at school at the time. >> there was a suicide note left at the scene. i'm not going to get into the contents of that note, but that appears to be the sum total of what it is at this point. >> reporter: spade's brother-in-law actor david spade paid tribute to her on instagram posting a picture and writing, kate and i during christmas family photos. we had so much fun that day. she was so sharp and quick on her feet. she could make me laugh so hard. i still can't believe it. and in 2002 spade won "glamour" magazine's woman of the year. she told the magazine back then she hoped to be remembered not just as a good businesswoman but as a great friend and a heck of a lot fun by the people close to her. she's certainly being remembered that way this morning. we turn to politics and the results overnight from the biggest primary night of the year. eight more states have now set their candidates for this november's midterm elections. but we're keeping watch on california, which could reshape the battle for control of congress. problems have been reported at

the polls, though, overnight. abc's janai norman has the latest from there, from d.c. good morning, janai. >> reporter: kendis, good morning. it was a very big day. the biggest primary day of the year as you said and democrats especially are keeping a close eye on the outcomes in california as those could have big implications for the midterm elections. the stakes are high and the competition stiff. >> if democrats are going to take back the house, they need to see the blue wave start right here in california. >> reporter: on tuesday voters picked nominees for senate seats, governor and a number of key congressional races that could determine whether democrats regain control of the house come november. at the center of the action is california. the state's jungle primary system allows the top two candidates to advance to november regardless of party creating a unique challenge for the 47 candidates running across three battleground districts. >> that means if you have ten good democrats and only two solid republicans, the democrats eat their own vote away, and you're stuck potentially with democrats shutting themselves out. >> reporter: incumbents majority

leader kevin mccarthy, house minority leader nancy pelosi, representatives devin nunes and maxine waters and senator dianne feinstein all fared well. in the race to succeed california's democratic governor, lieutenant governor gavin newsom is the clear frontrunner. >> we put a businessman in the white house. let's put a businessman in the governor's mansion, huh, yes. >> reporter: republican john cox is projected to run against newsom in november but democratic candidate and former los angeles mayor antonio villaraigosa is calling to re-open polls for the rest of the week after a printing error left more than 100,000 voter names off of polling place rosters. >> tonight the votes, as you all know, are still being counted, and the fight is far from won. >> reporter: and democrats would need to flip 24 republican seats in order to regain control of the house come november. and, kendis, get this, as far as that voting glitch in california, henry winkler also known as the fonz tweeted that his name was one of those left off voting polls. >> what?

>> the fonz. trying to keep the fonz from voting? >> he just showed up -- >> his name not there. >> did he say aaay! even that didn't work? >> reporter: that didn't work, i guess. >> janai, thank you. and the white house aide who caused controversy with a dismissive comment about senator john mccain has left the trump administration. kelly sadler told colleagues last month that mccain's opposition to the president's cia nominee didn't matter because, quote, mccain is dying anyway. well, she did not offer a public apology for that. and white house press secretary sarah sanders is firing back after some tense questioning. sanders told reporters she's an honest person, but she's refusing to explain why she falsely claimed that the president did not dictate his son's statement about a trump tower meeting with the russian >> i know that you guys would love to engage on matters of conversations between the special counsel and the outside counsel, but we've purposefully

its close relationship with the chinese government. the tennessee man accused of killing his former boss with a hatchet has been captured. domenic micheli was caught near bowling green, kentucky. he had been on the run since monday's early morning attack. it was at a gym near nashville. the arrest came a few hours after police released a video of micheli in a drugstore. time for a look at your weather on this wednesday morning. it could be months before this highway in north carolina is open again. a landslide after days of heavy rain pushed thousands of tons of mud, rocks and trees onto highway 9 in henderson county. the debris is 20 feet deep in some areas. luckily no injuries reported. looking at today's temps, the northeast will be cool today with boston not even reaching 60 degrees. the south will be hot and humid with highs in memphis and atlanta of 91. midwest will be warm. minneapolis hitting 81. seattle only hits 75.

