baker to create their wedding cake. >> we can't even get a wedding cake. what is this? 7-2. >> reporter: ruth bader ginsburg and sotomayor dissented. the couple asked colorado baker jack phillips to design a cake for their wedding. phillips refused stating it was against his religious faith. the couple took its complaint to the colorado civil rights commission which decided that phillips discriminated against them. but, led by justice anthony

kennedy, the other six justices agreed that from the beginning the commission was hostile towards the baker's religious beliefs. >> the first amendment free exercise clause requires there shall not be government preference or hostility towards religion. >> reporter: chairman of the san francisco republican party. >> i think all americans can find comfort in this ruling in that the government has to give you a fair, neutral and respectful hearing. >> reporter: the remainder believe because the colorado commission was not impartial the supreme court could not address the bigger issue of whether a business can refuse to serve gay and lesbian couples. >> other legal organizations will be there for the next case and situation. at some point the supreme court is going to have to address this issue head-on. they did it not do that today. >> and the mayor of san francisco mark farrell said he was disappointed with today's ruling saying that it will now

create the kind of hateful rhetoric the nation has been hearing since president trump took office. in the newsroom lyanne melendez, abc 7 news. a modesto man charged planning an attack pled guilty today. emerson entered for providing support to a foreign terrorist organization, namely isis. jameson was arrested after he told undercover agents of plans to use pipe bombs and guns to kill tourists at the popular tourist spot. a federal magistrate earlier found jameson appears to have a mental health condition. he's facing 15 years in prison. two men arrested and charged with sexually assaulting a san francisco woman after she mistook the suspect's car for a ride share. one of them is also being accused of trying to kill that woman. the crime happened april 14th when a woman left bruno's nightclub. she took a ride share to the wrong location at stanyan and

fulton streets where she waited for a second ride share. it was there that investigators say two men forced her into the back of their car and drove to sonoma leaving her is he safeway. they say she was assaulted during the entire trip. they arrested freddie lopez flores and quintero. quintero is being held without bail on the attempted murder charges. a head-on crash between a car and big rig truck shut down vasco road this happened around 2:30. sky 7 was over the scene in contra costa county. an emergency rk landed on the roadway to transport trauma patients. it's unknown how many were injured and the severity of their injuries. a fire is under investigation today this happened saturday at schnitzer steel near the port of oakland.

that plant has had nearly half a dozen fires since 2010 but none as big as this past weekend. laura anthony has more. >> reporter: the smoke could be seen for miles, a huge plume thick and black. all coming from the recycling plant. >> going back to 2010 there's been five incidents out here. >> reporter: the plant has had its share of fires but most not as serious as this one. again, we're going through an on going internal investigation to determine the cause so we can have best practices in place. >> reporter: as seen from drone view 7 on saturday the smoke billowed for about an hour before fire units from oakland and agencies as far away came in to help especially crucial since oakland no longer has a water boat of its own. >> we called in alameda county fire. we also used the fireboat from the alameda city and we also

were able to get a type one fireboat. >> reporter: they credit mutual aid with helping them knock down this fire quickly. the lack of available water in this neighborhood was a big challenge. >> it's not good for us to be breathing in. >> reporter: the thick, black smoke was alarming to residents of west oakland. >> oddly it's not the steel, it's the items in the car and the paint on the steel that produces the actual fumes that gets admitted into the atmosphere. >> reporter: the cause of the fire still under investigation. b.a.r.t. riders have a new tool the next time they encounter a nasty mess. a biohazard button on their website. they don't it need to submit their name or e-mail just a description and location. they have employed more cleaning crews in oakland. that way crews will get to

urgent messes faster. a new survey is giving us an idea how much time bay area commuters are spending getting to and from work each day. it is not pretty. according to a poll of registered voters, 50% say their commute is between one to two hours a day. residents have the longest commute averaging 48 minutes each way. >> the poll was released one day before voters will decide the fate of measure three, it calls for a $3 toll increase over six years to pay for road and transit improvements. former mayors campaigned for the measure today in san jose. they say it's a coordinated approach. >> transportation is horrible. this is a way to get some relief

entresto, for heart failure. let's get back to kristen sze as we talk about tomorrow's primary. in california we have an open primary, the system that we adopted eight years ago advances the top could finishers to the november election. there are 435 seats in the house of representatives. right now democrats control 193 seats. seven seats are vacant. to get a majority and reclaim the house democrats need to defend all their current seats.

