charged with did he frauding doctors patients. chris wynn is live in san jose with the story tonight. chris. >> reporter: dan and ama, friends and family were in the courtroom today to support holmes as she appeared in court for the tiers time this afternoon. she pled not guilty to the charges. once known as a rising star, theranos founder and ceo continued her downfall at the courthouse in san jose. facing charges of wire fraud longside the company president. as a 19-year-old stanford drop out holmes founded theranos in 2003 pitching the company's technology as a keeper more efficient way of doing blood tests. this video shows her meeting with then vice president joe biden we he visited the company's newark lab in 2015. however federal prosecutors say holmes and balwani engaged in a multimillion dollar skoem to did

he fraud investors and a separate scheme to did he fraud doctors and patients alleging the two lied about accuracy and rileability of products. in a statement the u.s. attorney for the northern district of california said investors large and small from around the world are attracted to silicon valley by its track record, talent and its promise and attracted by the fact that behind the entrepreneurship are rums of law requiring honesty fair play and transparency. abc news has covered claims against theranos in the past. this man says he became skeptical during a routine test at walg dreens when i understand of a test they took out a test tube. >> you can't lie. >> he claims that test inaccurately showed he had pree diabetes. holmes did not compensate on the charges as she walked out this afternoon but balwani's attorney says his client is innocent. >> mr. balwani invested millions of dollars his in own money.

police in the east bay are looking for gunman involved in a shooting that sent five people to the hospital last night. and of all places a mortuary. it happened outside the chapel of the chimes. abc 7 news reporter less will i brinkley is on the story. >> reporter: it was a quiet normal evening at chapel of the chimes cemetery. a group of 50 people were inside the chapel for a 7:00 p.m. viewing. outside on the vast lawn, another separate group had pitched a tent and chairs at the grave site of a loved one. the general manager says many cultures value spending hours at this cemetery with a picnic and a chance to be near a lost loved one. that's where the shooting took place. staff called 911. police say they found three gunshot victims in the driveway, right in front of the mortuary, along busy mission boulevard. >> the scene was pretty chaotic when the officers arrived. initially they located three victims of gunshot wounds.

in the driveway area in front of the mortuary. >> reporter: one woman says she saw people drinking under a tent. some with guns. >> they told us we were on lockdown for an hour. and we were there like the whole time they told us not to get out. >> officers did area checks to see if we could find witnesses maybe suspects and additional witnesses. as they did that they found a fourth victim. >> they kim upon this 7-eleven store two blocks away where workers say they noticed a man with a wound to his arm in the parking lot. they claim the police handcuffed three young men and took them away in ambulances. >> i heard the commotion, the police cars and the ambulance. and i kind of glanced. >> a fifth shooting victim drove himself to a local hospital. police towed two cars. they're now hoping to interview the victims to figure out a motive. all five victims are listed in stable condition at local hospitals. chapel of the chieps says they will prioritize safety as they

reevaluate security. they may limit gatherings with tents and chairs. and they may look into hiring private security. in hayward, leslie brinkley, abc 7 news. >> thank you leslie. four workers at a contra costa county chemical plant were taken to the hospital after a suspected color even skill. stooif was over k 2 peer solutions on love ridge road in. from the county and the dow chemical company worked to content the release. in san jose a swimming pool that was site of a hazmat incident will stay closed indefinitely. sky7 flew over the pool today at the shadow rock swim club. investigators say a pool maintenance worker mixed two chemical together that produced fumes that made several people including children sick. firefighters say the fumes were potentially fatal. the killeenup process is now under way. the pool will be inspected by experts before it can be used
