parents of 15-year-old benjamin curry. the high school freshman who drowned in the pool at san ramon high school. at the time there were rumors and some news reports that the boy had committed suicide. but now a coroner report says while curry might have been treated for depression his drowning was far from intentional. and there is video that appears to prove it. >> there was a false narrative out there that the school district could have put a stop to immediately all the school district had to do was tell the public and those listening that the young man died in class. >> according to the contra costa county coroner a danville police officers viewed video taken du a the end of the fourth period he observed the decedent in the swimming pool with multiple other students. he observed the decedent submerge and not surface. the video doesn't show the teen again until his body was discovered by students and the teacher of the next class. nearly an hour later. the coroner's report concludes all o although the decedent

a frank admission today from the husband of designer kate spade who committed suicide yesterday. andy spade told "the new york times" his wife suffered from severe depression the last six years. he said she had had been regularly seeing a doctor and taking medication for the disease. andy spade acknowledged they had been living apart the last ten months but no plans to divorce. kate spade hanged herself inside her new york city apartment. she was 55 years old. now a wild crash in oakland that ended in a violent confrontation, happening just after 6:00 this morning. police say the car ran off the road went airborne, and slammed into a house just look at it. the driver, though, walked away from the scene. authorities and paramedic caught up with him and he assaulted

mayor villaraigosa would do better. and i think in hindsight and politics is very much about hindsight he would have better served to sought the lieutenant governor position in this. one of the problems villaraigosa had going in is he angered teacher union in southern california. had been associatewood the charter schools. and that meant that public school teachers and their union which are powerful and spent a lot of money did not get behind him in this race. and as a consequence when you contrasted him with given newsom who had the lieutenant governor title behind him not that he was doing anything with it he was just hanging out. >> biding his time. >> waiting for brown to leave. that gave him the option. and republicans came into the race in a big way because they wanted somebody at least take the number two position and be in the race just like exacts have been hoping to do with congressional race zploos and villaraigosa really had been out of public life for several years. >> he had been. and that's why i'm saying i think he would be better served finding another job basically. >> does john cox have a chance

in november. >> well it's an election. everybody has a chance. but realistically no simply by the math there are more registered democrats voting in the state than republicans. and so by a big number. it will be difficult for cox to win. but the fact that he made the number two position means that republican are weigh up. and perhaps if any register more voters might have more impact. i think they are impact probably will be health in the assembly and senate not in the governor office. >> let's talk about the san francisco marries controversial rank choice voting. >> yeah. >> last night london breed when we all went to bed was apology ahead process. now mark leno doing because of the ranked choice voting process. any surprise and what is your take on ranked choice voting. >> let me preface that i went through two elections myself like that and saw up close and personal what rank choice vote omething like. and rank choice voting is all about who you give your number two and number three choice to. because the first place votes are counted and after that it

nobody has more than 50% of the votes you start moving up from the bottom taking seconds and thirds to see if you eliminate somebody. basically what happened this this election is the same thing that happened to so far as we know, what happened so don per ata when he ran for mayor of elbowed a race i was involved in. he got the most first place votes. but then there were deal making between the other candidates about seconds and thirds. and the most of those went to jean quan in that election. the guy getting most first place votes like londed breed found herself the next day today in second position. now let me just say about the race quickly we haven't counted the votes. s in a 1% difference. this could be a race for to one. with you right now it looks like leno out maneuvered. >> 21% voter turnout that's aenemyic can we expect better in november. >> absolutely. one of the problem with the primary system where we delivered two candidates it the fall is there is no finality. voters doesn't have as much investment in this as in the

dare disease causing debilitating seizures. >> she was having up to 20 seizures a day with tremors almost 24/7. very hard. >> two surgeries failed to help. so in 2015 katlyn traveled to the cleveland clinic for a third procedure to stop the seizures. during the recovery the hospital staff helped her decorate her room in warrior colors. the side effects of the surgery included left side paralysis and headaches. this video shows her during a physical therapy session learning to walk. when she got back to the bay area she emailed steve kerr who was suffering from headaches after final surgery. to her amazement the coach wrote back and invited her to a game. a kind gesture that cemented her status as a superfan. she has caught up academically. teachers applaud her spirit. >> she sets examples for students on campus about what looks like to hold yourself to high expectations and set goals
