raising graduation rates over 60%. marshall tuck for state superintendent. marshall tuck. live where you live, this is abc 7 news. it is your chance to make a change as the bay area goes to the polls. we caught up with two big gubernatorial contenders, cox and lieutenant governor looking for us to give him a promotion. i'm reggie o gie akei. there's so many decisions, but we start at the top of the ballot, race for governor. the top two move into the general election in november, and leading the polls going into today, the lieutenant governor. amy hollyfield is live, amy? >> reporter: hi, good morning, reggie.

the lieutenant governor voted moments ago. this is the moment we captured moments ago here with his four kids and wife. youngest, dutch, in his arms. polls show that he is the front runner. the headlines today that the big question, who gets sec place and run against newsome. he said he's watching the polls and feels good, but said he's not going to get over confident. >> at the end of the day, election day is what matters the most, and we'll be monitoring north and south to see if there's any anomalies, at least as i walked here, i have not checked my cell phone yet, things are looking favorable, but, again, it doesn't matter until the polls close at 8:00, and every vote is counted. >> reporter: he brought his kids and talked about them at the end of the interview saying campaigning with them is fun, but different, suggesting that's possibly why he was about an

hour late this morning casting that vote. we were waiting for him, thought he would be here at 9:45. he said it's been a different experience but thinks it would ruing ro hlsn to have the kids sacramento. he says that frames his decision making and view ps as he raises them. they are growing up, he said, as he's growing up. he's had a lot of ups and downs for the kids, watching them experience, and his daughter, montana, could not sleep because of negative talk she heard about her dad, so he talked to her about staying positive. a different gavin than covered throughout the years back when she was just supervisor in san francisco and then the mayor. he will be in san francisco tonight watching the returns come in. he's watching that in the mission district. live from his home, amy holk lefield, abc 7 news. >> thank you. let's talk about the former los angeles mayor who cast his ballot this morning in l.a. he entered the governor's race expected to be a tough

challenger against newsome, but he's been slipping in the polls. in attempt for a late surge, the former mayor criss-crossed the state in recent days. >> excited. i workedheart hard. last night, we finished at 1:00 in the morning, up at 5:00, and at a metro station, were were at pinks last night. >> leading republican in the race for governor cast his ballot yesterday in san diego. recent polls show john cox in second place behind newsome. cox looks forward to debating newsome ahead of the november election. the san francisco mayor race is another big one to watch. these are the eight people running. seven democrats, one republican. the winner will serve the remaining term of the late mayor ed lee, and will face some daunting challenges with the affordable housing and homelessness top of mind in the city. this is video of the mayor voting this morning at roosevelt middle school.

amy hollyfield caught up with him after he cast his ballot and asked about future plans. >> i want to focus on making sure the transition is smooth as possible and looking forward to spending time with these guys around here. >> reporter: will you miss the job? >> absolutely. it's an honor of a a lifetime, certainly as someone born and raised in san francisco to be the mayor and to lead the stay. >> reporter: he did not say how he voted, but no matter who wins form, he or she can expect full commitment on a smooth transition. now to a voting rarity in california. a judge is facing a recall vote the first time we've seep this in more than 80 years. that judge is aaron persky. he sparked nationwide outrage after sentencing former stanford student brock turner to six months in jail for the sexual assault of an unconscious woman. that followed the recommendation. prosecutorsme menmen wanted six.

they'll decide whether the term is cut short by four years. we'll decide on ballot measures today including regional measure 3. now, that would increase tolls at almost all bay area bridges by $3 over the next seven years. it includes the bay bridge. it does not include the golden gate bridge. the 4.5 billion dollar measure funds 35 projects with the goal of reducing traffic by increasing ferry service, improving bus systems, and replacing bart trains. other measures are proposition 69, state initiative ensuring new transportation revenue is spent only on transportation projects. this is a companion measure to the 12 cent a gallon gas tax approved last year. in san francisco, proposition e bans sale of flavored tobacco products and nicotine products. complete election coverage as results come in at 9:00 p.m. and at 11:00 p.m. here on abc 7 news. we have results online as soon

as the polls close. you'll find that at abc7news.com/election. now to a rear fire to a car dealer in the south bay. the gas and oil fueled the flames and put firefighters in danger. the acura dealer is where our abc 7 news reporter, matt keller, is right now. >> reporter: firefighters are here ensuring there's no hot spots here, and that the structure is still standing and secured. officials hope to reopen some time today. stevens creek boulevard in santa clara is well-known for one thing. >> this is the mekkah of car dealerships, this strip. >> reporter: unfortunately, the dealership never opened this morning before fire erupted in the service department. firefighters were called in at 6:20. workers say the flames burned part of the building where ten service bays were located. service technician, dave, told