the vehicle cops are chasing is an armored personnel vehicle belonging to the national guard. it was apparently stolen from a base about 40 miles south of richmond. police haven't released the suspect's name, but they say he is a member of the military. he led officers on a chase up i-95 until he was finally captured in richmond. and we turn now to the so-called dancing doctor facing new legal troubles. >> the georgia dermatologist was seen dancing to music during surgeries. she's facing numerous lawsuits and now one patient's family is speaking out claiming the doctor's actions caused brain damage. an atlanta area doctor's methods and recent settlements now under fire this morning. ♪ she had them apple bottom jeans ♪ >> reporter: dr. windell boutte or dr. booty as she calls herself is a dermatologist. in these now deleted videos on youtube she's seen dancing during surgeries. ♪ she's a brick house >> reporter: several of her patients are now suing saying

their cosmetic procedures went horribly wrong. investigative reporter jim strickland with our atlanta station wsb worked the story for several months. he found the doctor settled five malpractice cases in the last six months, and four more are pending. the cornelius family is one of those who settled for an undisclosed amount. their mother went into cardiac arrest during a tummy tuck. her family says she suffered permanent brain damage. the doctor's office had to call 911 in the middle of the procedure. >> we have a patient that doesn't have a heart rate. >> reporter: in a deposition the doctor explained she did $20,000 of work for ms. cornelius for a little more than half the price. other patients suing say they suffered post-operation infections. >> i don't feel like a normal person. i just feel deformed. >> it's more like freddy krueger cut my stomach. >> reporter: strickland caught up with the doctor, and she had little to share. >> so, i'm coming here to ask if

you have anything to say about the lawsuits against you or the youtube videos posted online. dr. boutte. >> she's still moving, not speaking. according to the state's physicians website, dr. boutte's license is in good standing. she continues to treat patients. abc reached out to the doctor and her lawyers, but they did not provide a comment. a new report is reminding parents about the danger of leaving children in hot cars. nine kids have died in hot cars already this season. on average 37 children across the country lose their lives this way. advocates are pushing states to pass tougher laws to bring attention to this annual problem. police in philadelphia say a 15-year-old learning to drive hit and killed two people in this parking lot. the men were actually trying to help her park in the front of a store when her suv lurched forward. her mother was in the passenger seat. no criminal charges have been filed. epa chief scott pruitt is under fire this time for allegedly using his position to try to line up work for his wife. pruitt reportedly contacted fast food chain chick-fil-a about his

wife becoming a franchise owner. now, she never completed the application process, but pruitt's use of a former staffer to initiate contact with the company is a possible violation of federal law. pruitt is already the subject of a dozen federal investigations. and the stars of the hgtv show "fixer upper" have reached a settlement with the epa after they were accused of mishandling lead paint. chip and joanna gaines have agreed to pay a $40,000 fine and complete work to reduce lead-based hazards. the epa says it uncovered the violations by reviewing the show. sports and politics, the warriors and cavs battle in game three of the nba finals tonight, but when it comes to president trump, they're on the same page. the president disinvited the super bowl champion eagles to the white house after most of the team decided to skip the event. instead he held a so-called celebration of america saying those who don't stand for the national anthem are disrespectful. nba rivals lebron james and steph curry are making it clear

now to those primary results. we'll kick off are the race for california governor. there are 27 ballocandidates. >> the top two candidates as of right now, gavin newsom with 33% of the vote and republican john cox, 26% of the vote. that is with 94% of precincts reporting. california has the open primary system. that means the top two vo vote-getters move on to the general election regardless of their party. >> gavin newsom says he's ready for that next step, heading towards the november election after taking the stage here and declaring victory two hours after the polls closed. he and his wife jennifer came out dancing to tupac shakur's rap song, california love. he shared with the crowd his vision for the state, one that includes health care for all and an end to childhood poverty.