seven of those are in california, more than any other state. districts 39, 48 and 49 all in southern california n. two of the races the gop incumbents are retiring and should offer democrats an opportunity but ironically due to a flood of democratic candidates running spurred on by opposition to president trump it will be split by many and that could allow two republican candidates to rise to the top. more parps in the key districts. democrats are hoping for a huge turnout tomorrow. traditionally midterm

when the worst oil spill hit san francisco, first responders went to work. and mayor gavin newsom, he went to hawaii. man: newsome left the day after the spill for a four-day vacation in hawaii. the same gavin who said his job as lieutenant governor was so dull, he only showed up for work at the state capitol one day a week, tops. gavin's not gonna work as governor.

the death toll is soaring from yesterday's violent eruption of guatemala's volcano of fire. officials now confirm the deaths of 62 people, more than double the total they released earlier today. the bodies were recovered in two of the villages that were buried under hot ash and mud. this video shows a mud flow just engulfing a highway.

officials are calling the eruption the most powerful in guatemala in a century. lava from kilauea volcano on the island of hawaii has cut off all access to one community trapping some 12 residents, some of whom still refusing to leave their homes. officialsish use mandatory evacuation orders. anybody who chooses to stay may have to pay the bill for their own rescue. >> 29 years since the tiananmen square crackdown. thousands attended a vigil in hong kong's victoria park. chinese troops killed hundreds of protesters in beijing who were demanding freedom of speech and government transparency. a lone man standing in front of a tank in the square. people can demonstrate but fellow citizens on the mainland

cannot. an fbi agent whose gun discharged after he did a back flip at a denver nightclub is still awaiting charges. police are awaiting test results to determine if alcohol was a factor in the accidental shooting early saturday morning. the fbi hasn't commented or released the name of the agent involved in the incident. one person was hit in the leg by the stray bullet. they are expected to be okay, fortunately. >> so many local laws, state laws have been passed to make everybody safe around the country but it is not enough. >> the two goals of their trip that will take them to 20 states. >> a man wanted for several murders has been found dead.

change is brought from same you people who helped organize the march for our lives protest in washington, d.c. today's announcement comes hours after an emotional graduation ceremony for the senior class of marjory stoneman high school. the former sheriff's deputy who has been widely criticized for not engaging the suspect broke his silence today. scott peterson said he's haunted by the events which took place at the high school on february 14th. he says if he knew exactly where the shooter was, he would have acted. >> knowing what i know today i would have been in that building in a heartbeat. like i said, it was my kids. it's just i didn't know and i rack my brain. i go, why? >> peterson retired from the broward sheriff's office after surveillance video showed him outside the building where the shooting happened. he never confronted the shooter. 17 people were killed in the

attack. arizona police believe the suspect in multiple murders is now dead after a shoot-out with police. we're learning more about the connection between the suspect and the victims. abc news reporter alex stone has the latest. >> reporter: the possible end to a string of murders, the suspect who sources tell abc news was dwight jones found dead inside this hotel after a shoot-out with police. hotel guests went running during the gunfire. >> shots were fired and then we ran over this side. >> reporter: a police robot found its way and side. >> we did make entry into that room and located the suspect deceased from an apparent self-inflicted gunshot. >> reporter: the murder spree started last week. on thursday dr. steven pitt, a well-known forensic psychiatrist who took part in high-profile cases including the jonbenet i dead at his office. witnesses said they heard arguing. >> they heard shots, think somebody is hurt. there was a lot of arguments.