us what was inside. >> customer cars,age, all our tool boxes, and we have oil drums, fresh oil, a big gas line through the building. >> reporter: firefighters pulled out quickly before the roof collapsed. there was a fire wall on the inside kept the flames from spreading to other parts of the building. because it's an auto repair shop, there's a lot of flammable fluids stored inside, however, the fire chief said they have done inspections here before. >> we limit the amount of chemicals they have on scene so that just for this reason, so if something happens, nothing gets out of control. >> reporter: no one injured, winds cooperated as well, but the black smoke went straight up, and the next step? fixing what was damaged today. >> it would be a shame for us to leave here, but i doubt -- maybe build a great new building, new products out, a nice new building to match it. >> fire marshalls are looking into what started the fire, looking at all possibilities. reporting live in santa clara,

abc 7 news. >> thanks, matt. new at 11:00, fashion designer kate spade is dead at the age of 55. sources tell abc news she die by suicide. here's more. >> reporter: it was around 10:30 in the morning when police here in new york city said they were called to an apartment on park avenue where a household employee found kate spade hanging from a bedroom doorway. police are treating her death as an apparent suicide. they said a note was found near the body. her husband was seen at the apartment speaking to detectives. kate spade was 55. in 1993, she founded her name sake fashion house starting by designing handbags and eventually branching out to accessories and clothing. she founded a new venture called francis valentine. kate spade dead of apparent suicide here in new york. she was 55. abc news, new york. >> we want to let you know, there's resources to help you or others you may know who could be having a mental health crisis.

you gotta go to ross. had is video of harvey weinstein arriving for arraignment this morning in new york city pleading not guilty to rape and criminal sex acts charges. abc explains why his attorney now says they are ready to begin their fight. >> reporter: harvey weinstein arriving at the courthouse today toorma hea tchar nts o rape and one count of criminal sex act. he pled not guilty at arraignment. >> we begin our fight now.

we will fight this case in the courtroom. >> reporter: he's accused of raping an unidentified woman and forcing a second to perform a sex act on him. evans told the new yorker in october that weinstein to perform the act in a business meeting in his office in 2004. harvey's lawyer called the rape accusation absurd claiming the accuser and he had a 10-year relationship. >> we will proceed expeditiously and vigorously to try to clear mr. weinstein's name. to date, these two charges are in my opinion imminently defensible based on what we have learned. >> reporter: the manhattan district attorney saying the team is trying to attack the victims, adding the defendant's recent assault on the integrity of the survivors and legal process is predictable. in the meantime, outside the white house here in manhattan, his attorney tells us he's considering filing a motion to split this case into two.

he says heelieveex s andheap chy ire two separate trials. linda lopez, abc news, new york. say good-bye to the swim suit competition. this year, the miss america competition will no longer be a beauty pageant. the chairwoman made the announcement this morning on "gma," and in addition to banishing swim suits, the competition no requires contestants to wear evening gowns. jessica castro spoke about the big changes. >> do you think they watch the competition without the swim suits? >> yep. ironically, there's been stereotype out there forever and ever that people watch to see the swimsuit, and that's not true at all. the highest ratings come when the candidates perform their talents. >> carlson says instead of beauty, miss america highlights the talents, passion, and ambition of the concontestants.

the philadelphia eagles were supposed to visit the white house today, but presidetoday, b took back the invitation. here's the thing, no one on the team knelt during the whole season. sources tell espn five or fewer players had committed to actually attend that white house ceremony. let's talk about the warriors now. their forward has not experienced any pain over the pat few days and plans to return to the nba finals. however, his status for corm's game three is still officially unknown. that's what sources tell espn, our sister network. andre sustained a bone bruise in the left knee during game three of the conference finals against the houston rockets. the head coach steve kerr is optimistic andre will play at some point in the series, and abc 7 is the only place to watch the nba times presented by youtube tv. game three of the warriors versus cavaliers is tomorrow evening in cleveland. we'll have a pregame show at

a a texas woman thanks her driver for reading her door mat that says "please hide packages from husband," so that's just what the man did, hiding the package behind a chair on the porch. the family posted video from their doorbell security camera to facebook saying they laughed, mike, had a good old laugh about that. he followed directions. >> he did. >> right? >> he listened, i like that. really good. >> tip the man next time. >> right. it's going to be talking about someone who is doing the right thing at your doorstep and not stealing your packages.