>> reporter: two paralegals working at a firm that focuses on child support issues were found murdered. they learned jones was involved in a contentious divorce. dr. pitt, the first victim killed, was ordered to evaluate jones and the two paralegals killed worked for the law firm that represented jones' ex-wife. >> evidence links these scenes, the phoenix murder, the double murder in scottsdale and the third murder. >> reporter: police release this had sketch of a possible suspect. the reward for capture increased several times, the case coming to a deadly end inside thisho >> late this afternoon police said they've connected the suspect to the shooting deaths of a man and woman inside a home. investigators say they're not sure if those victims are linked to the suspect's divorce case. there's been a lot of speculation as to the first lady's whereabouts in the last several ek undergoing surgery.

i support the affordable care act, and voted against all trump's attempts to repeal it. but we need to do more. i believe in universal health care. in a public health option to compete with private insurance companies. and expanding medicare to everyone over 55. and i believe medicare must be empowered to negotiate the price of drugs. california values senator dianne feinstein boasting. overselling his achievements. making false claims. as lieutenant governor, he skipped many of his duties, saying the job was "so dull," he only shows up to work at the state capitol "like one day a week, tops."

tomorrow's election day, always a lot of measures on your ballot. one seeks to ease bay area traffic congestion. measure three would raise the bridge tolls except on the golden gate to ease congestion and theoretically fix mass transit, and you are against it. why? >> i am, unfortunately. i've been involved at the local, state and federal level. that corridor that will contribute the most is the bay bridge, the most congested corridor in northern california. the people who will pay $750 million more won't see a benefit to their commute. ferries will help. i think it's unfair and not good planning. >> what would be better planning? >> they have you had have gone through the federally prescribed process and looked at all the projects and model them as they should and let the public know and have a discussion. if you're going to raise to a group of people they should see

benefit from that investment. >> a lot of people in the east bay feel like why would we go for this, it's not going to directly benefit them. we did the story about the suggestion president trump might pardon himself or theoretically could do that for anything uncovered in the russia investigation. you had an interesting tweet regarding that comment. >> rudy giuliani made a comment if he shot former director comey he could pardon himself, and the tweet just relates to that. the question is, does this sound like an innocent man? my colleague, republican colleag colleague, defended the president. recently he said to the president's attorney if your client is innocent, act like it. he's certainly not acting like an innocent men. >> have you gotten any pushback from your tweet? >> no. this is the bay area. >> that's true. it might be different in other areas. back to the election.

voter turnout is expected to be low, well below 50%. what's your general reaction to that? >> i'm depressed. i think if you want to have a vibrant democracy people have to vote. we have important elections locally. we have district attorney races around the bay area. we have legislative races and primaries. people need to be engaged. >> are you surprised at all especially in california with the reaction to the presidential election, i thought there would be a groundswell, okay, we have to get involved now. it's midterm and primaries or just a general disinterest people down on politics? >> i think research suggests the latter, people are so fed up of the reality tv show that is this administration they're tuning out. people have to re-engage. it's not unusual in the midterm. people need to vote and they need to know what they're voting

on and not be fooled. >> thanks for coming in. ama? professional sporting leagues in the state of new jersey are duking it out over a sports betting bill. the law is opposed because it doesn't include a so-called integrity fee that would compensate leagues for policing bets on their games. new jersey lawmakers say the fee isn't needed and won't happen. the bill considered includes a sports betting tax of 13% that would go to casinos, rate tracks and the state. time for ask finney. ben is asking, where is the best place to get a personal loan? >> if you have a good credit score and a long history with a financial institution, i would start there. then check with your credit union. if you don't have one there's certainly one near by.

the rates and fees you're going to pay, i have to warn you, will be all over the place. this is where you really have to shop around. they'll be really low and really high for a personal loan. lisa asks, i bought kitchen cabinets that were supposed to be installed within six weeks, but it took the contractors almost four months to finish. is that okay? >> we've never heard that story before. if you're happy with the cabinets, my advice is just forget it. by law there needs to be an approximate completion date written into the contract. if there were delays outside the contractor's control f. you think they were actually dragging their feet trying to save money now, spend it later, i want you to consider filing a complaint with the contractor's state license board. with all of that said, if you liked the cabinets i'd just forget it and move on.
